For up-to-date legal guidance, contact a <a href=\"https:\/\/lawyers.findlaw.com\/health-health-care-law\/\" target=\"_blank\" rel=\"noopener\">health care attorney<\/a> near you.<\/p>\n<h2>What is <span data-term-id=\"55751065\">Gender-Affirming Care<\/span>?<\/h2>\n<p>\u201c<span data-term-id=\"55751065\">Gender-affirming care<\/span>\u201d (GAC) refers to many types of treatment related to gender transition and <span data-term-id=\"55751085\">gender dysphoria<\/span>. It can focus on psychiatric care, physical <span data-term-id=\"55751073\">medical care<\/span>, or multidisciplinary treatment.\u00a0<\/p>\n<p><a href=\"https:\/\/www.webmd.com\/sex\/gender-dysphoria\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751085\">Gender dysphoria<\/span><\/a>\u00a0is the feeling of distress or discomfort a person feels when their <span data-term-id=\"55751068\">gender identity<\/span> does not align with the sex they were assigned at birth. It negatively impacts a person\u2019s <span data-term-id=\"55751084\">mental health<\/span>, often leading to depression and other issues.\u00a0<\/p>\n<p>Gender transitions can involve:<\/p>\n<ul>\n<li>Social transition (dressing according to <span data-term-id=\"55751068\">gender identity<\/span>, using a different name or pronouns)<\/li>\n<li>Physical transition (any combination of hormone therapy, surgical medical procedures, and nonsurgical medical procedures)<\/li>\n<li>Legal transition (legally\u00a0<a href=\"https:\/\/www.findlaw.com\/lgbtq-law\/how-to-change-your-legal-name-and-gender-marker.html\">changing name and gender marker<\/a>)<\/li>\n<\/ul>\n<p>Gender-affirming <span data-term-id=\"55751073\">medical care<\/span> helps nonbinary or <span data-term-id=\"55751072\">transgender people<\/span> with their physical transition. It can include hormone replacement therapy, gender-affirming surgery, or both.<\/p>\n<p>For many, <a href=\"https:\/\/www.webmd.com\/sex\/gender-affirming-care\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751065\">gender-affirming care<\/span><\/a> is a life-saving course of treatment. However, a transgender or nonbinary person\u2019s <span data-term-id=\"55751068\">gender identity<\/span> is still valid even if they have not pursued this type of care.<\/p>\n<h2><span data-term-id=\"55751065\">Gender-Affirming Care<\/span> for <span data-term-id=\"55751094\">Transgender Minors<\/span><\/h2>\n<p>For children and <span data-term-id=\"55751102\">adolescents<\/span>, GAC often focuses on social transition. However, in some cases, <span data-term-id=\"55751095\">transgender children<\/span> will be prescribed\u00a0<a href=\"https:\/\/www.webmd.com\/children\/what-are-puberty-blockers\" target=\"_blank\" rel=\"noopener\">puberty blockers<\/a>. These medications\u00a0<em>temporarily<\/em>\u00a0halt the secondary sex changes <span data-term-id=\"55751111\">young people<\/span> experience during puberty.\u00a0This pause gives the child and their parents time to explore their transition and determine if it is the correct course. Once the person stops taking the medication, puberty resumes, and they will go through the expected physical changes.<\/p>\n<p>Puberty blockers are also used to treat\u00a0<a href=\"https:\/\/www.webmd.com\/children\/precocious-puberty\" target=\"_blank\" rel=\"noopener\">precocious puberty<\/a>. This condition, unrelated to <span data-term-id=\"55751085\">gender dysphoria<\/span>, causes a child to go through puberty as early as six or seven years old. Precocious puberty is a medical condition and may be due to benign tumors or genetic factors.<\/p>\n<p>Many major medical organizations support <span data-term-id=\"55751077\">gender-affirming <\/span><span data-term-id=\"55751066\">health care<\/span> for minors, including:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.aap.org\/en\/news-room\/news-releases\/aap\/2018\/aap-policy-statement-urges-support-and-care-of-transgender-and-gender-diverse-children-and-adolescents\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751096\">American Academy of Pediatrics<\/span><\/a><\/li>\n<li><a href=\"https:\/\/www.ama-assn.org\/press-center\/press-releases\/ama-states-stop-interfering-health-care-transgender-children\" target=\"_blank\" rel=\"noopener\"><u>American