It happens more often than it should and can result in devastating consequences.<\/p>\n<p>It\u2019s one thing for someone to disclose a <span data-term-id=\"56410811\">taxpayer<\/span><span data-term-id=\"56410811\">\u2019s name<\/span>, but another entirely for them to share your <span data-term-id=\"56410786\">taxpayer<\/span><span data-term-id=\"56410786\"> identification number<\/span> and personal financial data. All it takes is for one disgruntled employee at a <span data-term-id=\"56410809\">government agency<\/span> to take pictures of your Social Security number for you to end up the victim of <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/how-to-deal-with-tax-identity-theft.html\"><span data-term-id=\"56410788\">taxpayer<\/span> <span data-term-id=\"56410787\">identity<\/span><span data-term-id=\"56410787\"> theft<\/span><\/a>.<\/p>\n<p>The same thing is true if your ex-spouse gets a copy of your most recent <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/individuals-and-income-tax.html\"><span data-term-id=\"56410759\">tax return<\/span><\/a> in an effort to get more <span data-term-id=\"56410803\">child support<\/span>. One way to protect yourself is to recognize some of the situations in which your <span data-term-id=\"56410760\">taxpayer<\/span> information is at risk.<\/p>\n<p>Some of the more common scenarios where this may happen include the following:<\/p>\n<ul>\n<li>In a divorce or family law case<\/li>\n<li>As part of a business or <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit.html\">civil lawsuit<\/a><\/li>\n<li>An untrustworthy <span data-term-id=\"56410784\">tax preparer<\/span> discloses your private information<\/li>\n<\/ul>\n<p>It\u2019s worth looking at each of these scenarios in more detail.<\/p>\n<h3>Divorce Proceedings<\/h3>\n<p>When you <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/where-to-file-for-divorce.html\">file for divorce<\/a>, the court requires that you provide both the court and the opposing party with copies of your tax records. These documents contain sensitive personal data, such as your Social Security number, date of birth, and financial account information.<\/p>\n<p>Some courts suggest, or even require, that this information be redacted from pleadings and supporting documents. However, these rules often don\u2019t apply to divorce cases. For example, in <a href=\"https:\/\/www.nycourts.gov\/Courthelp\/goingtocourt\/redaction.shtml\" target=\"_blank\" rel=\"noopener\">New York<\/a>, the court requires parties to redact this sensitive information only in cases other than family law and <span data-term-id=\"56410774\">criminal investigations<\/span>.<\/p>\n<p>The fear with sharing this sort of information with your soon-to-be ex-spouse is that they will use it for nefarious purposes later on. For instance, if your spouse has a copy of your <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/common-reasons-why-your-tax-refund-may-be-delayed\/\"><span data-term-id=\"56410793\">tax refund<\/span><\/a> showing the account number where the\u00a0<span data-term-id=\"56410758\">IRS<\/span>\u00a0deposits your money, they may use that account to make unauthorized online purchases.<\/p>\n<p>If you\u2019re still in the throes of divorce, talk to your attorney about protecting your private information. While your divorce lawyer won\u2019t be able to hide this information from your spouse, they may be able to include language in your <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/settlement-agreements-and-court-approval.html\">divorce agreement<\/a> prohibiting them from using or sharing this information. An attorney can also request a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-proof-do-you-need-to-get-a-restraining-order\/\">protective order<\/a> to prevent the unauthorized use of your private information.<\/p>\n<h3>Civil Litigation<\/h3>\n<p>If someone files a civil lawsuit against you, there\u2019s a chance you\u2019ll have to answer a <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-subpoena.html\"><span data-term-id=\"56410780\">subpoena<\/span><\/a> demanding your financial information. When you receive a <span data-term-id=\"56410780\">subpoena<\/span>, you have no choice but to comply with it.<\/p>\n<p>The danger here is that you are exposing your private, personal information to everyone at the courthouse. Not only will the opposing party and their attorney see it, but the court clerk, the judge, and other administrative staff will as well.