In most cases, if the inspector declares your car a <span data-term-id=\"55490786\">total loss<\/span>, the <span data-term-id=\"55490775\">insurance company<\/span> will cut you a check for the car&#8217;s value, and that is the end of the process.<\/p>\n<p>At this stressful moment, the insurer may ask you to sign two documents, a <span data-term-id=\"55490799\">Bill of Sale<\/span> and a <span data-term-id=\"55490769\">Power of Attorney<\/span>. What is a <span data-term-id=\"55490769\">power of attorney<\/span>, and why does your <span data-term-id=\"55490775\">insurance company<\/span> need one just to complete your <span data-term-id=\"55490778\">insurance claim<\/span>? Do you need to sign it? What happens if you don\u2019t?<\/p>\n<p>The short answer is yes, you do need to sign the <span data-term-id=\"55490769\">power of attorney<\/span> to process your claim. If you\u2019re cautious, there\u2019s no reason to worry about any other legal problems.<\/p>\n<h2>Why the Insurer Needs A <span data-term-id=\"55490769\">Power of Attorney<\/span><\/h2>\n<p>A <a href=\"https:\/\/www.findlaw.com\/estate\/financial-power-of-attorney.html\"><span data-term-id=\"55490769\">Power of Attorney<\/span> (<span data-term-id=\"55490772\">POA<\/span>)<\/a> gives another person (your agent) the ability to act on your behalf. You can create a <span data-term-id=\"55490772\">POA<\/span> for almost any situation. The most common use is a <span data-term-id=\"55490793\">durable <\/span><span data-term-id=\"55490769\">power of attorney<\/span> used in living wills. In an insurance situation, the company needs a <span data-term-id=\"55490769\">power of attorney<\/span> to complete your <span data-term-id=\"55490779\">car <\/span><span data-term-id=\"55490778\">insurance<\/span><span data-term-id=\"55490778\"> claim<\/span>.<\/p>\n<p>After an accident, the <span data-term-id=\"55490788\">insurance policy<\/span> pays out the fair market value of the vehicle. That is the end of your ownership of the vehicle, but not the <span data-term-id=\"55490775\">insurance company<\/span>\u2019s. To dispose of the car, they must have legal ownership of the vehicle and permission from the original owner to transfer title.<\/p>\n<p>The <span data-term-id=\"55490770\">power of attorney<\/span><span data-term-id=\"55490770\"> form<\/span> allows the insurer to transfer the title to a new owner, offer the wreck in an auction, or sell it to a salvage yard. Along with the <span data-term-id=\"55490799\">bill of sale<\/span>, the <span data-term-id=\"55490772\">POA<\/span> allows the insurer to remove the\u00a0<span data-term-id=\"55490802\">totaled vehicle<\/span>\u00a0from your home or the auto shop and dispose of it without needing to obtain your written permission every time it changes hands.<\/p>\n<h3>What a <span data-term-id=\"55490769\">Power of Attorney<\/span> Lets the <span data-term-id=\"55490775\">Insurance Company<\/span> Do<\/h3>\n<p>A <span data-term-id=\"55490790\">limited <\/span><span data-term-id=\"55490769\">power of attorney<\/span> gives the <span data-term-id=\"55490775\">insurance company<\/span> the ability to act for you to transfer ownership of your car. Normally, when you sell your car, you sign a document or a section of the title that surrenders your rights to the car, allowing the new owner to submit a request for a new title in their name.<\/p>\n<p>When your car is totaled, what happens next depends on whether you still owe the bank or lienholder or if you own the car free and clear. A <span data-term-id=\"55490772\">POA<\/span> lets the insurer handle the details of disposing of your car, paying for any remaining loan balance, and other state paperwork, without having to involve you in the process. The <span data-term-id=\"55490772\">POA<\/span> lets the <span data-term-id=\"55490775\">insurance company<\/span>:<\/p>\n<ul>\n<li>Sign the title transfer documents<\/li>\n<li>Execute the <span data-term-id=\"55490799\">bill of sale<\/span> from you to the <span data-term-id=\"55490775\">insurance company<\/span><\/li>\n<li>Sign the <span data-term-id=\"55490783\">odometer<\/span> disclosure form<\/li>\n<li>Obtain a <span data-term-id=\"55490801\">duplicate title<\/span> if necessary<\/li>\n<li>File all necessary <span data-term-id=\"55490774\">DMV<\/span> paperwork<\/li>\n<li>Transfer title to a salvage yard or auction company<\/li>\n<\/ul>\n<p>The insurance settlement and any money from the sale or salvage of the vehicle pay off your remaining loan. If that sum does not cover the remaining loan amount, you\u2019ll have to continue paying until you pay the loan in full. Your attorney can explain how this works and how to negotiate an accord and satisfaction after a collision.