This status entitles you to various benefits and rights while living in the United States. The card itself proves your immigration status.<\/p>\n<p>This article discusses who is eligible for <span data-term-id=\"58558001\">lawful <\/span><span data-term-id=\"58557993\">permanent resident<\/span> (<span data-term-id=\"58558054\">LPR<\/span>) status in the U.S. Use the questions below to determine if you may be able to get a green card. If you\u2019re unsure which category fits your situation, an <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58558031\">immigration attorney<\/span><\/a> can explain your options and guide you through the <span data-term-id=\"58558021\">application process<\/span>.<\/p>\n<h2>Is Your <span data-term-id=\"58557996\">Family Member<\/span> a <span data-term-id=\"58557994\">U.S. Citizen<\/span>?<\/h2>\n<p>If you process the green card through a <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-overview\/family-preference-and-immediate-relative-petitions-the-basics.html\"><span data-term-id=\"58557999\">family-based<\/span> petition<\/a>, obtaining <span data-term-id=\"58558001\">lawful <\/span><span data-term-id=\"58557993\">permanent residence<\/span> can be a relatively smooth process. Immediate <span data-term-id=\"58557996\">family members<\/span> of <span data-term-id=\"58557994\">U.S. citizens<\/span>, like their spouses or children under 21, have a more direct route.<\/p>\n<p>The following relations qualify under this category, in no particular order:<\/p>\n<ul>\n<li>Spouses of <span data-term-id=\"58557994\">U.S. citizens<\/span>, including recent widows and <span data-term-id=\"58558025\">widowers<\/span><\/li>\n<li><span data-term-id=\"58558009\">Unmarried children<\/span> under age 21 with at least one <span data-term-id=\"58557994\">U.S. citizen<\/span> parent<\/li>\n<li>Parents of <span data-term-id=\"58557994\">U.S. citizens<\/span>, if the <span data-term-id=\"58557994\">U.S. citizen<\/span> child is at least age 21<\/li>\n<li>Stepchildren and stepparents of <span data-term-id=\"58557994\">U.S. citizens<\/span>, if the marriage creating the stepparent\/stepchild relationship took place before the child\u2019s 18th birthday<\/li>\n<li>Adopted children of <span data-term-id=\"58557994\">U.S. citizens<\/span>, if the adoption took place before the child reached age 16<\/li>\n<\/ul>\n<p>Extended <span data-term-id=\"58557996\">family members<\/span> are eligible to file a <span data-term-id=\"58558003\">green card application<\/span>, but it takes longer than <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/eligibility-and-preference-categories.html\"><span data-term-id=\"58558008\">immediate relatives<\/span><\/a>. For the fiscal year of 2026, the U.S. <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/legal\/visa-law0\/visa-bulletin\/2026\/visa-bulletin-for-may-2026.html\" target=\"_blank\" rel=\"noopener\">grants 226,000 green cards<\/a> to family-sponsored preference immigrants. These are granted on a first-come, first-served basis. So, the sooner the citizen relative submits the petition, the sooner the non-citizen can file their\u00a0<span data-term-id=\"58558003\">green card application<\/span> and obtain a green card. The wait in\u00a0<a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility-categories\" target=\"_blank\" rel=\"noopener\">this category<\/a>\u00a0can be lengthy, varying from three to 24 years.<\/p>\n<h2>Is Your <span data-term-id=\"58557996\">Family Member<\/span> a <span data-term-id=\"58558001\">Lawful <\/span><span data-term-id=\"58557993\">Permanent Resident<\/span>?<\/h2>\n<p><span data-term-id=\"58558054\">LPRs<\/span> may also petition certain <span data-term-id=\"58557996\">family members<\/span> to come to the U.S. as <span data-term-id=\"58557993\">permanent residents<\/span>. However, the <span data-term-id=\"58557996\">family members<\/span> they can petition are more limited than that of a <span data-term-id=\"58557994\">U.S. Citizen<\/span>. Here are the categories of <span data-term-id=\"58557996\">family members<\/span> that <span data-term-id=\"58558054\">LPRs<\/span> can petition:<\/p>\n<ul>\n<li>Spouses of <span data-term-id=\"58558054\">LPRs<\/span>: They can petition their spouses to join them in the U.S. as <span data-term-id=\"58558054\">LPRs<\/span><\/li>\n<li><span data-term-id=\"58558009\">Unmarried children<\/span> of LPs: They can petition their <span data-term-id=\"58558009\">unmarried children<\/span> under 21 years of age<\/li>\n<li><span data-term-id=\"58558009\">Unmarried children<\/span> of any age<\/li>\n<\/ul>\n<p>If you are an <span data-term-id=\"58558054\">LPR<\/span> and want to <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/the-green-card-process-do-s-and-don-ts.html\">obtain a green card<\/a> for your <span data-term-id=\"58557996\">family members<\/span> mentioned above, you must do the following:<\/p>\n<ul>\n<li><span data-term-id=\"58558058\">File <\/span><a href=\"https:\/\/www.uscis.gov\/i-130\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58558040\">Form<\/span><span data-term-id=\"58558040\"> I-130<\/span><\/a> Petition for Alien Relative<\/li>\n<li>Provide proof that shows your status as a <span data-term-id=\"58558001\">lawful <\/span><span data-term-id=\"58557993\">permanent resident<\/span><\/li>\n<li>Submit evidence that qualifies the relationship. These documents include a marriage certificate, birth certificate, divorce decrees, etc.