Medical Association<\/u><\/a><\/li>\n<li><a href=\"https:\/\/www.aacap.org\/AACAP\/Latest_News\/AACAP_Statement_Responding_to_Efforts-to_ban_Evidence-Based_Care_for_Transgender_and_Gender_Diverse.aspx\" target=\"_blank\" rel=\"noopener\">American Academy of Child and <span data-term-id=\"55751102\">Adolescent<\/span> Psychiatry<\/a><\/li>\n<li><a href=\"https:\/\/www.apa.org\/topics\/lgbtq\/policy-issues\" target=\"_blank\" rel=\"noopener\">American Psychological Association<\/a><\/li>\n<li><a href=\"https:\/\/www.psychiatry.org\/getattachment\/8665a2f2-0b73-4477-8f60-79015ba9f815\/Position-Treatment-of-Transgender-Gender-Diverse-Youth.pdf\" target=\"_blank\" rel=\"noopener\">American Psychiatric Association<\/a><\/li>\n<li><a href=\"https:\/\/www.endocrine.org\/news-and-advocacy\/news-room\/2022\/endocrine-society-alarmed-at-criminalization-of-transgender-medicine\" target=\"_blank\" rel=\"noopener\">Endocrine Society<\/a><\/li>\n<\/ul>\n<p>These organizations view <span data-term-id=\"55751065\">gender-affirming care<\/span> as \u201c<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/11399348\/\" target=\"_blank\" rel=\"noopener\">medical best practice<\/a>\u201d for treating the psychological issues that may arise. Medical best practice means relying on scientific research, expert consensus, and patient preference to determine the best treatment plan for a patient. <span data-term-id=\"55751092\">State bans<\/span> against such treatment undermine <span data-term-id=\"55751104\">evidence-based<\/span> <span data-term-id=\"55751103\">transgender <\/span><span data-term-id=\"55751066\">health<\/span><span data-term-id=\"55751103\"> care<\/span>.<\/p>\n<p>It is important to note that even states that support the use of <a href=\"https:\/\/www.findlaw.com\/lgbtq-law\/how-to-access-gender-affirming-healthcare-for-transgender-youth.html\"><span data-term-id=\"55751065\">gender-affirming care<\/span> for minors<\/a> generally do not allow sexual reassignment surgery for minors.<\/p>\n<h2>United States v. Skrmetti<\/h2>\n<p>In 2023, the state of <span data-term-id=\"55751076\">Tennessee<\/span> passed a law prohibiting <span data-term-id=\"55751065\">gender-affirming care<\/span> for minor children. Several other states passed similar laws in 2023. Three families of <span data-term-id=\"55751095\">transgender children<\/span> and a doctor sued the state, claiming civil rights violations under the Fourteenth Amendment. The federal district court issued a statewide injunction until the matter could be heard on its merits. Other <span data-term-id=\"55751079\">state laws<\/span> were suspended pending the outcome of the case.<\/p>\n<p>The <span data-term-id=\"55751091\">U.S. <\/span><span data-term-id=\"55751067\">Supreme Court<\/span> heard the matter, <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/23-477.html\" target=\"_blank\" rel=\"noopener\"><em>United States v. Skrmetti<\/em><\/a>, in 2025. The appellants argued that the <span data-term-id=\"55751079\">state law<\/span> discriminated against <span data-term-id=\"55751074\">transgender youth<\/span> on the basis of gender, and thus deserved heightened scrutiny. At this <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/challenging-laws-3-levels-of-scrutiny-explained\/\">level of judicial scrutiny<\/a>, the burden is on the government to prove why the law is constitutional. By comparison, race, religion, or national origin trigger \u201cstrict scrutiny,\u201d and the government must show that the law is constitutional and serves an important government interest.<\/p>\n<p>The <span data-term-id=\"55751067\">Supreme Court<\/span> held that there was no discrimination under the <span data-term-id=\"55751109\">Equal Protection Clause<\/span> because the <span data-term-id=\"55751076\">Tennessee<\/span> law applied equally to male and female <span data-term-id=\"55751074\">transgender youth<\/span>. The basis for the law is age and medical condition, which trigger the rational basis standard of review. This judicial scrutiny requires the claimant to show that the law is unconstitutional.