The law offers safety and security for victims. <span data-term-id=\"58500843\">VAWA<\/span> is also a form of relief for <span data-term-id=\"58500896\">noncitizen<\/span> victims of abuse who are facing the threat of undergoing\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal.html\">removal proceedings<\/a>.<\/p>\n<p>Before the establishment of this law, <span data-term-id=\"58500883\">family-based<\/span> immigration generally asked the <span data-term-id=\"58500848\">U.S. citizen<\/span> or <span data-term-id=\"58500847\">lawful permanent resident<\/span> (LPR) to file an immigration petition on <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-overview\/family-preference-and-immediate-relative-petitions-the-basics.html\">behalf of their <span data-term-id=\"58500853\">family members<\/span><\/a>. Some petitioners take advantage of this immigration process to take control or intimidate their <span data-term-id=\"58500853\">family members<\/span>, threatening to withdraw the petition. <span data-term-id=\"58500843\">VAWA<\/span> is a form of relief for <span data-term-id=\"58500896\">noncitizen<\/span> victims of abuse.<\/p>\n<p>The <span data-term-id=\"58500845\">Violence Against Women Act<\/span> of 1994 changed the narrative. It provided <span data-term-id=\"58500896\">noncitizens<\/span> who experienced abuse by their relatives the chance to file a petition independently. With this law, the <span data-term-id=\"58500896\">noncitizen<\/span> may file an immigration petition without the <span data-term-id=\"58500846\">abuser<\/span>\u2019s knowledge, consent, or participation. This process gives the victim the chance to seek independence and safety from their <span data-term-id=\"58500846\">abusers<\/span>.<\/p>\n<h2><span data-term-id=\"58500849\">Green Card<\/span> Eligibility for <span data-term-id=\"58500850\">Abused Spouse<\/span>, Child, or Parent<\/h2>\n<p>Under <span data-term-id=\"58500843\">VAWA<\/span>, you are eligible to get LPR status if you are a victim of <span data-term-id=\"58500862\">extreme cruelty<\/span> or battery committed by either of the following:<\/p>\n<ul>\n<li>A <span data-term-id=\"58500848\">U.S. citizen<\/span> spouse or former spouse<\/li>\n<li>A <span data-term-id=\"58500848\">U.S. citizen<\/span> son or daughter<\/li>\n<li>A <span data-term-id=\"58500848\">U.S. citizen<\/span> parent<\/li>\n<li>An LPR spouse, former spouse<\/li>\n<li>An LPR parent<\/li>\n<\/ul>\n<p>Under <span data-term-id=\"58500843\">VAWA<\/span>, you may also file a petition without the knowledge or consent of the abusive <span data-term-id=\"58500853\">family member<\/span>. The process is filing\u00a0<a href=\"https:\/\/www.uscis.gov\/i-360\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58500885\">Form I-360<\/span>, called Petition for Amerasian, Widow(er), or <span data-term-id=\"58500892\">Special Immigrant<\/span><\/a>. Once filed, you will become a <span data-term-id=\"58500863\">VAWA<\/span><span data-term-id=\"58500863\"> self-petitioner<\/span>. If you meet all <span data-term-id=\"58500898\">eligibility requirements<\/span> and the U.S. government approves your petition, you may apply for <span data-term-id=\"58500886\">lawful permanent resident<\/span><span data-term-id=\"58500886\"> status<\/span> or become a <span data-term-id=\"58500849\">green card<\/span> holder.<\/p>\n<h2>Who Is Eligible for a <span data-term-id=\"58500843\">VAWA<\/span> Visa?<\/h2>\n<p>To be eligible to file a self-petition, you must qualify under one of the following categories:<\/p>\n<ul>\n<li><strong>As a spouse:<\/strong>\u00a0You can file for a self-petition if you are or were a victim of abuse, <span data-term-id=\"58500844\">domestic violence<\/span>, or battery by a <span data-term-id=\"58500848\">U.S. citizen<\/span> or permanent resident. You may also file the petition if a <span data-term-id=\"58500848\">U.S. citizen<\/span> or <span data-term-id=\"58500880\">permanent resident spouse<\/span> abused your child. You can include your unmarried children under 21 years of age in your petition if they haven\u2019t filed the immigration petition themselves.<\/li>\n<li><strong>As a parent:<\/strong>\u00a0You may file a self-petition if you are a <span data-term-id=\"58500900\">parent of a <\/span><span data-term-id=\"58500848\">U.S. citizen<\/span> and have suffered abuse at the hands of your son or daughter.<\/li>\n<li><strong>As a child:<\/strong>\u00a0You may file for self-petition if you suffered abuse from your <span data-term-id=\"58500848\">U.S. citizen<\/span> or permanent resident parent. Your eligibility for this classification as an &#8220;abused child&#8221; depends on your age and marital status. You should be under 21 years of age and unmarried. You may also file for a petition after you reach 21 but before you reach 25 if you can prove that the abuse was the primary reason for your delay in filing the petition.