However, military courts do not have exclusive jurisdiction over DUI charges, unlike military-specific charges such as desertion. This is because state courts generally have jurisdiction over DUI cases.<\/p>\n<p>So, <a href=\"https:\/\/www.findlaw.com\/dui\/charges.html\" target=\"false\">DUI charges<\/a> are sometimes filed by both military and civilian authorities. However, the constitutional protection against <a title=\"double jeopardy\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/when-double-jeopardy-protection-applies.html\" target=\"false\">double jeopardy<\/a> generally prevents prosecution in both systems for the same offense. Military administrative actions often happen quickly (within days) and can occur before the civilian court resolves your DUI case, which can take months.<\/p>\n<p>Jurisdiction usually depends on where the incident took place and the circumstances of the arrest. We&#8217;ll explain how this works in a few different scenarios below:<\/p>\n<h3>If You\u2019re Arrested for a DUI on Base<\/h3>\n<p>You will not face civilian criminal charges for the DUI if you&#8217;re arrested on base. But you can be charged by the military for <a title=\"drunken or reckless operation of a vehicle \" href=\"https:\/\/codes.findlaw.com\/us\/title-10-armed-forces\/10-usc-sect-913\/\" target=\"false\" rel=\"noopener\">drunken or reckless operation of a vehicle<\/a> under the\u00a0Uniform Code of Military Justice (UCMJ). Penalties include court-martial and administrative actions.<\/p>\n<p>The state Department of Motor Vehicles (DMV) can also take action, including:<\/p>\n<ul>\n<li><a title=\"suspend your driver\u2019s license\" href=\"https:\/\/www.findlaw.com\/dui\/cases\/how-to-get-your-license-back-after-a-dui.html\" target=\"false\">Suspension of your driver\u2019s license<\/a><\/li>\n<li><a title=\"Ignition interlock device\" href=\"https:\/\/www.findlaw.com\/dui\/cases\/ignition-interlock-devices.html\" target=\"false\">Ignition interlock device<\/a><\/li>\n<li>Restricted driving privileges<\/li>\n<\/ul>\n<p>Even if you&#8217;re not ultimately convicted, the DMV can impose penalties based on a <a title=\"DUI arrest\" href=\"https:\/\/www.findlaw.com\/dui\/cases\/dui-arrest.html\" target=\"false\">DUI arrest<\/a> alone. Most states have administrative license suspension laws that are separate from criminal proceedings and can occur regardless of what happens in criminal court.<\/p>\n<h3>If You\u2019re Arrested for a DUI by Civilian Police Off Base<\/h3>\n<p>If the arrest happens off base, you will likely only face criminal charges in civilian court. Still, your commanding officer may take administrative actions at the same time, such as:<\/p>\n<ul>\n<li>Mandatory substance abuse treatment<\/li>\n<li>Suspension of on-base driving privileges<\/li>\n<li>Revocation of pass privileges<\/li>\n<li>Corrective training<\/li>\n<\/ul>\n<p>The military may also charge you with other crimes related to the incident. For example, they might charge you with <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/disorderly-conduct.html\" target=\"false\">disorderly conduct<\/a>.<\/p>\n<h3><strong>If You\u2019re a Civilian Arrested for a DUI on Base<\/strong><\/h3>\n<p>Since military bases are federal property, you&#8217;d face DUI charges in federal court, not state court. However, the federal court will likely apply <a title=\"the state\u2019s DUI laws\" href=\"https:\/\/www.findlaw.com\/dui\/laws-resources\/state-by-state-dui-penalties.html\" target=\"false\">the state\u2019s DUI laws<\/a> since there are no federal DUI laws applying to civilians.<\/p>\n<p>This applies to military family members or friends visiting the base. It could also apply to civilian employees working on the installation, or anyone else with authorized access to military property.<\/p>\n<h2>Consequences of a Military DUI<\/h2>\n<p>If you\u2019re arrested and charged with <a href=\"https:\/\/www.findlaw.com\/dui.html\" target=\"false\">driving under the influence<\/a> while on a military installation, your commanding officer will have a great deal of discretion on how to proceed. The actions generally fall into two main categories: punitive actions and administrative actions.