You may have to provide evidence of <span data-term-id=\"56407635\">comparable sales<\/span> or independent appraisals.<\/p>\n\n    <\/div>\n\n\n\n<p>Every year, <span data-term-id=\"56407609\">property owners<\/span> receive a tax assessment from their county or city. <span data-term-id=\"56407603\">Property taxes<\/span>, or \u201cad valorem\u201d taxes, are based on the <span data-term-id=\"56407619\">value of your property<\/span>. They fluctuate each year, depending on the\u00a0<span data-term-id=\"56407636\">property&#8217;s <\/span><span data-term-id=\"56407606\">assessed value<\/span>. <span data-term-id=\"56407603\">Property taxes<\/span> fund schools and other community projects.<\/p>\n<p>For some owners, receiving their <span data-term-id=\"56407603\">property tax<\/span> notice is a major shock. Most owners know they need to pay <span data-term-id=\"56407603\">property taxes<\/span>, but didn\u2019t know it was going to be <em>that much<\/em>. In some states, <a href=\"https:\/\/assessor.lacounty.gov\/real-estate-toolkit\/proposition-13\" target=\"_blank\" rel=\"noopener\">such as California<\/a>, laws cap <span data-term-id=\"56407603\">property taxes<\/span> and <span data-term-id=\"56407632\">reassessment<\/span> at the time of sale. Others assess taxes annually, so your taxes can go up or down depending on the property\u2019s current value.<\/p>\n<p>That\u2019s the bad news. The good news is you can sometimes have your <span data-term-id=\"56407603\">property taxes<\/span> reassessed. You must act quickly to challenge your <span data-term-id=\"56407630\">property <\/span><span data-term-id=\"56407614\">tax<\/span><span data-term-id=\"56407630\"> bill<\/span>, so don\u2019t wait if the <span data-term-id=\"56407606\">assessed value<\/span> seems too high.<\/p>\n<h2><strong>Review Your <span data-term-id=\"56407616\">Assessment Notice<\/span><\/strong><\/h2>\n<p>An ad valorem tax is a tax on any real or <span data-term-id=\"56407622\">personal property<\/span> <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/property-tax-assessments.html\">based on the sales value<\/a>. Like a sales tax, the <span data-term-id=\"56407618\">county assessor<\/span> calculates the property\u2019s fair <span data-term-id=\"56407611\">market value<\/span> and taxes it accordingly. A <span data-term-id=\"56407636\">property\u2019s <\/span><span data-term-id=\"56407606\">assessed value<\/span> should be comparable with similar properties and what a buyer would pay under normal conditions. In other words, there are no <span data-term-id=\"56407608\">exemptions<\/span> for distressed properties or weak housing markets.<\/p>\n<p>Depending on your state, some types of <span data-term-id=\"56407617\">real property<\/span> are not included in <span data-term-id=\"56407615\">property tax<\/span><span data-term-id=\"56407615\"> assessment<\/span>. Religious properties, nonprofit entities, and homestead <span data-term-id=\"56407608\">exemptions<\/span> may exist in some locations. In some states, fixed machinery and equipment within a taxed business property are not themselves taxed.<\/p>\n<p>The <span data-term-id=\"56407606\">assessed value<\/span> is not the final word on your <span data-term-id=\"56407603\">property tax<\/span>. As with anything else the government does, you have the right to <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/valuation-of-property-tips-for-challenging-the-valuation.html\" target=\"_blank\" rel=\"noopener\">appeal the assessment<\/a>. A review of the <span data-term-id=\"56407616\">assessment notice<\/span> may give you grounds for an appeal.<\/p>\n<h2><strong>Grounds for Assessment Appeal<\/strong><\/h2>\n<p>The <span data-term-id=\"56407621\">assessment <\/span><span data-term-id=\"56407604\">appeal process<\/span> begins with a review of your notice. Your first step is to look for <span data-term-id=\"56407637\">discrepancies<\/span> or errors in the notice itself. Common grounds for appeal include:<\/p>\n<ul>\n<li><strong>Factual errors in the assessment<\/strong>: The assessor got the square footage of your property wrong, listed the wrong number of rooms, or made other material errors that affected the <span data-term-id=\"56407610\">valuation<\/span> of the property<\/li>\n<li><strong><span data-term-id=\"56407610\">Valuation<\/span> errors<\/strong>: The <span data-term-id=\"56407606\">assessed value<\/span> is substantially higher than <span data-term-id=\"56407623\">comparable properties<\/span> sold in the area<\/li>\n<li><strong>Statutory errors<\/strong>: The tax levied does not meet statutory requirements according to state law, such as California\u2019s capping of the annual increase of the <span data-term-id=\"56407636\">property\u2019s <\/span><span data-term-id=\"56407606\">assessed value<\/span> at 2%<\/li>\n<li><strong>Uniformity errors<\/strong>: The assessor rated your property at a higher <span data-term-id=\"56407611\">market value<\/span> than <span data-term-id=\"56407623\">comparable properties<\/span> in similar condition<\/li>\n<\/ul>\n<p>Once you\u2019ve located possible grounds for a <span data-term-id=\"56407633\">property tax<\/span><span data-term-id=\"56407633\"> assessment<\/span><span data-term-id=\"56407633\"> appeal<\/span>, it\u2019s a good idea to contact a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">tax attorney<\/a> for legal advice.