These laws are not uniform, as the following examples illustrate:<\/p>\n<ul>\n<li><span data-term-id=\"53682949\">California<\/span> requires <span data-term-id=\"53682952\">helmet use<\/span> for <a href=\"https:\/\/codes.findlaw.com\/ca\/vehicle-code\/veh-sect-21212\/\" target=\"_blank\" rel=\"noopener\">all <span data-term-id=\"53682945\">bicyclists<\/span> under 18 years old<\/a>. The <span data-term-id=\"53682972\">helmet requirement<\/span> applies to riding <span data-term-id=\"53682948\">scooters<\/span>, <span data-term-id=\"53682954\">skateboards<\/span>, roller skates, and nonmotorized <span data-term-id=\"53682948\">scooters<\/span>.<\/li>\n<li>Florida requires <span data-term-id=\"53682952\">helmet use<\/span> for all <span data-term-id=\"53682955\">bicycle riders<\/span> and passengers <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xxiii-motor-vehicles\/fl-st-sect-316-2065\/\" target=\"_blank\" rel=\"noopener\">under 16 years old<\/a>. This includes kids in anything attached to or trailing a bicycle.<\/li>\n<li>Louisiana has the lowest age requirement for <span data-term-id=\"53682972\">helmet requirements<\/span>. The state only requires <span data-term-id=\"53682952\">helmet use<\/span> for <span data-term-id=\"53682961\">bike riders<\/span> <a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-32-sect-199\/\" target=\"_blank\" rel=\"noopener\">under 12 years old<\/a>.<\/li>\n<\/ul>\n<p>The states that aren\u2019t listed do not have statewide <span data-term-id=\"53682972\">helmet requirements<\/span>. However, most states have localities with their <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-tickets\/bicycle-laws.html\">own helmet ordinances<\/a>. For example, <span data-term-id=\"53682979\">Texas<\/span> has no statewide laws that <span data-term-id=\"53682981\">mandate<\/span> <span data-term-id=\"53682961\">bike riders<\/span> to use helmets, but there are cities that <span data-term-id=\"53682981\">mandate<\/span> the use of bicycle helmets. <span data-term-id=\"53682963\">Illinois<\/span> doesn\u2019t have a statewide helmet law, but Chicago requires <span data-term-id=\"53682952\">helmet use<\/span> for all commercial <span data-term-id=\"53682943\">cyclists<\/span>, such as delivery workers and messengers.<\/p>\n<p>Local ordinances can be more strict than state laws. In <span data-term-id=\"53682959\">New York<\/span>, the state law <span data-term-id=\"53682981\">mandates<\/span> <span data-term-id=\"53682952\">helmet use<\/span> only for <span data-term-id=\"53682961\">bike riders<\/span> under 14 years old. However, certain counties, such as <a href=\"https:\/\/www.greenburghny.com\/318\/Bicycle-Helmet-Law\" target=\"_blank\" rel=\"noopener\">Greenburgh <\/a>and <a href=\"https:\/\/rocklandsafestreets.org\/vtl\" target=\"_blank\" rel=\"noopener\">Rockland<\/a>, have local ordinances that require all <span data-term-id=\"53682945\">bicyclists<\/span>, regardless of age, to <span data-term-id=\"53682944\">wear helmets<\/span>.<\/p>\n<h2>Can You Be Fined for Not Wearing a Helmet?<\/h2>\n<p>States and localities with helmet <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-tickets\/bicycle-laws.html\">laws can impose fines <\/a>on those who violate their <span data-term-id=\"53682957\">local laws<\/span>. In most cases, the penalties are considerably modest and aim to serve as educational rather than punitive measures. The following are the states with helmet laws and their corresponding fines for violating the law:<\/p>\n<ul>\n<li><a class=\"editor-rtfLink\" href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2012\/316.2065\" target=\"_blank\" rel=\"noopener\">Florida<\/a> imposes a $15 fine\u00a0for violations of its youth helmet law. It also fines the parent or guardian of the minor who fails to wear a helmet: $25 for the first offense and $50 for subsequent offenses.<\/li>\n<li><a class=\"editor-rtfLink\" href=\"https:\/\/codes.findlaw.com\/hi\/division-1-government\/hi-rev-st-sect-291c-150\/\" target=\"_blank\" rel=\"noopener\">Hawaii<\/a> requires <span data-term-id=\"53682955\">bicycle riders<\/span>\u00a0under 16 to <span data-term-id=\"53682944\">wear helmets<\/span>. Regardless of the law, wearing a <span data-term-id=\"53682946\">bike helmet<\/span> ensures safety and avoids getting a penalty.<\/p>\n<h3>Use an <span data-term-id=\"53682964\">Approved Helmet<\/span><\/h3>\n<p>Riders must use an <span data-term-id=\"53682964\">approved helmet<\/span> by the <a href=\"https:\/\/helmets.org\/stansumm.htm\" target=\"_blank\" rel=\"noopener\">U.S. <span data-term-id=\"53682953\">Consumer Product Safety Commission<\/span> (<span data-term-id=\"53682950\">CPSC<\/span>)<\/a>. As of March 1999, all <span data-term-id=\"53682946\">bike helmets<\/span> sold in the U.S. are required to pass the <span data-term-id=\"53682950\">CPSC<\/span> helmet standards or other recognized certifications such as ASTM, ANSI, or Snell. These states prohibit helmet non-use in establishing fault.<\/p>\n<p>There are also states without these protective statutes.
