The I-601 waiver, or Application for Waiver of Grounds of Inadmissibility, requests the U.S. Citizenship and Immigration Services&nbsp;(USCIS) to waive some inadmissibility grounds that often affect their U.S. visa or green card application\u2014for instance, health-related issues, prior immigration violations, or criminal history.<\/p>\n\n    <\/div>\n\n\n\n<p>But to obtain approval of the I-601 waiver, the applicant should show that denial of entry in the United States would result in exceptional difficulties for your family members in the U.S.<\/p>\n<p>Other compelling factors could also make you eligible for an I-601 waiver. But USCIS may approve a <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-9-part-d-chapter-3\" target=\"_blank\" rel=\"noopener\">waiver of vaccination inadmissibility<\/a> if:<\/p>\n<ul>\n<li>The applicant receives the needed vaccination<\/li>\n<li>A qualified medical officer certifies that the vaccination wouldn&#8217;t be medically appropriate; or<\/li>\n<li>The Secretary of the DHS determines that requiring the vaccination would go against the applicant&#8217;s religious beliefs or moral convictions.<\/li>\n<\/ul>\n<h3>Immigrant Membership in a Totalitarian Party<\/h3>\n<p>An applicant can be inadmissible if they are or have been affiliated with the <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-8-part-f-chapter-3\" target=\"_blank\" rel=\"noopener\">Communist or any other totalitarian party<\/a>. But a waiver may be granted for &#8220;humanitarian purposes, to assure family unity, or in the public interest&#8221; if:\u00a0<\/p>\n<ul>\n<li>The applicant is the spouse, parent, son, daughter, brother, or sister of a U.S. citizen or a spouse, son, or daughter of an alien lawfully admitted for permanent residence, or the <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/fiance-visas.html\">fianc\u00e9 of a K visa petitioner<\/a>;<\/li>\n<li>The applicant isn&#8217;t a threat to the security of the U.S.; and<\/li>\n<li>In the immigration officer&#8217;s opinion, the applicant&#8217;s undesirability as a permanent resident is outweighed by social and humane considerations.<\/li>\n<\/ul>\n<h3>Misrepresentation<\/h3>\n<p>An applicant is inadmissible if they intentionally lied about, or misrepresented, any significant fact while seeking a visa, admission to the U.S., or any other benefit under the <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/basic-immigration-laws.html\">Immigration and Nationality Act<\/a> (INA). But the applicant may get a waiver if they can show that:<\/p>\n<ul>\n<li>Refusal of admission to the U.S. would result in extreme hardship to a U.S. citizen or lawful permanent resident spouse or parent, or to the K visa petitioner; and<\/li>\n<li>In the immigration officer&#8217;s opinion, the applicant&#8217;s undesirability as a permanent resident is outweighed by social and humane considerations.<\/li>\n<\/ul>\n<h3>Unlawful Presence<\/h3>\n<p>A foreign national is inadmissible for three years if they have lived unlawfully in the U.S. for an uninterrupted period or more than 180 days but less than one year, and then voluntarily departed before <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/overview-of-removal-procedures.html\">removal proceedings<\/a> were initiated against them. But a waiver may be granted for a foreign national who establishes at the visa interview that:<\/p>\n<ul>\n<li>Refusal of admission to the U.S. would result in extreme hardship to a U.S. citizen or lawful permanent resident spouse or parent, or the K visa petitioner; and<\/li>\n<li>In the immigration officer&#8217;s opinion, social and humane considerations outweigh the applicant&#8217;s undesirability as a permanent resident.<\/li>\n<\/ul>\n<h2><b>Filing Fee<\/b><\/h2>\n<p>As of May 2026, the <a href=\"https:\/\/www.uscis.gov\/g-1055?form=i-601\" target=\"_blank\" rel=\"noopener\">filing fee for Form I-601 is $1,050<\/a>. It is nonrefundable and can be paid by check or money order.<\/p>\n<h2><b>Penalties<\/b><\/h2>\n<p>If you knowingly and willfully misrepresent or conceal a material fact on your I-601 waiver, or submit a false document or affidavit, USCIS may deny your waiver as well as any other immigrant benefit. Also, you may be subject to penalties and <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/view-all-criminal-charges.html\">criminal prosecution<\/a>.<\/p>\n<h2><b>Appealing a 601 Waiver Denial<\/b><\/h2>\n<p>If USCIS denies an I-601 waiver, the applicant may appeal the decision by filing\u00a0<a href=\"https:\/\/www.uscis.gov\/i-290b\" target=\"_blank\" rel=\"noopener\">Form I-290B<\/a>, Notice of Appeal, with the USCIS Administrative Appeals Office.<\/p>\n<p>You can file an appeal on your own, but having an <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/\" target=\"_blank\" rel=\"noopener\">immigration lawyer<\/a> on your side for this process can be a critical support.<\/p>\n<h2><b>What Else To Know About I-601 Waivers<\/b><\/h2>\n<p>When applying for an I-601 waiver, you&#8217;ll need to submit a check of your <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/how-does-an-arrest-affect-immigration-status.html\">criminal history.<\/a> It is used to determine whether you have a criminal record in either your home country or elsewhere. Having such a criminal history can create difficulties in obtaining an I-601 waiver.<\/p>\n<p>If you can present evidence of extreme hardship, any fees associated with the application can also be waived or adjusted.<\/p>\n<p>If an immediate relative or qualifying relative is already a citizen in the United States, you may also be eligible for prioritization in the I-601 application review process. Having family members in the U.S. who <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/family-visa.html\">are already citizens<\/a> often helps resolve many immigration-related issues. This is as true of visa applicants, as it is of applicants for these kinds of waivers.<\/p>\n<p>Throughout the process, you will need to be in regular communication U.S. Citizenship and Immigration Services (USCIS). You may also need to communicate with the U.S. Department of State. In your waiver request, you will need to meet with a <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/u-s-embassy-consulate-guide.html\">consular officer<\/a> where you are located.
