Submit <span data-term-id=\"58496773\">U Visa<\/span><span data-term-id=\"58496773\"> Application<\/span><\/h3>\n<p>The first step is submitting <span data-term-id=\"58496754\">Form I-918<\/span> or the\u00a0<a href=\"https:\/\/www.uscis.gov\/I-918\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58496775\">Petition for <\/span><span data-term-id=\"58496747\">U Nonimmigrant Status<\/span><\/a>. Request Permission to Enter the Country<\/h3>\n<p>If you have issues with your admissibility into the U.S., you may need to file an\u00a0<a href=\"https:\/\/www.uscis.gov\/i-192\" target=\"_blank\" rel=\"noopener\">Application for Advance Permission to Enter as a Nonimmigrant<\/a>\u00a0(Form I-192). This application will form as a <span data-term-id=\"58496748\">waiver<\/span> of your <span data-term-id=\"58496758\">inadmissibility<\/span> to enter the country.<\/p>\n<p>You should also include a statement describing the criminal activity you became a victim of. It is also best to provide evidence to support your <span data-term-id=\"58496784\">eligibility<\/span><span data-term-id=\"58496784\"> requirements<\/span> and that you have been a victim of a crime.<\/p>\n<p>For <span data-term-id=\"58496773\">U visa<\/span><span data-term-id=\"58496773\"> applicants<\/span> outside of the U.S., the process starts with <span data-term-id=\"58496761\">filing forms<\/span> with the\u00a0<a href=\"https:\/\/www.uscis.gov\/i-129-addresses\" target=\"_blank\" rel=\"noopener\">Vermont Service Center<\/a>. The service center will give you instructions to follow based on your set of applications and forms.<\/p>\n<h3>3. File Your <span data-term-id=\"58496741\">U Visa<\/span> Forms<\/h3>\n<p>Next, you go to the\u00a0<a href=\"https:\/\/www.usa.gov\/find-embassy\" target=\"_blank\" rel=\"noopener\">nearest U.S. embassy or consulate<\/a>. An immigration official takes your fingerprints. Certain <span data-term-id=\"58496750\">family members<\/span> of the principal <span data-term-id=\"58496773\">U visa<\/span><span data-term-id=\"58496773\"> applicant<\/span> may apply for a derivative <span data-term-id=\"58496741\">U visa<\/span>. Their <span data-term-id=\"58496744\">eligibility<\/span> for a <span data-term-id=\"58496803\">U visa<\/span><span data-term-id=\"58496803\"> petition<\/span> depends on the <span data-term-id=\"58496750\">family member<\/span>\u2019s relationship with the principal petitioner. If you are the principal petitioner, you should have your <span data-term-id=\"58496741\">U visa<\/span> approved before <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-overview\/family-preference-and-immediate-relative-petitions-the-basics.html\">petitioning your <span data-term-id=\"58496750\">family members<\/span><\/a> for a <span data-term-id=\"58496741\">U visa<\/span>.<\/p>\n<p>If you are the principal petitioner under 21 <span data-term-id=\"58496802\">years of age<\/span>, you may petition your:<\/p>\n<ul>\n<li>Children<\/li>\n<li>Parents<\/li>\n<li>Spouse<\/li>\n<li>Unmarried siblings under 18 parents<\/li>\n<\/ul>\n<p>If you are the principal applicant and are 21 or older, you may petition on behalf of your:<\/p>\n<ul>\n<li>Children<\/li>\n<li>Spouse<\/li>\n<\/ul>\n<p>To apply for a <span data-term-id=\"58496741\">U visa<\/span> for <span data-term-id=\"58496790\">qualified <\/span><span data-term-id=\"58496750\">family members<\/span>, the principal applicant should file\u00a0<a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-918supa.pdf\" target=\"_blank\" rel=\"noopener\">Supplement A, Petition for <span data-term-id=\"58496790\">Qualifying <\/span><span data-term-id=\"58496750\">Family Member<\/span><\/a>. The supplement may be filed together with your <span data-term-id=\"58496773\">U visa<\/span><span data-term-id=\"58496773\"> application<\/span> or at a later time.<\/p>\n<h2>Can I Work in the U.S. with a <span data-term-id=\"58496741\">U Visa<\/span>?<\/h2>\n<p>Yes. Principal holders of U <span data-term-id=\"58496783\">nonimmigrant visas<\/span> receive <span data-term-id=\"58496786\">employment authorization<\/span> after approval of their <span data-term-id=\"58496741\">U visa<\/span> status. The <span data-term-id=\"58496786\">employment authorization<\/span> is\u00a0<a href=\"https:\/\/www.uscis.gov\/humanitarian\/victims-of-criminal-activity-u-nonimmigrant-status#:~:text=Principal%20U%20nonimmigrant%20petitioners%20are%20employment%20authorized%20incident%20to%20status%2C%20after%20the%20underlying%20petition%20for%20U%20nonimmigrant%20status%20is%20approved%20and%20an%20employment%20authorization%20document%20is%20automatically%20issued%20without%20filing%20Form%20I%2D765%2C%20Application%20for%20Employment%20Authorization.\" target=\"_blank\" rel=\"noopener\">automatically given<\/a>\u00a0after approval of the <span data-term-id=\"58496773\">U visa<\/span><span data-term-id=\"58496773\"> application<\/span>, without the need to file an\u00a0<a href=\"https:\/\/www.uscis.gov\/i-765\" target=\"_blank\" rel=\"noopener\">Application for <span data-term-id=\"58496786\">Employment Authorization<\/span><\/a>\u00a0(Form I-765)<\/p>\n<p>Derivative <span data-term-id=\"58496750\">family members<\/span> do not automatically get <span data-term-id=\"58496786\">employment authorization<\/span>. So, <span data-term-id=\"58496750\">family members<\/span> of the <span data-term-id=\"58496773\">U visa<\/span><span data-term-id=\"58496773\"> applicants<\/span> must <span data-term-id=\"58496761\">file Form<\/span> I-765 to get <span data-term-id=\"58496786\">employment authorization<\/span> documents.<\/p>\n<p>Principal holders of a <span data-term-id=\"58496741\">U visa<\/span> may only receive automatic <span data-term-id=\"58496786\">employment authorization<\/span> after <span data-term-id=\"58496773\">U visa<\/span><span data-term-id=\"58496773\"> application<\/span> approval. For those on the waiting list, the principal petitioner and derivative <span data-term-id=\"58496750\">family members<\/span> may still get <span data-term-id=\"58496786\">employment authorization<\/span> by <span data-term-id=\"58496761\">filing\u00a0<\/span><a href=\"https:\/\/www.uscis.gov\/i-765\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58496761\">Form<\/span> I-765<\/a>.<\/p>\n<h2><span data-term-id=\"58496741\">U Visa<\/span> Cap<\/h2>\n<p>There is an\u00a0<a href=\"https:\/\/www.uscis.gov\/I-918\" target=\"_blank\" rel=\"noopener\">annual cap of 10,000 <span data-term-id=\"58496741\">U visas<\/span><\/a>\u00a0available for principal <span data-term-id=\"58496773\">U visa<\/span><span data-term-id=\"58496773\"> applicants<\/span> every fiscal year. This cap does not apply to <span data-term-id=\"58496750\">family members<\/span> seeking derivative <span data-term-id=\"58496741\">U visas<\/span>.<\/p>\n<p>Once the <span data-term-id=\"58496742\">USCIS<\/span> reaches the 10,000 annual cap, there is a waiting list. While on the waiting list, the <span data-term-id=\"58496742\">USCIS<\/span> may grant parole or <span data-term-id=\"58496774\">deferred action<\/span>.
