You\u2019ve heard so many horror stories. Can you go to jail for not paying taxes?<\/p>\n<p>The answer is maybe, but it\u2019s unlikely. In general, the <span data-term-id=\"56409924\">IRS<\/span> only files <span data-term-id=\"56409935\">criminal charges<\/span> for intentional acts such as <span data-term-id=\"56409963\">criminal <\/span><span data-term-id=\"56409925\">tax<\/span><span data-term-id=\"56409963\"> evasion<\/span>, fraud, and <span data-term-id=\"56409979\">underreporting income<\/span>. The <span data-term-id=\"56409924\">IRS<\/span> prosecutes these actions as serious <span data-term-id=\"56409949\">tax crimes<\/span>. Nonpayment because of inability to pay is a civil issue. The <span data-term-id=\"56409924\">IRS<\/span> is usually willing to work with you if you are willing to be honest with them.<\/p>\n<h2><span data-term-id=\"56409925\">Tax Evasion<\/span> vs. Tax Avoidance<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/tax-evasion.html\"><span data-term-id=\"56409925\">Tax evasion<\/span><\/a> is a criminal act, subject to <span data-term-id=\"56409942\">criminal prosecution<\/span> by the <span data-term-id=\"56409924\">IRS<\/span> and by state tax agencies. Tax avoidance is what people do to lawfully reduce their tax burden. It is legal to do some things to lower your <span data-term-id=\"56409946\">tax liability<\/span>, as long as you <span data-term-id=\"56409944\">file <\/span><span data-term-id=\"56409923\">tax<\/span><span data-term-id=\"56409944\"> returns<\/span> and list what you have done.<\/p>\n<p>If you <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/\" target=\"_blank\" rel=\"noopener\">reduce your taxes lawfully<\/a> and file your taxes on time, you have not broken any laws. While it\u2019s common to believe doing this is \u201ccheating on your taxes,\u201d it is not.<\/p>\n<h2>When It Becomes Criminal<\/h2>\n<p><span data-term-id=\"56409950\">Willful failure<\/span> to pay <span data-term-id=\"56409936\">income taxes<\/span> is a serious crime. <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/tax-evasion-and-fraud.html\">Deliberate fraud<\/a>, lying on your returns, or <span data-term-id=\"56409966\">unreported income<\/span> can all result in criminal penalties. If the <span data-term-id=\"56409924\">IRS<\/span> determines you defrauded the government, you will face <span data-term-id=\"56409928\">jail time<\/span> and stiff <span data-term-id=\"56409957\">financial penalties<\/span>. Some of the charges may include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"56409925\">Tax evasion<\/span><\/strong>: Falsifying your return, <span data-term-id=\"56409979\">underreporting income<\/span>, or other acts are serious crimes with stiff <span data-term-id=\"56409941\">prison sentences<\/span><\/li>\n<li><strong>Conspiracy to commit <span data-term-id=\"56409927\">tax fraud<\/span><\/strong>: Helping someone else avoid paying taxes via money laundering or other methods can result in up to five years\u2019 imprisonment<\/li>\n<li><strong>Intentional failure to file a return<\/strong>: Failing to file a return can result in up to one year\u2019s imprisonment for every year you fail to file<\/li>\n<\/ul>\n<p>These are penalties for deliberate acts of <span data-term-id=\"56409925\">tax evasion<\/span>. <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/income-tax-fraud-vs-negligence.html\"><span data-term-id=\"56409947\">Honest mistakes<\/span> on your <span data-term-id=\"56409923\">tax return<\/span><\/a> will not land you in prison. The <span data-term-id=\"56409975\">Internal Revenue Service<\/span> (<span data-term-id=\"56409924\">IRS<\/span>)\u00a0does not initiate civil or criminal proceedings against <span data-term-id=\"56409926\">taxpayers<\/span> unless they intentionally violate\u00a0<a href=\"https:\/\/www.findlaw.com\/tax.html\">U.S. <span data-term-id=\"56409940\">tax laws<\/span><\/a>.