While some are more complex than others, every tax question has an answer (although you may not like it). This includes those concerned with <span data-term-id=\"56412483\">IRS<\/span> debt and how long the agency has to collect.<\/p>\n<p>The short answer is that the <span data-term-id=\"56412483\">IRS<\/span> cannot try to collect <span data-term-id=\"56412515\">back taxes<\/span> forever, but it\u2019s not quite that simple. This article examines and explains the <span data-term-id=\"56412500\">amount of time<\/span> the <span data-term-id=\"56412483\">IRS<\/span> has to find you and collect taxes, which depends on when you filed and whether you took any actions to pay your overdue taxes during that time. If you owe the <span data-term-id=\"56412483\">IRS<\/span>, consider speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56412516\">tax attorney<\/span><\/a>.<\/p>\n<h2>The Two <span data-term-id=\"56412508\">IRS<\/span> <span data-term-id=\"56412490\">Statutes of Limitation<\/span><\/h2>\n<p>There is no single <span data-term-id=\"56412508\">IRS<\/span> <span data-term-id=\"56412490\">statute of limitations<\/span>. The <span data-term-id=\"56412483\">IRS<\/span> can assess your <span data-term-id=\"56412525\">taxes due<\/span> for any <span data-term-id=\"56412533\">tax year<\/span> for three years from either of the following, based on whichever is later:<\/p>\n<ul>\n<li>The date of the return<\/li>\n<li>The <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/filing-taxes.html\">date of filing<\/a><\/li>\n<\/ul>\n<p>The <span data-term-id=\"56412497\">tax assessment<\/span> means an <span data-term-id=\"56412483\">IRS<\/span> officer has reviewed your taxes and affirmed the amount owed to the government. The April 15 <span data-term-id=\"56412520\">due date<\/span> is the start date for the three-year assessment period, so when you file your taxes does not affect that.<\/p>\n<p>The <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/the-irs-collection-process.html\"><span data-term-id=\"56412509\">10-year <\/span><span data-term-id=\"56412493\">collection period<\/span><\/a> or <span data-term-id=\"56412492\">Collection Statute Expiration Date<\/span> (<span data-term-id=\"56412491\">CSED<\/span>) begins on the date of the <span data-term-id=\"56412497\">tax assessment<\/span>. In theory, the collection process could last up to 13 years from the date of your last filing: three years from the date of the return, and 10 years from the date of the assessment.<\/p>\n<p>The <span data-term-id=\"56412491\">CSED<\/span> prevents the\u00a0<span data-term-id=\"56412483\">IRS<\/span>\u00a0from collecting on\u00a0<span data-term-id=\"56412528\">income <\/span><span data-term-id=\"56412486\">tax<\/span><span data-term-id=\"56412528\"> returns<\/span>\u00a0filed decades ago and blocks the agency from collecting on <span data-term-id=\"56412511\">unpaid taxes<\/span> forever. However, some <span data-term-id=\"56412484\">taxpayer<\/span> actions can halt the statute and give the <span data-term-id=\"56412483\">IRS<\/span> more time to collect your taxes.<\/p>\n<h2>Running Out the Clock<\/h2>\n<p>Can you just not file or wait out the <span data-term-id=\"56412483\">IRS<\/span>? You can try, but success is unlikely. The <span data-term-id=\"56412491\">CSED<\/span> is not a magic \u201cavoid taxes and jail\u201d card. The <span data-term-id=\"56412502\">IRS<\/span> <span data-term-id=\"56412524\">collection<\/span> <span data-term-id=\"56412490\">statute of limitations<\/span> begins when you file a <span data-term-id=\"56412486\">tax return<\/span>. If you never file, the statute never begins. The <span data-term-id=\"56412483\">IRS<\/span> can begin collections whenever it learns you owe taxes. The agency has other means of collecting delinquent taxes, which makes it a good idea to consult a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56412529\">tax professional<\/span><\/a> if you have long-overdue taxes.<\/p>\n<p>Certain actions, such as filing an <span data-term-id=\"56412506\">amended return<\/span> or calling the <span data-term-id=\"56412483\">IRS<\/span> to offer to pay your delinquent taxes, could make things worse by <span data-term-id=\"56412513\">tolling<\/span> (pausing) the deadline. If you\u2019re in this situation, consider speaking with a <span data-term-id=\"56412516\">tax attorney<\/span> before contacting the <span data-term-id=\"56412483\">IRS<\/span>.<\/p>\n<h2><span data-term-id=\"56412513\">Tolling<\/span>: How You Can Accidentally Stop the Clock<\/h2>\n<p>\u201c<span data-term-id=\"56412513\">Tolling<\/span>\u201d is a legal term for a pause. <span data-term-id=\"56412513\">Tolling<\/span> a deadline means extending it for a certain <span data-term-id=\"56412514\">time period<\/span> for legal reasons. For example, if someone cannot file a lawsuit because they are underage, the law extends, or &#8220;tolls,&#8221; the time to file their lawsuit until they are old enough.