<\/li>\n<li>Submit evidence to show proof of any legal name change for you or your <span data-term-id=\"58557996\">family member<\/span><\/li>\n<\/ul><\/div>\n\n\n\n<div style=\"background:#f3f7fb; border-left:4px solid #0B3f73; padding:18px; margin:20px 0; border-radius:6px;\">\n  \n  <h2 style=\"font-size:16px; margin:0;\">\n    Green Card Update: USCIS Issues Stricter Guidance on Adjustment of Status\n  <\/h2>\n<br>\n\n  U.S. Citizenship and Immigration Services (USCIS) <a href=\"https:\/\/www.uscis.gov\/newsroom\/news-releases\/us-citizenship-and-immigration-services-will-grant-adjustment-of-status-only-in-extraordinary\" target=\"_blank\" style=\"color:#0B3F73; text-decoration:underline;\" rel=\"noopener\">recently announced<\/a> that for those currently on temporary visas (H-1B, student, tourist, etc.) <strong>adjustment of status within the United States will only be granted in extraordinary circumstances.<\/strong> This means most people must return to their home country to apply for a green card before re-entering as a lawful permanent resident. \n  <br><br>\n  Seek <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/?fli=dcta\" target=\"_blank\" style=\"color:#0B3F73; text-decoration:underline;\" rel=\"noopener\">legal help from an immigration attorney<\/a> who can help you understand your options before starting the process.\n\n<\/div>\n\n\n\n<div><h2>Do You Have Notable Talent in Your Profession?<\/h2>\n<p>Non-citizens whose skills are needed in the USA may also file to\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/other-ways-to-obtain-an-immigrant-visa-green-card.html\">obtain a green card.<\/a>\u00a0Like the extended <span data-term-id=\"58557996\">family members<\/span>, this classification also uses a <span data-term-id=\"58558019\">preference category<\/span> system. They admit only 140,000 workers yearly and\u00a0use the <span data-term-id=\"58558019\">preference category<\/span> system. Like extended <span data-term-id=\"58557996\">family members<\/span>, workers can expect to wait years before their <span data-term-id=\"58558003\">green card application<\/span> gains <span data-term-id=\"58557993\">permanent residency<\/span>.<\/p>\n<p>Usually, the non-citizens must show proof that there is a <span data-term-id=\"58558033\">job offer<\/span>. In those cases, the employer must show that they\u00a0recruited for the position in the USA and that no qualified <span data-term-id=\"58557994\">US citizens<\/span> could fill the position.<\/p>\n<p>You may be eligible for a green card if you are a foreign national with notable talent or skills. This <span data-term-id=\"58558003\">green card application<\/span> is known as <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/employment-visa-eligibility-faq.html\">employment-based immigrants<\/a>. Here, the <span data-term-id=\"58558035\">U.S. <\/span><span data-term-id=\"58558013\">immigration<\/span><span data-term-id=\"58558013\"> law<\/span> gives foreign nationals various ways to obtain <span data-term-id=\"58558054\">LPR<\/span> status through employment.<\/p>\n<p>Non-citizens who want to obtain a\u00a0<a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility\/green-card-for-employment-based-immigrants\" target=\"_blank\" rel=\"noopener\">green card based on employment<\/a>\u00a0must wait for an immigrant visa number to become available according to the following preferences:<\/p>\n<p><a href=\"https:\/\/www.uscis.gov\/working-united-states\/permanent-workers\/employment-based-immigration-first-preference-eb-1\" target=\"_blank\" rel=\"noopener\">First Preference<\/a>\u00a0(EB-1):\u00a0<span data-term-id=\"58558061\">Priority Workers<\/span>. <span data-term-id=\"58558061\">Priority workers<\/span> include those with unique and advanced skills, education, or talents, such as:<\/p>\n<ul>\n<li>Individuals who excel in the arts, sciences, athletics, business, or education<\/li>\n<li>Exceptional professors and researchers<\/li>\n<li>Supervisors and executives of global companies<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.uscis.gov\/working-united-states\/permanent-workers\/employment-based-immigration-second-preference-eb-2\" target=\"_blank\" rel=\"noopener\">Second