They are sometimes referred to as \u201c<span data-term-id=\"57534476\">death benefits<\/span>\u201d or \u201c<span data-term-id=\"57534487\">widow\u2019s benefits<\/span>.\u201d The <span data-term-id=\"57534441\">SSA<\/span> designed <span data-term-id=\"57534435\">survivor benefits<\/span> to protect the families of workers against loss of income in the case of a worker\u2019s untimely death.<\/p>\n<p>When a worker dies, their family often faces immediate financial uncertainty. <span data-term-id=\"57534444\">Social Security <\/span><span data-term-id=\"57534435\">survivor benefits<\/span> can provide crucial income support during this difficult time. Understanding your <span data-term-id=\"57534443\">eligibility<\/span> and <span data-term-id=\"57534447\">benefit amounts<\/span> is essential to protecting your family\u2019s financial security.<\/p>\n<h3>The <span data-term-id=\"57534451\">Lump-Sum<\/span> Death Payment<\/h3>\n<p>In addition to monthly <span data-term-id=\"57534435\">survivor benefits<\/span>,\u00a0Social Security provides a <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/social-security-lump-sum-death-payment-overview.html\">one-time <span data-term-id=\"57534451\">lump-sum<\/span> <span data-term-id=\"57534476\">death benefit<\/span><\/a> of $255 to eligible survivors. If there is no <span data-term-id=\"57534437\">surviving spouse<\/span>, <span data-term-id=\"57534441\">SSA<\/span> can make the payment to eligible children who are receiving <span data-term-id=\"57534454\">monthly benefits<\/span> on the deceased\u2019s record.<\/p>\n<p>While you can only receive the <span data-term-id=\"57534451\">lump-sum<\/span> death payment once for a loss, <span data-term-id=\"57534435\">survivor benefits<\/span> are recurring. <span data-term-id=\"57534435\">Survivor benefits<\/span> provide <span data-term-id=\"57534462\">monthly payments<\/span>.<\/p>\n<h2>Who Is Eligible for <span data-term-id=\"57534444\">Social Security <\/span><span data-term-id=\"57534435\">Survivor Benefits<\/span>?<\/h2>\n<p><span data-term-id=\"57534466\">Family members<\/span> who may be eligible to receive monthly <span data-term-id=\"57534444\">Social Security <\/span><span data-term-id=\"57534435\">survivor benefits<\/span> include:<\/p>\n<ul>\n<li>Spouses age 60 or older<\/li>\n<li>Spouses with qualifying disabilities age 50 or older<\/li>\n<li>Regardless of age, any <span data-term-id=\"57534437\">surviving spouse<\/span> who is caring for the <span data-term-id=\"57534481\">deceased worker<\/span>\u2018s young child (under age 16) or a child with a disability<\/li>\n<li><span data-term-id=\"57534484\">Unmarried children<\/span> under 18 years old or up to age 19 if still enrolled <span data-term-id=\"57534463\">full-time<\/span> in elementary or secondary school, including <span data-term-id=\"57534479\">stepchildren<\/span> and <span data-term-id=\"57534478\">adopted children<\/span> who meet the dependency requirements<\/li>\n<li>Children who developed a disability before age 22<\/li>\n<li>A <span data-term-id=\"57534448\">dependent parent<\/span> of the <span data-term-id=\"57534481\">deceased worker<\/span> who is 62 years or older<\/li>\n<li>A <span data-term-id=\"57534458\">surviving <\/span><span data-term-id=\"57534439\">divorced spouse<\/span> who is age 60 or older and was married to the deceased for at least 10 years<\/li>\n<\/ul>\n<p>In most cases,\u00a0the marriage between the deceased and the widow or <span data-term-id=\"57534446\">widower<\/span> should have lasted for at least nine months to qualify for <span data-term-id=\"57534435\">survivor benefits<\/span>. Yet, there are important exceptions to this requirement. If the worker\u2019s death was accidental or occurred in the line of <a href=\"https:\/\/www.findlaw.com\/military\/administrative-issues-benefits.html\">military duty<\/a>, the nine-month marriage requirement does not apply.<\/p>\n<p>You may also qualify for benefits if you are caring for the <span data-term-id=\"57534481\">deceased worker<\/span>\u2018s child. This applies when the child is under age 16 or has a disability. In these cases, you may qualify for benefits regardless of how long the marriage lasted.<\/p>\n<h3>Can an <span data-term-id=\"57534450\">Ex-Spouse<\/span> <span data-term-id=\"57534486\">Claim <\/span><span data-term-id=\"57534435\">Survivor Benefits<\/span>?