<\/p>\n<p>The holding in <em>Skirmetti<\/em> reasoned that since the law applied to males and females alike, there was no discrimination. Since the law allows <span data-term-id=\"55751107\">hormone treatment<\/span> and surgical <span data-term-id=\"55751097\">intervention<\/span> in other circumstances, it did not unduly burden the public.<\/p>\n<p>The Court allowed the <span data-term-id=\"55751076\">Tennessee<\/span> law to stand. States that appear in light blue currently restrict access to <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors. Those states are:<\/p>\n<ul>\n<li>Alabama<\/li>\n<li><span data-term-id=\"55751081\">Arizona<\/span><\/li>\n<li><span data-term-id=\"55751078\">Arkansas<\/span><\/li>\n<li>Florida<\/li>\n<li>Georgia<\/li>\n<li>Idaho<\/li>\n<li>Indiana<\/li>\n<li>Iowa<\/li>\n<li>Kansas<\/li>\n<li>Kentucky<\/li>\n<li>Louisiana<\/li>\n<li>Mississippi<\/li>\n<li><span data-term-id=\"55751080\">Montana<\/span><\/li>\n<li>Nebraska<\/li>\n<li>New Hampshire<\/li>\n<li><span data-term-id=\"55751110\">North Carolina<\/span><\/li>\n<li>North Dakota<\/li>\n<li>Ohio<\/li>\n<li>Oklahoma<\/li>\n<li><span data-term-id=\"55751088\">South Carolina<\/span><\/li>\n<li>South Dakota<\/li>\n<li><span data-term-id=\"55751076\">Tennessee<\/span><\/li>\n<li><span data-term-id=\"55751089\">Texas<\/span><\/li>\n<li>Utah<\/li>\n<li>West Virginia<\/li>\n<li>Wyoming<\/li>\n<\/ul>\n<p>There are six states with <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges.html\">criminal penalties<\/a> for providing <span data-term-id=\"55751065\">gender-affirming care<\/span> to a minor. They are:<\/p>\n<ul>\n<li>Alabama<\/li>\n<li>Florida<\/li>\n<li>Idaho<\/li>\n<li>North Dakota<\/li>\n<li>Oklahoma<\/li>\n<li><span data-term-id=\"55751088\">South Carolina<\/span><\/li>\n<\/ul>\n<h3>States Without Restrictions on <span data-term-id=\"55751065\">Gender-Affirming Care<\/span><\/h3>\n<p>States that appear in medium blue currently have no restrictions on <span data-term-id=\"55751065\">gender-affirming care<\/span>. Those states are:<\/p>\n<ul>\n<li>Alaska<\/li>\n<li>Delaware<\/li>\n<li><span data-term-id=\"55751116\">District of Columbia<\/span><\/li>\n<li>Hawai\u2019i<\/li>\n<li><span data-term-id=\"55751118\">Maine<\/span><\/li>\n<li><span data-term-id=\"55751117\">Maryland<\/span><\/li>\n<li>Nevada<\/li>\n<li>Oregon<\/li>\n<li>Pennsylvania<\/li>\n<li><span data-term-id=\"55751113\">Rhode Island<\/span><\/li>\n<li>Virginia<\/li>\n<li>Wisconsin<\/li>\n<\/ul>\n<h3>Sanctuary and Shield States<\/h3>\n<p>Sanctuary states protect access to <span data-term-id=\"55751065\">gender-affirming care<\/span> for residents. Shield states prevent <a href=\"https:\/\/www.findlaw.com\/lgbtq-law\/do-insurance-companies-and-medicaid-cover-gender-affirming-care.html\">insurance companies from denying coverage<\/a> to transgender individuals. These states will not cooperate with law enforcement or respond to subpoenas from <span data-term-id=\"55751090\">out-of-state<\/span> investigators.<\/p>\n<ul>\n<li>California<\/li>\n<li>Colorado<\/li>\n<li>Connecticut<\/li>\n<li>Illinois<\/li>\n<li>Massachusetts<\/li>\n<li>Michigan<\/li>\n<li>Minnesota<\/li>\n<li><span data-term-id=\"55751114\">New Jersey<\/span><\/li>\n<li>New Mexico<\/li>\n<li><span data-term-id=\"55751105\">New York<\/span><\/li>\n<li>Vermont<\/li>\n<li>Washington<\/li>\n<\/ul>\n<h3>Sanctuary Cities<\/h3>\n<p>A number of cities within both sanctuary states and other states have declared themselves as \u201csanctuary cities,\u201d including:<\/p>\n<ul>\n<li>Sacramento, California<\/li>\n<li>Kansas City, Missouri<\/li>\n<li>State College, Pennsylvania<\/li>\n<li>Olympia, Washington<\/li>\n<\/ul>\n<p>It is difficult to know <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/municipal-law.html\">how much power a city has<\/a> to enact laws that conflict with\u00a0<span data-term-id=\"55751079\">state law<\/span>. However, these cities aim to offer some protection to transgender individuals and youth within their jurisdiction.<\/p>\n<h2>Access to <span data-term-id=\"55751065\">Gender-Affirming Care<\/span> by State<\/h2>\n<p><em>Note: The status of state <span data-term-id=\"55751065\">gender-affirming care<\/span> laws changes rapidly. While we aim to provide the most up-to-date information on this topic, it\u2019s best to check your <span data-term-id=\"55751087\">state legislature<\/span>\u2019s website and speak with local medical and legal professionals.