It changed the tax treatment of investment income, gave homeowners a tax break on selling their homes, and increased the tax incentives for retirement savings. Its tax cuts benefitted a broad range of taxpayers.&nbsp;<\/p>\n\n        <\/div>\n    <\/div>\n<\/div>\n<p>The law created tax policies intended to spur the country&#8217;s economic development. It was also notable as the first fast-track reconciliation act passed by Congress.<\/p>\r\n<p>Generally, the TRA:<\/p>\r\n<ul>\r\n<li>Lowered rates for long-term capital gains tax rate<\/li>\r\n<li>Created a child tax credit<\/li>\r\n<li>Gave homeowners an exemption on the profits from the sale of their principal home<\/li>\r\n<li>Increased the estate tax exemption<\/li>\r\n<li>Gave more exemptions in other areas of the tax code<\/li>\r\n<\/ul>\r\n<p>The TRA changed the federal tax code, but many states have passed their own versions of the law. These versions apply to state taxes and taxes imposed by local governments, such as state and local property taxes.<\/p>\r\n<p>The following is an overview of the TRA&#8217;s most significant tax provisions. See FindLaw&#8217;s&nbsp;<a href=\"https:\/\/www.findlaw.com\/tax.html\">Tax Law<\/a>&nbsp;section for more articles and resources, including&nbsp;<a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/tax-exemptions.html\">Tax Exemptions<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/ten-ways-to-lower-your-taxes.html\">10 Ways to Lower Your Taxes<\/a>.<\/p>\r\n<h2>Reductions in Individual Capital Gains Rates<\/h2>\r\n<p>The TRA reduced the tax rates for long-term&nbsp;<a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-are-capital-gains-.html\">capital gains<\/a>. Long-term capital gains are the profits you earn from an asset you have owned for more than one year. The TRA made a series of changes to capital gains rates:<\/p>\r\n<ul>\r\n<li>For property held for more than 18 months, the 20% maximum tax rate applied (10% for those in the 15% bracket)<\/li>\r\n<li>Applied a 25% maximum rate to gains on the disposition of real estate assets otherwise eligible for the 20% rate<\/li>\r\n<li>Made taxpayers in the 15% bracket eligible for an 8% maximum rate on capital assets without marking to market property owned before 2001<\/li>\r\n<li>The 28% maximum rate continued to apply to the sale of collectibles held for more than one year<\/li>\r\n<li>Gains from the sale of certain small business stocks held more than six months could get rolled over tax-free if the seller reinvested the proceeds in new qualifying small business stock. Also, the excluded portion was no longer subject to the alternative minimum tax<\/li>\r\n<li>Capital gains of up to $250,000 ($500,000 for joint filers) on a sale of a principal home could be excluded from gross income every two years<\/li>\r\n<li>The alternative minimum tax capital gain rate was set to the same amount as the new regular capital gain rates<\/li>\r\n<\/ul>\r\n<h2>Estate and Gift Tax Relief<\/h2>\r\n<p>1.<b>&nbsp;Increased the unified credit against federal gift and estate taxation.<\/b>&nbsp;The law increased the unified estate and gift tax credit to allow each U.S. citizen to make tax-free transfers of up to $1 million. With proper planning, a married couple could make otherwise taxable transfers of up to $2 million without paying a federal wealth transfer tax.<\/p>\r\n<p>2.&nbsp;<b>Family-owned business exclusion. <\/b>An estate&#8217;s executor could elect to exclude the value of all or a part of business interest above the unified credit amount in effect at the time of death from the decedent&#8217;s estate for&nbsp;<a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/estate-tax-laws.html\">federal estate tax<\/a>&nbsp;purposes (up to a maximum of $1.3 million). To qualify for this exclusion, the family-owned business or farm needed to meet several requirements:<\/p>\r\n<ul>\r\n<li>The decedent must be a U.S. citizen or resident (at the time of death).<\/li>\r\n<li>The business must have its principal place of business in the United States.<\/li>\r\n<li>The decedent and their family must own at least 50% of the business. If more than one family owns an interest in the business, members of two families must own 70% or three families must own 90%.<\/li>\r\n<li>No company stock or security can have been publicly traded within three years of the decedent&#8217;s death.<\/li>\r\n<li>The decedent (or their family) must have materially participated in and owned the business for at least five of the eight years before the decedent&#8217;s death.<\/li>\r\n<li>The business interest must pass to a qualified heir.