<\/h3>\n<p>Yes, a <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/social-security-survivor-benefits-after-divorce.html\">surviving <span data-term-id=\"57534455\">former spouse<\/span><\/a> can receive the same benefits as a widow or <span data-term-id=\"57534446\">widower<\/span> after their <span data-term-id=\"57534450\">ex-<\/span><span data-term-id=\"57534470\">spouse<\/span><span data-term-id=\"57534470\">\u2019s death<\/span>. Their marriage must have lasted for at least 10 years. The amount they receive does not count toward the family\u2019s maximum benefit.<\/p>\n<h3>Can Same-Sex Couples Apply for <span data-term-id=\"57534435\">Survivor Benefits<\/span>?<\/h3>\n<p>Yes, if the <span data-term-id=\"57534437\">surviving spouse<\/span> meets all other <span data-term-id=\"57534483\">eligibility<\/span><span data-term-id=\"57534483\"> requirements<\/span>. The <span data-term-id=\"57534441\">SSA<\/span> processes retirement, <span data-term-id=\"57534437\">surviving spouse<\/span>, and <span data-term-id=\"57534451\">lump-sum<\/span> death payment claims for <a href=\"https:\/\/www.findlaw.com\/lgbtq-law.html\">LGBTQ+ couples<\/a>.<\/p>\n<p>This benefit wasn\u2019t always available to LGBTQ+ couples. Over the years, there have been many legal changes, such as the landmark <a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/obergefell-v-hodges-case-summary-and-significance.html\" target=\"_blank\" rel=\"noopener\"><em>Obergefell v. Hobbs<\/em> <\/a>Supreme Court decision and the <a href=\"https:\/\/www.findlaw.com\/lgbtq-law\/respect-for-marriage-act.html\">Respect for Marriage Act<\/a> of 2022. These cases and laws reinforced that <a href=\"https:\/\/www.ssa.gov\/pubs\/EN-17-019.pdf\" target=\"_blank\" rel=\"noopener\">same-sex couples<\/a> have the same entitlements to federal benefits as other married couples.<\/p>\n<p>Today, you can claim the <a href=\"https:\/\/www.findlaw.com\/family\/marriage\/same-sex-marriage-and-federal-benefits.html\"><span data-term-id=\"57534445\">spousal benefits<\/span><\/a> of a legal marriage regardless of gender. The <span data-term-id=\"57534441\">SSA<\/span> may also approve <span data-term-id=\"57534435\">survivor benefits<\/span> for some non-marital relationships, such as <a href=\"https:\/\/www.findlaw.com\/family\/marriage\/same-sex-marriage-civil-unions-and-domestic-partnerships.html\">civil unions and domestic partnerships<\/a>.<\/p>\n<h2>How Much Is the <span data-term-id=\"57534435\">Survivor <\/span><span data-term-id=\"57534447\">Benefit<\/span><span data-term-id=\"57534447\"> Amount<\/span>?<\/h2>\n<p>Many factors affect the amount of benefits you may receive, including:<\/p>\n<ul>\n<li>The decedent\u2019s <span data-term-id=\"57534461\">work history<\/span> and payment of <span data-term-id=\"57534471\">Social Security taxes<\/span><\/li>\n<li>Your age<\/li>\n<li>Your relationship to the decedent<\/li>\n<li>The presence of minor children, <span data-term-id=\"57534448\">dependent parents<\/span>, or a <span data-term-id=\"57534466\">family member<\/span> with a disability<\/li>\n<\/ul>\n<p>You can calculate your benefits online through the <a href=\"https:\/\/www.ssa.gov\/OACT\/quickcalc\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57534441\">SSA<\/span>\u2019s estimator<\/a>. You can also find out exactly what benefits you\u2019re entitled to by requesting your Social Security Statement online.<\/p>\n<p>Each survivor is entitled to a percentage of the decedent\u2018s benefits, depending on their relationship to them. The total benefits available to all <span data-term-id=\"57534466\">family members<\/span> can\u2019t exceed 150% to 180% of the decedent\u2019s <span data-term-id=\"57534447\">benefit amount<\/span>. When cases reach the maximum benefit limit, Social Security will reduce all benefits proportionately.<\/p>\n<h3>The Decedent\u2019s <span data-term-id=\"57534460\">Lifetime <\/span><span data-term-id=\"57534456\">Earnings<\/span><span data-term-id=\"57534456\"> Record<\/span><\/h3>\n<p>The basis of the <span data-term-id=\"57534435\">survivor\u2019s benefit<\/span> is the amount of contributions that the worker paid to Social Security. This works similarly to <span data-term-id=\"57534436\">retirement benefits<\/span>.