They are\u00a0<a href=\"https:\/\/academic.oup.com\/gerontologist\/article\/57\/1\/121\/2801284?login=false\" target=\"_blank\" rel=\"noopener\">less likely to seek out health services<\/a>, which leads to higher rates of chronic illnesses and eventual reliance on\u00a0<a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/social-security-disability-explained.html\"><span data-term-id=\"58795151\">Social Security<\/span> disability<\/a>\u00a0payments as a primary source of income as they age.<\/li>\n<\/ul>\n<p>In addition to disability, <span data-term-id=\"58795151\">Social Security<\/span> retirement and survivors benefits are crucial financial safety nets for LGBTQ+ OA. Survivors benefits were only made available less than a decade ago, following the U.S. <span data-term-id=\"58795168\">Supreme Court<\/span> decision in\u00a0<a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/obergefell-v--hodges-case-summary-and-significance.html\" target=\"_blank\" rel=\"noopener\"><em>Obergefell v. Hodges<\/em><\/a>\u00a0(2015) that states must recognize marriages between <span data-term-id=\"58795180\">same-sex<\/span><span data-term-id=\"58795180\"> couples<\/span>.<\/p>\n<h2><span data-term-id=\"58795149\">LGBTQ+ Older Adults<\/span> and <span data-term-id=\"58795151\">Social Security<\/span><\/h2>\n<p>The <span data-term-id=\"58795151\">Social Security<\/span> taxes you pay cover three types of \u00a0<a href=\"https:\/\/www.ssa.gov\/pubs\/EN-05-10014.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58795151\">Social Security<\/span> benefits<\/a>:<\/p>\n<ul>\n<li>Retirement<\/li>\n<li>Disability<\/li>\n<li>Survivors<\/li>\n<\/ul>\n<p>If you are eligible for <span data-term-id=\"58795151\">Social Security<\/span> payments, your spouse and children may also get benefits. This is why <a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/obergefell-v--hodges-case-summary-and-significance.html\" target=\"_blank\" rel=\"noopener\"><em>Obergefell v. Hodges<\/em><\/a> is so critical. It finally guaranteed that same\u2011sex marriages must be legally recognized nationwide.<\/p>\n<h3>What Is <span data-term-id=\"58795151\">Social Security<\/span>?<\/h3>\n<p><span data-term-id=\"58795151\">Social Security<\/span>, also known as the\u00a0<a href=\"https:\/\/www.ssa.gov\/policy\/docs\/statcomps\/supplement\/2022\/oasdi.html\" target=\"_blank\" rel=\"noopener\">Old Age, Survivors, and Disability Insurance program<\/a>\u00a0(OASDI), is the largest federal income-maintenance program in the United States. It is funded primarily through payroll taxes paid by covered workers and their employers.<\/p>\n<p>The <span data-term-id=\"58795151\">Social Security<\/span> Act of 1935 created the\u00a0<a href=\"https:\/\/www.ssa.gov\/history\/orghist.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58795151\">Social Security<\/span> Administration<\/a>, the federal agency that administers all programs.<\/p>\n<ul>\n<li><a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/RL\/RL30920\" target=\"_blank\" rel=\"noopener\">Title II<\/a>\u00a0of the <span data-term-id=\"58795151\">Social Security<\/span> Act of 1935 (the Act) authorizes monthly cash benefits to covered retired workers (Retirement), disabled workers (SSDI), and eligible surviving beneficiaries of deceased workers.<\/li>\n<li><a href=\"https:\/\/www.ssa.gov\/OP_Home\/ssact\/title16b\/1600.htm\" target=\"_blank\" rel=\"noopener\">Title XVI<\/a>\u00a0of the Act authorizes monthly cash benefits (SSI) to persons who are aged 65 or older, disabled, or blind, and who lack the income and the work credits to receive benefits under Title II.<\/li>\n<\/ul>\n<p><span data-term-id=\"58795151\">Social Security<\/span> is the primary\u00a0<a href=\"https:\/\/www.ssa.gov\/news\/press\/factsheets\/basicfact-alt.pdf\" target=\"_blank\" rel=\"noopener\">source of income<\/a>\u00a0for the majority of older adults,\u00a0including <span data-term-id=\"58795149\">LGBTQ+ older adults<\/span>. However, the\u00a0<a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/IF\/IF10426\" target=\"_blank\" rel=\"noopener\">Congressional Research Service<\/a>\u00a0reports that this essential program may be unable to pay full benefits as currently allotted beginning in 2035.<\/p>\n<h3><span data-term-id=\"58795151\">Social Security<\/span> Disability Insurance<\/h3>\n<p><span data-term-id=\"58795151\">Social Security<\/span> Disability Insurance (SSDI) pays benefits to people who cannot work due to a\u00a0qualifying medical condition\u00a0that is expected to last at least one year or result in death. In order to receive SSDI, you must:<\/p>\n<ul>\n<li>Meet <span data-term-id=\"58795151\">Social Security<\/span>\u2019s\u00a0<a href=\"https:\/\/www.findlaw.com\/socialsecurity\/disability\/how-is-social-security-disability-defined.html\">strict definition of disability<\/a>;\u00a0and<\/li>\n<li>Have the required years of\u00a0employment\u00a0in which you paid <span data-term-id=\"58795151\">Social Security<\/span> taxes.