Sponsoring employment-based visas not only benefits the <span data-term-id=\"58729380\">foreign worker<\/span> beneficiary. It also creates a diverse talent pool in the United States, contributing to the growth of the U.S. workforce.<\/p>\n<p>But <span data-term-id=\"58729365\">U.S. employers<\/span> and <span data-term-id=\"58729380\">foreign workers<\/span> must understand how the process works. This helps to ensure an effective, smooth, and lawful transition into the United States. It also ensures compliance with U.S. immigration and <a href=\"https:\/\/www.findlaw.com\/employment.html\">employment laws<\/a>.<\/p>\n<p>The following are the common steps that <span data-term-id=\"58729365\">U.S. employers<\/span> follow when sponsoring foreign employees:<\/p>\n<ol>\n<li>\n<p><strong><span data-term-id=\"58729371\">Job offer<\/span>.<\/strong>\u00a0The <span data-term-id=\"58729383\">foreign national<\/span> must have a <span data-term-id=\"58729371\">job offer<\/span> from a qualified <span data-term-id=\"58729365\">U.S. employer<\/span>. The <span data-term-id=\"58729371\">job offer<\/span> should specify the conditions and terms of employment.<\/p>\n<\/li>\n<li>\n<p><strong><span data-term-id=\"58729366\">Labor certification<\/span>.<\/strong>\u00a0Employers should get <span data-term-id=\"58729366\">labor certification<\/span> from the <span data-term-id=\"58729392\">U.S. <\/span><span data-term-id=\"58729364\">Department of Labor<\/span>. The certificate shows that no able, qualified, and willing workers in the United States could fill the position.<\/p>\n<\/li>\n<li>\n<p><strong>Submission of petition.\u00a0<\/strong><span data-term-id=\"58729365\">U.S. employers<\/span> should submit an <a href=\"https:\/\/www.uscis.gov\/i-140\" target=\"_blank\" rel=\"noopener\">Immigrant Petition for Alien Worker<\/a> (Form I-140) for immigrant visas and <a href=\"https:\/\/www.uscis.gov\/i-129\" target=\"_blank\" rel=\"noopener\">Petition for <span data-term-id=\"58729358\">Nonimmigrant<\/span> Worker<\/a> (Form I-129) for <span data-term-id=\"58729376\">nonimmigrant<\/span><span data-term-id=\"58729376\"> visas<\/span>. This includes verifying\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/employment-visa-eligibility-faq.html\">employee <span data-term-id=\"58729382\">eligibility<\/span><\/a>, keeping an accurate employment record, and complying with labor and wage requirements.<\/p>\n<h2>Employment Visa and Numerical Limitations<\/h2>\n<p>Every fiscal year, the\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/h-2b-non-agricultural-workers\/temporary-increase-in-h-2b-nonimmigrant-visas-for-fy-2022#:~:text=On%20May%2016,new%20attestation%20form.\" target=\"_blank\" rel=\"noopener\">U.S. Department of Homeland Security<\/a>\u00a0(DHS) and the <span data-term-id=\"58729364\">Department of Labor<\/span> (DOL) set a numerical limit on the number of visas. They look at the needs of businesses in the United States. The DHS and the DOL also examine the impact on <span data-term-id=\"58729372\">U.S. citizens<\/span> and <span data-term-id=\"58729374\">U.S. workers<\/span> and the integrity of the employment-based visa program.<\/p>\n<h2>Proving Your <span data-term-id=\"58729382\">Eligibility<\/span> To Work in the United States<\/h2>\n<p>Employees applying to work in the U.S. must prove their <span data-term-id=\"58729382\">eligibility<\/span> to work in the country. They can complete Form I-19 or the <a href=\"https:\/\/www.uscis.gov\/i-9\" target=\"_blank\" rel=\"noopener\">Employment <span data-term-id=\"58729382\">Eligibility<\/span> Verification Form<\/a>. The employer uses the form to verify the <span data-term-id=\"58729405\">employment authorization<\/span> and identity of the hired worker.<\/p>\n<p>Note that employers use the form for <span data-term-id=\"58729380\">foreign workers<\/span> and U.S. employees. The <span data-term-id=\"58729365\">U.S. employer<\/span> and the employee should complete the form.<\/p>\n<p>The form asks them to attest to their authority to work in the United States. They also must present documents proving their identity and work <span data-term-id=\"58729382\">eligibility<\/span>. Documents that show <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/employment-eligibility-verification.html\">proof of authority to work in the United States<\/a> include:<\/p>\n<ul>\n<li><span data-term-id=\"58729405\">Employment authorization<\/span> identification card<\/li>\n<li>Employment visa<\/li>\n<li><span data-term-id=\"58729360\">Permanent residency<\/span> card<\/li>\n<\/ul>\n<p>The <span data-term-id=\"58729365\">U.S. employer<\/span> should examine these documents and determine if they are genuine and relate to the employee.<\/p>\n<h2>Moving to the U.S. With Your Family<\/h2>\n<p>Employment-based visas also allow your spouse and children to join you in the United States. But this may depend on the <span data-term-id=\"58729377\">visa category<\/span> given to the <span data-term-id=\"58729380\">foreign worker<\/span>. Some visas allow <span data-term-id=\"58729412\">dependents<\/span> to go with the primary <span data-term-id=\"58729389\">visa holders<\/span> into the U.S., while others may not.\u00a0<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/family-visa.html\">Visas for the <span data-term-id=\"58729409\">family members<\/span><\/a>\u00a0are not automatic. They have to go through a separate immigration process. The <span data-term-id=\"58729412\">dependents<\/span> should still meet specific visa requirements to join their <span data-term-id=\"58729409\">family member<\/span> when traveling to the U.S. for work.<\/p>\n<p>For example, if you receive an\u00a0<span data-term-id=\"58729370\">H-1B visa<\/span>, your spouse and children under 21 may file for H-4 visas to accompany you to the United States. Your <span data-term-id=\"58729409\">family members<\/span> can only apply for an H-4 visa once you have an <span data-term-id=\"58729370\">H-1B visa<\/span>.<\/p>\n<p>The U.S. consulate may ask you to show a copy of your <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/h-1b-visa-requirements.html\"><span data-term-id=\"58729370\">H-1B visa<\/span><\/a> issued by <span data-term-id=\"58729359\">USCIS<\/span>. The consular officer may also ask you to show proof of your relationship with the H-4 applicants. These documents may include a marriage certificate or birth certificate.<\/p>\n<p>With an H-4 visa, the <span data-term-id=\"58729389\">visa holder<\/span> may study in the United States. But H-4 <span data-term-id=\"58729389\">visa holders<\/span> <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/h-1b-specialty-occupations\/employment-authorization-for-certain-h-4-dependent-spouses\" target=\"_blank\" rel=\"noopener\">can\u2019t work in the United States<\/a>.