<\/p>\n<h2>What Happens When You Can\u2019t Pay<\/h2>\n<p>If you can\u2019t pay or have just made a mistake, the\u00a0<span data-term-id=\"56409924\">IRS<\/span>\u00a0would rather work out a solution than hit you with a <span data-term-id=\"56409935\">criminal charge<\/span>. They prefer\u00a0that <span data-term-id=\"56409926\">taxpayers<\/span>\u00a0be free to pay their\u00a0taxes rather than face <span data-term-id=\"56409928\">jail time<\/span>. Here are some examples of <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/the-irs-collection-process.html\">how the <span data-term-id=\"56409924\">IRS<\/span> collects <span data-term-id=\"56409938\">back taxes<\/span><\/a>:<\/p>\n<ul>\n<li>Before they send you any notices, the <span data-term-id=\"56409924\">IRS<\/span> simply attaches <span data-term-id=\"56409973\">late payment penalties<\/span> and interest to your existing <span data-term-id=\"56409937\">tax bill<\/span>. Unless you have a business or owe a very large <span data-term-id=\"56409948\">tax debt<\/span>, the <span data-term-id=\"56409924\">IRS<\/span> will not file collections immediately.<\/li>\n<li>If you miss one year and file the next, the <span data-term-id=\"56409924\">IRS<\/span> may use your refund from one <span data-term-id=\"56409943\">tax year<\/span> to offset any owed taxes. The money you would have received is instead applied to what you owed the previous <span data-term-id=\"56409943\">tax year<\/span>.<\/li>\n<li>At some point, they will send you a Notice of Taxes Due or a Tax Lien. At this point, they have started formal collections. You should consider <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">contacting a <span data-term-id=\"56409934\">tax attorney<\/span><\/a> for guidance and assistance.<\/li>\n<\/ul>\n<p>The <span data-term-id=\"56409924\">IRS<\/span> can place a <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/how-to-stop-an-irs-tax-levy.html\">tax lien or tax levy<\/a> on your property. A tax levy allows the <span data-term-id=\"56409924\">IRS<\/span> to seize any property they want to pay off your <span data-term-id=\"56409938\">back taxes<\/span>. They may file a wage garnishment, force a property sale, and do other things to pay off the bill.<\/p>\n<h2>Resolving Your <span data-term-id=\"56409948\">Tax Debt<\/span><\/h2>\n<p>If you have more <span data-term-id=\"56409948\">tax debt<\/span> than you can afford to pay, ignoring it won\u2019t make it go away. Disregarding <span data-term-id=\"56409968\">IRS<\/span><span data-term-id=\"56409968\"> notices<\/span> is where most people get into trouble if they have not deliberately committed <span data-term-id=\"56409927\">tax fraud<\/span>.<\/p>\n<p>The <span data-term-id=\"56409924\">IRS<\/span> will locate you and start collection proceedings. The longer you wait, the higher the <span data-term-id=\"56409969\">civil penalties<\/span> and fines you will face. A <span data-term-id=\"56409956\">CPA<\/span>, <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56409934\">tax attorney<\/span><\/a>, or other <span data-term-id=\"56409953\">tax professional<\/span> can help you arrange a <span data-term-id=\"56409930\">payment plan<\/span> with the <span data-term-id=\"56409924\">IRS<\/span> and avoid other penalties.<\/p>\n<h3><span data-term-id=\"56409965\">Installment Agreements<\/span><\/h3>\n<p>The <span data-term-id=\"56409924\">IRS<\/span> has arrangements based on your assets and ability to pay over time already set up on its website. Some <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/the-irs-installment-agreement.html\">types of installment plans<\/a> include:<\/p>\n<ul>\n<li><strong>Individual agreement<\/strong>: If you owe less than $10,000 and can pay back the amount in less than three years, this plan lets you pay the taxes back in monthly installments<\/li>\n<li><strong>Streamlined installments<\/strong>: If you owe less than $50,000 and can pay the amount back in 72 months with the minimum payment, streamlined payments are available with payment of a fee<\/li>\n<li><strong>Partial payment installment:<\/strong> Lets you pay off part of your <span data-term-id=\"56409946\">tax