Unless you\u2019re a career tax evader, the <span data-term-id=\"56395601\">IRS<\/span> will be satisfied if you get up to date on paying your taxes. There are ways to admit your <span data-term-id=\"56395608\">tax debt<\/span>, agree to pay the <span data-term-id=\"56395625\">balance due<\/span>, and even avoid paying the <span data-term-id=\"56395628\">full amount<\/span> of penalties and interest owed.<\/p>\n<p>Ignoring the issue will make things worse, as the <span data-term-id=\"56395601\">IRS<\/span> will continue to assess interest and <span data-term-id=\"56395632\">late payment penalties<\/span> each year you fail to pay on time. The sooner you reach an agreement with the <span data-term-id=\"56395601\">IRS<\/span>, the more likely you are to reach a resolution you can afford and be able to pay off your <span data-term-id=\"56395635\">back taxes<\/span>.<\/p>\n<h2><strong>Time, Liens, and Levies<\/strong><\/h2>\n<p>The <span data-term-id=\"56395601\">IRS<\/span> has a <a href=\"https:\/\/codes.lp.findlaw.com\/uscode\/26\/F\/66\/A\/6502\" target=\"_blank\" rel=\"noopener\">10-year statute of limitations<\/a> to collect your unpaid taxes. That 10-year period starts running from the time they processed your <span data-term-id=\"56395605\">federal tax<\/span> assessment. The <span data-term-id=\"56395601\">IRS<\/span> can do a tax assessment within three years of when they receive your tax return or when it is due. In other words, if you hoped that it was too late for them to collect your taxes, it probably isn\u2019t. If you last filed taxes in 2024, the <span data-term-id=\"56395601\">IRS<\/span> can try to collect taxes until 2034.<\/p>\n<p>The <span data-term-id=\"56395601\">IRS<\/span> has many ways to collect your taxes until then. The most common step is simply applying next year\u2019s <span data-term-id=\"56395646\">tax refund<\/span> payment to last year\u2019s overdue taxes. You\u2019ll receive a notice explaining that you did not receive an expected refund because the <span data-term-id=\"56395601\">IRS<\/span> used it to offset your <span data-term-id=\"56395635\">back taxes<\/span>.<\/p>\n<p>If you owe more, the <span data-term-id=\"56395601\">IRS<\/span> takes other steps:<\/p>\n<h3><strong><span data-term-id=\"56395617\">Short-Term<\/span> Solutions<\/strong><\/h3>\n<p>The <span data-term-id=\"56395601\">IRS<\/span> can label your account \u201c<span data-term-id=\"56395645\">currently not collectible<\/span>.\u201d This means they will not resume collections until your financial status improves. The <span data-term-id=\"56395601\">IRS<\/span> can make this decision while it reviews your <span data-term-id=\"56395637\">installment agreement<\/span><span data-term-id=\"56395637\"> request<\/span>.<\/p>\n<h3><strong>Tax Liens<\/strong><\/h3>\n<p>A\u00a0<a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-a-tax-lien-.html\"><span data-term-id=\"56395605\">federal tax<\/span> lien<\/a>\u00a0is a legal claim against your property or assets. The claim can include real estate, personal property, and future property or judgments. Failure to pay the tax owed after you receive your first <span data-term-id=\"56395606\">tax bill<\/span> automatically creates a tax lien. You will receive a notice of <span data-term-id=\"56395605\">federal tax<\/span> lien once the <span data-term-id=\"56395601\">IRS<\/span> files it.<\/p>\n<h3><strong>Tax Levies<\/strong><\/h3>\n<p>A <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/how-to-stop-an-irs-tax-levy.html\">tax levy<\/a> is the execution of a tax lien. The government has a claim on your property, which it seizes to pay off your <span data-term-id=\"56395608\">tax debt<\/span>. The <span data-term-id=\"56395601\">IRS<\/span> can seize a wide range of property using a levy, including:<\/p>\n<ul>\n<li>Houses and real estate<\/li>\n<li>Cars, boats, and physical property<\/li>\n<li>Wages and other income (wage <span data-term-id=\"56395634\">garnishment<\/span>)<\/li>\n<li><span data-term-id=\"56395619\">Bank accounts<\/span> and other financial accounts<\/li>\n<li>Federal payments, Social Security benefits, and some federal pensions<\/li>\n<\/ul>\n<p>The <span data-term-id=\"56395601\">IRS<\/span> will not seize necessary personal property, such as clothing and household goods. It will not take your primary personal residence without court approval. Child support and disability payments are exempt by federal law.