Health-Related Reasons<\/h2>\n<p>The Department of Health and Human Services and <span data-term-id=\"58492229\">INA<\/span> are crucial in defining the grounds for <span data-term-id=\"58492210\">inadmissibility<\/span> for public health-related concerns. The United States does not admit a foreign national who has any of the following\u00a0<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid%3AUSC-prelim-title8-section1182&amp;num=0&amp;edition=prelim\" target=\"_blank\" rel=\"noopener\">health issues:<\/a><\/p>\n<ul>\n<li>Foreign nationals who have a communicable disease that can quickly spread to other people. The U.S. Department of Health <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-8-part-b-chapter-6\" target=\"_blank\" rel=\"noopener\">classifies these diseases<\/a>.<\/li>\n<li>Foreign nationals who want to live in the U.S. permanently who haven\u2019t shown proof of\u00a0<a href=\"https:\/\/www.uscis.gov\/tools\/designated-civil-surgeons\/vaccination-requirements\" target=\"_blank\" rel=\"noopener\">vaccination for certain diseases<\/a>. These vaccinations include those against measles, mumps, rubella, polio, tetanus, pertussis, diphtheria, influenza type B, and hepatitis B. U.S. health professionals would also recommend other vaccines. Vaccination requirements may also vary in each circumstance and per <span data-term-id=\"58492224\">visa category<\/span>.<\/li>\n<li>Foreign nationals who have a mental or physical disorder that could put them or other people in danger. This could be because these conditions would cause a threat to others, their property, or their safety.<\/li>\n<li>Foreign nationals who <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-8-part-b-chapter-8\" target=\"_blank\" rel=\"noopener\">abuse drugs or are addicts<\/a>. The Department of Health likewise decides these conditions.<\/li>\n<\/ul>\n<p>Anyone who falls under this category cannot enter the United States. But some exemptions may apply. For instance, children 10 years of age or younger who are being adopted by a <span data-term-id=\"58492233\">U.S. citizen<\/span> (either by birth or naturalization) do not have to follow these vaccination rules. They only need to have their future adoptive parent assert that the adopted child will have all the vaccines within 30 days of entry into the country or as soon as possible medically.<\/p>\n<h2><span data-term-id=\"58492259\">2. Criminal Activity<\/span><\/h2>\n<p>A foreign national is ineligible for a <span data-term-id=\"58492220\">U.S. visa<\/span> if they\u2019ve <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/how-does-an-arrest-affect-immigration-status.html\">committed certain crimes<\/a>. These include:<\/p>\n<h3><span data-term-id=\"58492228\">Criminal Conviction<\/span> of Certain Crimes<\/h3>\n<ul>\n<li>Foreign nationals who have been guilty of or committed crimes involving <span data-term-id=\"58492261\">moral turpitude<\/span>, which means crimes that show a lack of good moral character. These crimes include <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/fraud.html\">fraud<\/a> or theft.<\/li>\n<li>Foreign nationals convicted of drug-related crimes.<\/li>\n<\/ul>\n<p>But there are exceptions to this list. This means they can still enter the United States upon assessment by the proper immigration official. This exception includes the following:<\/p>\n<ul>\n<li>Foreign nationals involved in a crime involving <span data-term-id=\"58492255\">controlled substances<\/span> while they were under 18 years of age, and that crime was over five years ago.<\/li>\n<li>Foreign nationals convicted of a crime with a maximum jail time of less than one year were not sentenced to over six months in jail. This rule applies to a single offense and not multiple criminal offenses.<\/li>\n<\/ul>\n<h3>Conviction for Multiple Crimes<\/h3>\n<p>Foreign nationals who have been previously convicted of two or more crimes. This rule applies whether the crimes committed involve <a href=\"https:\/\/fam.state.gov\/fam\/09FAM\/09FAM030203.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58492261\">moral turpitude<\/span><\/a>. And the person has received a sentence of five years of confinement or more. This rule does not apply to political crimes.<\/p>\n<h3>Trafficker of <span data-term-id=\"58492255\">Controlled Substances<\/span><\/h3>\n<p>Foreign nationals with whom an <span data-term-id=\"58492271\">immigration officer<\/span> or the Attorney General believes to have been involved or are involved in <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-trafficking-distribution.html\">drug trafficking<\/a> cannot enter the United States. The same rule applies to those who are <span data-term-id=\"58492235\">family members<\/span> of a person involved in drug trafficking, and the <span data-term-id=\"58492235\">family member<\/span> received a significant benefit from the illegal activity in the past five years.Prostitution and Commercialized Vice<\/p>\n<p>Foreign nationals cannot enter the country if their purpose is to participate in sex work. They are also inadmissible to enter the country if they have been <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/prostitution.html\">involved in prostitution<\/a> within the past 10 years. The 10-year timeframe need not necessarily be during the entire 10-year duration.