<\/li>\n<\/ul>\n<p>Whatever your age when you claim SSDI, <span data-term-id=\"58795151\">Social Security<\/span> sets your monthly benefit payment as though you had reached\u00a0<a href=\"https:\/\/www.ssa.gov\/benefits\/retirement\/planner\/ageincrease.html\" target=\"_blank\" rel=\"noopener\">full retirement age<\/a>\u00a0(FRA), when you become eligible for unreduced <span data-term-id=\"58795151\">Social Security<\/span> retirement benefits based on your lifetime earnings. Your FRA depends on your date of birth. For example, if you were born between 1943 and 1954, your FRA is 66. If you are receiving SSDI when you reach FRA, your disability benefit will\u00a0automatically convert\u00a0over to your Retirement benefit.<\/p>\n<h3>Supplemental Security Income<\/h3>\n<p>If you are aged 65 or older, blind, or have a qualifying medical condition that prevents you from working, you may be eligible for\u00a0<a href=\"https:\/\/www.ssa.gov\/pubs\/EN-05-11000.pdf\" target=\"_blank\" rel=\"noopener\">Supplemental Security Income<\/a>\u00a0(SSI), a monthly benefit for people who are <span data-term-id=\"58795156\">low-income<\/span> and have limited resources. If you qualify for SSI, you may also be eligible for:<\/p>\n<ul>\n<li>Food assistance through\u00a0SNAP<\/li>\n<li><span data-term-id=\"58795160\">Health insurance<\/span> coverage through <span data-term-id=\"58795153\">Medicare<\/span> and\/or\u00a0<span data-term-id=\"58795144\">Medicaid<\/span><\/li>\n<li>Other <span data-term-id=\"58795173\">social services<\/span> provided <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">through your state<\/a><\/li>\n<\/ul>\n<h2>Applying for Disability: A Timeline<\/h2>\n<p>Here are the steps in the <span data-term-id=\"58795151\">Social Security<\/span> Disability application process:<\/p>\n<ol>\n<li><strong>Information gathering:\u00a0<\/strong><a href=\"https:\/\/www.ssa.gov\/hlp\/radr\/10\/ovw001-checklist.pdf\" target=\"_blank\" rel=\"noopener\">Gather the information<\/a>\u00a0<span data-term-id=\"58795151\">Social Security<\/span> will ask for before starting the application process.<\/li>\n<li><strong>Application:<\/strong>\u00a0You can\u00a0<a href=\"https:\/\/www.ssa.gov\/applyfordisability\/\" target=\"_blank\" rel=\"noopener\">apply online<\/a>\u00a0or make an appointment with your local\u00a0<a href=\"https:\/\/secure.ssa.gov\/ICON\/main.jsp\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58795151\">Social Security<\/span> Field Office<\/a>. If you choose to apply online, you can ask your <span data-term-id=\"58795141\">caregiver<\/span>, partner, friend, or chosen <span data-term-id=\"58795165\">family member<\/span> for\u00a0<a href=\"https:\/\/www.ssa.gov\/benefits\/retirement\/planner\/thirdparty.html#h1\" target=\"_blank\" rel=\"noopener\">help completing the application<\/a>. You can also select one of those people to act as your formal\u00a0<a href=\"https:\/\/www.ssa.gov\/pubs\/EN-05-10075.pdf\" target=\"_blank\" rel=\"noopener\">SSA Representative<\/a>\u00a0or consult with a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/social-security-disability\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">disability attorney<\/a>\u00a0near you.<\/li>\n<li><strong>DDS review:\u00a0<\/strong>Once your application is submitted, it will be assigned to your state\u2019s Disability Determination Services (DDS) office. The DDS office will collect and review your medical records. You will be assigned a DDS caseworker who may mail you additional forms to fill out (e.g.,\u00a0<a href=\"https:\/\/www.ssa.gov\/forms\/ssa-3369.pdf\" target=\"_blank\" rel=\"noopener\">Work History<\/a>\u00a0Report,\u00a0<a href=\"https:\/\/www.ssa.gov\/forms\/ssa-3373-bk.pdf\" target=\"_blank\" rel=\"noopener\">Adult Function<\/a>\u00a0Report). It is important that you complete and return all forms to DDS on time.<\/li>\n<li><strong>Medical exams:<\/strong>\u00a0DDS may also schedule a Consultative Examination (CE) and\/or Mental Status Examination (ME) with a doctor authorized by the SSA to independently assess your medical condition(s). DDS will mail you a written notification with the appointment location, date, and time. It is important that you attend these appointment(s), which will be at no cost to you.