<\/p>\n<p>Your defense attorney has several options when it comes to <a href=\"https:\/\/www.findlaw.com\/consumer\/online-scams\/federal-data-privacy-laws.html\">protecting your privacy<\/a>, including:<\/p>\n<ul>\n<li>Filing a \u201c<a href=\"https:\/\/caselaw.findlaw.com\/court\/spr-crt-new-yor-fra-cou\/116930954.html\" target=\"_blank\" rel=\"noopener\">Motion to Quash<\/a>\u201d the <span data-term-id=\"56410780\">subpoena<\/span>: If your attorney is successful, the judge will rule that you don\u2019t have to respond to the <span data-term-id=\"56410780\">subpoena<\/span> at all<\/li>\n<li>Negotiate the <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-subpoena.html\">scope of the <span data-term-id=\"56410780\">subpoena<\/span><\/a>: In some cases, your lawyer can negotiate with the other party\u2019s attorney to limit the type and amount of information you must disclose<\/li>\n<li>Challenge the <span data-term-id=\"56410780\">subpoena<\/span>: You can also challenge the <span data-term-id=\"56410780\">subpoena<\/span>, arguing that it is too broad or is requesting irrelevant information<\/li>\n<\/ul>\n<p>In these situations, it\u2019s a good idea to consult an <a href=\"https:\/\/lawyers.findlaw.com\/litigation-appeals\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">experienced attorney<\/a>. They\u2019ll have experience in protecting your private information.<\/p>\n<h3><span data-term-id=\"56410784\">Tax Preparer<\/span> Sharing Private <span data-term-id=\"56410760\">Taxpayer<\/span> Information<\/h3>\n<p>There\u2019s a good deal of trust that goes into hiring someone to <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/how-to-find-tax-audit-help.html\">prepare your taxes<\/a>. There\u2019s always a chance they may disclose or share your private, personal information with another party. The good news is that there are laws that prohibit tax professionals from doing this.<\/p>\n<p>For example, the <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56410764\">Internal Revenue Code<\/span><\/a> (<span data-term-id=\"56410769\">IRC<\/span>) specifically prohibits tax professionals from disclosing or using <span data-term-id=\"56410760\">taxpayer<\/span> information. <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/26-usc-sect-7216\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56410799\">Federal law<\/span><\/a> states that no tax professional can knowingly or recklessly disclose <span data-term-id=\"56410761\">tax return<\/span><span data-term-id=\"56410761\"> information<\/span> without their client\u2019s consent. If they do, they are subject to penalties <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/26-usc-sect-6713\/\" target=\"_blank\" rel=\"noopener\">that start at $250 per violation<\/a>.<\/p>\n<p>Violations of these laws will result in monetary fines and potential prison time. The <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-continues-efforts-stop-unlawful-tax-return-preparers\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56410789\">Department of Justice<\/span><\/a> enforces the <span data-term-id=\"56410769\">IRC<\/span> and prosecutes violators.<\/p>\n<p>As with some rules, there are <span data-term-id=\"56410801\">exemptions<\/span>. These include:<\/p>\n<ul>\n<li>Sharing information with another <span data-term-id=\"56410784\">tax preparer<\/span><\/li>\n<li>Regulatory compliance<\/li>\n<li>Internal administrative needs<\/li>\n<li>Internal audits<\/li>\n<li>Client invoices<\/li>\n<li>Quality control<\/li>\n<\/ul>\n<p>As a <span data-term-id=\"56410790\">general rule<\/span>, <span data-term-id=\"56410784\">tax preparers<\/span> and other tax professionals should never share a client\u2019s personal financial information. Not only is it against the law, but it can also cost the person their <a href=\"https:\/\/www.op.nysed.gov\/certified-public-accountants\" target=\"_blank\" rel=\"noopener\">Certified Public Accountant\u2019s license<\/a>.<\/p>\n<h2><span data-term-id=\"56410759\">Tax Return<\/span> Confidentiality and <span data-term-id=\"56410799\">Federal Law<\/span><\/h2>\n<p>The <span data-term-id=\"56410764\">Internal Revenue Code<\/span> (<span data-term-id=\"56410769\">IRC<\/span>) states that &#8220;[<span data-term-id=\"56410768\">federal tax<\/span>] returns and <span data-term-id=\"56410763\">taxpayer<\/span><span data-term-id=\"56410763\"> return information<\/span>\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/26-usc-sect-6103.html\" target=\"_blank\" rel=\"noopener\">shall be confidential<\/a>.