<\/p>\n<h3><strong>Making Your Case for Appeal<\/strong><\/h3>\n<p>Your first step is filing an <span data-term-id=\"56407605\">appeal form<\/span> at your state <span data-term-id=\"56407627\">assessor\u2019s office<\/span>. It\u2019s a good idea to have a legal professional help you find the right form and ensure it&#8217;s filled out correctly. There are strict deadlines for filing your application, often 60 or 90 days from receipt of your tax notice. There may be exceptions for disasters or other emergencies.<\/p>\n<p>You will need <span data-term-id=\"56407631\">supporting documentation<\/span> to bolster your claims. Depending on what you\u2019re claiming is the reason for the appeal, you\u2019ll need different kinds of documentation. For example:<\/p>\n<ul>\n<li><strong><span data-term-id=\"56407635\">Comparable sales<\/span><\/strong>: Evidence can show the assessor overvalued your property. You will need either proof of similar homes in your neighborhood selling at lower prices, or comparable homes in other locations. When you do this, the other properties and areas must be reasonably similar to your own. For instance, you cannot compare your neighborhood in rural Alabama to Beverly Hills, California.<\/li>\n<li><strong>Comparable conditions<\/strong>: Photographic evidence can show proof that your property is in considerably worse condition (old roof, cracking foundations) than a lower-assessed neighbor. Assessors are not\u00a0<span data-term-id=\"56407629\">realtors<\/span>\u00a0and do not consider the structural aspects of your property. Keep in mind that an assessment does not include cosmetic factors like paint or fixtures.<\/li>\n<li><strong>Using a professional independent appraiser<\/strong>: If the appraisal seems grossly unfair, consider having a professional appraiser provide a second opinion on the property value. Having an analysis from a respected appraiser can be helpful.<\/li>\n<\/ul>\n<p>Once you have this evidence in hand, you can begin the <span data-term-id=\"56407604\">appeals process<\/span>.<\/p>\n<h3><strong>The <span data-term-id=\"56407633\">Property Tax<\/span> <span data-term-id=\"56407621\">Assessment<\/span> <span data-term-id=\"56407604\">Appeals<\/span><span data-term-id=\"56407621\"> Process<\/span><\/strong><\/h3>\n<p>The <span data-term-id=\"56407618\">county <\/span><span data-term-id=\"56407627\">assessor<\/span><span data-term-id=\"56407627\">\u2019s office<\/span> has an informal <span data-term-id=\"56407625\">appeals board<\/span> to hear <span data-term-id=\"56407607\">taxpayer<\/span> complaints. Depending on your county, these may require appointments or only be open on certain days. You can find these <span data-term-id=\"56407634\">hearing dates<\/span> and how to petition the <span data-term-id=\"56407624\">county board<\/span> at the tax <span data-term-id=\"56407627\">assessor\u2019s office<\/span> website.<\/p>\n<p>For more serious matters, you will need to make a <span data-term-id=\"56407640\">formal appeal<\/span>. The <span data-term-id=\"56407624\">County <\/span><span data-term-id=\"56407620\">Board<\/span><span data-term-id=\"56407620\"> of Equalization<\/span>\u00a0often conducts these hearings as a neutral third party between <span data-term-id=\"56407607\">taxpayers<\/span> and the <span data-term-id=\"56407618\">County Assessor<\/span>. The Board can review your documentation and make a decision on your request.<\/p>\n<p>If the Board cannot resolve your issue, the final step is a judicial review. You may have grounds for legal action against the county. For instance, in Los Angeles County, for new construction or a change of ownership, you must file a request within 60 days of the date of your tax notice. If you are an owner challenging the appraised value, you must file an appeal between July 2 and November 30 of the year in question, although you can still request an informal reappraisal.<\/p>\n<p>Having an attorney who can explain these puzzling, contradictory deadlines is extremely useful and ensures that all your paperwork gets in on time. They\u2019ll know which <span data-term-id=\"56407639\">petition forms<\/span> you should use and what evidence you should include with your form. If your case requires a formal hearing or judicial review, your attorney can present the case to the Board.
