Recklessness means knowingly taking a risk. This is unlike negligence, which occurs when a person unknowingly takes a risk of which they should have been aware.<\/p>\n<p>Recklessness may also allow recovery from certain people who are typically <a href=\"https:\/\/dictionary.findlaw.com\/definition\/immunity.html\" target=\"_blank\" rel=\"noopener\">immune from liability<\/a> for mere negligence, such as:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/injury-claims-against-the-government.html\">Government workers<\/a><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/medical-malpractice\/medical-malpractice-who-can-be-sued.html\">Health care professionals<\/a><\/li>\n<\/ul>\n<h2>What Is Recklessness?<\/h2>\n<p>Recklessness is a legal term that describes a person&#8217;s state of mind. This state is determined both subjectively and objectively. Though people sometimes use &#8220;reckless&#8221; to describe a variety of negligent or intentional acts, this term has a distinct legal definition.\u00a0<\/p>\n<p>A person may be liable for serious injuries caused by their recklessness if they either:<\/p>\n<ul>\n<li>Acted with conscious disregard for the safety of others<\/li>\n<li>Knew (or should have known) that their actions may cause harm to someone else and consciously disregarded that risk<\/li>\n<\/ul>\n<h3>Types of Recklessness<\/h3>\n<p>There are two types of reckless behavior. The first considers what the actor knew or is believed to have been thinking when the act occurred. This is a subjective test.<\/p>\n<p>The second considers what a reasonable person would have thought in the defendant&#8217;s position. This is an objective test. In both situations, the issue turns on conscious awareness. Negligence consists mainly of carelessness or incompetence. Recklessness requires the conscious choice to take a particular course of action despite a high degree of awareness of the risk. Recklessness requires a further degree of risk-taking by the actor than negligence.<\/p>\n<p>On one point, reckless misconduct differs from intentional wrongdoing. Under recklessness, the actor intends to commit the act but does not actually intend to cause harm to others. Instead, they may wish that the harm does not happen but have a strong reason to believe that it might.<\/p>\n<h2>How Recklessness Factors Into Car Accidents<\/h2>\n<p>Car accidents are one of the most common contexts in which recklessness takes center stage.<\/p>\n<p>All motorists bear a duty of care towards other road users.