<\/li>\n<li><strong>Notice of decision:<\/strong>\u00a0Once DDS makes its disability determination, <span data-term-id=\"58795151\">Social Security<\/span> will mail you a written notice of its decision.<\/li>\n<li><strong>Appeal:\u00a0<\/strong>If your claim is denied, you can appeal by submitting a\u00a0<a href=\"https:\/\/www.ssa.gov\/forms\/ssa-561.html\" target=\"_blank\" rel=\"noopener\">Request for Reconsideration<\/a>\u00a0within 60 days of the date on the decision letter. Consider consulting with a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/social-security-disability\/?fli-dcta\" target=\"_blank\" rel=\"noopener\">disability attorney<\/a>\u00a0near you for help with the appeal process, which can be lengthy and complicated.\u00a0You can also reach out to a\u00a0<a href=\"https:\/\/www.findlaw.com\/pro-bono-resource-center\/free-legal-resources\/legal-aid-and-pro-bono-organizations-by-state.html\">legal aid organization<\/a>\u00a0in your area. If you meet income <span data-term-id=\"58795167\">eligibility<\/span> and other requirements, most legal aid organizations assist with <span data-term-id=\"58795151\">Social Security<\/span> appeals free of charge.<\/li>\n<\/ol>\n<h3>Continuing Disability Review<\/h3>\n<p>Generally, your disability benefits continue as long as your medical conditions are severe enough to prevent you from working. SSA will periodically review your medical records to determine whether your medical conditions are likely to improve, as part of the\u00a0<a href=\"https:\/\/www.ssa.gov\/ssi\/text-cdrs-ussi.htm\" target=\"_blank\" rel=\"noopener\">Continuing Disability Review<\/a>\u00a0(CDR). Your annual benefits award letter tells you when to expect your CDR.<\/p>\n<h2><span data-term-id=\"58795151\">Social Security<\/span> Retirement Benefits<\/h2>\n<p><span data-term-id=\"58795151\">Social Security<\/span> retirement benefits are\u00a0<a href=\"https:\/\/www.ssa.gov\/benefits\/retirement\/planner\/credits.html#h2\" target=\"_blank\" rel=\"noopener\">earned entitlements<\/a>\u00a0paid for through payroll taxes taken directly from your lifetime earnings. SSA calculates your monthly retirement benefit based on the payroll taxes you contributed during your working years.<\/p>\n<p>This means that in order to qualify for retirement benefits, you must contribute <span data-term-id=\"58795151\">Social Security<\/span> taxes for the minimum amount of time set by SSA. Persons born in 1929 or later need\u00a0<a href=\"https:\/\/www.ssa.gov\/pubs\/EN-05-10072.pdf\" target=\"_blank\" rel=\"noopener\">10 years of work<\/a>\u00a0(40 credits) to be eligible for retirement benefits.<\/p>\n<p><span data-term-id=\"58795151\">Social Security<\/span> plays a significant role in retirement planning. Current data suggests that LGBTQ+ OA who are Black, Indigenous, or People of Color (BIPOC) generally retire with less income security than their white LGBTQ+ peers, in part due to\u00a0<a href=\"https:\/\/static1.squarespace.com\/static\/548f810ce4b057b610535ef2\/t\/6333338818103e65f01dd2f1\/1664299915354\/Dignity+2022_+The+Experience+of+LGBTQ+Older+Adults_FINAL.pdf\" target=\"_blank\" rel=\"noopener\">race-based discrimination in employment<\/a>\u00a0over their lifetimes. Gaps in employment and lower wages result in lower <span data-term-id=\"58795151\">Social Security<\/span> retirement benefit payments.<\/p>\n<p>Your monthly retirement benefit amount will vary based on your age when you first begin collecting benefits. You can start collecting\u00a0reduced\u00a0monthly retirement benefits at age 62, before you reach\u00a0<a href=\"https:\/\/www.ssa.gov\/OACT\/ProgData\/nra.html\" target=\"_blank\" rel=\"noopener\">full retirement age<\/a>\u00a0(FRA). Your\u00a0<a href=\"https:\/\/www.ssa.gov\/benefits\/retirement\/planner\/ageincrease.html\" target=\"_blank\" rel=\"noopener\">date of birth<\/a>\u00a0determines your FRA.<\/p>\n<p>Alternatively, you can maximize your monthly benefit\u00a0<a href=\"https:\/\/www.ssa.gov\/OACT\/quickcalc\/early_late.html#late\" target=\"_blank\" rel=\"noopener\">by delaying retirement<\/a>\u00a0until you reach age 70. In summary, if you start retirement benefits:<\/p>\n<ul>\n<li>Before FRA,\u00a0your monthly benefit will be lower, and you will receive it for a longer time.<\/li>\n<li>At FRA or later,\u00a0your monthly benefit will be higher, but you will receive it for less time.