A person may be at fault for defamation if they knowingly publish a false statement of fact.<\/p>\n\n    <\/div>\n\n\n\n<p>In the past, a defamation lawsuit plaintiff only needed to prove that a statement was defamatory. The court did not require that the defendant know that the statement was false. The only requirement was that the defendant must have intentionally or negligently published the information.<\/p>\n<p>But now, fault for defamation only applies when the defendant knew their statement was false. By extension, fault also applies when the defendant should have reasonably known it was false. Even if someone tells a lie about you, it might not be defamatory if that person genuinely believed the lie was true.<\/p>\n<p>This article discusses defamation causes of action (claims) regarding public officials and private individuals. It explains how the definition of fault has changed in defamation law and why this change affects cases today. You can get more insight into a specific case by discussing your claim with a <a href=\"https:\/\/lawyers.findlaw.com\/defamation\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">defamation lawyer<\/a>.\u00a0<\/p>\n<h2>Common Law Rules of Defamation<\/h2>\n<p>Common law rules, or rules created through judicial history, created\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/liability.html#:~:text=obligation%20at%20obligation-,strict%20liability,-%3A%20liability%20that\" target=\"_blank\" rel=\"noopener\">strict liability<\/a>\u00a0on the part of the defendant. This meant that a defendant could be liable in a civil lawsuit for\u00a0<a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-law-the-basics.html\">defamation<\/a>\u00a0merely for publishing a false statement. This was the case even if the defendant was not aware that the statement was false.<\/p>\n<p>Defamation law cases involving\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment1.html\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a>\u00a0free speech later modified the common law rules. To protect the freedom of speech, these modifications were made in judicial proceedings involving public officials, public figures, or matters of public concern.<\/p>\n<h2>Defaming Public Officials and Public Figures<\/h2>\n<p>Defamation of character goes beyond a plaintiff&#8217;s reputation as a private figure. <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/376\/254.html\" target=\"_blank\" rel=\"noopener\"><i>New York Times v. Sullivan<\/i><\/a><i> <\/i>is a notable case. In it, the Supreme Court recognized that <a href=\"https:\/\/dictionary.findlaw.com\/definition\/liability.html\" target=\"_blank\" rel=\"noopener\">strict liability<\/a>\u00a0rules in defamation cases could lead to undesirable results. This was especially true in defamation actions involving members of the press reporting on the activities of public officials.<\/p>\n<p>Under the strict liability rules of common law, a public official had a much easier time winning a defamation suit. They did not have to prove that a reporter was aware that a particular statement about them was false. The effect of lawsuits could deter members of the press from commenting on the activities of a public official.<\/p>\n<p>Under the rules set forth in\u00a0<i>Sullivan<\/i>, a public official cannot recover from a person who publishes a harmful statement about a public official unless either:<\/p>\n<ul>\n<li>The defendant knew that the statement was false<\/li>\n<li>The defendant acted in <a href=\"https:\/\/dictionary.findlaw.com\/definition\/reckless-disregard-of-the-truth.html\" target=\"_blank\" rel=\"noopener\">reckless disregard<\/a> of the statement&#8217;s truth or falsity<\/li>\n<\/ul>\n<p>This standard is referred to as <a href=\"https:\/\/dictionary.findlaw.com\/definition\/malice.html#:~:text=in%20this%20entry-,actual%20malice,-1%20%3A%20malice\" target=\"_blank\" rel=\"noopener\">actual malice<\/a>. Malice, in this sense, does not mean ill will. Instead, the actual malice standard refers to the defendant&#8217;s knowledge of the truth or falsity of the statement.<\/p>\n<p>Later cases expanded the rule to apply to public figures.<\/p>\n<h3>Who Is a Public Official in Defamation Law?<\/h3>\n<p>Public officials generally include employees of the government who have responsibility for the affairs of the government. In order for the First Amendment rule to apply to a public official, the communication must concern a matter related directly to the office or the public interest.<\/p>\n<h3>Who Is a Public Figure in Defamation Law?