This is why it\u2019s crucial that you work hard to stop the levy before it even starts. The government relies heavily on your CIS when determining your eligibility for a <a href=\"https:\/\/www.irs.gov\/payments\/payment-plans-installment-agreements\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56390171\">payment plan<\/span><\/a>, <span data-term-id=\"56390173\">Offer in Compromise<\/span>, or Currently Not <span data-term-id=\"56390207\">Collectible<\/span><span data-term-id=\"56390207\"> Status<\/span>.<\/p>\n<p>Specifically, you must submit the following information in your CIS (Form 433-F):<\/p>\n<ul>\n<li>Income<\/li>\n<li>Expenses<\/li>\n<li>Assets<\/li>\n<li>Liabilities<\/li>\n<\/ul>\n<p>Based on the information you provide in your CIS, the government may approve one of the options below.<\/p>\n<h3><span data-term-id=\"56390170\">Installment Agreement<\/span> (<span data-term-id=\"56390171\">Payment Plan<\/span>)<\/h3>\n<p>This is the most common solution. An <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/the-irs-installment-agreement.html\"><span data-term-id=\"56390170\">installment agreement<\/span><\/a> is a formal plan with the IRS to make manageable monthly payments toward your <span data-term-id=\"56390166\">tax debt<\/span>. As long as you make your payments on time, the IRS will cease all other <span data-term-id=\"56390176\">collection actions<\/span>. <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">An attorney<\/a> can help negotiate a payment amount that fits your budget.<\/p>\n<h3><span data-term-id=\"56390173\">Offer in Compromise<\/span> (OIC)<\/h3>\n<p>An OIC allows eligible <span data-term-id=\"56390165\">taxpayers<\/span> to <a href=\"https:\/\/money.usnews.com\/money\/personal-finance\/debt-settlement\/articles\/how-to-avoid-paying-taxes-on-debt-settlement\" target=\"_blank\" rel=\"noopener\">settle their <span data-term-id=\"56390166\">tax debt<\/span><\/a> for less than the <span data-term-id=\"56390174\">full amount<\/span> owed. The IRS evaluates OICs on a case-by-case basis. To qualify, you must prove, through detailed financial disclosure, that you do not have the income or assets to pay the <span data-term-id=\"56390174\">full amount<\/span>.<\/p>\n<p>An OIC is a complex legal negotiation. This will pause <span data-term-id=\"56390176\">collection actions<\/span>, including levies.<\/p>\n<p>Be aware that under a CNC, your debt does not go away. While it provides temporary relief, <a href=\"https:\/\/www.irs.gov\/payments\/penalties\" target=\"_blank\" rel=\"noopener\">interest and penalties<\/a> continue to accrue. The IRS will review your <span data-term-id=\"56390199\">financial situation<\/span> to see if your ability to pay has changed.<\/p>\n<h2>Can You Dispute the Alleged <span data-term-id=\"56390184\">Estimated Taxes<\/span> Owed?<\/h2>\n<p>If you disagree with the amount of tax the IRS alleges you owe, you do have recourse. You can respond in writing to the original notice of tax deficiency. You can also <a href=\"https:\/\/www.irs.gov\/newsroom\/taxpayers-can-appeal-when-they-disagree-with-an-irs-decision\" target=\"_blank\" rel=\"noopener\">request a reconsideration<\/a> of the <span data-term-id=\"56390166\">tax debt<\/span>. When you do so, remember to include all supporting documentation.<\/p>\n<p>If the IRS doesn\u2019t agree with your dispute, you can file an appeal with the <a href=\"https:\/\/www.irs.gov\/about-irs\/a-closer-look-at-the-irs-independent-office-of-appeals\" target=\"_blank\" rel=\"noopener\">IRS Independent Office of Appeals<\/a>. This panel will take a second look at your reconsideration request and make its own determination as to the debt\u2019s validity.<\/p>\n<p>If this doesn\u2019t work, you can opt to petition the tax court for a final review. However, this is a last resort and, unless you owe a significant amount in <span data-term-id=\"56390178\">back taxes<\/span>, not the most prudent move.<\/p>\n<p>If you choose to dispute the debt, you may want to consult an <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">experienced tax attorney<\/a>. An attorney can handle all communications and protect your interests.<\/li>\n<li>Your conversations with an attorney are protected: <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/do-you-need-a-lawyer\/what-is-the-attorney-client-privilege.html\">Attorney-client privilege<\/a> ensures your discussions are confidential, which is critical if you are concerned about potential wrongdoing.