<\/li>\n<\/ul>\n<h2><span data-term-id=\"58500898\">Eligibility Requirements<\/span> for <span data-term-id=\"58500843\">VAWA<\/span> Petition<\/h2>\n<p>To be eligible for the <span data-term-id=\"58500863\">VAWA<\/span><span data-term-id=\"58500863\"> self-petition<\/span>, you must have a qualifying relationship either as the spouse, child, or parent of an abusive <span data-term-id=\"58500848\">U.S. citizen<\/span> or permanent resident.<\/p>\n<p>Additional requirements depend on the qualifiying relationship.<\/p>\n<h3>Spouse<\/h3>\n<p>You are the intended spouse or former spouse of a <span data-term-id=\"58500848\">U.S. citizen<\/span> or LPR if:<\/p>\n<ul>\n<li>You are married to the <span data-term-id=\"58500848\">U.S. citizen<\/span> or LPR <span data-term-id=\"58500846\">abuser<\/span>.<\/li>\n<li>Your marriage with the <span data-term-id=\"58500846\">abuser<\/span> was legally terminated by death or <a href=\"https:\/\/www.findlaw.com\/family\/divorce.html\">by divorce<\/a>. If the termination was by divorce, you must file the petition within two years from the date of the divorce to be eligible for self-petitioning.<\/li>\n<li>Your spouse renounced their <span data-term-id=\"58500882\">U.S. citizenship<\/span> or permanent residency within two years before you filed your petition because of <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/what-is-domestic-violence.html\"><span data-term-id=\"58500844\">domestic violence<\/span><\/a>.<\/li>\n<li>You thought you were legally married to the <span data-term-id=\"58500846\">abuser<\/span>. But the marriage was not legitimate due to the bigamy of the <span data-term-id=\"58500850\">abusive spouse<\/span>.<\/li>\n<\/ul>\n<h3>Children<\/h3>\n<p>You are a child of an abusive parent who is a <span data-term-id=\"58500848\">U.S. citizen<\/span> or <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/who-may-obtain-a-green-card.html\"><span data-term-id=\"58500847\">lawful permanent resident<\/span><\/a>.<\/p>\n<h3>Parents<\/h3>\n<p>You are a <span data-term-id=\"58500900\">parent of a <\/span><span data-term-id=\"58500848\">U.S. citizen<\/span> or permanent resident <span data-term-id=\"58500846\">abuser<\/span>. When filing, <span data-term-id=\"58500848\">U.S. citizens<\/span> or <span data-term-id=\"58500847\">lawful permanent residents<\/span> should be at least 21 or older.<\/p>\n<ul>\n<li>You suffered battery or <span data-term-id=\"58500862\">extreme cruelty<\/span> from a <span data-term-id=\"58500848\">U.S. citizen<\/span> or permanent resident relative.<\/li>\n<li>You were living or lived with your abusive <span data-term-id=\"58500848\">U.S. Citizen<\/span> or permanent resident <span data-term-id=\"58500853\">family member<\/span>.<\/li>\n<li>You are a person of <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-d-chapter-9\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58500856\">good moral character<\/span><\/a>.<\/li>\n<\/ul>\n<h2>Applying for Benefits<\/h2>\n<p>If you are a spouse or child of an abusive <span data-term-id=\"58500848\">U.S. citizen<\/span> or an LPR, you may also include a derivative beneficiary in your petition. A derivative beneficiary is your child under 21 and unmarried. But, this is only for spouses or children of abusive <span data-term-id=\"58500848\">U.S. citizens<\/span> or permanent residents. Parents of the <span data-term-id=\"58500846\">abuser<\/span> are not eligible to file for the derivative beneficiary in their petitions.<\/p>\n<p>To apply for the <span data-term-id=\"58500843\">VAWA<\/span> benefits, you have to submit the following documents:<\/p>\n<ul>\n<li><span data-term-id=\"58500885\">Form I-360<\/span> or the Petition for Amerasian, Widow(er), or <span data-term-id=\"58500892\">Special Immigrant<\/span>. Note that there is no fee to file for this petition<\/li>\n<li>Evidence to show that you meet all the <span data-term-id=\"58500898\">eligibility requirements<\/span><\/li>\n<\/ul>\n<p>If you listed a <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/glossary-of-visa-terms.html\">derivative beneficiary<\/a> in your self-petition, you must also submit proof of your relationship with the child. You should also present evidence that the child is under 21 and unmarried by the time you filed for the petition.<\/p>\n<h2><span data-term-id=\"58500843\">VAWA<\/span> Frequently Asked Questions<\/h2>\n<p>The following are some frequently asked questions about <span data-term-id=\"58500843\">VAWA<\/span> petitions.<\/p>\n<h3>What happens after your petition gets approved?