<\/h3>\n<p>A public figure is someone who has gained a significant degree of fame or notoriety. This can be fame in general or in the context of a particular issue or controversy. Even though these figures have no official role in government affairs, they often hold considerable influence over decisions made by the government or by the public.<\/p>\n<p>Examples of public figures are numerous and could include:<\/p>\n<ul>\n<li>Celebrities<\/li>\n<li>Prominent athletes<\/li>\n<li>Advocates who involve themselves in a public debate<\/li>\n<li>News anchors<\/li>\n<li>Talk show hosts and podcasters<\/li>\n<li>Influencers, particularly those with a large social media audience<\/li>\n<\/ul>\n<h2>Defaming Private Persons<\/h2>\n<p>Speech may be directed at a person who is neither a public official nor a public figure. An ordinary person can still suffer reputational harm without any prior fame.<\/p>\n<p>The case of\u00a0<i><a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/418\/323.html\" target=\"_blank\" rel=\"noopener\">Gertz v. Robert Welsh, Inc.<\/a>\u00a0<\/i>and subsequent decisions have set forth different standards for these situations. The Court in <i>Gertz<\/i>\u00a0determined that the actual malice standard established in\u00a0<i>New York Times Inc. v. Sullivan<\/i>\u00a0should not apply where speech concerns a private person. However, the Court also determined that the common law strict liability rules impermissibly burden publishers and broadcasters.<\/p>\n<p>Under the <a href=\"https:\/\/www.ali.org\/publications\/restatement-law-second\/torts\" target=\"_blank\" rel=\"noopener\">Restatement (Second) of Torts<\/a>, a defendant who publishes a false and defamatory communication about a private individual is liable to the individual only if either:<\/p>\n<ul>\n<li>The defendant acts with actual malice (applying the standard under\u00a0<i>New York Times v. Sullivan<\/i>)<\/li>\n<li>The defendant acts negligently in failing to ascertain whether a statement was false or defamatory<\/li>\n<\/ul>\n<h2>Other Considerations: Defenses &amp; Damages<\/h2>\n<p>Suppose a defendant posts a statement about another person on <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-and-social-media-what-you-need-to-know.html\">social media<\/a>. In general, an affected plaintiff can&#8217;t win a defamation claim if the communication:<\/p>\n<ul>\n<li>Is a true statement (truth is an\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/absolute-defense.html\" target=\"_blank\" rel=\"noopener\">absolute defense<\/a>)<\/li>\n<li>Comes off as a statement of opinion to a reasonable person<\/li>\n<li>Is made with\u00a0<a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-law-the-basics.html\">qualified privilege<\/a>\u00a0(legal protection)<\/li>\n<li>Is made with\u00a0<a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-law-the-basics.html\">absolute privilege<\/a>\u00a0(another type of legal protection)<\/li>\n<\/ul>\n<p>Suppose the communication is an unprivileged and false statement of fact. But even winning a defamation case won&#8217;t automatically mean the plaintiff will get money. A plaintiff can ask for:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-are-compensatory-damages.html\">Compensatory damages<\/a> to make them whole<\/li>\n<li><a href=\"https:\/\/dictionary.findlaw.com\/definition\/damage.html\" target=\"_blank\" rel=\"noopener\">Punitive damages<\/a> to punish the defendant if they acted egregiously<\/li>\n<\/ul>\n<p>To get money, a plaintiff will usually need to prove\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/actual-damages.html\" target=\"_blank\" rel=\"noopener\">actual damages<\/a>, such as:<\/p>\n<ul>\n<li>Special damages which are quantifiable, such as medical expenses and lost earning capacity<\/li>\n<li>General damages for emotional distress (difficult to prove and may not be available in every state)<\/li>\n<\/ul>\n<p>A plaintiff does not have to prove their damages if they win a\u00a0<a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/what-is-defamation-per-se-.html\">defamation per se<\/a> claim. This rule is in contrast to defamation per quod, which concerns a statement that is not inherently defamatory.<\/p>\n<p>A defamation per se claim involves allegations of:<\/p>\n<ul>\n<li>Criminal activity<\/li>\n<li>Sexual misconduct<\/li>\n<li>Infectious disease<\/li>\n<li>Bad business conduct<\/li>\n<\/ul>\n<h2>Have an Attorney Help You With Your Defamation Claim<\/h2>\n<p>It&#8217;s not always easy to prove defamation, whether it&#8217;s libel or slander.