<\/p>\n<p>In general, the <span data-term-id=\"57534481\">deceased worker<\/span> must have worked for a specified period of time. This can be as little as one and a half years if they worked in the past three years leading up to their death, if they died young. Otherwise, it requires 10 years of work to qualify for Social Security benefits.\u00a0<\/p>\n<p>As a worker pays more into\u00a0Social Security during their lifetime, a <span data-term-id=\"57534477\">higher amount<\/span> of <span data-term-id=\"57534435\">survivor benefits<\/span> will be available for their <span data-term-id=\"57534466\">family members<\/span>. Special rules apply to the families of workers who have died young.<\/p>\n<h3>Widows\/<span data-term-id=\"57534446\">Widowers<\/span><\/h3>\n<p>You\u2019re\u00a0entitled to different <span data-term-id=\"57534447\">benefit amounts<\/span> depending on\u00a0your\u00a0age and circumstances:<\/p>\n<ul>\n<li><strong>At <span data-term-id=\"57534438\">full retirement age<\/span><\/strong>:\u00a0You\u00a0receive 100% of the <span data-term-id=\"57534449\">deceased <\/span><span data-term-id=\"57534440\">spouse<\/span><span data-term-id=\"57534440\">\u2018s benefits<\/span>. <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/when-should-you-start-claiming-social-security-benefits.html\"><span data-term-id=\"57534438\">Full retirement age<\/span><\/a> is 65 for those born before 1940, increasing gradually to 67 for those born after 1962. For <span data-term-id=\"57534435\">survivor benefits<\/span>, <span data-term-id=\"57534438\">full retirement age<\/span> ranges between 66 and 67, depending on\u00a0your\u00a0birth year.<\/li>\n<li><strong>Early benefits (age 60-64)<\/strong>:\u00a0You\u00a0may <span data-term-id=\"57534486\">claim <\/span><span data-term-id=\"57534435\">survivor benefits<\/span> as early as age 60, but\u00a0your\u00a0payments will be reduced. Benefits <a href=\"https:\/\/www.ssa.gov\/survivor\/amount\" target=\"_blank\" rel=\"noopener\">start at 71.5%<\/a> of\u00a0your <span data-term-id=\"57534440\">spouse\u2019s benefit<\/span> at age 60, increasing gradually as\u00a0you\u00a0get older. By age 65,\u00a0you\u00a0can receive over 90% of the full <span data-term-id=\"57534447\">benefit amount<\/span> and become eligible for <a href=\"https:\/\/www.findlaw.com\/healthcare\/medicare-medicaid.html\"><span data-term-id=\"57534485\">Medicare<\/span> coverage<\/a>.<\/li>\n<li><strong>Disabled recipients<\/strong>: If\u00a0you\u2019re\u00a0disabled, you\u00a0can receive reduced <span data-term-id=\"57534435\">survivor benefits<\/span> starting at age 50. If you qualify for Social Security <span data-term-id=\"57534453\">disability benefits<\/span>, you may be eligible for both\u00a0<a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability.html\">Social Security Disability Insurance <\/a>(SSDI) and <span data-term-id=\"57534435\">survivor benefits<\/span>. However, certain rules may apply to receive the higher benefit.<\/li>\n<li><strong>Parents or caregivers of children under the age of 16<\/strong>: Certain minors are\u00a0entitled to 75% of the worker\u2019s benefits. The qualifying spouse\u2019s age doesn\u2019t affect the amount of the benefits.<\/li>\n<\/ul>\n<h3><span data-term-id=\"57534474\">Dependent Children<\/span> and Parents<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/social-security-survivor-benefits-for-children.html\">Children under 18<\/a> may receive up to 75% of the worker\u2019s benefits. Meanwhile, dependent surviving parents may receive up to 82.5% of the deceased parent\u2019s income for one parent or 75% for both parents.<\/p>\n<h2>How Much Does a <span data-term-id=\"57534444\">Social Security <\/span><span data-term-id=\"57534435\">Survivor Benefit<\/span> Pay per Month?<\/h2>\n<p>According to the <a href=\"https:\/\/www.ssa.gov\/policy\/docs\/quickfacts\/stat_snapshot\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57534442\">Social Security Administration<\/span><\/a>, the average <span data-term-id=\"57534435\">survivor benefit<\/span> paid in January 2026 was $1,622 per month. However, your actual Social Security <span data-term-id=\"57534447\">benefit amount<\/span> depends on the <span data-term-id=\"57534481\">deceased worker<\/span>\u2018s earnings history and your age when you begin receiving benefits.