<\/em><\/p>\n<h3>Alabama<\/h3>\n<p><a href=\"https:\/\/legiscan.com\/AL\/text\/SB184\/id\/2566425%22_blank%22\" target=\"_blank\" rel=\"noopener\">Alabama <\/a>banned prescribing or administering hormones or puberty blockers or performing any surgical <span data-term-id=\"55751065\">gender affirming care<\/span> for minors under 19. Counselors, teachers, and school officials must inform parents and guardians if a child discloses they believe their <span data-term-id=\"55751068\">gender identity<\/span> differs from their assigned birth sex.<\/p>\n<p>Violations are a Class C felony, with possible sentences of up to 10 years in prison.<\/p>\n<h3>Alaska<\/h3>\n<p>Alaska has no ban on <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors or adults.<\/p>\n<h3><span data-term-id=\"55751081\">Arizona<\/span><\/h3>\n<p><a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/2R\/bills\/SB1138P.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751081\">Arizona<\/span><\/a> prohibits physicians from performing \u201cirreversible\u201d gender-affirming surgery on minors under 18. Exceptions for those with \u201cambiguous\u201d external genitalia.<\/p>\n<h3><span data-term-id=\"55751078\">Arkansas<\/span><\/h3>\n<p><a href=\"https:\/\/www.arkleg.state.ar.us\/Bills\/Detail?id=HB1570&amp;ddBienniumSession=2021%2F2021R\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751078\">Arkansas<\/span><\/a> prohibits <span data-term-id=\"55751066\">health care<\/span> professionals from providing or referring minors for hormones or puberty blockers. Bans surgical <span data-term-id=\"55751065\">gender affirming care<\/span> for minors. <span data-term-id=\"55751082\">Medicaid<\/span>, public funding, and private health insurance plans may not cover minor care that is not covered for adults.<\/p>\n<h3>California<\/h3>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220SB923\" target=\"_blank\" rel=\"noopener\">California<\/a> is a sanctuary state. California will not enforce another state\u2019s order to remove a minor based on <span data-term-id=\"55751065\">gender-affirming care<\/span> or custody.<\/p>\n<h3>Colorado<\/h3>\n<p><a href=\"https:\/\/leg.colorado.gov\/bills\/hb25-1309\" target=\"_blank\" rel=\"noopener\">Colorado<\/a> is a sanctuary state. The <span data-term-id=\"55751079\">state\u2019s laws<\/span> ensure that all such care is covered by insurance if the doctor feels the treatment is medically necessary.<\/p>\n<h3>Connecticut<\/h3>\n<p><a href=\"https:\/\/search.cga.state.ct.us\/2022\/PA\/pdf\/2022PA-00019-R00HB-05414-PA.pdf\" target=\"_blank\" rel=\"noopener\">Connecticut<\/a> is a sanctuary state. New prescriptions for hormones and puberty blockers are banned. Existing treatment can continue under much tighter requirements. Public funds, including <span data-term-id=\"55751082\">Medicaid<\/span>, cannot be used for any treatment, including adults.<\/p>\n<h3>Georgia<\/h3>\n<p><a href=\"https:\/\/www.legis.ga.gov\/legislation\/64231\" target=\"_blank\" rel=\"noopener\">Georgia<\/a> bans hospitals from providing surgical <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors. Hormones and puberty blockers are prohibited for minors. For adults, state funds, including <span data-term-id=\"55751082\">Medicaid<\/span>, cannot be used for any transgender services.<\/p>\n<h3>Hawai\u2019i<\/h3>\n<p>Hawai\u2019i is a shield state. It provides strong laws protecting transgender individuals\u2019 rights, including <span data-term-id=\"55751090\">out-of-state<\/span> legal actions against state residents, protection for <span data-term-id=\"55751066\">healthcare<\/span> <span data-term-id=\"55751069\">providers<\/span>, and access to <span data-term-id=\"55751065\">gender affirming care<\/span>. A <a href=\"https:\/\/humanservices.hawaii.gov\/hawai%CA%BBi-modernizes-parentage-law-strengthening-protections-for-lgbtqia-families\/\" target=\"_blank\" rel=\"noopener\">recent law passed<\/a> ensuring parental support for a child\u2019s transition cannot be used against them in a custody hearing.