This crime involves intentionally not paying taxes by illegal means, such as underreporting income, overstating deductions, or not filing tax returns altogether. A conviction can lead to severe penalties, including prison time.<\/p>\n\n    <\/div>\n\n<p>Most people know that having <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/what-to-expect-if-you-don-t-pay-your-taxes.html\">unpaid taxes<\/a> is a serious problem. The fees and penalties can add up, significantly increasing the amount you owe the government.<\/p>\r\n<p>The good news is that owing back taxes is typically not a criminal offense. But, this doesn\u2019t mean that you\u2019ll be immune from a criminal investigation. If you attempt to avoid paying your taxes, you may face charges for criminal <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/what-is-tax-evasion.html#:~:text=Tax%20evasion%20is%20defined%20under,have%20attempted%20to%20evade%20assessment.\">tax evasion<\/a>.<\/p>\r\n<p>For example, if you <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/what-happens-if-you-dont-file-taxes-for-10-years-or-more.html\">don\u2019t file tax returns for several years<\/a>, the government will want to know why. Specifically, we\u2019ll discuss whether you can go to jail for not filing taxes.<\/p>\r\n<h2>What Is Tax Evasion?<\/h2>\r\n<p>You don\u2019t have to be an expert in <a href=\"https:\/\/www.findlaw.com\/tax\/tax-laws-forms\/federal-tax-laws.html#:~:text=Federal%20tax%20laws%20are%20how%20the%20IRS%20calculates,FindLaw%27s%20brief%20overview%20of%20the%20federal%20tax%20system.\">tax law<\/a> to know that not filing income taxes is illegal. Regardless of the amount of tax you owe, the law requires that you file a tax return every year that you earn income. If you fail to do this, you may face tax evasion charges.<\/p>\r\n<p>Tax evasion involves the nonpayment and underpayment of taxes through illegal means. The IRS must show that you acted intentionally to be found guilty of <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/tax-evasion.html\">tax evasion<\/a>. The government doesn\u2019t pursue criminal charges against someone who underpays their taxes by <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/income-tax-fraud-vs-negligence.html\">honest mistake<\/a> or due to a reasonable error.&nbsp;<\/p>\r\n<p>Generally, the IRS cannot send you to jail for late filing. Tax evasion requires that you intentionally file taxes or lie on your <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/do-i-have-to-file-a-federal-tax-return.html#:~:text=FindLaw%20explains%20who%20has%20to%20file%20a%20federal,federal%20taxes%20based%20on%20income%20and%20filing%20status.\">tax return<\/a>.<\/p>\r\n<p>In most <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/famous-tax-evasion-cases.html\">tax evasion cases<\/a>, the government must show that you falsified your tax return or submitted false documents to the Internal Revenue Service. The government must also show that you did this to underreport your income or otherwise reduce your tax bill.<\/p>\r\n<h2>Common Types of Tax Evasion<\/h2>\r\n<p>As stated above, forgetting to file your <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/filing-taxes.html\">tax return<\/a> on time or having unfiled returns does not constitute tax evasion. Nor is it illegal to make an honest mistake on your return. Tax evasion involves deliberately avoiding paying taxes or paying less than you actually owe.<\/p>\r\n<p>Some common examples of tax evasion include:<\/p>\r\n<ul>\r\n<li>Unreported income<\/li>\r\n<li>Deliberately overstating expenses or deductions<\/li>\r\n<li>Claiming illegitimate <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-a-tax-credit-.html#:~:text=A%20tax%20credit%20is%20a%20reduction%20in%20the,tax%20credits%20and%20how%20they%20differ%20from%20deductions.\">tax credits<\/a><\/li>\r\n<li>Not filing income tax returns when you have taxable income<\/li>\r\n<li>Filing a false tax return<\/li>\r\n<li>Not claiming <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/26-usc-sect-1401\/\" target=\"_blank\" rel=\"noopener\">self-employment income<\/a><\/li>\r\n<li>Falsifying information on your return to get a larger tax refund<\/li>\r\n<\/ul>\r\n<p>If you engage in any of these, there\u2019s a good chance the IRS will conduct an audit and assess late fees, interest, and tax penalties. They may also file criminal charges against you for tax evasion. If this happens, you\u2019ll face a possible prison sentence in addition to the financial penalties.<\/p>\r\n<h3>Tax Evasion vs. Tax Avoidance<\/h3>\r\n<p>Tax evasion is different than <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/tax-evasion-vs-tax-avoidance.html\">tax avoidance<\/a>. Under the U.S. Tax Code, individuals or entities who commit tax fraud may face civil and criminal fraud penalties.<\/p>\r\n<p>However, the government treats tax evasion as a criminal act. That means you may face jail time and harsh financial penalties.<\/p>\r\n<h2>Tax Evasion Penalties<\/h2>\r\n<p>There is a long list of potential penalties and consequences for tax evasion. In the grand scheme of things, you\u2019ll be better off reporting your actual income and paying your tax liability.