This 2025 law repealed the <span data-term-id=\"53278340\">Windfall Elimination Provision<\/span> (<span data-term-id=\"53278347\">WEP<\/span>) and the <span data-term-id=\"53278342\">Government Pension Offset<\/span> (<span data-term-id=\"53278341\">GPO<\/span>), which previously lowered benefits for those with pensions from non-covered work. As a result, individuals who were affected by the old rules may be eligible for higher monthly payments and retroactive benefit adjustments dating back to January 2024.<\/p>\n\n    <\/div>\n\n\n\n<p>Receiving a <span data-term-id=\"53278359\">pension plan<\/span> does not automatically reduce your <span data-term-id=\"53278331\">Social Security benefits<\/span> nor disqualify you from receiving them. This is even more true in light of the recent legislative changes that eliminated provisions that reduced benefits for millions of Americans.<\/p>\n<p>The interaction between your <span data-term-id=\"53278366\">pension benefits<\/span> and <span data-term-id=\"53278331\">Social Security benefits<\/span> can complicate your finances. You can receive your full <span data-term-id=\"53278331\">Social Security benefit<\/span> and your full pension without penalty. However, the Internal Revenue Service (<span data-term-id=\"53278358\">IRS<\/span>) may still consider both as <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/individuals-and-income-tax.html\" aria-expanded=\"false\"><span data-term-id=\"53278379\">taxable income<\/span><\/a> on your <span data-term-id=\"53278363\">tax return<\/span>.<\/p>\n<h2>Important Changes: The Social Security Fairness Act<\/h2>\n<p>On January 5, 2025, President Biden signed the Social Security Fairness Act into law. This legislation eliminates two rules that had reduced or eliminated <span data-term-id=\"53278331\">Social Security benefits<\/span> for millions of Americans:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.ssa.gov\/benefits\/retirement\/social-security-fairness-act.html\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"53278340\">Windfall Elimination Provision<\/span> (<span data-term-id=\"53278347\">WEP<\/span>)<\/a><\/li>\n<li><a class=\"underline\" href=\"https:\/\/www.ssa.gov\/policy\/docs\/program-explainers\/windfall-elimination-provision.html\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"53278342\">Government Pension Offset<\/span> (<span data-term-id=\"53278341\">GPO<\/span>)<\/a><\/li>\n<\/ul>\n<p>Although these changes are good news for many people, what they affect can be confusing and complicated. The adjustments take effect retroactively as of January 2024. December 2023 is the last month that <span data-term-id=\"53278347\">WEP<\/span> and <span data-term-id=\"53278341\">GPO<\/span> apply. This means that eligible <span data-term-id=\"53278369\">beneficiaries<\/span> may receive adjusted benefits and past-due payments. However, for benefits earned before January 2024, <span data-term-id=\"53278347\">WEP<\/span> and <span data-term-id=\"53278341\">GPO<\/span> may still apply, which can further complicate the situation for some recipients.<\/p>\n<p>If it sounds intimidating, that\u2019s because it is. They can help you determine your <span data-term-id=\"53278344\">eligibility<\/span> for retroactive payments and ensure that you receive the proper benefits amount you are entitled to under the new law.<\/p>\n<h3>What Was the <span data-term-id=\"53278340\">Windfall Elimination Provision<\/span> (<span data-term-id=\"53278347\">WEP<\/span>)?<\/h3>\n<p>Before lawmakers eliminated it, the <a href=\"http:\/\/www.ssa.gov\/retire2\/wep.htm\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"53278347\">WEP<\/span><\/a> may have reduced your benefits. The <span data-term-id=\"53278347\">WEP<\/span> rules impacted how retirement or disability benefits are calculated, often resulting in a lower <span data-term-id=\"53278331\">Social Security benefit<\/span>. This happened if you earned a pension from a job where your employer didn&#8217;t withhold <span data-term-id=\"53278334\">Social Security taxes<\/span> from your paycheck. It also applied if you worked at least 10 years in other jobs with <span data-term-id=\"53278377\">substantial earnings<\/span>.<\/p>\n<p>The <a href=\"http:\/\/www.socialsecurity.gov\/retire2\/wep-chart.htm\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"53278347\">WEP<\/span> reduction<\/a> was limited to no more than one-half the amount of the pension from employment that isn\u2019t covered by Social Security. For example, if a public-sector pension was $600 per month, the <span data-term-id=\"53278347\">WEP<\/span> reduction in benefits couldn\u2019t be greater than $300.