<\/p>\n<p>Foreign nationals are inadmissible to enter the U.S. if they are entering the country to commit illegal commercial vice. This includes activities <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/investment-business-immigrant-visas.html\">related to business<\/a> and immoral crimes, whether or not related to prostitution.<\/p>\n<h3>Noncitizens Involved in Serious Crimes Who Received Immunity from Prosecution<\/h3>\n<p>In some cases, the U.S. removes foreign nationals who committed criminal offenses but were not prosecuted due to diplomatic immunity. These people haven\u2019t submitted to the jurisdiction or have been held accountable for the crime. They are prohibited from re-entering the U.S.<\/p>\n<h3>Human Trafficking<\/h3>\n<p>Foreign nationals who committed or attempted to commit <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/human-trafficking-and-slavery.html\">human trafficking offenses<\/a> outside or inside the United States. Someone who has assisted someone else in committing human trafficking is inadmissible to enter the country. The same rule applies to <span data-term-id=\"58492235\">family members<\/span> of the foreign national who benefited from this act in the past five years.<\/p>\n<p>An exception applies to children of the foreign national who received the benefit while they were minors.<\/p>\n<h3>Money Laundering<\/h3>\n<p>Foreign nationals involved in <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/money-laundering.html\">money laundering<\/a> who attempt to enter the country to commit this crime are inadmissible in the U.S. This rule applies to those who assisted someone in committing money laundering.<\/p>\n<h2>3. Security Related Concerns<\/h2>\n<p>A foreign national who <span data-term-id=\"58492221\">U.S. government<\/span> officials believe intends to enter the country to commit the following acts:<\/p>\n<ul>\n<li>Break the <span data-term-id=\"58492253\">U.S. laws<\/span> related to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/sabotage.html\">sabotage<\/a>, spying, or exporting illegal items.<\/li>\n<li>Conduct unlawful acts.<\/li>\n<li>Do any activity that aims to oppose, control, or overthrow the <span data-term-id=\"58492221\">U.S. government<\/span> through violence, force, or other unlawful means.<\/li>\n<li>Engage in any <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/supporting-terrorism.html\">terrorist activities<\/a> or being part of a terrorist organization.<\/li>\n<\/ul>\n<p>This section is listed in detail on the <span data-term-id=\"58492234\">U.S. Citizenship<\/span> and Immigration Services\u00a0<a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-7-part-l-chapter-3\" target=\"_blank\" rel=\"noopener\">(<span data-term-id=\"58492238\">USCIS<\/span>) website<\/a>.<\/p>\n<h2><span data-term-id=\"58492226\">4. Public Charge<\/span><\/h2>\n<p>If the <span data-term-id=\"58492212\">consular officer<\/span> thinks the foreign national is attempting to enter the U.S. for <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">government support<\/a>, they can also deny entry. Some of the factors that are taken into consideration are as follows:<\/p>\n<ul>\n<li>Age<\/li>\n<li>Family consideration<\/li>\n<li>Health<\/li>\n<li>Financial resources<\/li>\n<li>Education and skills<\/li>\n<\/ul>\n<p>In addition to this, the <span data-term-id=\"58492212\">consular officer<\/span> may also take into consideration any <span data-term-id=\"58492232\">affidavit of support<\/span>.<\/p>\n<h2>5. Labor Certification<\/h2>\n<p>Foreign citizens who want to\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/employment-based-visas.html\">enter the U.S. for work<\/a>\u00a0are inadmissible unless the Secretary of Labor determines that:<\/p>\n<ul>\n<li>There are not enough workers in the U.S. who are available, qualified, and willing to do the work; and<\/li>\n<li>The foreign national\u2019s employment will not affect the wages and working conditions in the United States.<\/li>\n<\/ul>\n<p>But special considerations may apply to professionals in education and those with <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/o-1-visa-individuals-with-extraordinary-ability-or-achievement\" target=\"_blank\" rel=\"noopener\">exceptional abilities in arts and sciences<\/a>. Professional athletes may also qualify for certifications.<\/p>\n<p>In addition, foreign nationals who are graduates of <span data-term-id=\"58492272\">health care<\/span> professions are also inadmissible to practice their profession unless they pass the necessary licensure examination.<\/p>\n<p>Each fiscal year, the number of temporary work visas given to nonimmigrants may be limited. Factors such as the state population (where they plan to work) will determine how many visas will be issued. This is particularly true for those coming to the U.S. to provide nursing services.