liability<\/span> with a financial review every two years, and the possibility of selling off some assets to pay part of your <span data-term-id=\"56409948\">tax debt<\/span><\/li>\n<li><strong>Non-streamlined <span data-term-id=\"56409965\">installment agreement<\/span>:<\/strong> Can be negotiated if you owe more than $50,000 in taxes, you and the\u00a0<span data-term-id=\"56409924\">IRS<\/span>\u00a0can agree on the payment amount, and the\u00a0<span data-term-id=\"56409924\">IRS<\/span>\u00a0doesn\u2019t reject your proposal if it disagrees with your living expenses and other costs<\/li>\n<\/ul>\n<p>All <span data-term-id=\"56409965\">installment agreements<\/span> require <span data-term-id=\"56409926\">taxpayers<\/span> to provide detailed information, including\u00a0<span data-term-id=\"56409960\">bank account<\/span>\u00a0details, living and <span data-term-id=\"56409970\">business expenses<\/span>, assets, and other debts.<\/p>\n<h3><span data-term-id=\"56409932\">Offer in Compromise<\/span><\/h3>\n<p>If you are unable to pay your debt via a <span data-term-id=\"56409930\">payment plan<\/span>, you may make an <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-an-offer-in-compromise-.html\"><span data-term-id=\"56409932\">offer in compromise<\/span><\/a> (OIC). This is an agreement to pay a lump sum that is less than your total debt but more than you could pay under a <span data-term-id=\"56409930\">payment plan<\/span>. The <span data-term-id=\"56409924\">IRS<\/span> will not accept an <span data-term-id=\"56409932\">offer in compromise<\/span> unless:<\/p>\n<ul>\n<li><strong>Your assets and income are not sufficient to cover the <span data-term-id=\"56409948\">tax debt<\/span> through a regular monthly plan<\/strong>: The <span data-term-id=\"56409924\">IRS<\/span> cannot garnish more than a certain percentage of your gross wages, so if you lack the income and assets to pay the debt, an OIC is preferable<\/li>\n<li><strong>You may not be liable for the taxes<\/strong>: If you are not sure you owe the full tax amount but are unwilling to go to litigation, you can offer an OIC to settle the dispute without admitting guilt if you have enough evidence to support your claim and offer enough in compromise to clear the debt<\/li>\n<li><strong>There are special circumstances<\/strong>: Even if you genuinely owe the tax and could pay, you can make an argument that paying the full taxes on a monthly installment plan would cause you undue financial hardship or otherwise be unfair<\/li>\n<\/ul>\n<p>Negotiating an OIC requires legal assistance. You should contact a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56409934\">tax attorney<\/span><\/a> before attempting any sort of <span data-term-id=\"56409932\">offer in compromise<\/span> to reduce your <span data-term-id=\"56409946\">tax liability<\/span>.<\/p>\n<h2><span data-term-id=\"56409964\">Statute of Limitations<\/span> for <span data-term-id=\"56409935\">Criminal Charges<\/span><\/h2>\n<p>If the government is going to file <span data-term-id=\"56409935\">criminal charges<\/span> against you for failing to pay your taxes, there is a limited time for doing so. Depending on the nature of the alleged wrongdoing, <span data-term-id=\"56409935\">criminal\u00a0<\/span><a href=\"https:\/\/www.irs.gov\/irm\/part9\/irm_09-001-003\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56409935\">charges<\/span> must generally be filed within six years<\/a>\u00a0of the violation.<\/p>\n<p>The <span data-term-id=\"56409924\">IRS<\/span> also has a time limit on collections. In most instances, the <span data-term-id=\"56409924\">IRS<\/span> will not take <span data-term-id=\"56409972\">collection action<\/span> after 10 years from the date of the assessment. If you filed a return 10 years ago but\u00a0never paid the associated taxes, the <span data-term-id=\"56409924\">IRS<\/span> will not try and collect on the <span data-term-id=\"56409933\">unpaid taxes<\/span>. You also will not be criminally charged.<\/p>\n<h2>Still Have Questions?