<\/li>\n<\/ul>\n<p>If you do decide to delay your retirement benefits, make sure to\u00a0<a href=\"https:\/\/www.ssa.gov\/pubs\/EN-05-10043.pdf\" target=\"_blank\" rel=\"noopener\">enroll in <span data-term-id=\"58795153\">Medicare<\/span><\/a>\u00a0when you turn 65. You can start the enrollment process up to three months before your 65th birthday. Failing to sign up for <span data-term-id=\"58795153\">Medicare<\/span> at age 65 could delay your coverage and result in higher premiums.<\/p>\n<p>Deciding when to\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/when-can-i-retire\">begin claiming retirement benefits<\/a>\u00a0depends on a host of factors, including your:<\/p>\n<ul>\n<li>Employment status,<\/li>\n<li>Savings, pension, and other retirement income,<\/li>\n<li>Overall health and life expectancy; and<\/li>\n<li><span data-term-id=\"58795167\">Eligibility<\/span> for <span data-term-id=\"58795151\">Social Security<\/span> Survivor benefits.<\/li>\n<\/ul>\n<p>You can apply for retirement benefits\u00a0<a href=\"https:\/\/www.ssa.gov\/apply?benefits=retirement&amp;age=adult\" target=\"_blank\" rel=\"noopener\">online<\/a>\u00a0or by contacting your local <span data-term-id=\"58795151\">Social Security<\/span>\u00a0<a href=\"https:\/\/secure.ssa.gov\/ICON\/main.jsp\" target=\"_blank\" rel=\"noopener\">Field Office<\/a>. During the application process, you can\u00a0designate up to three representative payees. If you are unsure of the best way forward, seek advice from a qualified <span data-term-id=\"58795151\">Social Security<\/span> attorney or financial adviser.<\/p>\n<p>Currently, the <span data-term-id=\"58795151\">Social Security<\/span> Administration\u2019s (SSA\u2019s) record system only allows people to designate their sex\/gender as \u201cfemale\u201d or \u201cmale\u201d when applying for benefits or replacement <span data-term-id=\"58795151\">Social Security<\/span> cards. You cannot choose a <span data-term-id=\"58795148\">non-binary<\/span> (&#8220;X&#8221;) gender marker.<\/p>\n<p>As of the date of this publication, individuals may\u00a0<a href=\"https:\/\/www.ssa.gov\/ssnumber\/changes_to_your_record.html\" target=\"_blank\" rel=\"noopener\">change their sex\/gender identification on their <span data-term-id=\"58795151\">Social Security<\/span> record<\/a>\u00a0without providing medical or legal confirmation for the change. SSA is\u00a0<a href=\"https:\/\/www.ssa.gov\/people\/lgbtq\/gender-identity.html\" target=\"_blank\" rel=\"noopener\">exploring ways to accommodate <span data-term-id=\"58795148\">non-binary<\/span> individuals<\/a>\u00a0and others who choose not to specify a sex designation on their identity documents.<\/p>\n<h2>Survivors Benefits<\/h2>\n<p>Until the U.S. <span data-term-id=\"58795168\">Supreme Court<\/span>\u2019s decision in\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/marriage\/same-sex-marriage-understanding-obergefell-v-hodges.html\"><em>Obergefell v. Hodges<\/em><\/a>, surviving <span data-term-id=\"58795140\">same-sex<\/span> partners and spouses were barred from receiving a host of privileges strictly reserved for heterosexual married couples, including <span data-term-id=\"58795151\">Social Security<\/span> survivors benefits. Once the Court recognized the constitutional right for <span data-term-id=\"58795180\">same-sex<\/span><span data-term-id=\"58795180\"> couples<\/span> to marry, surviving spouses became eligible to apply for <span data-term-id=\"58795151\">Social Security<\/span> survivors benefits.<\/p>\n<p>But at first, many individuals whose partners either died before the Obergefell decision or died shortly after were denied survivors benefits due to <span data-term-id=\"58795151\">Social Security<\/span>\u2019s rule that a couple must have been legally married for at least nine months in order for the surviving spouse to be eligible for survivors benefits. Lawsuits were filed on behalf of <span data-term-id=\"58795140\">same-sex<\/span> surviving partners and spouses, and two class actions emerged:\u00a0<em>Ely v. Saul\u00a0<\/em>and\u00a0<em>Thornton v. Commissioner of <span data-term-id=\"58795151\">Social Security<\/span>.<\/em><\/p>\n<p><strong><em>Ely v. Saul<\/em><\/strong><\/p>\n<p>Michael Ely and James Taylor were in a committed relationship for 43 years. In 2014, they married in their home state of Arizona after the state began allowing <span data-term-id=\"58795180\">same-sex<\/span><span data-term-id=\"58795180\"> couples<\/span> to marry. Seven months later, James died of cancer. The SSA denied Michael\u00a0survivors benefits\u00a0because their legal marriage lasted less than nine months.