The Burden of Proof in Negligence Law<\/h2>\n

The injured person (plaintiff) generally has the burden of proof in a personal injury case. They must prove that the defendant was negligent by a preponderance of the evidence<\/a>.<\/p>\n

This standard of proof is different from a criminal case<\/a>, in which the defendant must be guilty beyond a reasonable doubt. In an injury case, the burden of proof is lower. There may still be some room for doubt, but the plaintiff must show it is more likely than not that the defendant is responsible for causing their injury and damages (losses).\u00a0<\/p>\n

There is an exception in certain types of accidents in which liability is an obvious factor. This scenario is known as the res ipsa loquitur doctrine<\/a>.