<\/p>\n<h3>Idaho<\/h3>\n<p><a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2023\/legislation\/H0071.pdf\" target=\"_blank\" rel=\"noopener\">Idaho<\/a>\u00a0law prohibits all <span data-term-id=\"55751065\">gender affirming care<\/span> for minors including hormones and puberty blockers. Idaho is one of six states that make it a criminal offense for medical professionals to provide such care to minors.<\/p>\n<h3>Illinois<\/h3>\n<p><a href=\"https:\/\/ilga.gov\/legislation\/102\/HB\/PDF\/10200HB4664lv.pdf\" target=\"_blank\" rel=\"noopener\">Illinois<\/a> is a sanctuary state. The state provides strong access for all individuals for <span data-term-id=\"55751077\">gender-affirming <\/span><span data-term-id=\"55751066\">healthcare<\/span> and is currently working to get such <span data-term-id=\"55751066\">healthcare<\/span> provided to incarcerated individuals.<\/p>\n<h3>Indiana<\/h3>\n<p><a href=\"https:\/\/iga.in.gov\/legislative\/2023\/bills\/senate\/480#document-c139e764\" target=\"_blank\" rel=\"noopener\">Indiana<\/a>\u00a0prohibited minors from accessing <span data-term-id=\"55751065\">gender-affirming care<\/span> as of 2023. The law includes an \u201caiding and abetting\u201d clause prohibiting doctors from referring patients to <span data-term-id=\"55751090\">out-of-state<\/span> facilities for care. The law permits <span data-term-id=\"55751084\">mental health<\/span> treatment, but prohibits the use of any public funds, including <span data-term-id=\"55751082\">Medicaid<\/span>, for payment.<\/p>\n<p>The state does not have any laws prohibiting adults from receiving <span data-term-id=\"55751065\">gender-affirming care<\/span>.<\/p>\n<h3>Iowa<\/h3>\n<p><a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ba=SF%20538&amp;ga=90\" target=\"_blank\" rel=\"noopener\">Iowa<\/a>\u00a0bans medical professionals from providing any <span data-term-id=\"55751065\">gender-affirming care<\/span> to minors. This includes any hormones, puberty blockers, and surgical treatment. Medical professionals cannot refer patients to <span data-term-id=\"55751090\">out-of-state<\/span> <span data-term-id=\"55751069\">providers<\/span>, although such referrals are not unlawful.<\/p>\n<h3>Kansas<\/h3>\n<p><a href=\"https:\/\/kslegislature.gov\/li\/b2025_26\/measures\/documents\/sb63_enrolled.pdf\" target=\"_blank\" rel=\"noopener\">Kansas<\/a> enacted the \u201cHelp Not Harm\u201d Act in 2025. The law bans all <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors, restricts public funds and referrals, and criminalizes providing care to minors. Kansas is one of six states that makes providing <span data-term-id=\"55751065\">gender-affirming care<\/span> to minors a felony. The state may intervene in custody cases if one parent intends to provide the minor with such care.<\/p>\n<h3>Kentucky<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/ky\/title-xxvi-occupations-and-professions\/ky-rev-st-sect-311-372\/\" target=\"_blank\" rel=\"noopener\">Kentucky<\/a> law prevents minors from accessing any <span data-term-id=\"55751065\">gender affirming care<\/span>, requires all medical professionals to terminate such care, and loosens bans on conversion therapy. Adults are not banned from seeking care, but the <span data-term-id=\"55751087\">state legislature<\/span> has banned all public funding, including <span data-term-id=\"55751082\">Medicaid<\/span>. Doctors and medical facilities may face civil and professional penalties for providing care.<\/p>\n<h3>Louisiana<\/h3>\n<p><a href=\"https:\/\/legis.la.gov\/legis\/BillInfo.aspx?i=244986\" target=\"_blank\" rel=\"noopener\">Louisiana <\/a>prohibits all <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors, including hormones, puberty blockers, and any type of surgery. Physicians may not provide any treatment or referrals, although there are no bans on <span data-term-id=\"55751084\">mental health<\/span> treatment. Penalties include civil liability and suspension of professional licenses.<\/p>\n<h3><span data-term-id=\"55751118\">Maine<\/span><\/h3>\n<p><a href=\"https:\/\/legislature.maine.gov\/statutes\/22\/title22sec3174-MMM.