They can explain more details about how the state law applies to your case.<\/p>\n<h2>Federal Funding Laws<\/h2>\n<p>Separate from state laws, federal laws also affect nursing homes. The <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/nursing-home-reform-act.html\">Nursing Home Reform Act of 1987<\/a> sets general guidelines to prevent physical and emotional abuse and neglect. Since the passage of this law, many states have enacted more stringent requirements. These laws place greater responsibility on nursing care facilities to ensure the safety of the elderly.<\/p>\n<p>Certified nursing homes can choose to receive federal\u00a0<a href=\"https:\/\/www.cms.gov\/medicare\/provider-enrollment-and-certification\/certificationandcomplianc\/nhs.html\" target=\"_blank\" rel=\"noopener\">Medicare or Medicaid funding<\/a>. But in order to get the funds, they must at least comply with\u00a0<a href=\"http:\/\/www.aarp.org\/home-garden\/livable-communities\/info-2001\/the_1987_nursing_home_reform_act.html\" target=\"_blank\" rel=\"noopener\">federal nursing home regulations<\/a>. Federal nursing home laws provide a\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/the-supremacy-clause-and-the-doctrine-of-preemption.html\">minimum requirement for regulations<\/a>.