<\/p>\n<p>On May 27, 2020, a federal district court held in\u00a0<a href=\"https:\/\/www.ssa.gov\/ely\/\" target=\"_blank\" rel=\"noopener\"><em>Ely v. Saul<\/em><\/a>\u00a0that the SSA\u2019s denial of survivors benefits to Michael violated his constitutional rights to equal protection and due process as James\u2019s surviving spouse. Additionally, the court\u00a0certified a class\u00a0of <span data-term-id=\"58795140\">same-sex<\/span> surviving spouses across the United States:<\/p>\n<ul>\n<li>Who have filed or will file a survivors benefits claim,<\/li>\n<li>Whose claims were denied or would be denied because they were married to their spouse for less than nine months when their spouse died; and<\/li>\n<li>Who were prevented from being married for at least nine months due to discriminatory state laws prohibiting <span data-term-id=\"58795179\">same-sex<\/span><span data-term-id=\"58795179\"> marriage<\/span>.<\/li>\n<\/ul>\n<p>If you believe you are a member of the\u00a0<em>Ely<\/em>\u00a0class,\u00a0<a href=\"https:\/\/secure.ssa.gov\/ICON\/main.jsp\" target=\"_blank\" rel=\"noopener\">contact <span data-term-id=\"58795151\">Social Security<\/span><\/a>\u00a0to apply or request that your claim be reopened.<\/p>\n<p><strong><em>Thornton v. Commissioner of <span data-term-id=\"58795151\">Social Security<\/span><\/em><\/strong><\/p>\n<p>Helen Thornton and Margery Brown were a couple for 27 years.\u00a0Ms. Brown died in 2006. At the time of her death, Washington State had a law prohibiting <span data-term-id=\"58795179\">same-sex<\/span><span data-term-id=\"58795179\"> marriage<\/span> (although it eventually recognized <span data-term-id=\"58795179\">same-sex<\/span><span data-term-id=\"58795179\"> marriage<\/span> in 2012). Ms. Thornton applied for survivors benefits in 2015 but was denied because she was not legally married to Ms. Brown at the time of her death.<\/p>\n<p>On November 25, 2020, a federal district court held in\u00a0<a href=\"https:\/\/www.ssa.gov\/thornton\/\" target=\"_blank\" rel=\"noopener\"><em>Thornton v. Commissioner of <span data-term-id=\"58795151\">Social Security<\/span><\/em><\/a>\u00a0that the SSA may not deny survivors benefits to <span data-term-id=\"58795140\">same-sex<\/span> partners who were barred from marriage by unconstitutional laws. The\u00a0<em>Thornton<\/em>\u00a0court also certified a class of persons across the United States:<\/p>\n<ul>\n<li>Who were unable to marry their deceased partner because of unconstitutional laws prohibiting <span data-term-id=\"58795179\">same-sex<\/span><span data-term-id=\"58795179\"> marriage;<\/span>\u00a0and<\/li>\n<li>Whose claims were denied because they were unable to meet the SSA\u2019s marriage requirements to obtain survivors benefits.<\/li>\n<\/ul>\n<p>A surviving partner of a <span data-term-id=\"58795140\">same-sex<\/span> relationship who files a survivors benefits application after November 25, 2020 will not technically be a\u00a0<em>Thornton<\/em>\u00a0class member. However, the SSA continues to consider claims from surviving partners of <span data-term-id=\"58795140\">same-sex<\/span> relationships on the same terms and conditions as the agency processes claims for\u00a0<em>Thornton\u00a0<\/em>class members.<\/p>\n<p><em>Ely\u00a0<\/em>and\u00a0<em>Thornton<\/em>\u00a0made it possible for surviving spouses and partners of <span data-term-id=\"58795140\">same-sex<\/span> relationships to\u00a0qualify for <span data-term-id=\"58795151\">Social Security<\/span> survivors benefits. If you were in a <span data-term-id=\"58795140\">same-sex<\/span> relationship and your partner or spouse has passed away,\u00a0<a href=\"https:\/\/www.sageusa.org\/wp-content\/uploads\/2022\/08\/social-security-survivor-benefits-for-lgbtq-elders-one-pager-final-2.pdf\" target=\"_blank\" rel=\"noopener\">you could be eligible<\/a>\u00a0for survivors benefits based on their earnings record.<\/p>\n<p>You can\u00a0<a href=\"https:\/\/secure.ssa.gov\/ICON\/main.jsp\" target=\"_blank\" rel=\"noopener\">contact your local <span data-term-id=\"58795151\">Social Security<\/span> office<\/a>\u00a0to apply for survivors benefits. Note that\u00a0you cannot apply for survivors benefits online\u00a0at this time. If you were previously denied survivors benefits, you can request that the SSA reopen your claim. If you were previously denied and the SSA determines that you qualify for survivor benefits under\u00a0<em>Ely<\/em>\u00a0or the\u00a0<em>Thornton<\/em>\u00a0rules, you could be eligible for retroactive benefit payments dating back to your spouse\u2019s or partner\u2019s death.