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751118\">Maine<\/span><\/a> is a shield state, with laws protecting the state\u2019s <span data-term-id=\"55751066\">healthcare<\/span> <span data-term-id=\"55751069\">providers<\/span> and access to <span data-term-id=\"55751065\">gender affirming care<\/span> for all citizens. <span data-term-id=\"55751118\">Maine<\/span>\u2019s hospitals are vulnerable to recent proposed changes in federal rules that would ban <span data-term-id=\"55751082\">Medicaid<\/span> payments to any facility that permits doctors to provide <span data-term-id=\"55751103\">transgender <\/span><span data-term-id=\"55751066\">health<\/span><span data-term-id=\"55751103\"> care<\/span>.<\/p>\n<h3><span data-term-id=\"55751117\">Maryland<\/span><\/h3>\n<p><a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/hb0283?ys=2023RS\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751117\">Maryland<\/span><\/a>\u2019s Trans Health Equity Act ensures equal access to <span data-term-id=\"55751066\">healthcare<\/span> for all transgender individuals. The act defines <span data-term-id=\"55751066\">health care<\/span> as \u201cage-appropriate treatment\u201d for all individuals with <span data-term-id=\"55751085\">gender dysphoria<\/span>, including hormone therapy, surgery, and <span data-term-id=\"55751084\">mental health<\/span> treatment. <span data-term-id=\"55751117\">Maryland<\/span> is a shield state.<\/p>\n<h3>Massachusetts<\/h3>\n<p>Massachusetts is a sanctuary state. In 2022, the state\u00a0<a href=\"https:\/\/malegislature.gov\/Laws\/SessionLaws\/Acts\/2022\/Chapter127\" target=\"_blank\" rel=\"noopener\">passed a law<\/a>\u00a0expanding protections for individuals seeking <span data-term-id=\"55751065\">gender-affirming care<\/span>. The law defined <span data-term-id=\"55751065\">gender-affirming care<\/span> as \u201clegally protected <span data-term-id=\"55751066\">health care<\/span>\u201d and protected individuals from <span data-term-id=\"55751090\">out-of-state<\/span> legal action for seeking it.<\/p>\n<h3>Michigan<\/h3>\n<p>In March 2023, the state\u2019s House of Representatives passed an amendment to the\u00a0<a href=\"https:\/\/www.michigan.gov\/-\/media\/Project\/Websites\/mdcr\/legal\/public-act-453-of-1976-elliott-larsen.pdf?rev=778962c60c314c849814d5a560e5ad93\" target=\"_blank\" rel=\"noopener\">Eliot-Larsen Civil Rights Act<\/a>. This bill expands the state\u2019s protections against discrimination to include <span data-term-id=\"55751068\">gender identity<\/span> and sexual orientation. Governor Gretchen Whitmer signed the bill into law on March 16, 2023.<\/p>\n<h3>Minnesota<\/h3>\n<p><a href=\"https:\/\/malegislature.gov\/Laws\/SessionLaws\/Acts\/2022\/Chapter127\" target=\"_blank\" rel=\"noopener\">Minnesota<\/a> is a sanctuary state. <span data-term-id=\"55751079\">State law<\/span> ensures <span data-term-id=\"55751065\">gender-affirming care<\/span> to all individuals, and prohibits <span data-term-id=\"55751090\">out-of-state<\/span> actors from obtaining information about patients and <span data-term-id=\"55751069\">providers<\/span>. The state provides custody protection for parents or guardians who assist minor children in accessing care.<\/p>\n<h3>Mississippi<\/h3>\n<p><a href=\"http:\/\/billstatus.ls.state.ms.us\/documents\/2023\/pdf\/HB\/1100-1199\/HB1125SG.pdf\" target=\"_blank\" rel=\"noopener\">Mississippi <\/a>bans medical professionals from providing any <span data-term-id=\"55751065\">gender-affirming care<\/span> to minors. Penalties include a 30-year private right of action and loss of medical license. The law does not affect adults, but public funds cannot be used for this care.<\/p>\n<h3>Missouri<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/mo\/title-xii-public-health-and-welfare\/mo-rev-st-191-1720\/\" target=\"_blank\" rel=\"noopener\">Missouri<\/a> laws are very restrictive and ban all <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors. Adults may access care, but public funds, including <span data-term-id=\"55751082\">Medicaid<\/span>, cannot be used for surgical or <span data-term-id=\"55751107\">hormonal treatment<\/span>. <span data-term-id=\"55751069\">Providers<\/span> may face civil action and loss of license.