&#8221; The <span data-term-id=\"56410769\">IRC<\/span> safeguard extends to all information related to returns, such as your <span data-term-id=\"56410770\">tax liability<\/span>, <span data-term-id=\"56410778\">tax payments<\/span>, and efforts to collect unpaid taxes. In fact, the <span data-term-id=\"56410767\">tax laws<\/span> bar the <span data-term-id=\"56410765\">Internal Revenue Service<\/span> (<span data-term-id=\"56410758\">IRS<\/span>) from even telling anyone\u00a0<a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/do-i-have-to-file-a-federal-tax-return.html\">whether you filed<\/a>\u00a0a <span data-term-id=\"56410759\">tax return<\/span>.<\/p>\n<p>This wasn\u2019t always the case. Before the passage of the <a href=\"https:\/\/www.congress.gov\/bill\/94th-congress\/house-bill\/10612\" target=\"_blank\" rel=\"noopener\">Tax Reform Act of 1976<\/a>, in the wake of the Watergate scandal, <span data-term-id=\"56410761\">tax return<\/span><span data-term-id=\"56410761\"> information<\/span> was not protected by law. Reports that the Nixon administration used\u00a0<span data-term-id=\"56410761\">tax return<\/span><span data-term-id=\"56410761\"> information<\/span>\u00a0to compile its infamous &#8220;enemies list&#8221; prompted lawmakers to make <span data-term-id=\"56410768\">federal tax<\/span> records confidential.<\/p>\n<p>Violations of\u00a0the <span data-term-id=\"56410758\">IRS<\/span> <span data-term-id=\"56410759\">tax return<\/span> confidentiality laws\u00a0may be charged as felonies. Violations may be punished by up to five years in prison and fines of up to $250,000. <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/26-usc-sect-7431\/\" target=\"_blank\" rel=\"noopener\">Victims of the unlawful disclosure of <span data-term-id=\"56410782\">tax matters<\/span><\/a> may also sue for civil damages of $1,000 for each act or the sum of actual and punitive damages in case of gross negligence. <span data-term-id=\"56410800\">Federal employees<\/span> convicted of this crime must be fired,\u00a0in addition to criminal law charges and potential <span data-term-id=\"56410796\">civil liability<\/span>.<\/p>\n<h2>Voluntary Disclosure of <span data-term-id=\"56410759\">Tax Returns<\/span><\/h2>\n<p>Since other parties may need to see return information, it may be disclosed. The right to offer <span data-term-id=\"56410792\">disclosure of <\/span><span data-term-id=\"56410761\">tax return<\/span><span data-term-id=\"56410792\"> information<\/span> is limited to individuals. <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/the-irs-and-your-rights.html\"><span data-term-id=\"56410760\">Taxpayers<\/span><\/a> are free to disclose anything about\u00a0their own\u00a0<span data-term-id=\"56410759\">tax returns<\/span>, but the <span data-term-id=\"56410758\">IRS<\/span> can\u2019t comment on anything voluntarily disclosed.<\/p>\n<p><span data-term-id=\"56410760\">Taxpayers<\/span> may request that the <span data-term-id=\"56410758\">IRS<\/span> disclose tax records to a third party. This is done by providing\u00a0<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8821.pdf\" target=\"_blank\" rel=\"noopener\">written authorization<\/a>\u00a0to the agency. <span data-term-id=\"56410760\">Taxpayers<\/span> may also authorize a third-party <span data-term-id=\"56410805\">designee<\/span> by checking a box on their return. That authorization expires after one year. In addition, a party with\u00a0<a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney.html\">power of attorney<\/a>\u00a0may access that <span data-term-id=\"56410794\">particular <\/span><span data-term-id=\"56410760\">taxpayer<\/span>\u2019s <span data-term-id=\"56410761\">tax return<\/span><span data-term-id=\"56410761\"> information<\/span>.<\/p>\n<h2><span data-term-id=\"56410759\">Tax Return<\/span> Disclosure Laws<\/h2>\n<p>In some limited situations, return information can\u00a0be disclosed without the <span data-term-id=\"56410777\">taxpayer<\/span><span data-term-id=\"56410777\">\u2019s consent<\/span>. These include <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-subpoena.html\">court <span data-term-id=\"56410780\">subpoenas<\/span><\/a>\u00a0or valid requests from legislative oversight committees.
