The seat belt defense<\/span> is a legal defense used by an at-fault driver to reduce the damages they owe in a car accident<\/span> lawsuit. The theory is that the plaintiff is partially responsible for the severity of the plaintiff\u2019s injuries<\/span> if they were not wearing a seat belt at the time of the accident<\/span>.<\/p>\n\n <\/div>\n\n\n\n

Every state but New Hampshire<\/span> requires adult drivers and passengers to wear seatbelts<\/span>. Most states have stricter seatbelt laws<\/span><\/a> for children. If someone gets into a car accident<\/span> and isn’t wearing their seatbelt, can they still demand damages?<\/p>\n

Several states allow an at-fault driver to reduce their liability because the accident victim<\/span> wasn’t wearing their seatbelt at the time of the accident<\/span>. This doesn’t mean the person who caused the car crash is off the hook entirely, but it can mean that the plaintiff in a car accident<\/span> lawsuit <\/a>may receive less money than they would have had they worn their seatbelt.<\/p>\n

Seatbelt Use<\/span> in the United States<\/h2>\n

According to the Centers for Disease Control<\/a> (CDC), wearing a seatbelt can cut down a person’s risk of serious injury or death by more than half. In 2017 alone, seatbelt use<\/span> prevented more than 15,000 traffic fatalities. With this knowledge, it should come as no surprise that all but one state has laws requiring drivers and passengers to buckle up<\/span>.<\/p>\n

There are two types of seatbelt laws<\/span> in the United States: primary and secondary enforcement laws. Primary enforcement laws<\/a> allow the police to pull someone over for not wearing a seat belt. Secondary enforcement laws permit the police to issue a seatbelt ticket only after pulling them over for another reason.<\/p>\n

As of October 2025, 34 states have primary seatbelt laws<\/span> and 15 have secondary seatbelt laws<\/span>. Research has shown that seatbelt use<\/span><\/a> is higher in states with primary enforcement laws, leading to fewer fatal accidents in these states.<\/p>\n

Seat Belt Defense<\/span> Theory<\/h2>\n

The seat belt defense<\/span> is simple to understand. This defense states that if the accident victim<\/span> had been wearing their seatbelt at the time of the accident<\/span>, they would not have suffered severe injuries<\/span>. In states that recognize the seatbelt defense<\/span>, at-fault drivers<\/a> can avoid some or all liability if they can prove the plaintiff wasn’t wearing a seatbelt at the time of impact.<\/p>\n

In general, this defense reduces the amount of damages<\/span><\/a> the accident victim<\/span> could have received had they been wearing their seatbelt. However, it\u2019s not guaranteed to be a successful defense for the at-fault driver.<\/p>\n

Rationale Behind the Seatbelt Defense<\/span><\/h2>\n

There are two main rationales behind the seatbelt defense<\/span>, both related to tort law. The first concerns the comparative negligence<\/span> rule<\/a>, which states that drivers who are partly at fault for their motor vehicle<\/span> accident can still collect damages. The court will reduce their damages by their percentage of fault.<\/p>\n

There are two versions of comparative negligence<\/span>: pure and modified. The pure comparative negligence<\/span><\/a> rule allows you to recover damages regardless of your percentage of fault. Even if you were 90% responsible, you could recover 10% of your damages.<\/p>\n

In the states that apply the modified comparative negligence<\/span><\/a> rule, accident victims<\/span> can only collect damages if they were less than 50% at fault. A handful of states allow you to recover damages if you’re less than 51% responsible.<\/p>\n

While most states follow the comparative negligence<\/span> rule, a few states follow the contributory negligence<\/span> rule. This rule prohibits plaintiffs from recovering compensation if they were partially responsible<\/a> for the crash, even if it\u2019s only 1%. Alabama, Maryland, North Carolina, Virginia, and the District of Columbia still follow contributory negligence<\/span>.<\/p>\n

The second rationale behind the seatbelt defense<\/span> is that, under tort law, plaintiffs must mitigate their damages<\/a>. Mitigation<\/span> requires accident victims<\/span> to do everything they can to minimize their damages.<\/p>\n

Under this principle of mitigation<\/span>, if a car <\/span>accident<\/span> victim<\/span> doesn’t use their safety belt<\/span>, they have failed to mitigate damages. The plaintiff’s failure<\/span> to wear their seatbelt justifies the reduction in damages<\/a>.<\/p>\n

Seat Belt Defense<\/span> Jurisdictions<\/h2>\n