<\/p>\n<p><a href=\"https:\/\/apnews.com\/article\/lgbtq-sanctuary-city-gender-affirming-care-f253f23b9eefe9ede53d98c7b36f7310\" target=\"_blank\" rel=\"noopener\">Kansas City, Missouri<\/a>, is a sanctuary city for minors seeking <span data-term-id=\"55751065\">gender-affirming care<\/span> within the city limits. The law was blocked by permanent injunction in 2025. The state has not yet appealed.<\/p>\n<h3>Nebraska<\/h3>\n<p><a href=\"https:\/\/nebraskalegislature.gov\/FloorDocs\/108\/PDF\/Intro\/LB574.pdf\" target=\"_blank\" rel=\"noopener\">Nebraska<\/a> bans gender-affirming <span data-term-id=\"55751073\">medical care<\/span> for patients under 19, including gender transition surgeries, puberty blockers, and <span data-term-id=\"55751107\">hormone treatments<\/span>. Doctors may not make <span data-term-id=\"55751090\">out-of-state<\/span> referrals for such care, with penalties including license suspension. The law prohibits use of public funds, including <span data-term-id=\"55751082\">Medicaid<\/span>, for such procedures. The law does not affect <span data-term-id=\"55751084\">mental health<\/span> treatment or adults over 19.<\/p>\n<h3>Nevada<\/h3>\n<p><a href=\"https:\/\/www.leg.state.nv.us\/App\/NELIS\/REL\/83rd2025\/Bill\/12189\/Overview\" target=\"_blank\" rel=\"noopener\">Nevada<\/a>\u2019s <span data-term-id=\"55751093\">shield law<\/span> was vetoed by the governor, but the state has no laws banning minors from accessing <span data-term-id=\"55751065\">gender-affirming care<\/span> or limits on use of public or private insurance for such care.<\/p>\n<h3>New Hampshire<\/h3>\n<p><a href=\"https:\/\/legiscan.com\/NH\/text\/HB377\/2025\" target=\"_blank\" rel=\"noopener\">New Hampshire<\/a> laws HB610, HB1205 and HB377 are currently in effect. Together they prevent <span data-term-id=\"55751094\">transgender minors<\/span> from accessing any <span data-term-id=\"55751065\">gender-affirming care<\/span>, including surgery, puberty blockers, and <span data-term-id=\"55751107\">hormone treatment<\/span>. Physicians cannot refer patients for <span data-term-id=\"55751090\">out-of-state<\/span> surgery. The laws do not bar <span data-term-id=\"55751084\">mental health<\/span> treatment or care for adults.<\/p>\n<h3><span data-term-id=\"55751114\">New Jersey<\/span><\/h3>\n<p><a href=\"https:\/\/www.nj.gov\/governor\/news\/news\/562023\/20230404b.shtml\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751114\">New Jersey<\/span><\/a> is a sanctuary state. Under <span data-term-id=\"55751075\">Executive Order<\/span> No. 326, the state protects its own <span data-term-id=\"55751074\">transgender youth<\/span> and adults, and protects <span data-term-id=\"55751066\">healthcare<\/span> professionals who provide that care. <span data-term-id=\"55751090\">Out-of-state<\/span> residents may come to <span data-term-id=\"55751114\">New Jersey<\/span> to seek <span data-term-id=\"55751066\">health care<\/span> without repercussion.<\/p>\n<h3>New Mexico<\/h3>\n<p><a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?chamber=S&amp;legtype=B&amp;legno=13&amp;year=23\" target=\"_blank\" rel=\"noopener\">New Mexico<\/a> is a sanctuary state. <span data-term-id=\"55751079\">State law<\/span> protects <span data-term-id=\"55751065\">gender-affirming care<\/span> as \u201ca protected <span data-term-id=\"55751066\">health care<\/span> activity.\u201d The law prohibits release of <span data-term-id=\"55751065\">gender-affirming care<\/span> to <span data-term-id=\"55751090\">out-of-state<\/span> investigators. The <span data-term-id=\"55751079\">state law<\/span> also ensures that municipal governments cannot pass city laws blocking access to treatment.<\/p>\n<h3><span data-term-id=\"55751105\">New York<\/span><\/h3>\n<p><a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2023\/S2475B\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751105\">New York<\/span><\/a> is a sanctuary state. <span data-term-id=\"55751079\">State law<\/span> prohibits removing a child from a parent or guardian based on <span data-term-id=\"55751065\">gender-affirming care<\/span> claims, protects <span data-term-id=\"55751066\">healthcare<\/span> <span data-term-id=\"55751069\">providers<\/span> who provide such care, and protects families and minors seeking care. <span data-term-id=\"55751105\">New York<\/span>\u2019s Gender Expression Non-Discrimination Act (GENDA) has been on the books since 2019.