<\/p>\n<h3>What a <span data-term-id=\"55490772\">POA<\/span> Does NOT Let the <span data-term-id=\"55490775\">Insurance Company<\/span> Do<\/h3>\n<p>Unlike a <span data-term-id=\"55490780\">general <\/span><span data-term-id=\"55490769\">power of attorney<\/span>, which gives your agent broad power to act on your behalf, <span data-term-id=\"55490779\">car insurance<\/span> <span data-term-id=\"55490772\">POAs<\/span> give the insurer a narrow scope of authority. A <span data-term-id=\"55490772\">POA<\/span> should only give the company the ability to transfer the title and dispose of your car. It should not:<\/p>\n<ul>\n<li>Let the <span data-term-id=\"55490775\">insurance company<\/span> access your finances or bank accounts<\/li>\n<li>Involve any other damaged property<\/li>\n<li>Let the company make decisions about any other property<\/li>\n<li>Continue indefinitely or give the company authority in other matters besides the title transfer<\/li>\n<li>Have any blank spaces the company will \u201cfill in later,\u201d or have vague terms like \u201cact in my best interest.\u201d The <span data-term-id=\"55490772\">POA<\/span> should spell out exactly what the <span data-term-id=\"55490775\">insurance company<\/span> can and cannot do<\/li>\n<li>Waive any rights besides the ones listed in the <span data-term-id=\"55490782\">Power of Attorney<\/span><span data-term-id=\"55490782\"> document<\/span><\/li>\n<\/ul>\n<p>Make sure either you or your attorney confirms that the <span data-term-id=\"55490772\">POA<\/span> you\u2019re signing doesn\u2019t contain any of these provisions.<\/p>\n<h3>Limiting your <span data-term-id=\"55490772\">POA<\/span><\/h3>\n<p>It\u2019s a good idea to have an attorney review the <span data-term-id=\"55490772\">POA<\/span> before you sign, even if you don\u2019t have a lawyer handling your <span data-term-id=\"55490778\">insurance claim<\/span>. If you\u2019re doing this yourself, look over the document carefully, and watch out for the following:<\/p>\n<ul>\n<li>Your vehicle\u2019s VIN number should appear on the document in all relevant places<\/li>\n<li>There should be specific start and stop dates<\/li>\n<li>The document should specifically state that it only allows the agent to handle title transfer or <span data-term-id=\"55490774\">DMV<\/span> matters and grant no other powers<\/li>\n<li>It should be very short, as an insurance <span data-term-id=\"55490772\">POA<\/span> that\u2019s longer than one or two pages is a red flag that something is amiss<\/li>\n<\/ul>\n<p>For example, the <a href=\"https:\/\/esign.com\/wp-content\/uploads\/California-Motor-Vehicle-Power-of-Attorney-Form-REG-260.pdf\" target=\"_blank\" rel=\"noopener\">California <span data-term-id=\"55490774\">DMV<\/span> <span data-term-id=\"55490772\">POA<\/span> form<\/a> is half a page long. It contains blanks for the vehicle&#8217;s VIN, make, model, and license plate number (and the engine number for a motorcycle). The only language on the form states that:<\/p>\n<p>\u201cI [name of signer] appoint [name of agent] as my <span data-term-id=\"55490781\">attorney in fact<\/span>, to complete all necessary documents, as needed, to transfer ownership as required by law.