<\/li>\r\n<\/ul>\r\n<p>3. <b>Increased gift tax annual exclusion.<\/b>&nbsp;The TRA said that the annual&nbsp;<a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/estate-and-gift-tax-an-overview.html#:~:text=Gift%20Tax%20Exclusions%3A%20Gifts%20to%20individuals&amp;text=In%202022%2C%20the%20annual%20exclusion,they%20can%20together%20give%20%2432%2C000.\">gift tax<\/a>&nbsp;exclusion must get adjusted for inflation.<\/p>\r\n<p>4. <b>Finality of gift tax valuation.&nbsp;<\/b>The law prevents the IRS from adjusting the value of a lifetime gift properly reported on a gift tax return for which the statute of limitations had expired.<\/p>\r\n<h2>Student Loans<\/h2>\r\n<p>The TRA provided a tax deduction for the interest paid on student loans.<\/p>\r\n<h2>Individual Retirement Accounts (IRAs)<\/h2>\r\n<p>The TRA changed the rules governing existing IRA investment products and savings accounts to increase their accessibility, expand the availability of IRAs, create new types of IRAs, and significantly broaden the range of penalty-free IRA distributions a taxpayer could take:<\/p>\r\n<ul>\r\n<li><b>Increased deductibility of IRA contributions.<\/b>&nbsp;A person not actively participating in a qualified retirement plan could contribute up to $2,000 per tax year to an IRA and claim a deduction.<\/li>\r\n<li><b>Roth IRAs.<\/b>&nbsp;Contributions to a&nbsp;<a href=\"https:\/\/www.findlaw.com\/estate\/probate\/the-advantages-of-an-inherited-roth-ira.html\">Roth IRA<\/a>&nbsp;were not deductible, but earnings on Roth IRAs were not immediately subject to federal income tax. Also, a contributor to a Roth IRA could withdraw funds, including contributions and earnings, from a Roth IRA tax-free beginning at age 59-1\/2 if at least five years had passed since the first contribution.<\/li>\r\n<li><b>Education IRAs.&nbsp;<\/b>Parents could establish an education IRA for each child and make annual nondeductible contributions of up to $500 per IRA if the child for whose benefit the IRA was created was under 18.<\/li>\r\n<li><b>Penalty-free withdrawals for education and first-home buyers.<\/b>&nbsp;Withdrawals from traditional IRAs could be made for a taxpayer&#8217;s qualified higher education expenses and those of the taxpayer&#8217;s spouse, dependent child, or grandchild without the 10% penalty.<\/li>\r\n<\/ul>\r\n<h2>Child Tax Credit<\/h2>\r\n<p>The TRA allowed a $500 per child tax credit for parents with children under 17. Taxpayers with one or two children should calculate the credit before the earned income tax credit to provide for the maximum tax benefit.<\/p>\r\n<h2>Repeal of 15% Penalty Tax on Excess Distributions and Accumulations<\/h2>\r\n<p>The law repealed the 15% penalty tax on certain large lifetime distributions from IRAs and other qualified retirement plans.<\/p>\r\n<h2>Alternate Minimum Tax<\/h2>\r\n<p>The TRA provided an exemption from the corporate alternative minimum tax (AMT) for small businesses,&nbsp;<a href=\"http:\/\/www.irs.gov\/Businesses\/Small-Businesses-&amp;-Self-Employed\" target=\"_blank\" rel=\"noopener\">as defined by the IRS<\/a>. The TRA also conformed the depreciable life of property for AMT purposes to the depreciable life of similar property used for regular corporate income tax purposes.<\/p>\r\n<h2>ESOP, Pension, and Employee Benefit Provisions<\/h2>\r\n<p>The law repealed the application of the unrelated business taxable income rules to&nbsp;<a href=\"https:\/\/corporate.findlaw.com\/corporate-governance\/s-corporations-an-overview.html\" target=\"_blank\" rel=\"noopener\">S corporation<\/a>&nbsp;income allocated to an employee stock ownership plan (ESOP) shareholder. So, ESOPs could be shareholders of S corporations. The law also increased the prohibited transaction excise tax for qualified plans and disqualified pensions from 10% to 15%. Also, the TRA required broader diversification by 401(k) plans and investment of elective deferrals in stock of the 401(k) employer.<\/p>\r\n<h2>Changes To Net Operating Loss Rules<\/h2>\r\n<p>Subject to certain exceptions, the TRA limited the net operating loss (NOL) carryback period to two years rather than the three years allowed under prior law. It also extended the NOL carryforward period from 15 years to 20 years.<\/p>\r\n<h2>Lifetime Learning Credit<\/h2>\r\n<p>The law gave a&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/student-or-recent-grad-dont-forget-tax-credits-deductions\/\">lifetime learning credit<\/a>. Taxpayers can claim it for qualified tuition and related costs paid to an institution of higher education for an undergraduate, graduate, or professional degree.<\/p>\r\n<h2>Can the TRA Benefit You?