<\/p>\n<p>If you&#8217;re affected by the <span data-term-id=\"53278347\">WEP<\/span> and receive a reduced <span data-term-id=\"53278331\">Social Security benefit<\/span> of $800 per month, your spouse would receive a maximum <span data-term-id=\"53278354\">spousal benefit<\/span> of $400. This is one-half of your <span data-term-id=\"53278347\">WEP<\/span> <span data-term-id=\"53278356\">benefit amount<\/span>. However, if you die, Social Security removes the <span data-term-id=\"53278347\">WEP<\/span> reduction. They calculate your surviving spouse&#8217;s benefit using the standard formula.<\/p>\n<h3>What Was the <span data-term-id=\"53278342\">Government Pension Offset<\/span> (<span data-term-id=\"53278341\">GPO<\/span>)?<\/h3>\n<p>Before January 2025, some or all of your Social Security spousal or <span data-term-id=\"53278339\">survivor benefit<\/span> may have been offset. This happened if you received a pension from a government job in which you didn&#8217;t pay <span data-term-id=\"53278334\">Social Security taxes<\/span>.<\/p>\n<p>In most cases, Social Security <span data-term-id=\"53278354\">spousal benefits<\/span> equal half of the worker&#8217;s benefit if claimed at the spouse&#8217;s <span data-term-id=\"53278338\">full retirement age<\/span>. They reduce if claimed at an earlier age. <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/social-security-survivor-benefits-overview.html\" aria-expanded=\"false\"><span data-term-id=\"53278339\">Survivor benefits<\/span><\/a> are equal to the full amount of the worker&#8217;s benefit if claimed at the survivor&#8217;s <span data-term-id=\"53278338\">full retirement age<\/span>. Just like <span data-term-id=\"53278354\">spousal benefits<\/span>, the amount is also less if claimed at an earlier age.<\/p>\n<p>The <span data-term-id=\"53278341\">GPO<\/span> reduced the amount of Social Security spousal or <span data-term-id=\"53278339\">survivor benefits<\/span> by <a href=\"http:\/\/www.ssa.gov\/retire2\/gpo.htm\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">two-thirds of the amount of your government pension<\/a>. For example, if you received a monthly government pension of $600, two-thirds of that amount, or $400, had to be used to offset your spousal or <span data-term-id=\"53278339\">survivor benefit<\/span>. If you were eligible for a $500 <span data-term-id=\"53278354\">spousal benefit<\/span>, you\u2019d receive $100 per month from Social Security.<\/p>\n<p>Some individuals were exempt from the <span data-term-id=\"53278341\">GPO<\/span>. Your Social Security spousal or <span data-term-id=\"53278339\">survivor benefit<\/span> was not reduced if one of the following is true:<\/p>\n<ul>\n<li>You receive a government pension that isn\u2019t based on your <span data-term-id=\"53278365\">earned income<\/span><\/li>\n<li>You were a <span data-term-id=\"53278364\">federal government<\/span>, state, or <span data-term-id=\"53278348\">local <\/span><span data-term-id=\"53278373\">government<\/span><span data-term-id=\"53278373\"> employee<\/span> whose pension was from a job for which you paid <span data-term-id=\"53278334\">Social Security taxes<\/span><\/li>\n<li>Your last day of employment (that your pension is based on) was before July 1, 2004<\/li>\n<li>You filed for and were entitled to spousal or <span data-term-id=\"53278339\">survivor benefits<\/span> before April 1, 2004<\/li>\n<li>You paid <span data-term-id=\"53278334\">Social Security taxes<\/span> on your earnings during the last 60 months of government service.<\/li>\n<\/ul>\n<h3>Who Benefits From the Repeal of <span data-term-id=\"53278347\">WEP<\/span> and <span data-term-id=\"53278341\">GPO<\/span>?<\/h3>\n<p>The repeal of the <span data-term-id=\"53278340\">Windfall Elimination Provision<\/span> (<span data-term-id=\"53278347\">WEP<\/span>) and <span data-term-id=\"53278342\">Government Pension Offset<\/span> (<span data-term-id=\"53278341\">GPO<\/span>) benefits public service employees and their families the most. If you receive a pension from a job where you did not pay <span data-term-id=\"53278334\">Social Security taxes<\/span>, such as a teacher, firefighter, or state employee, and also worked other jobs where you did pay them, you may be eligible for increased benefits.<\/p>\n<p>The repeal also directly impacts the spouses, <span data-term-id=\"53278357\">widows<\/span>, and <span data-term-id=\"53278357\">widowers<\/span> of these workers. Before, the <span data-term-id=\"53278341\">GPO<\/span> rule reduced or even eliminated any Social Security spousal or <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/basics\/social-security-survivor-benefits-overview.html\" aria-expanded=\"false\"><span data-term-id=\"53278339\">survivor benefits<\/span><\/a> they were entitled to receive. With the <span data-term-id=\"53278341\">GPO<\/span> eliminated, these individuals are now eligible to receive their full <span data-term-id=\"53278356\">benefit amount<\/span>.<\/p>\n<p>Because the process of recalculating benefits and issuing retroactive payments can be complex, consulting a Social Security attorney is advised.
