Appealing a denied <span data-term-id=\"57291651\">disability claim<\/span> is the next step.<\/p>\n\n    <\/div>\n\n\n\n<p>When you apply for <span data-term-id=\"57291633\">disability benefits<\/span>, you submit your <span data-term-id=\"57291655\">initial application<\/span> to the <span data-term-id=\"57291629\">SSA<\/span>. Your application should include <span data-term-id=\"57291654\">medical records<\/span> that describe your <span data-term-id=\"57291635\">medical condition<\/span>. They can also assist with providing the right evidence to support your claim.<\/p>\n<h2>Why Was My Initial <span data-term-id=\"57291651\">Disability Claim<\/span> Denied?<\/h2>\n<p>Before you <span data-term-id=\"57291670\">request reconsideration<\/span>, it\u2019s important to understand why the <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/why-a-disability-claim-gets-denied.html\"><span data-term-id=\"57291629\">SSA<\/span> denied your case<\/a> in the first place.<\/p>\n<p>The <span data-term-id=\"57291629\">SSA<\/span> may deny <span data-term-id=\"57291651\">disability claims<\/span> for the\u00a0following reasons:<\/p>\n<ul>\n<li>The <span data-term-id=\"57291634\">claimant<\/span>\u2019s <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/medical-conditions-that-qualify-you-for-social-security.html\"><span data-term-id=\"57291635\">medical condition<\/span> isn\u2019t severe<\/a> or expected to last 12 or more months.<\/li>\n<li>The <span data-term-id=\"57291634\">claimant<\/span> can perform their usual or other types of work.<\/li>\n<li>The <span data-term-id=\"57291634\">claimant<\/span> provided <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/how-to-prove-disability.html\">insufficient <span data-term-id=\"57291656\">medical evidence<\/span><\/a>.<\/li>\n<li>The <span data-term-id=\"57291634\">claimant<\/span> failed to cooperate or didn\u2019t adhere to the prescribed medical treatment.<\/li>\n<li>The <span data-term-id=\"57291634\">claimant<\/span> resumed\u00a0<a href=\"https:\/\/faq.ssa.gov\/en-us\/Topic\/article\/KA-01843\" target=\"_blank\" rel=\"noopener\">substantial gainful activity<\/a>\u00a0before the disability could be proven.<\/li>\n<\/ul>\n<p>If you know why the <span data-term-id=\"57291629\">SSA<\/span> denied your case, you can take steps to fix any issues. You may also need to <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/social-security-disability-determinations-and-consultative-exams.html\">complete a consultative exam<\/a>.<\/p>\n<h2>What Is the <span data-term-id=\"57291663\">Social Security Disability <\/span><span data-term-id=\"57291630\">Appeals Process<\/span>?<\/h2>\n<p>There are four levels to the <span data-term-id=\"57291630\">appeals process<\/span> for claims under <span data-term-id=\"57291650\">Social Security Disability Insurance<\/span> (SSDI) and <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/what-is-the-difference-between-ssdi-and-ssi.html\"><span data-term-id=\"57291644\">Supplemental Security Income<\/span> (<span data-term-id=\"57291641\">SSI<\/span>)<\/a>, including:<\/p>\n<ol>\n<li><a href=\"#reconsideration\"><span data-term-id=\"57291639\">Request for reconsideration<\/span><\/a><\/li>\n<li><a href=\"#hearing\">Administrative hearing<\/a><\/li>\n<li><a href=\"#appeals-council\"><span data-term-id=\"57291632\">Appeals Council<\/span><span data-term-id=\"57291632\"> review<\/span><\/a><\/li>\n<li><a href=\"#court\"><span data-term-id=\"57291649\">Federal court review<\/span><\/a><\/li>\n<\/ol>\n<p>Strict deadlines apply. In each step of the process, you have 60 days to file for further review. The clock starts the day you receive notice of the <span data-term-id=\"57291629\">SSA<\/span>\u2019s decision. The <span data-term-id=\"57291629\">SSA<\/span> usually assumes this is five days after the date of the letter. Failure to file within the time frame may result in the inability to appeal.<\/p>\n<h3><span data-term-id=\"57291670\">Request Reconsideration<a id=\"reconsideration\"><\/a><\/span><\/h3>\n<p>The <span data-term-id=\"57291674\">reconsideration stage<\/span> is the first <span data-term-id=\"57291645\">level of appeal<\/span>. Reconsideration involves a review of your <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/applying-for-disability-benefits.html\">initial claim<\/a>, including all submitted <span data-term-id=\"57291656\">medical evidence<\/span>. At this stage, they will also consider any <span data-term-id=\"57291652\">additional evidence<\/span>. You would need to include the updated or <span data-term-id=\"57291637\">new evidence<\/span> since the first time you applied for benefits.<\/p>\n<p>Your state\u2019s DDS, which received your <span data-term-id=\"57291655\">initial application<\/span>, is still involved at this level. The DDS reevaluates your disability application and your eligibility for SSDI benefits or <span data-term-id=\"57291641\">SSI<\/span> benefits. The reconsideration is conducted by a person who didn\u2019t take part in the original decision.