Preference<\/a>\u00a0(EB-2):\u00a0Professionals with <span data-term-id=\"58558000\">extraordinary ability<\/span> or advanced academic degrees<\/p>\n<p><a href=\"https:\/\/www.uscis.gov\/working-united-states\/permanent-workers\/employment-based-immigration-third-preference-eb-3\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58558045\">Third Preference<\/span><\/a>\u00a0(EB-3):\u00a0<span data-term-id=\"58558017\">Skilled Workers<\/span>, professionals, and other qualified workers<\/p>\n<p><a href=\"https:\/\/www.uscis.gov\/working-united-states\/permanent-workers\/employment-based-immigration-fourth-preference-eb-4\" target=\"_blank\" rel=\"noopener\">Fourth Preference<\/a>\u00a0(EB-4):\u00a0People in religious vocations and <span data-term-id=\"58558007\">special immigrants<\/span>, including:<\/p>\n<ul>\n<li><span data-term-id=\"58558002\">Religious workers<\/span> of legitimate religious organizations<\/li>\n<li>Foreign medical graduates who have been in the USA since 1978<\/li>\n<li>Former Panama Canal Zone employees<\/li>\n<li>Foreign workers who were longtime employees of the <span data-term-id=\"58558005\">U.S. government<\/span><\/li>\n<li>Retired officers or employees of certain international organizations who have lived in the USA for a certain period<\/li>\n<li>Non-citizen workers employed by the U.S. consulate in Hong Kong for at least three years<\/li>\n<li>Non-citizen children who have been declared dependent in juvenile courts in the United States<\/li>\n<li>International broadcasting employees<\/li>\n<li>Certain U.S. Armed Forces enlisted overseas have served for at least 12 years<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/immigration-through-investment.html\">Fifth Preference<\/a>\u00a0(EB-5):\u00a0Investors wishing to invest at least $1,050,000\u00a0into a US business (or $800,000 in depressed economies). This investor must also have at least ten employees.<\/p>\n<h2>Is Your Country in This Year\u2019s <span data-term-id=\"58558023\">Diversity Visa Lottery<\/span>?<\/h2>\n<p>Every year, 50,000 immigrant visas are given through the\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/the-diversity-lottery-overview.html\">Diversity Immigrant Visa Program<\/a> (DV Program). Here, a <span data-term-id=\"58558023\">diversity visa lottery<\/span> occurs, which is drawn\u00a0randomly from a selection of foreign nationals from countries that have low rates of immigration to the U.S. The U.S. <span data-term-id=\"58558060\">Department of State<\/span> manages the DV Program.<\/p>\n<p>Most <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/immigrate\/diversity-visa-program-entry\/diversity-visa-submit-entry1.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58558023\">diversity visa lottery<\/span><\/a> winners are <span data-term-id=\"58558032\">visa applicants<\/span> outside of the country. They immigrate through the issuance of an immigrant visa and <span data-term-id=\"58558012\">consular processing<\/span>. However, there are a small number of individuals who, at the time of winning,\u00a0are living in the U.S. with a nonimmigrant status. For these individuals, <span data-term-id=\"58557995\">USCIS<\/span> administers their <span data-term-id=\"58558004\">adjustment of status<\/span>.<\/p>\n<h2>Is Your <span data-term-id=\"58558047\">Home Country<\/span> Unsafe?<\/h2>\n<p>Asylum is used to refer to the protection of those noncitizens who are already living in the United States, whereas refugee refers to foreign nationals who live outside the U.S. and seek protection from the country. In most cases, these individuals are unable or unwilling to return to their <span data-term-id=\"58558047\">home country<\/span> due to <a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/asylum-eligibility-and-asylum-claims-faq.html\">credible fear of persecution<\/a>.<\/p>\n<p>The <span data-term-id=\"58558035\">U.S. <\/span><span data-term-id=\"58558013\">immigration<\/span><span data-term-id=\"58558013\"> law<\/span> allows an asylum seeker to apply for <span data-term-id=\"58558054\">LPR<\/span> status after being present in the U.S. for at least one year since being <a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/seeking-lawful-permanent-resident-lpr-status.html\">granted asylum status<\/a>.<\/p>\n<p>Sometimes, members of Congress have helped non-citizens obtain <span data-term-id=\"58557993\">permanent residence<\/span> where the law would not allow it. These incidents have all been extraordinary cases that involved humanitarian reasons.<\/p>\n<h2>Would <span data-term-id=\"58558044\">Deportation<\/span> Cause Major Hardship?