<\/p>\n<h2>LGBTQ+ OA Access to <span data-term-id=\"58795153\">Medicare<\/span> and <span data-term-id=\"58795144\">Medicaid<\/span> Services<\/h2>\n<p>The Center for <span data-term-id=\"58795153\">Medicare<\/span> and <span data-term-id=\"58795144\">Medicaid<\/span> Services (CMS) is the <span data-term-id=\"58795192\">federal government<\/span> agency that administers two large, publicly funded <span data-term-id=\"58795160\">health insurance<\/span> programs:\u00a0<a href=\"https:\/\/www.findlaw.com\/elder\/elder-care-law\/medicare-vs-medicaid.html\"><span data-term-id=\"58795153\">Medicare<\/span> and <span data-term-id=\"58795144\">Medicaid<\/span><\/a>. You might qualify for both programs (called dual-eligible) if you meet certain income and asset requirements.<\/p>\n<h3><span data-term-id=\"58795153\">Medicare<\/span><\/h3>\n<p><a href=\"https:\/\/www.medicare.gov\/basics\/get-started-with-medicare\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58795153\">Medicare<\/span><\/a>\u00a0is the most frequently used <span data-term-id=\"58795160\">health insurance<\/span> program for older adults aged 65 and older. <span data-term-id=\"58795153\">Medicare<\/span> provides <span data-term-id=\"58795160\">health insurance<\/span> coverage to:<\/p>\n<ul>\n<li>Older adults aged 65 and older<\/li>\n<li>People under age 65 with certain disabilities<\/li>\n<li>People of all ages with permanent kidney failure (ESRD) or Lou Gehrig\u2019s disease (ALS)<\/li>\n<\/ul>\n<p><span data-term-id=\"58795153\">Medicare<\/span> coverage is divided into\u00a0<a href=\"https:\/\/www.medicare.gov\/basics\/get-started-with-medicare\/medicare-basics\/parts-of-medicare\" target=\"_blank\" rel=\"noopener\">four parts<\/a>:<\/p>\n<ul>\n<li>Part A (hospital insurance)<\/li>\n<li>Part B (medical insurance)<\/li>\n<li>Part C (<span data-term-id=\"58795153\">Medicare<\/span> Advantage), and<\/li>\n<li>Part D (prescription drug coverage)<\/li>\n<\/ul>\n<p>To qualify for free <span data-term-id=\"58795153\">Medicare<\/span> Part A benefits, you (or your spouse) must have contributed <span data-term-id=\"58795153\">Medicare<\/span> payroll taxes. If you were born in 1929 or later, you need 10 years of work (40 quarters) to be eligible for Part A with a $0 premium. The standard monthly premium for Part B in 2026 is $202.90. However, you may be able to qualify for spousal <span data-term-id=\"58795151\">Social Security<\/span> and related <span data-term-id=\"58795153\">Medicare<\/span> coverage if\u00a0unconstitutional state laws\u00a0prevented you from marrying or from marrying sooner.<\/p>\n<p>Depending upon\u00a0your individual income\u00a0and that of your prospective spouse, marriage could either raise or lower your Part B and Part D premiums. For example, if you are planning to get married and currently receive the <a href=\"https:\/\/www.ssa.gov\/medicare\/part-d-extra-help\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58795153\">Medicare<\/span> Part D <span data-term-id=\"58795156\">Low Income<\/span> Subsidy<\/a> (LIS) to help pay for prescription drugs, your new spouse\u2019s income and assets will be counted toward your total household income. This may impact your ability to maintain your LIS.<\/p>\n<p>To determine how marriage will impact your <span data-term-id=\"58795153\">Medicare<\/span> coverage, consult with a qualified tax professional or a licensed\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/health-health-care-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">healthcare attorney<\/a>.<\/p>\n<p><strong>Impact on <span data-term-id=\"58795159\">Long-Term <\/span><span data-term-id=\"58795188\">Care<\/span><span data-term-id=\"58795188\"> Services<\/span><\/strong><\/p>\n<p>Keep in mind that <span data-term-id=\"58795153\">Medicare<\/span>\u00a0<a href=\"https:\/\/www.findlaw.com\/elder\/elder-care-law\/dealing-with-the-cost-of-long-term-elder-care.html\">will not cover<\/a>\u00a0most <span data-term-id=\"58795159\">long-term <\/span><span data-term-id=\"58795188\">care<\/span><span data-term-id=\"58795188\"> services<\/span>. Consider purchasing private <span data-term-id=\"58795159\">long-term care<\/span> insurance to avoid having to transfer your assets to comply with <span data-term-id=\"58795144\">Medicaid<\/span> spend-down rules. Another option to consider (depending on which state you live in) is setting up a\u00a0Qualified Income Trust.<\/p>\n<p><strong><span data-term-id=\"58795153\">Medicare<\/span> Coverage for <span data-term-id=\"58795142\">Transgender<\/span><span data-term-id=\"58795142\"> People<\/span><\/strong><\/p>\n<p>Your <span data-term-id=\"58795153\">Medicare<\/span> records will include the gender marker (sex identification) from your <span data-term-id=\"58795151\">Social Security<\/span> record. You may\u00a0<a href=\"https:\/\/www.ssa.gov\/ssnumber\/changes_to_your_record.html\" target=\"_blank\" rel=\"noopener\">change your gender marker<\/a>\u00a0(as of 2023, there are only \u201cmale\u201d and \u201cfemale\u201d options) by requesting that SSA update your record and\/or send you a replacement <span data-term-id=\"58795151\">Social Security<\/span> card. Once completed, the SSA changes should be reflected in your <span data-term-id=\"58795153\">Medicare<\/span> records.