<\/p>\n<p>You may either file for reconsideration\u00a0<a href=\"https:\/\/www.ssa.gov\/apply\/appeal-decision-we-made\/request-reconsideration\" target=\"_blank\" rel=\"noopener\">online<\/a>\u00a0or complete\u00a0<a href=\"https:\/\/www.ssa.gov\/forms\/ssa-561-u2.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57291643\">Form <\/span><span data-term-id=\"57291629\">SSA<\/span>-561-U2<\/a>\u00a0and submit it to your\u00a0<span data-term-id=\"57291640\">local Social Security office<\/span>.<\/p>\n<h3>Attend an Administrative Hearing<a id=\"hearing\"><\/a><\/h3>\n<p>Many Social Security <span data-term-id=\"57291651\">disability claims<\/span> are also denied at the reconsideration level. The second <span data-term-id=\"57291645\">level of appeal<\/span> is a hearing before an <span data-term-id=\"57291628\">Administrative Law Judge<\/span> (ALJ).<\/p>\n<p><span data-term-id=\"57291676\">Hearing offices<\/span> sometimes offer <span data-term-id=\"57291665\">online appeal<\/span> hearings. But many ALJ hearings are <span data-term-id=\"57291653\">in person<\/span> at the <span data-term-id=\"57291676\">hearing offices<\/span>. Showing up and being on time is essential. The <span data-term-id=\"57291629\">SSA<\/span> may cover your travel costs if you need help. You can also\u00a0waive the right to appear\u00a0at your <span data-term-id=\"57291647\">disability hearing<\/span>. In that case, the ALJ decides the case based only on the evidence of record.<\/p>\n<p>At the hearing, the ALJ may ask you questions about your <span data-term-id=\"57291635\">medical condition<\/span> or question a <span data-term-id=\"57291662\">vocational expert<\/span>. A <span data-term-id=\"57291662\">vocational expert<\/span> can testify about whether you can return to your previous job or do other work, given your functional limitations. A medical expert may testify about your medical impairment(s) and <span data-term-id=\"57291654\">medical records<\/span>.<\/p>\n<p>The ALJ reviews all the evidence in your case, including any <span data-term-id=\"57291637\">new evidence<\/span>, and issues a <span data-term-id=\"57291646\">hearing decision<\/span>. Some <span data-term-id=\"57291634\">claimants<\/span> decide to hire a <span data-term-id=\"57291664\">Social Security Disability attorney<\/span> or a non-attorney representative at this stage.<\/p>\n<h3>Ask for the <span data-term-id=\"57291648\">Appeals Council<\/span><span data-term-id=\"57291648\">\u2019s Decision<a id=\"appeals-council\"><\/a><\/span><\/h3>\n<p>If you receive a <span data-term-id=\"57291668\">denial letter<\/span> after the ALJ <span data-term-id=\"57291666\">hearing level<\/span>, you can continue to seek benefits. The <span data-term-id=\"57291632\">Appeals Council<\/span><span data-term-id=\"57291632\"> review<\/span> is the third <span data-term-id=\"57291645\">level of appeal<\/span>. There is no hearing at this stage.<\/p>\n<p>An Administrative Appeals Judge will review the <span data-term-id=\"57291660\">ALJ\u2019s decision<\/span>. They may issue a new decision. Alternatively, they may <span data-term-id=\"57291659\">remand<\/span> (send back) the case to the ALJ for further action. This may include a <span data-term-id=\"57291675\">new hearing<\/span> and decision.<\/p>\n<h3>Sue for Review in Federal Court<a id=\"court\"><\/a><\/h3>\n<p>The final <span data-term-id=\"57291645\">level of appeal<\/span> is to sue in <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/us-federal-court-system.html\">federal court<\/a>. <span data-term-id=\"57291649\">Federal court review<\/span> involves filing a civil action in your local <span data-term-id=\"57291642\">U.S. District Court<\/span>.<\/p>\n<p>There are three typical outcomes at this level, including:<\/p>\n<ul>\n<li>If the federal judge doesn\u2019t find any error, they will affirm the <span data-term-id=\"57291629\">SSA<\/span>\u2019s decision to deny benefits.<\/li>\n<li>The judge may send the case back to the <span data-term-id=\"57291629\">SSA<\/span> for further review.<\/li>\n<li>In rarer instances, the <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-kinds-of-cases-can-federal-courts-decide.html\"><span data-term-id=\"57291638\">judge\u2019s decision<\/span><\/a> may rule in your favor.<\/li>\n<\/ul>\n<p>You may have had the help of a non-attorney representative at previous <span data-term-id=\"57291645\">levels of appeal<\/span>. At this stage, you want the help of an experienced attorney to help you navigate this complex process. A disability attorney will <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit.html\">file your civil action<\/a> in <span data-term-id=\"57291636\">federal district court<\/span>, submit legal briefs, and make arguments in court to help you win your case. A non-attorney representative cannot help you in federal court.<\/p>\n<h2>Getting Ready for a <span data-term-id=\"57291647\">Disability Hearing<\/span><\/h2>\n<p>Your <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/what-happens-at-a-disability-hearing.html\"><span data-term-id=\"57291647\">disability hearing<\/span><\/a> will influence your case. While the <span data-term-id=\"57291630\">appeals process<\/span> is complex, a <span data-term-id=\"57291664\">Social Security disability attorney<\/span> can help you prepare and advocate on your behalf.