<\/p>\n<p>The <span data-term-id=\"56395601\">IRS<\/span> also won\u2019t seize your property if you have a current or pending <span data-term-id=\"56395604\">installment agreement<\/span> or <span data-term-id=\"56395624\">offer in compromise<\/span> (<span data-term-id=\"56395626\">OIC<\/span>). If you can show that paying your <span data-term-id=\"56395606\">tax bill<\/span> would cause severe <span data-term-id=\"56395638\">financial hardship<\/span>, you could avoid a levy or lien completely. Any seized property can be sold.<\/p>\n<h2><strong>Solutions: Installment Plans and <span data-term-id=\"56395626\">OICs<\/span><\/strong><\/h2>\n<p>If you can pay your <span data-term-id=\"56395635\">back <\/span><span data-term-id=\"56395631\">tax<\/span><span data-term-id=\"56395631\"> liability<\/span> in smaller amounts over time, the <span data-term-id=\"56395601\">IRS<\/span> will let you set up an <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/receiving-a-tax-bill-from-the-irs.html\"><span data-term-id=\"56395604\">installment agreement<\/span><\/a>. As a simple <span data-term-id=\"56395600\">payment plan<\/span>, an <span data-term-id=\"56395604\">installment agreement<\/span> lets the <span data-term-id=\"56395602\">taxpayer<\/span> make regular monthly payments over a specified period of time. Certain requirements must be met to qualify for an <span data-term-id=\"56395604\">installment agreement<\/span>. You must have paid all your taxes for the previous five years, and agree to file all your regular tax returns during the repayment period.<\/p>\n<p>The <span data-term-id=\"56395604\">installment agreement<\/span> is ideal for those with less than $50,000 in <span data-term-id=\"56395635\">back taxes<\/span>. If your <span data-term-id=\"56395635\">back taxes<\/span> are higher than that, you may still be able to work out an installment plan. Given the complexity, you might want to consult with a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">tax attorney<\/a> to assist in the negotiations.<\/p>\n<p>A partial payment installment plan is available for those who cannot pay taxes during the 10-year collections period and who do not qualify for a loan or any other form of relief. The requirements for this <span data-term-id=\"56395600\">payment plan<\/span> are strict, which may require meeting with a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56395647\">tax professional<\/span><\/a>\u00a0to determine whether you qualify.<\/p>\n<h2><strong><span data-term-id=\"56395624\">Offer in Compromise<\/span><\/strong><\/h2>\n<p>If you cannot pay your taxes in full and have no assets to sell or borrow against, consider an <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/receiving-a-tax-bill-from-the-irs.html\"><span data-term-id=\"56395624\">offer in compromise<\/span><\/a>. This alternative takes some negotiation with the <span data-term-id=\"56395601\">IRS<\/span>, so you may need help from an <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">experienced tax attorney<\/a>.<\/p>\n<p>An <span data-term-id=\"56395624\">offer in compromise<\/span> (<span data-term-id=\"56395626\">OIC<\/span>) is an offer to pay a lump sum less than your <span data-term-id=\"56395631\">tax liability<\/span> to settle your debt in full. <span data-term-id=\"56395626\">OICs<\/span> are common in civil law, when debtors offer to pay such sums to settle contracts and loans.