<\/p>\n<h3>Punitive Actions<\/h3>\n<p>Punitive actions could include a <a title=\"court-martial\" href=\"https:\/\/www.findlaw.com\/military\/criminal-law\/the-court-martial-process.html\" target=\"false\">court-martial<\/a>, which could result in:<\/p>\n<ul>\n<li>Forfeiture of pay<\/li>\n<li>Grade reduction<\/li>\n<li>Imprisonment<\/li>\n<li>Dismissal from the military<\/li>\n<\/ul>\n<p>They could also impose non-judicial punishments listed in <a href=\"https:\/\/codes.findlaw.com\/us\/title-10-armed-forces\/10-usc-sect-815\/\" target=\"false\" rel=\"noopener\">Article 15 of the UCMJ<\/a>, often referred to as &#8220;Office Hours&#8221; or &#8220;Captain\u2019s Mast.&#8221;<\/p>\n<h3>Administrative Actions<\/h3>\n<p>Administrative actions focus on corrective measures and career impact. These include:<\/p>\n<ul>\n<li>Letters of reprimand<\/li>\n<li>Suspension of driving or base privileges<\/li>\n<li>Mandatory <a href=\"https:\/\/www.findlaw.com\/dui\/cases\/dui-school-and-alcohol-treatment.html\" target=\"false\">substance abuse treatment programs<\/a><\/li>\n<li>Corrective training<\/li>\n<\/ul>\n<p>Serious cases could result in administrative separation proceedings or a bar to reenlistment.<\/p>\n<p>Commanders can also exercise discretion to pursue both administrative and punitive actions. This could include nonjudicial punishment, which could result in the following:<\/p>\n<ul>\n<li>Extra duty<\/li>\n<li>Restriction to base<\/li>\n<li>Reduction in rank<\/li>\n<\/ul>\n<p>More serious cases could proceed to <a href=\"https:\/\/www.findlaw.com\/military\/criminal-law\/military-dui-court-martial-and-civilian-charges.html\" target=\"false\">court-martial<\/a>. It could also result in confinement or dismissal from service.<\/p>\n<h2>Military DUI Consequences by Branch<\/h2>\n<p>All military branches prosecute DUI cases under <a href=\"https:\/\/codes.findlaw.com\/us\/title-10-armed-forces\/10-usc-sect-913\/\" target=\"false\" rel=\"noopener\">UCMJ Article 113<\/a>. However, each branch service may impose specific regulations and documentation. Most branches require separation proceedings for service members with two or more alcohol incidents in the past 12 months.<\/p>\n<h3>Army<\/h3>\n<p>Army servicemembers convicted of DUI could face a reprimand. A <a href=\"https:\/\/home.army.mil\/ansbach\/application\/files\/3616\/0162\/2625\/AR_600-85-The_Army_Substance_Abuse_Program_23_JUL_20.pdf\" target=\"false\" rel=\"noopener\">Letter of Reprimand (LOR)<\/a> is a warning given to a military servicemember who fails to comply with standard military policies.<\/p>\n<p>An LOR could be reflected in the soldier&#8217;s Military Personnel Records. This letter could also become part of their official record, visible to the entire chain of command.<\/p>\n<p>After learning of a DUI conviction, commanders will flag the soldier and refer them to the military&#8217;s <a title=\"Department of Behavioral Health\" href=\"https:\/\/medcoe.army.mil\/life-connection-behavioral-health\" target=\"false\" rel=\"noopener\">Department of Behavioral Health<\/a> for a substance use disorder (SUD). They will often evaluate the soldier within five duty days. As a result, the soldier could face automatic enrollment in mandatory alcohol treatment. This treatment includes the following:<\/p>\n<ul>\n<li>Minimum of 12 hours of Alcohol and Drug Abuse Prevention and Treatment program<\/li>\n<li>Weekly counseling session<\/li>\n<li>Unannounced drug and alcohol testing to monitor compliance<\/li>\n<\/ul>\n<p>Throughout the treatment process, soldiers could face random drug testing. The Army uses the term &#8220;smart testing,&#8221; which is unpredictable testing that could happen at any time, including weekends, during field exercises, and holidays.<\/p>\n<p>The Army requires commanders to initiate <a title=\"separation proceedings\" href=\"https:\/\/www.findlaw.com\/military\/administrative-issues-benefits\/administrative-separation-the-basics.html\" target=\"false\">separation proceedings<\/a> for soldiers involved in two or more incidents of alcohol-related misconduct in a year. Commanders typically start an administrative separation proceeding within 30 days of receiving a DUI notification or positive drug test report.