\u201d<\/p>\n<p>By contrast, the Nevada <span data-term-id=\"55490774\">DMV<\/span> form states the same thing, albeit in more \u201clegalese\u201d and confusing language. It says that the signer makes the <span data-term-id=\"55490775\">insurance company<\/span> the:<\/p>\n<p><em>\u201ctrue and lawful <span data-term-id=\"55490781\">Attorney in Fact<\/span> to sign in the name, place and stead of the undersigned, any and all documents, including but not limited to <span data-term-id=\"55490806\">Certificate of Title<\/span> and\/or Vehicle Registration Certificate, issued by the Department of <span data-term-id=\"55490771\">Motor Vehicles<\/span> of the State of Nevada (NV <span data-term-id=\"55490774\">DMV<\/span>), or issued by another state to the extent authorized by that <span data-term-id=\"55490776\">state\u2019s law<\/span> and within the scope of the NV <span data-term-id=\"55490774\">DMV<\/span>\u2019s authority to require and\/or <\/em><strong><em>accept such signed documents, covering the <span data-term-id=\"55490771\">motor vehicle<\/span> described above, in whatever manner necessary to transfer any Registration Certificate and\/or secure, transfer, and\/or release any <span data-term-id=\"55490806\">Certificate of Title<\/span>. <\/em><\/strong><em>Granting and giving unto said <span data-term-id=\"55490781\">Attorney in Fact<\/span>, full authority and power to do and perform any and all acts authorized hereby, as fully to all intents and purposes as the <span data-term-id=\"55490792\">grantor<\/span> might, or could do if personally present, with full power of substitution.\u201d<\/em><\/p>\n<p>The key sentence is in bold. Otherwise, Nevada\u2019s document is nearly identical to California\u2019s.<\/p>\n<p>California and Nevada both require wet-ink signatures for a valid <span data-term-id=\"55490769\">power of attorney<\/span>. Some states may require <span data-term-id=\"55490784\">notarization<\/span> or other verification. Check your <span data-term-id=\"55490776\">state laws<\/span> for the requirements. The California document expires once the insurer transfers ownership to the new owner. You can specify an end date if you know you will be able to complete the transfer process by that date.<\/p>\n<h2>Signing the <span data-term-id=\"55490772\">POA<\/span><\/h2>\n<p>Before you sign any document from an <span data-term-id=\"55490775\">insurance company<\/span>, you may want to get <span data-term-id=\"55490773\">legal advice<\/span>. The <span data-term-id=\"55490772\">POA<\/span> and <span data-term-id=\"55490799\">Bill of Sale<\/span> are a part of the <span data-term-id=\"55490778\">insurance claim<\/span> settlement. However, you may need to sign a <span data-term-id=\"55490772\">POA<\/span> to begin or finalize the <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/car-accident-settlement-process-and-timeline.html\">settlement process<\/a>. If you\u2019re unsure about where the <span data-term-id=\"55490772\">POA<\/span> should fall in the settlement procedure, consider <a href=\"https:\/\/lawyers.findlaw.com\/personal-injury-plaintiff\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">talking to an attorney<\/a>.<\/p>\n<p>If you\u2019re not satisfied with the settlement amount or are unclear on where the money is going, do not sign the\u00a0<span data-term-id=\"55490772\">POA<\/span>\u00a0until someone explains it to you. The settlement should look something like this:<\/p>\n<ul>\n<li>The Actual Cash Value (ACV) of the vehicle (this is what you\u2019d get if you could sell the car as-is without owing anyone)<\/li>\n<li>Minus the insurance deductible, since you won\u2019t get that back<\/li>\n<li>Minus either the salvage value (unless you keep the car) or the amount due on the loan (if you still owe on the car)<\/li>\n<\/ul>\n<p>The ACV minus the deductible and the loan amount is what you\u2019ll get from the <span data-term-id=\"55490775\">insurance company<\/span>.<\/p>\n<p>You can <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/can-i-keep-a-totaled-car\/\">keep the car<\/a> and sell it for salvage yourself, but that value comes out of your settlement. If you choose that option, the <span data-term-id=\"55490775\">insurance company<\/span> will deduct that amount from a settlement check. The bank gets paid first, so you don\u2019t have to pay for a wrecked car. If the math doesn\u2019t add up, do not sign the <span data-term-id=\"55490772\">POA<\/span>.