<\/p>\n<h3>Gather <span data-term-id=\"57291652\">Additional Evidence<\/span><\/h3>\n<p>A well-written letter from your doctor can help overturn a denied Social Security <span data-term-id=\"57291651\">disability claim<\/span>. Your doctor\u2019s letter about your limitations should be consistent with your provided <span data-term-id=\"57291654\">medical records<\/span>.<\/p>\n<p>The <span data-term-id=\"57291654\">medical records<\/span> you send with your claim should generally contain the following information:<\/p>\n<ul>\n<li>Medical history<\/li>\n<li>Laboratory findings<\/li>\n<li>Clinical findings, including symptom reports<\/li>\n<li>Medical diagnosis and prognosis<\/li>\n<li>Medical treatment prescribed with response and adherence<\/li>\n<\/ul>\n<p>Your doctor may include information about your\u00a0ability to perform work-related activities\u00a0in the statement. For physical impairments, these activities may involve hearing, talking, walking, standing, and sitting. These activities may also include carrying, lifting, and handling objects.<\/p>\n<p>If you have a mental impairment, your doctor\u2019s statement may discuss your ability to remember, understand, and carry out instructions. The statement may also include your ability to respond to your supervisor, co-workers, and typical pressures in the workplace.<\/p>\n<h3>Use Your Right to Representation<\/h3>\n<p>You have the right to representation in the <span data-term-id=\"57291672\">SSDI <\/span><span data-term-id=\"57291630\">appeals process<\/span>. <span data-term-id=\"57291629\">SSA<\/span> even allows you to appoint a friend or another trusted and qualified person to represent you.<\/p>\n<p>But sometimes, a\u00a0<a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/do-you-need-a-disability-benefits-attorney-.html\" target=\"_blank\" rel=\"noopener\"><u>Social Security disability lawyer<\/u><\/a>\u00a0may be in your best interests. Federal lawsuits are rare.<\/p>\n<p>This data means two-thirds of all <span data-term-id=\"57291651\">disability claims<\/span> end in a denial. This includes <span data-term-id=\"57291634\">claimants<\/span> who pursued an appeal as well as those who let their appeal period lapse.<\/p>\n<p>If you plan to appeal, you must stay aware of the deadlines in your case. Missing a deadline jeopardizes your ability to get benefits, even if you believe you are eligible. Careful preparation can maximize your chances of winning the appeal.<\/p>\n<h2>How Long Do Social Security Disability Appeals Take?<\/h2>\n<p>Appeals cases can take from a few months to many years. This timeline varies widely because each of the four stages can take a few months or more. The last stage, suing the government for benefits, can take several years on its own. Yet, your case might not proceed through all four stages.<\/p>\n<p>The disability <span data-term-id=\"57291630\">appeals process<\/span> ends when you either:<\/p>\n<ul>\n<li>Receive an approval for <span data-term-id=\"57291633\">disability benefits<\/span><\/li>\n<li>Choose not to proceed with the next <span data-term-id=\"57291645\">level of appeal<\/span><\/li>\n<li>Make a mistake that disqualifies you from the next appeal stage<\/li>\n<li>Exhaust all four <span data-term-id=\"57291645\">levels of appeal<\/span><\/li>\n<\/ul>\n<p>The long timeline for SSDI appeals can be frustrating. The <span data-term-id=\"57291629\">SSA<\/span>\u2019s processing time and delays can slow down the process. But if your claim is approved, the <span data-term-id=\"57291629\">SSA<\/span> may provide back pay for up to 12 months of any benefits you missed. These benefits would have begun five months after your <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/what-is-my-disability-onset-date.html\">established disability onset date<\/a>.<\/p>\n<h2>How Do I Survive While Waiting for the Appeal?<\/h2>\n<p>If possible, you may need to work during the lengthy <span data-term-id=\"57291630\">appeals process<\/span> to support yourself or your family. But to protect your <span data-term-id=\"57291651\">disability claim<\/span>, you must not earn at substantial gainful activity levels (SGA).<\/p>\n<p>In 2026, SGA levels are $1,690 a month for non-blind <span data-term-id=\"57291634\">claimants<\/span> and $2,380 for blind <span data-term-id=\"57291634\">claimants<\/span>. If you make at or over that amount while your appeal is pending, the <span data-term-id=\"57291629\">SSA<\/span> may presume you can work and find you ineligible for benefits or not disabled.<\/p>\n<p>In some cases, people with disabilities may consider <a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/social-security-disability-and-unemployment.html\">collecting unemployment benefits<\/a> for a short time after leaving their previous job. Applying for both types of benefits can present complications for your disability case, so you may want to consult an attorney first.<\/p>\n<p>Luckily, legal representation usually costs nothing up front in these cases. If you win your claim, you pay your representative\u2019s fee from your past-due benefits.