<\/p>\n<h3>Navy<\/h3>\n<p>Navy servicemembers could also face swift action after any DUI incident. Their commander will refer them to the <a href=\"https:\/\/www.secnav.navy.mil\/doni\/Directives\/05000%20General%20Management%20Security%20and%20Safety%20Services\/05-300%20Manpower%20Personnel%20Support\/5350.4E.pdf\" target=\"false\" rel=\"noopener\">Substance Abuse Rehabilitation Program (SARP)<\/a> within 5 working days. The servicemember will also undergo medical screening, conducted by a Licensed Independent Provider (LIP). The LIP will examine the servicemember and recommend the type of treatment they should undergo.<\/p>\n<p>After the LIP assessment, sailors are automatically enrolled in mandatory substance abuse treatment. The Navy implements a five-level treatment system that is categorized based on severity:<\/p>\n<ul>\n<li><strong>Level 0.5<\/strong> &#8211; Early Intervention and Education Program<\/li>\n<li><strong>Level 1<\/strong> &#8211; Outpatient Treatment<\/li>\n<li><strong>Level 2<\/strong> &#8211; Intensive Outpatient or Partial Hospitalization<\/li>\n<li><strong>Level 3<\/strong> &#8211; Residential Treatment<\/li>\n<li><strong>Level 4<\/strong> &#8211; Medically Managed Intensive Inpatient Treatment<\/li>\n<\/ul>\n<p>Similar to other service branches, Navy personnel with two or more alcohol related incidents in a year could face severe consequences. They could face mandatory processing for administrative separation.<\/p>\n<h3>Marines<\/h3>\n<p>If a Marine Corps member receives a DUI conviction, commanders must refer them to a <a href=\"https:\/\/www.marines.mil\/portals\/1\/publications\/mco%205300.17.pdf\" target=\"_blank\" rel=\"noopener\">Substance Abuse Counseling Center (SACC<\/a>) for mandatory screening and assessment.<\/p>\n<p>Following a DUI incident, commanders initiate several immediate steps. Marines undergo comprehensive substance abuse screening at SACCs. The service requires enrollment in evidence-based treatment programs. These programs may include the Prime for Life <a href=\"https:\/\/pendleton.usmc-mccs.org\/marine-family-support\/prevention-and-counseling\/counseling-referrals\/substance-assessment-and-counseling-program\" target=\"_blank\" rel=\"noopener\">(PFL) 16-hour curriculum<\/a> for those with significant alcohol concerns.<\/p>\n<p>As part of the deterrence program, the Marine Corps maintains substance abuse programs, drug testing, and alcohol screening procedures. They enforce a zero-tolerance policy for substance abuse. They also consider alcohol-related incidents serious threats to mission readiness.<\/p>\n<p>Service members who have had two or more DUI incidents during their current enlistment could face severe consequences. The Marine Corps enforces strict separation policies. This applies regardless of the period between the incidents. Those who fail to complete the treatment programs or show patterns of noncompliance could also face separation proceedings.<\/p>\n<h3>Air Force<\/h3>\n<p>When facing DUI charges, Air Force military personnel are asked to participate in the comprehensive <a href=\"https:\/\/static.e-publishing.af.mil\/production\/1\/af_sg\/publication\/dafi44-121\/dafi44-121.pdf\" target=\"_blank\" rel=\"noopener\">Alcohol and Drug Abuse Prevention and Treatment Program<\/a> (ADAPT).<\/p>\n<p>After a DUI incident, Air Force service members undergo mandatory screening within 14 days. A qualified substance abuse evaluators assess them. The ADAPT program also provides five treatment levels:<\/p>\n<ul>\n<li><strong>Level 0.5 &#8211; <\/strong>Early Intervention and Education Program<\/li>\n<li><strong>Level 1 &#8211; <\/strong>Outpatient Treatment<\/li>\n<li><strong>Level 2 &#8211; <\/strong>Intensive Outpatient or Partial Hospitalization<\/li>\n<li><strong>Level 3 &#8211; <\/strong>Residential Treatment<\/li>\n<li><strong>Level 4 &#8211; <\/strong>Medically Managed Intensive Inpatient Treatment<\/li>\n<\/ul>\n<p>The treatment provided depends on the severity of the substance or alcohol use disorder and other circumstances.<\/p>\n<p>Airmen who fail the ADAPT program could face administrative separation.