<\/p>\n<p>In the case of the <span data-term-id=\"56412524\">collection <\/span><span data-term-id=\"56412490\">statute of limitations<\/span>, certain actions can extend the time the <span data-term-id=\"56412483\">IRS<\/span> has to collect your taxes. If you do not want this to happen, try to avoid doing any of these things without talking to your attorney first:<\/p>\n<h3>Request an <span data-term-id=\"56412485\">Installment Agreement<\/span><\/h3>\n<p><span data-term-id=\"56412484\">Taxpayers<\/span> may request an <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/the-irs-installment-agreement.html\"><span data-term-id=\"56412485\">installment agreement<\/span><\/a> when they owe the\u00a0<span data-term-id=\"56412483\">IRS<\/span> money. You can pay your <span data-term-id=\"56412515\">back taxes<\/span> over a period of time, usually three to six years. An <span data-term-id=\"56412485\">installment agreement<\/span> prevents the <span data-term-id=\"56412483\">IRS<\/span> from executing any tax levies against you during that period. As long as you stay current on your <span data-term-id=\"56412485\">installment agreement<\/span> and file your <span data-term-id=\"56412486\">tax returns<\/span> annually, the <span data-term-id=\"56412483\">IRS<\/span> cannot continue any collection procedures.<\/p>\n<p>There are several types of <span data-term-id=\"56412527\">payment plans<\/span> depending on the amount of your <span data-term-id=\"56412515\">back taxes<\/span>. The <span data-term-id=\"56412483\">IRS<\/span> prefers monthly payments. If you miss any, the <span data-term-id=\"56412483\">IRS<\/span> can resume collections immediately.<\/p>\n<h3><span data-term-id=\"56412488\">Offer in Compromise<\/span><\/h3>\n<p>If you can\u2019t pay your <span data-term-id=\"56412515\">back taxes<\/span> in full or make a monthly installment payment, you can make an <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-an-offer-in-compromise-.html\"><span data-term-id=\"56412488\">offer in compromise<\/span> (<span data-term-id=\"56412495\">OIC<\/span>)<\/a>. Like an installment offer, the\u00a0<span data-term-id=\"56412483\">IRS<\/span>\u00a0cannot collect while it considers your offer. If they reject the offer, the collection process will resume. There is no <span data-term-id=\"56412535\">time limit<\/span> for negotiating an <span data-term-id=\"56412495\">OIC<\/span>, but the procedure tolls the collections process while you and your attorney arrange the details with the <span data-term-id=\"56412483\">IRS<\/span>.<\/p>\n<h3>Request for a Due Process Hearing<\/h3>\n<p>You can request a <a href=\"https:\/\/www.irs.gov\/appeals\/collection-due-process-cdp-faqs\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56412505\">collection due process<\/span><span data-term-id=\"56412505\"> hearing<\/span> (<span data-term-id=\"56412521\">CDP<\/span>)<\/a>. The <span data-term-id=\"56412483\">IRS<\/span> must send you notice of an intent to file liens and other actions during the process. If you believe you have not received these properly, or that there have been other violations of your right to due process, you can request a hearing to challenge the collection process. You have 30 days to do this.<\/p>\n<p>You should not request a <span data-term-id=\"56412521\">CDP<\/span> without first consulting an attorney. If the hearing officer denies your request or you lose your challenge, the collections process resumes immediately.<\/p>\n<h3>Other Things that Toll Collections<\/h3>\n<p>The collections process is also tolled if:<\/p>\n<ul>\n<li>You have filed for bankruptcy<\/li>\n<li>You are serving in the military or live outside the U.S.<\/li>\n<li>Your case is in the U.S. <span data-term-id=\"56412504\">tax court<\/span><\/li>\n<\/ul>\n<p>These actions all give the <span data-term-id=\"56412483\">IRS<\/span> additional time beyond the <span data-term-id=\"56412532\">10-year <\/span><span data-term-id=\"56412490\">statute of limitations<\/span> to collect <span data-term-id=\"56412515\">back taxes<\/span> and any additional fines and penalties. You can also file a <span data-term-id=\"56412503\">waiver<\/span> to extend the limitations period if the period is about to expire and you want to keep the <span data-term-id=\"56412483\">IRS<\/span> from taking <span data-term-id=\"56412517\">collection actions<\/span>.