<\/p>\n<p><span data-term-id=\"58795153\">Medicare<\/span> approves coverage of\u00a0<a href=\"https:\/\/www.lgbtagingcenter.org\/resources\/pdfs\/SAGE%20SHIP%20Medicare%20and%20Trans%20Older%20Adults%20Final%20R1.pdf\" target=\"_blank\" rel=\"noopener\">medically necessary gender-affirming surgeries<\/a>\u00a0on a case-by-case basis, informed by the standards of care provided by the\u00a0<a href=\"https:\/\/wpath.org\/publications\/soc\" target=\"_blank\" rel=\"noopener\">World Professional Association for <span data-term-id=\"58795130\">Transgender<\/span> Health<\/a>\u00a0(WPATH). <span data-term-id=\"58795153\">Medicare<\/span> Part D also covers transition-related drugs.<\/p>\n<p>Additionally, <span data-term-id=\"58795153\">Medicare<\/span> will not deny coverage for sex-specific services (e.g., pap smear, prostate cancer screening) if your <span data-term-id=\"58795131\">gender identity<\/span> does not match the gender marker in your <span data-term-id=\"58795153\">Medicare<\/span> record. Instead, your <span data-term-id=\"58795136\">provider<\/span> can bill <span data-term-id=\"58795153\">Medicare<\/span>\u00a0condition code 45\u00a0when ordering those procedures.<\/p>\n<p>If you are denied gender-affirming treatment under <span data-term-id=\"58795153\">Medicare<\/span>, you can\u00a0<a href=\"https:\/\/www.hhs.gov\/civil-rights\/filing-a-complaint\/complaint-process\/index.html\" target=\"_blank\" rel=\"noopener\">file a written complaint<\/a>\u00a0with the U.S. Department of Health and Hospitals (<span data-term-id=\"58795185\">HHS<\/span>) Office of <span data-term-id=\"58795158\">Civil Rights<\/span> (OCR) by U.S. mail, fax, e-mail, or through the\u00a0<a href=\"https:\/\/ocrportal.hhs.gov\/ocr\/smartscreen\/main.jsf\" target=\"_blank\" rel=\"noopener\">OCR online Complaint Portal<\/a>. You should also seek advice from a licensed attorney specializing in healthcare and\/or <span data-term-id=\"58795158\">civil rights<\/span>.<\/p>\n<h3><span data-term-id=\"58795144\">Medicaid<\/span><\/h3>\n<p><a href=\"https:\/\/www.medicaid.gov\/medicaid\/index.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58795144\">Medicaid<\/span><\/a>\u00a0is a national insurance program that provides health coverage to millions of <span data-term-id=\"58795156\">low-income<\/span> Americans. Although <span data-term-id=\"58795144\">Medicaid<\/span> is funded jointly by the states and the <span data-term-id=\"58795192\">federal government<\/span>, each state manages its own <span data-term-id=\"58795144\">Medicaid<\/span> program in keeping with federal rules (which include protection from <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/gay-and-lesbian-rights-sexual-orientation-discrimination.html\">discrimination based on <span data-term-id=\"58795133\">sexual orientation<\/span> or <span data-term-id=\"58795131\">gender identity<\/span><\/a>).<\/p>\n<p><span data-term-id=\"58795144\">Medicaid<\/span> <span data-term-id=\"58795167\">eligibility<\/span> is strictly based on financial need, calculated based on your\u00a0<a href=\"https:\/\/laborcenter.berkeley.edu\/modified-adjusted-gross-income-under-the-affordable-care-act\/\" target=\"_blank\" rel=\"noopener\">Modified Adjusted Gross Income<\/a>\u00a0(MAGI). In the absence of\u00a0<a href=\"https:\/\/www.findlaw.com\/elder\/elder-care-law\/dealing-with-the-cost-of-long-term-elder-care.html\">private <span data-term-id=\"58795159\">long-term care<\/span> insurance<\/a>, many LGBTQ+ OA will rely on <span data-term-id=\"58795144\">Medicaid<\/span> to cover their <span data-term-id=\"58795159\">long-term care<\/span>, whether they receive services at home or move into a nursing facility. <span data-term-id=\"58795144\">Medicaid<\/span> \u201cspend down\u201d rules, known as\u00a0<a href=\"https:\/\/www.medicaid.gov\/medicaid\/eligibility\/spousal-impoverishment\/index.html\" target=\"_blank\" rel=\"noopener\">spousal impoverishment<\/a>\u00a0rules for married individuals, come into play.<\/p>\n<p><span data-term-id=\"58795144\">Medicaid<\/span> is often the only option, which means individuals must \u201cspend down\u201d or transfer their assets in order to qualify for coverage under <span data-term-id=\"58795144\">Medicaid<\/span>\u2019s strict income requirements.