<\/p>\r\n<p>If you engage in tax evasion or <a href=\"https:\/\/dictionary.findlaw.com\/definition\/tax-fraud.html\" target=\"_blank\" rel=\"noopener\">tax fraud<\/a>, you could face the following repercussions.<\/p>\r\n<h3>Civil Penalties<\/h3>\r\n<p>If you attempt to avoid paying taxes, the government can fine you up to $250,000. Even if the IRS doesn\u2019t formally charge you with tax evasion, it will assess fines and <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/tax-evasion-penalties-and-other-consequences.html\">penalties<\/a> if you file your return more than 60 days after the due date.<\/p>\r\n<p>The failure-to-file penalty is up to ten times more than the failure-to-pay penalty. The IRS recommends that even if you can&#8217;t pay in full, you should file your tax return and pay as much as possible. You can always negotiate a payment plan or submit an \u201c<a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-an-offer-in-compromise-.html\">Offer in Compromise<\/a>.\u201d At least this way, you\u2019ll avoid criminal liability and hefty penalties.<\/p>\r\n<h3>Interest<\/h3>\r\n<p>The <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/tax-basics-a-beginners-guide-to-taxes.html\">tax code<\/a> requires that the IRS charge taxpayers interest&nbsp;when they don&#8217;t pay their taxes on time. The government will charge interest from when your tax return is due until you pay your tax debt in full. This includes interest and IRS penalties.<\/p>\r\n<p>The interest rate you\u2019ll pay on your tax debt depends on how much you owe and how late your tax payments are. Check with your <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/26-usc-sect-6694\/\" target=\"_blank\" rel=\"noopener\">tax preparer<\/a> or CPA to see how much interest you\u2019ll have to pay.<\/p>\r\n<h3>Criminal Charges<\/h3>\r\n<p>Tax evasion is a felony&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges.html\">criminal offense<\/a>. The United States Attorney&#8217;s Office will file charges in federal court.<\/p>\r\n<p>As with most criminal prosecutions, before a judge can send you to jail, the court must find you guilty beyond a reasonable doubt. This is different than the &quot;clear and convincing evidence&quot; standard the court uses for financial penalties associated with tax fraud.<\/p>\r\n<h3>Prison Time<\/h3>\r\n<p>If the court finds you guilty of tax evasion, you\u2019ll face up to five years in <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/is-tax-evasion-a-felony-or-misdemeanor-.html\">federal prison<\/a>.<\/p>\r\n<h3>Loss of Social Security Benefits<\/h3>\r\n<p>If you owe the IRS for back taxes, the government can take 15% of your monthly Social Security benefits until you pay the tax debt in full. The government does this through the \u201c<a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/federal-payment-levy-program\" target=\"_blank\" rel=\"noopener\">Federal Payment Levy Program<\/a>.\u201d<\/p>\r\n<h3>Tax Lien on Your Property<\/h3>\r\n<p>When you owe taxes, the IRS can file a <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/how-to-resolve-a-tax-lien.html\">federal tax lien<\/a>. The lien arises automatically when you don&#8217;t pay your taxes within ten days of the IRS\u2019 tax assessment. Once the lien is in place, the IRS will send you a notice of taxes due and demand full payment.<\/p>\r\n<p>The IRS may also include a notice of the federal tax lien in the <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/is-my-legal-case-public-record\/\">public records<\/a>. This notice alerts creditors that the IRS has a claim against your property. This includes property you acquire after the IRS files its tax lien.<\/p>\r\n<p>Once it files its lien, the IRS can&#8217;t release it until you pay the tax debt, penalties, interest, and recording fees or until the <a href=\"https:\/\/dictionary.findlaw.com\/definition\/statute-of-limitation.html\" target=\"_blank\" rel=\"noopener\">statute of limitations<\/a> expires.<\/p>\r\n<h3>Loss of Personal or Real Property<\/h3>\r\n<p>Once the IRS places a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/lien.html\" target=\"_blank\" rel=\"noopener\">lien<\/a> on your real and personal property, it can put a levy on your property to pay off your tax debt. A levy is a legal seizure of your property, such as your house, car, income, bank accounts, retirement accounts, and Social Security payments. The IRS will seize this property and, where possible, sell it, using the proceeds&nbsp;to satisfy your tax debt.<\/p>\r\n<h3>Damage to Your Credit<\/h3>\r\n<p>The filing of a \u201cNotice of Federal Tax Lien\u201d will not appear on your&nbsp;<a href=\"https:\/\/corporate.findlaw.com\/business-operations\/checking-your-credit-report.html\" target=\"_blank\" rel=\"noopener\">credit report<\/a>. However, it is a public record and can make it challenging to secure a loan.<\/p>\r\n<h3>Loss of Passport<\/h3>\r\n<p>The Department of State will not issue or renew your <a href=\"https:\/\/dictionary.findlaw.com\/definition\/passport.html\" target=\"_blank\" rel=\"noopener\">passport<\/a> if you have a seriously delinquent tax debt. It may also revoke a passport it previously issued to the taxpayer.<\/p>\r\n<h2>Additional Questions?