<\/p>\n<h2>What Happens After You Sign the <span data-term-id=\"55490772\">POA<\/span>?<\/h2>\n<p>After you sign, the <span data-term-id=\"55490775\">insurance company<\/span> will transfer all documents and prepare the financial transfers. Remove your personal belongings from the vehicle as soon as possible, as the salvage company or auction agents will arrive to remove the wreck sooner rather than later. Once you sign, the car is no longer yours.<\/p>\n<p>The <span data-term-id=\"55490774\">DMV<\/span> should send notice of title transfer. You may want to check on this in about ten days, since you are liable for the car until the title transfer, and the <span data-term-id=\"55490774\">DMV<\/span> may not notify you of the change. When you get the notice, keep a copy for your records.<\/p>\n<h2>If You Don\u2019t Want To Sign (Or Cannot)<\/h2>\n<p>You are not legally required to sign the <span data-term-id=\"55490772\">POA<\/span>, but you have few other options at this point. As a practical matter, signing is necessary to complete the <span data-term-id=\"55490786\">total loss<\/span> settlement process.<\/p>\n<p>It can be complicated signing over the\u00a0<span data-term-id=\"55490772\">POA<\/span>\u00a0if you are not the sole person on the title. If the settlement will not pay off <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/my-car-was-totaled-but-i-still-owe-money-on-it.html\">the outstanding loan<\/a>, you may want to keep the wreck and make your own arrangements for payment.<\/p>\n<p>In some states, not signing means that you cannot receive the settlement payment, so consult an attorney before taking this step. If you can refuse to sign, consider the following to help determine if it\u2019s worth the complications:<\/p>\n<ul>\n<li>You\u2019ll have to handle the title transfer and sale to a salvage yard or auction house yourself<\/li>\n<li>Your <span data-term-id=\"55490776\">state law<\/span> may not permit the private sale under these circumstances<\/li>\n<li>You will be liable for transporting the wreck from wherever it is now to wherever you sell it<\/li>\n<\/ul>\n<p>If the language of the <span data-term-id=\"55490772\">POA<\/span> is what is making you uncomfortable, you can try asking for changes to the <span data-term-id=\"55490772\">POA<\/span> itself. Most <span data-term-id=\"55490775\">insurance companies<\/span> use the state <span data-term-id=\"55490800\">vehicle <\/span><span data-term-id=\"55490770\">power of attorney<\/span><span data-term-id=\"55490770\"> form<\/span> that is applicable to their location. These forms already limit the insurer&#8217;s ability to transfer title and usually require a separate form to obtain <span data-term-id=\"55490783\">odometer<\/span> readings.<\/p>\n<p>If you want to negotiate changes to a <span data-term-id=\"55490772\">POA<\/span>, such as additional conditions or a definite expiration date, contact an attorney. They can negotiate terms with the <span data-term-id=\"55490775\">insurance company<\/span> and avoid delays or a flat no from the insurer.<\/p>\n<h2>Get <span data-term-id=\"55490773\">Legal Advice<\/span> From a <span data-term-id=\"55490804\">Personal Injury<\/span> Attorney<\/h2>\n<p>It is normal to have reservations about signing any <span data-term-id=\"55490777\">legal document<\/span>. You should always get <span data-term-id=\"55490773\">legal advice<\/span> when dealing with <span data-term-id=\"55490775\">insurance companies<\/span> after a car accident and during the settlement process. To get your <span data-term-id=\"55490787\">legal questions<\/span> answered during the claims process, contact a <a href=\"https:\/\/lawyers.findlaw.com\/personal-injury-plaintiff\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55490804\">personal injury<\/span> lawyer<\/a> or <span data-term-id=\"55490771\">motor vehicle<\/span> attorney in your area to discuss the matter. <span data-term-id=\"55490772\">POA<\/span> requirements, forms, and settlement processes vary significantly by state, so it\u2019s important to talk to someone licensed in your