<\/p>\n<p>The spousal impoverishment rules protect the healthier spouse by exempting the marital home from counted assets, which allows the healthy spouse to keep at least one-half of the couple\u2019s joint assets and prevents <span data-term-id=\"58795144\">Medicaid<\/span> from placing a lien on the marital home until after the death of the healthy spouse.<\/p>\n<p><strong><span data-term-id=\"58795144\">Medicaid<\/span> Coverage for <span data-term-id=\"58795186\">Transgender<\/span><span data-term-id=\"58795186\"> Older Adults<\/span><\/strong><\/p>\n<p>The\u00a0<a href=\"https:\/\/mapresearch.org\/equality-map\/medicaid-coverage-of-transgender-related-health-care\/\" target=\"_blank\" rel=\"noopener\">Movement Advancement Project<\/a>\u00a0(MAP) researched state <span data-term-id=\"58795144\">Medicaid<\/span> programs and found that:<\/p>\n<ul>\n<li>27 states\u2019 <span data-term-id=\"58795144\">Medicaid<\/span> policies cover <span data-term-id=\"58795130\">transgender<\/span>-related healthcare.<\/li>\n<li>12 states explicitly ban <span data-term-id=\"58795130\">transgender<\/span> healthcare coverage for people of all ages.<\/li>\n<li>12 states do not have any specific <span data-term-id=\"58795130\">transgender<\/span> healthcare coverage policy.<\/li>\n<li>3 states explicitly exclude <span data-term-id=\"58795130\">transgender<\/span> healthcare for minors.<\/li>\n<\/ul>\n<p>However, if you are enrolled in <span data-term-id=\"58795144\">Medicaid<\/span>, federal law prohibits SOGI-based discrimination by <span data-term-id=\"58795174\">nursing homes<\/span>, home health\u00a0agencies, and other health and senior\u00a0<span data-term-id=\"58795150\">service <\/span><span data-term-id=\"58795136\">providers<\/span>\u00a0that accept <span data-term-id=\"58795144\">Medicaid<\/span> dollars.<\/p>\n<p>If you are denied gender-affirming treatment by a <span data-term-id=\"58795144\">Medicaid<\/span> <span data-term-id=\"58795136\">provider<\/span> you can\u00a0<a href=\"https:\/\/www.hhs.gov\/civil-rights\/filing-a-complaint\/complaint-process\/index.html\" target=\"_blank\" rel=\"noopener\">file a written complaint<\/a>\u00a0with the U.S. Department of Health and Hospitals (<span data-term-id=\"58795185\">HHS<\/span>) Office of <span data-term-id=\"58795158\">Civil Rights<\/span> (OCR) by U.S. mail, fax, e-mail, or through the\u00a0<a href=\"https:\/\/ocrportal.hhs.gov\/ocr\/smartscreen\/main.jsf\" target=\"_blank\" rel=\"noopener\">OCR online Complaint Portal<\/a>. You should also seek advice from a licensed attorney specializing in healthcare and\/or <span data-term-id=\"58795158\">civil rights<\/span>.<\/p>\n<p>Additionally, your state\u2019s <span data-term-id=\"58795144\">Medicaid<\/span> policy does not affect\u00a0<a href=\"https:\/\/www.lgbtagingcenter.org\/resources\/pdfs\/SAGE%20SHIP%20Medicare%20and%20Trans%20Older%20Adults%20Final%20R1.pdf\" target=\"_blank\" rel=\"noopener\">your right to <span data-term-id=\"58795153\">Medicare<\/span> coverage<\/a>.<\/p>\n<h2>Veteran\u2019s Benefits<\/h2>\n<p>In 1949, the\u00a0<a href=\"https:\/\/www.nps.gov\/articles\/000\/blue-and-other-than-honorable-discharges.htm\" target=\"_blank\" rel=\"noopener\">Department of Defense released its policy<\/a>\u00a0banning LGBTQA+ people from serving in \u201cany branch of the Armed Forces in any capacity.\u201d Under that policy, any service member who was a \u201cknown <span data-term-id=\"58795171\">homosexual<\/span>\u201d was separated from their unit, their enlistment period cut short, and released with a \u201cblue card,\u201d or \u201cOther Than Honorable\u201d (OTH) discharge status.<\/p>\n<p>With strict exceptions for veterans experiencing\u00a0<span data-term-id=\"58795145\">mental health<\/span> crises\u00a0or\u00a0homelessness, the Department of Veterans Affairs (VA) treats any discharge status other than \u201cHonorable\u201d <a href=\"https:\/\/www.findlaw.com\/lgbtq-law\/the-legal-history-of-lgbtq-people-in-the-military.html\">as dishonorable<\/a> for the purpose of VA benefits, including its healthcare, education, and home loan programs.<\/p>\n<p>When\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/courtside\/dont-ask-dont-tell-repeal-goes-into-effect\/\">Don\u2019t Ask, Don\u2019t Tell was repealed<\/a>\u00a0in 2011, nearly\u00a0114,000 service members\u00a0had already received \u201cOther Than Honorable\u201d discharges on the basis of\u00a0<span data-term-id=\"58795133\">sexual orientation<\/span> and\/or <span data-term-id=\"58795131\">gender identity<\/span>.