<\/p>\n<h2>When the <span data-term-id=\"56412490\">Statute of Limitations<\/span> Does Not Apply<\/h2>\n<p>There are instances in which the statute does not affect the collection process. The <span data-term-id=\"56412483\">IRS<\/span> can begin assessment and collection proceedings without limitations if:<\/p>\n<ul>\n<li>Someone files a <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/tax-evasion-and-fraud.html\">false or <span data-term-id=\"56412531\">fraudulent<\/span><\/a><span data-term-id=\"56412531\">\u00a0return<\/span><\/li>\n<li>Committed <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/what-is-tax-evasion.html\">intentional <span data-term-id=\"56412526\">tax evasion<\/span><\/a> (as opposed to carelessness or negligence)<\/li>\n<li>Did not file a return<\/li>\n<\/ul>\n<p><span data-term-id=\"56412537\">Tax fraud<\/span> and <span data-term-id=\"56412526\">tax evasion<\/span> are criminal offenses when committed with the deliberate intent to defraud the government. Failing to <span data-term-id=\"56412530\">file returns<\/span> with an intent to defraud can result in jail time and other <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/can-you-go-to-jail-for-not-paying-taxes.html\">criminal penalties<\/a>.<\/p>\n<p>The <span data-term-id=\"56412483\">IRS<\/span> realizes that some individuals miss the filing deadline due to simple carelessness or an inability to pay their full <span data-term-id=\"56412512\">tax liability<\/span>. You are still responsible for the full amount, plus <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/tax-penalties-quick-reference-guide.html\">interest and penalties<\/a>, when the <span data-term-id=\"56412483\">IRS<\/span> catches up with you. While the <span data-term-id=\"56412483\">IRS<\/span> can provide some answers for <a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/what-to-expect-if-you-don-t-pay-your-taxes.html\"><span data-term-id=\"56412510\">tax issues<\/span><\/a>, speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56412516\">tax attorney<\/span><\/a> before moving forward is often the best option.<\/p>\n<h2><strong>My 10-Year <span data-term-id=\"56412491\">CSED<\/span> Is Approaching. What Should I Do?<\/strong><\/h2>\n<p>Do not call or contact the <span data-term-id=\"56412483\">IRS<\/span> yourself. Calling the <span data-term-id=\"56412483\">IRS<\/span> could accidentally toll the <span data-term-id=\"56412490\">statute of limitations<\/span>. Even suggesting a <span data-term-id=\"56412527\">payment plan<\/span> or <span data-term-id=\"56412495\">OIC<\/span> could be enough to halt the <span data-term-id=\"56412491\">CSED<\/span>. Consider these options instead:<\/p>\n<ul>\n<li>You can obtain your <a href=\"https:\/\/www.irs.gov\/individuals\/get-transcript\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56412483\">IRS<\/span> <span data-term-id=\"56412534\">account transcripts<\/span><\/a> without telling the <span data-term-id=\"56412483\">IRS<\/span> why you need them. If you believe your deadline is approaching, do this as soon as possible. The <span data-term-id=\"56412483\">IRS<\/span> website lets you download a copy, or you can request one by mail.<\/li>\n<li>Contact a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56412516\">tax attorney<\/span><\/a>. The attorney can review the transcript and determine the actual <span data-term-id=\"56412491\">CSED<\/span>. Confirmation that the ten years are up lets you know if you\u2019re beyond possible <span data-term-id=\"56412517\">collection actions<\/span>. The attorney can also check for unrecognized <span data-term-id=\"56412513\">tolling<\/span> actions or other delays.<\/li>\n<\/ul>\n<p>A tax lawyer will then explain your best options. These may include waiting it out or contacting the <span data-term-id=\"56412483\">IRS<\/span> if the deadline is farther away than you thought. If the <span data-term-id=\"56412483\">IRS<\/span> has already begun tax <span data-term-id=\"56412517\">collection actions<\/span>, such as <span data-term-id=\"56412507\">tax liens<\/span> and levies, a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56412516\">tax attorney<\/span><\/a> can help with contacting the <span data-term-id=\"56412483\">IRS<\/span> and arranging <span data-term-id=\"56412527\">payment plans<\/span> or other repayment methods.<\/p>\n<h2>Get Legal Advice From a <span data-term-id=\"56412516\">Tax Attorney<\/span><\/h2>\n<p>If you have unpaid <span data-term-id=\"56412499\">federal taxes<\/span> and believe the <span data-term-id=\"56412493\">collection period<\/span> is due to expire, consider speaking to a <a href=\"https:\/\/lawyers.findlaw.com\/taxation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">local tax lawyer<\/a>\u00a0as soon as possible. <span data-term-id=\"56412511\">Unpaid taxes<\/span> may also involve your state tax collector, so local <span data-term-id=\"56412529\">tax professionals<\/span> can give you advice about how to manage your state collection agencies as well.