<\/h3>\n<p>You will have an immigrant classification if the U.S. government approves your petition. This does not give you and your derivative beneficiary an <span data-term-id=\"58500859\">immigration status<\/span>. But you and your derivative beneficiary may <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/immigration-through-adjustment-of-immigrant-status.html\">apply for permanent residency<\/a> when a visa is available.<\/p>\n<h3>What happens if your <span data-term-id=\"58500843\">VAWA<\/span> petition gets denied?<\/h3>\n<p>If your <span data-term-id=\"58500885\">Form I-360<\/span> petition gets denied, the denial letter will tell you how to <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/administrative-appeals-with-the-uscis.html\">file an appeal<\/a>. You may file a notice of appeal and pay the required fee at the Nebraska Service Center. After the service center receives the documents and your filing fee, the appeal will go to the Office of Administrative Appeals in Washington, D.C.<\/p>\n<p>Note that the place to file an appeal undergoes frequent changes. It is best to check the <span data-term-id=\"58500882\">U.S. Citizenship<\/span> and <span data-term-id=\"58500893\">Immigration Services<\/span> (<span data-term-id=\"58500855\">USCIS<\/span>) website for information on the\u00a0<a href=\"https:\/\/www.uscis.gov\/forms\/all-forms\/direct-filing-addresses-for-form-i-360-immigrant-petition-for-amerasian-widower-or-special-immigrant\" target=\"_blank\" rel=\"noopener\">direct filing address for <span data-term-id=\"58500885\">Form I-360<\/span>.<\/a><\/p>\n<h3>Do I have to stay married to my <span data-term-id=\"58500850\">abusive spouse<\/span> until my immigration petition gets approved?<\/h3>\n<p>Since Oct. 28, 2000, you can apply for <span data-term-id=\"58500885\">Form I-360<\/span> whether you are still married to your abusive <span data-term-id=\"58500848\">U.S. citizen<\/span> or LPR spouse. But, if you are no longer married to your <span data-term-id=\"58500850\">abusive spouse<\/span>, you have to meet one of the following:<\/p>\n<ul>\n<li>You believed you were lawfully married to your <span data-term-id=\"58500846\">abuser<\/span>, but the marital relationship was not legitimate because of bigamy committed by the <span data-term-id=\"58500850\">abusive spouse<\/span>.<\/li>\n<li>Your <span data-term-id=\"58500850\">abusive spouse<\/span> died within two years of filing the petition.<\/li>\n<li>Your <span data-term-id=\"58500850\">abusive spouse<\/span> renounced or lost their <span data-term-id=\"58500882\">U.S. citizenship<\/span> or permanent resident status because of an incident of abuse or <span data-term-id=\"58500844\">domestic violence<\/span>.<\/li>\n<li>Your marriage to your <span data-term-id=\"58500846\">abuser<\/span> ended within two years before the filing of the petition. And there is a connection between the end of the marriage and the violence committed against you.<\/li>\n<\/ul>\n<p>The actual reasons your marriage ended do not need to say that there was <span data-term-id=\"58500862\">extreme cruelty<\/span> or battery involved explicitly. After you file your petition, the <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/green-card-marriage-interview-faq-s.html\">termination of your marriage<\/a> will often not affect the status of your petition.<\/p>\n<h2>Can a divorced spouse seek relief through self-petitioning?<\/h2>\n<p>Yes. Starting Oct. 28, 2000, you can file <span data-term-id=\"58500885\">Form I-360<\/span> if the marriage ended within two years before the date of filing the petition. But you should provide supporting documentation to show the connection between the end of the union and the abusive behavior against you.<\/p>\n<p>Suppose you can\u2019t show proof of the connection between the abusive behavior and the end of your marriage with the <span data-term-id=\"58500848\">U.S. Citizen<\/span> or <span data-term-id=\"58500880\">permanent resident spouse<\/span>. In that case, you may still be eligible to\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/forms-of-relief-from-removal.html\">apply for cancellation of removal<\/a>.<\/p>\n<p>The immigration officials may deny your <span data-term-id=\"58500885\">Form I-360<\/span> if you remarry before the approval of your petition. If you get married after its approval, the marriage will not affect your petition.<\/p>\n<h2>What if the <span data-term-id=\"58500850\">abusive spouse<\/span> filed a Form I-130 petition on behalf of the <span data-term-id=\"58500857\">battered spouse<\/span>, which is either still pending or withdrawn?<\/h2>\n<p>A self-petitioner who is the beneficiary of a Form I-130 petition filed by the <span data-term-id=\"58500850\">abusive spouse<\/span> will be able to transfer the priority date of the Form I-130 petition to the I-360 self-petition.