<\/h2>\n<p>Long-time residents who have lived in the USA for more than ten years can request <span data-term-id=\"58557993\">permanent residence<\/span>. This typically happens in <span data-term-id=\"58558044\">deportation<\/span> court proceedings, where the non-citizen requests <span data-term-id=\"58557993\">permanent residence<\/span> as a defense. The non-citizen must show that\u00a0their\u00a0<span data-term-id=\"58557994\">U.S. citizen<\/span> children or spouse would face extraordinary and <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/extreme-hardship-601-waiver.html\">exceptionally unusual hardship<\/a> if deported.<\/p>\n<p>If this could apply to you, consult a lawyer. Going to <span data-term-id=\"58557995\">USCIS<\/span> to ask about this is risky, as it could trigger removal proceedings. Talking to an attorney first is safer. <a class=\"in-cell-link\" href=\"https:\/\/www.findlaw.com\/hirealawyer\/do-you-need-a-lawyer\/what-is-the-attorney-client-privilege.html\" target=\"_blank\" rel=\"noopener\">Attorney-client privilege<\/a> prohibits them from sharing information about your immigration status. Their role is to help you, not act as an enforcement agent.<\/p>\n<h2>Have You Been Living Continuously in the U.S. Since January 1st, 1972?<\/h2>\n<p>Non-citizens who have lived continuously in the USA since January 1, 1972,\u00a0<a href=\"https:\/\/www.uscis.gov\/green-card\/other-ways-get-green-card\/green-card-through-registry\" target=\"_blank\" rel=\"noopener\">may apply for a green card<\/a>. A green card through the registry is a part of <span data-term-id=\"58558013\">immigration law<\/span> that allows individuals living continuously in the U.S. since January 1, 1972, to apply for a green card. This applies even when the individual is living in the U.S. unlawfully.<\/p>\n<p>However, the individual should meet the following <span data-term-id=\"58558029\">eligibility<\/span><span data-term-id=\"58558029\"> requirements<\/span> to avail of this benefit:<\/p>\n<ul>\n<li>You are a person of <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-d-chapter-9\" target=\"_blank\" rel=\"noopener\">good moral character<\/a><\/li>\n<li>You are not ineligible for <span data-term-id=\"58558028\">naturalization<\/span> (citizenship)<\/li>\n<li>You entered the United States before Jan. 1, 1972<\/li>\n<li>You have lived in the United States continuously since you entered<\/li>\n<li>You are not removable (<span data-term-id=\"58558044\">deportable<\/span>) under Section 237(a)(4)(B) of the\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/basic-immigration-laws.html\">Immigration and Nationality Act<\/a>\u00a0(INA). You are not inadmissible under Section 212(a)(3)(E) of the INA or as a criminal, procurer, other immoral person, subversive, violator of the narcotics laws, or noncitizen smuggler<\/li>\n<\/ul>\n<h2>Do You Already Have a <span data-term-id=\"58558024\">Non-Immigrant Visa<\/span>?<\/h2>\n<p>You may be eligible for <span data-term-id=\"58558001\">lawful <\/span><span data-term-id=\"58558026\">permanent resident<\/span><span data-term-id=\"58558026\"> status<\/span> if you have successfully qualified for a nonimmigrant temporary visa. This applies in particular in cases wherein the criteria of your green card align closely with your temporary visa.\u00a0<\/p>\n<p>For instance, if you have an <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/h-1b-visa-requirements.html\">H-1B or work visa<\/a>, you may temporarily live and work in the United States. However, foreign nationals with H1-B visas may transition to <span data-term-id=\"58558026\">permanent resident<\/span><span data-term-id=\"58558026\"> status<\/span>. The process to <span data-term-id=\"58558041\">adjust status<\/span> often involves a series of steps.<\/p>\n<p>First, your employer will need to file an I-140 to sponsor you. Then, when your <span data-term-id=\"58558039\">priority date<\/span> becomes current, you should <span data-term-id=\"58558058\">file F<\/span><span data-term-id=\"58558043\">orm<\/span><span data-term-id=\"58558043\"> I-485<\/span> petition with the <span data-term-id=\"58558010\">U.S. Citizenship<\/span> and Immigration Services (<span data-term-id=\"58557995\">USCIS<\/span>). This will allow you to maintain your lawful immigration status while processing your <span data-term-id=\"58558003\">green card application<\/span>. Also, to qualify for an <span data-term-id=\"58558016\">employment-based green card<\/span>, there should be a <span data-term-id=\"58558048\">U.S. employer<\/span> willing to <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/how-to-apply-for-immigrant-status-based-on-employment.html\">sponsor you for that status<\/a>.<\/p>\n<p>Other types of <span data-term-id=\"58558024\">nonimmigrant visas<\/span> may allow you to transition your immigration status into <span data-term-id=\"58558054\">LPR<\/span> status.