<\/p>\n<p>Here\u2019s what survivors typically receive:<\/p>\n<ul>\n<li><strong>Nondisabled widows and <span data-term-id=\"57534446\">widowers<\/span><\/strong>: $1,923 per month on average<\/li>\n<li><strong>Disabled widows and <span data-term-id=\"57534446\">widowers<\/span><\/strong>: $982 per month on average<\/li>\n<li><strong>Children of <span data-term-id=\"57534481\">deceased workers<\/span><\/strong>: $1,176 per month on average<\/li>\n<li><strong>Widowed mothers and fathers caring for children<\/strong>: $1,354 per month on average<\/li>\n<\/ul>\n<p>If you have reached your <span data-term-id=\"57534438\">full retirement age<\/span> for <span data-term-id=\"57534435\">survivor benefits<\/span>, you should receive 100% of what the deceased would have collected.<\/p>\n<h2>Can You Work While Receiving <span data-term-id=\"57534435\">Survivor Benefits<\/span>?<\/h2>\n<p>Many survivors wonder whether they can continue working while receiving benefits. The answer is yes, but your benefits may be temporarily reduced if you have not yet reached <span data-term-id=\"57534438\">full retirement age<\/span> and <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/income-limits-for-social-security-benefits.html\">earn above certain limits<\/a>.<\/p>\n<p>In 2026, the annual earnings limit is $24,480 for those under <span data-term-id=\"57534438\">full retirement age<\/span>. If you earn more than this amount, there will be a deduction from your Social Security benefits payment. The deduction will be $1 for every $2 you earn more than the annual earnings limit. For example, if you earn $30,000 annually, you would be $5,520 over the limit. Social Security would withhold $2,760 of your <span data-term-id=\"57534435\">survivor benefits<\/span> for the year.<\/p>\n<p>During the year you reach <span data-term-id=\"57534438\">full retirement age<\/span>, a different earnings limit applies. The reduction changes to $1 withheld for every $3 earned above the limit. After reaching <span data-term-id=\"57534438\">full retirement age<\/span>, you can earn any amount without <span data-term-id=\"57534441\">SSA<\/span> reducing your benefits.<\/p>\n<h2>Impact of the Social Security Fairness Act<\/h2>\n<p>A significant change took effect in 2025 that may increase benefits for some survivors.\u00a0<a href=\"https:\/\/blog.ssa.gov\/celebrating-our-recent-ssfa-milestone-and-what-it-may-mean-for-you\/\" target=\"_blank\" rel=\"noopener\">The Social Security Fairness Act<\/a> was signed into law in January 2025. This Act eliminated two provisions that previously reduced benefits for many public sector workers and their survivors: the Windfall Elimination Provision and the Government Pension Offset (GPO).<\/p>\n<p>For survivors affected by the Government Pension Offset, this change has been substantial. <span data-term-id=\"57534437\">Surviving spouses<\/span> affected by the GPO repeal saw an average increase of <a href=\"https:\/\/www.congress.gov\/crs-product\/IF12890#:~:text=The%20Congressional%20Budget,and%20other%20adjustments.\" target=\"_blank\" rel=\"noopener\">$1,190 per month<\/a>. If you worked as a teacher, firefighter, police officer, or other public employee with a pension from work not covered by Social Security, you may now be eligible for <a href=\"https:\/\/blog.ssa.gov\/social-security-announces-expedited-retroactive-payments-and-higher-monthly-benefits-for-millions-actions-support-the-social-security-fairness-act\/\" target=\"_blank\" rel=\"noopener\">higher <span data-term-id=\"57534435\">survivor benefits<\/span><\/a> than you would have received under the old rules.<\/p>\n<h2>How To Apply for <span data-term-id=\"57534444\">Social Security <\/span><span data-term-id=\"57534435\">Survivor Benefits<\/span><\/h2>\n<p>Unlike retirement and <span data-term-id=\"57534453\">disability benefits<\/span>, the ability to apply for <span data-term-id=\"57534444\">Social Security <\/span><span data-term-id=\"57534435\">survivor benefits<\/span> is not available online. You can <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/applying-for-social-security-benefits.html\">apply for Social Security benefits <\/a>by contacting Social Security\u2019s toll-free service at 1-800-772-1213 (TTY: 1-800-325-0778). You can also visit your <a href=\"https:\/\/www.ssa.gov\/locator\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57534473\">local Social Security office<\/span><\/a>.<\/p>\n<p>The Social Security office will need several documents from you. These can be originals or certified copies.