<\/p>\n<p>To make an <span data-term-id=\"56395626\">OIC<\/span> for a <span data-term-id=\"56395606\">tax bill<\/span>, you must show that either:<\/p>\n<ul>\n<li><strong>The debt is uncollectible<\/strong>: You must show you do not have funds or assets to pay the bill in monthly installments and still pay your monthly living expenses, which requires evidence to prove you are in a <span data-term-id=\"56395649\">low-income<\/span> situation, since the <span data-term-id=\"56395601\">IRS<\/span> bases your income on your <span data-term-id=\"56395609\">estimated tax<\/span><\/li>\n<li><strong>You do not owe the <span data-term-id=\"56395608\">tax debt<\/span> as shown<\/strong>: Based on your evidence, you do not owe the <span data-term-id=\"56395630\">estimated <\/span><span data-term-id=\"56395607\">tax<\/span><span data-term-id=\"56395630\"> payment<\/span>, but you are willing to pay an alternative sum to settle the dispute<\/li>\n<li><strong>The debt would be financially crippling<\/strong>: Paying the <span data-term-id=\"56395628\">full amount<\/span> in monthly installments would create a significant <span data-term-id=\"56395638\">financial hardship<\/span> or be unfair for other reasons<\/li>\n<\/ul>\n<p>These alternatives pause or \u201ctoll\u201d the statute of limitations for collecting your taxes. The <span data-term-id=\"56395601\">IRS<\/span> cannot collect your taxes while you are making a <span data-term-id=\"56395623\">payment agreement<\/span> or while an <span data-term-id=\"56395626\">OIC<\/span> is in negotiation. If you fail to keep up your <span data-term-id=\"56395600\">payment plan<\/span> or your <span data-term-id=\"56395626\">OIC<\/span> is rejected, the <span data-term-id=\"56395601\">IRS<\/span> can resume collection actions.<\/p>\n<h2><strong>Penalty Abatement<\/strong><\/h2>\n<p>If you tried to pay your taxes but were unable to do so, or were on a <span data-term-id=\"56395600\">payment plan<\/span> and could not make your monthly payments, you can request <span data-term-id=\"56395601\">IRS<\/span> penalty relief. There are several types of penalty abatement, depending on your circumstances.<\/p>\n<h3><strong>First-Time Abate<\/strong><\/h3>\n<p>An administrative waiver is available if you have not missed any other <span data-term-id=\"56395607\">tax payments<\/span>, and your penalty is due to any of these issues:<\/p>\n<ul>\n<li>Failure to file tax returns, partnership returns, or S corp returns<\/li>\n<li>Failure to pay by the <span data-term-id=\"56395618\">due date<\/span> shown on the return<\/li>\n<li>Failure to deposit taxes by the <span data-term-id=\"56395618\">due date<\/span><\/li>\n<\/ul>\n<h3><strong>Reasonable Cause<\/strong><\/h3>\n<p>If there was a reasonable cause for your failure to file or failure to pay, you can request a penalty abatement for that reason. This abatement depends on circumstances, so you may need to provide additional proof of the cause. Valid reasons for a failure to file can include:<\/p>\n<ul>\n<li>Natural disaster or civil disturbance<\/li>\n<li>Death or serious illness of the <span data-term-id=\"56395602\">taxpayer<\/span> or someone in the immediate family<\/li>\n<li>Inability to obtain essential records to file the <span data-term-id=\"56395610\">income tax return<\/span><\/li>\n<li>Systems issues that prevented a timely <span data-term-id=\"56395615\">online payment<\/span><\/li>\n<\/ul>\n<p>Reasonable causes do not include errors, lack of funds, or reliance on a <span data-term-id=\"56395647\">tax professional<\/span> who gave you bad advice.<\/p>\n<h3><strong>Statutory Relief<\/strong><\/h3>\n<p>You can receive relief from a penalty by law if you fall into these categories:<\/p>\n<ul>\n<li>You acted on written advice from the <span data-term-id=\"56395601\">IRS<\/span>, in response to a written request (keep copies of your request and the <span data-term-id=\"56395601\">IRS<\/span> response)<\/li>\n<li>You mailed or e-filed the return in a timely manner, but received a penalty anyway (as long as your filing met deadlines according to the <span data-term-id=\"56395601\">IRS<\/span> website)<\/li>\n<li>If you resided in a federally designated disaster zone at the time the return was due or were serving overseas in a combat area, you may be eligible for a penalty abatement<\/li>\n<\/ul>\n<p>Whenever you attempt these alternative payments, you should consult a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">tax attorney<\/a> or other <span data-term-id=\"56395642\">tax pro<\/span>.