<\/p>\n<h2>6. Prior Removal or Violation of <span data-term-id=\"58492231\">Immigration Laws<\/span><\/h2>\n<p>Foreign nationals who have previously violated <span data-term-id=\"58492231\">immigration laws<\/span>, such as by <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/ewi-entry-without-inspection.html\">entering the U.S. illegally<\/a> or by <span data-term-id=\"58492217\">misrepresentation<\/span> of information in a previous <span data-term-id=\"58492209\">visa application<\/span>, are ineligible for visas. The <span data-term-id=\"58492217\">misrepresentation<\/span> must be material to the application to be ineligible for a <span data-term-id=\"58492220\">U.S. visa<\/span>. Or if the foreign national obtained entry to the U.S. through fraud.<\/p>\n<p>But certain exceptions and <span data-term-id=\"58492208\">waivers<\/span> apply. For instance, under the\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/immigration-visas-for-battered-spouses-and-children.html\">Violence Against Women Act (<span data-term-id=\"58492242\">VAWA<\/span>)<\/a>, noncitizens who were victims of domestic violence by a <span data-term-id=\"58492233\">U.S. citizen<\/span> or a <span data-term-id=\"58492227\">lawful permanent resident<\/span> (LPR) may petition to stay in the country despite the violation of <span data-term-id=\"58492231\">immigration law<\/span>.<\/p>\n<p><span data-term-id=\"58492242\">VAWA<\/span> <span data-term-id=\"58492257\">self-petitioners<\/span> may apply for a <span data-term-id=\"58492208\">Waiver<\/span> of <span data-term-id=\"58492230\">Grounds of <\/span><span data-term-id=\"58492210\">Inadmissibility<\/span> (<a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/extreme-hardship-601-waiver.html\"><span data-term-id=\"58492265\">Form I-601<\/span><\/a>). This form is available for inadmissible nonimmigrants who want to be admitted into the U.S. as an immigrant or for <span data-term-id=\"58492256\">adjustment of status<\/span>.<\/p>\n<h2><span data-term-id=\"58492239\">Waiver<\/span><span data-term-id=\"58492239\"> of <\/span><span data-term-id=\"58492214\">Ineligibility<\/span><\/h2>\n<p>Certain aliens who are otherwise ineligible for a visa may be able to get a\u00a0<a href=\"https:\/\/www.uscis.gov\/i-601\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58492239\">waiver<\/span><span data-term-id=\"58492239\"> of <\/span><span data-term-id=\"58492214\">ineligibility<\/span><\/a>. For instance, if a foreign national can show that their presence in the country is not contrary to national safety, security, or public welfare. If their admission to the country would bring <span data-term-id=\"58492248\">public benefit<\/span>, a <span data-term-id=\"58492239\">waiver<\/span><span data-term-id=\"58492239\"> of <\/span><span data-term-id=\"58492214\">ineligibility<\/span> may be given.<\/p>\n<p>For instance, refugees who are inadmissible for <span data-term-id=\"58492209\">visa application<\/span> may seek refugee status. They can apply for a <span data-term-id=\"58492208\">waiver<\/span> of <span data-term-id=\"58492210\">inadmissibility<\/span> by filing an Application by Refugee for <span data-term-id=\"58492208\">Waiver<\/span> of Ground of Excludability (<a href=\"https:\/\/www.uscis.gov\/i-602\" target=\"_blank\" rel=\"noopener\">Form I-602<\/a>). Note, however, that refugees and <span data-term-id=\"58492249\">asylees<\/span> are in a different category of <span data-term-id=\"58492209\">visa applicant<\/span>.<\/p>\n<p>The <span data-term-id=\"58492239\">waiver<\/span><span data-term-id=\"58492239\"> of <\/span><span data-term-id=\"58492214\">ineligibility<\/span> usually begins after the representative of the <span data-term-id=\"58492225\">Department of State<\/span>, such as a <span data-term-id=\"58492212\">consular officer<\/span>, determines that the applicant is ineligible for a <span data-term-id=\"58492220\">U.S. visa<\/span>. The officer will then allow the person to apply for a <span data-term-id=\"58492239\">waiver<\/span><span data-term-id=\"58492239\"> of <\/span><span data-term-id=\"58492214\">ineligibility<\/span>.<\/p>\n<p>The United States\u2019 <span data-term-id=\"58492262\">foreign policy<\/span> plays an integral part in these decisions. The U.S. facilitates the legal travel of foreign nationals while keeping the nation\u2019s security and public safety.<\/p>\n<p>The U.S. Attorney General has discretion whether to grant a <span data-term-id=\"58492208\">waiver<\/span> to a <span data-term-id=\"58492209\">visa applicant<\/span>. They determine whether specific grounds for exclusion exist on a case-by-case basis. The Attorney General may also parole into the U.S. certain foreign nationals for urgent humanitarian reasons or significant <span data-term-id=\"58492248\">public benefit<\/span>.<\/p>\n<p><span data-term-id=\"58492239\">Waiver<\/span><span data-term-id=\"58492239\"> of <\/span><span data-term-id=\"58492214\">ineligibility<\/span> does not guarantee a <span data-term-id=\"58492220\">U.S. visa<\/span>. It simply removes the <span data-term-id=\"58492230\">grounds of <\/span><span data-term-id=\"58492210\">inadmissibility<\/span>.