<\/p>\n<h3><span data-term-id=\"55751110\">North Carolina<\/span><\/h3>\n<p><a href=\"https:\/\/www.ncleg.gov\/Sessions\/2023\/Bills\/House\/PDF\/H808v8.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751110\">North Carolina<\/span><\/a> bans all <span data-term-id=\"55751065\">gender-affirming care<\/span> for <span data-term-id=\"55751094\">transgender minors<\/span>. Doctors and hospitals cannot be required to perform transition surgeries for any individual, even adults. No public funds may be used for any such care. <span data-term-id=\"55751110\">North Carolina<\/span> passed a law that went into effect in January 2026 officially <a href=\"https:\/\/www.ncleg.gov\/Sessions\/2025\/Bills\/House\/PDF\/H805v6.pdf\" target=\"_blank\" rel=\"noopener\">recognizing only two genders<\/a>, male and female.<\/p>\n<h3>North Dakota<\/h3>\n<p><a href=\"https:\/\/ndlegis.gov\/assembly\/68-2023\/regular\/documents\/23-0869-04000.pdf\" target=\"_blank\" rel=\"noopener\">North Dakota<\/a> bans all <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors. North Dakota is one of six states that makes providing care a criminal offense for medical professionals. Providing hormones or puberty blockers is a misdemeanor and surgical treatment is a felony. At present, adults may still access such care. The ban was upheld by the <span data-term-id=\"55751091\">U.S. <\/span><span data-term-id=\"55751067\">Supreme Court<\/span>.<\/p>\n<h3>Ohio<\/h3>\n<p><a href=\"https:\/\/search-prod.lis.state.oh.us\/api\/v2\/general_assembly_135\/legislation\/hb68\/05_EN\/pdf\/\" target=\"_blank\" rel=\"noopener\">Ohio<\/a> law specifically bans minors from receiving medical and surgical <span data-term-id=\"55751065\">gender-affirming care<\/span> and prohibits transgender females from competing in scholastic women\u2019s sports. It does not prohibit transgender males from competing in scholastic men\u2019s sports. The law also prohibits <span data-term-id=\"55751084\">mental health<\/span> practitioners from treating minors for <span data-term-id=\"55751085\">gender dysphoria<\/span> without first screening for other \u201cpsychopathologies\u201d and physical or emotional abuse.<\/p>\n<p>A legal case challenging the ban, <a href=\"https:\/\/www.aclu.org\/cases\/moe-v-yost\" target=\"_blank\" rel=\"noopener\"><em>Moe v. Yost<\/em><\/a><em>, <\/em>is currently on appeal. The ban is in place pending appeal.<\/p>\n<h3>Oklahoma<\/h3>\n<p><a href=\"http:\/\/webserver1.lsb.state.ok.us\/cf_pdf\/2023-24%20ENR\/SB\/SB613%20ENR.PDF\" target=\"_blank\" rel=\"noopener\">Oklahoma<\/a> is one of six states that make it a felony for doctors and medical professionals to provide <span data-term-id=\"55751065\">gender-affirming care<\/span> to minors. The law also prohibits all gender-affirming treatment for minors under 18. Prohibits the use of any public funds, including <span data-term-id=\"55751082\">Medicaid<\/span>, for minors and adults.<\/p>\n<h3>Oregon<\/h3>\n<p><a href=\"https:\/\/olis.oregonlegislature.gov\/liz\/2023R1\/Downloads\/MeasureDocument\/HB2002\/Enrolled\" target=\"_blank\" rel=\"noopener\">Oregon<\/a> is a shield state. Its laws require insurance companies to cover all medically necessary treatment, including <span data-term-id=\"55751065\">gender-affirming care<\/span>. <span data-term-id=\"55751065\">Gender-affirming care<\/span> is considered \u201cmedically essential care.\u201d The Oregon Health Plan is mandated to cover treatment for consenting individuals over 15 years of age.<\/p>\n<h3>Pennsylvania<\/h3>\n<p>Pennsylvania has no <span data-term-id=\"55751092\">state bans<\/span> against <span data-term-id=\"55751065\">gender-affirming care<\/span>. Pittsburgh has passed an affirmative sanctuary law protecting access within the city.<\/p>\n<h3><span data-term-id=\"55751113\">Rhode Island<\/span><\/h3>\n<p><a href=\"https:\/\/governor.ri.gov\/press-releases\/governor-mckee-signs-legislation-supporting-reproductive-health-care-lgbtq-community\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751113\">Rhode Island<\/span><\/a> is a shield state and protects patients from insurance denials and interference from <span data-term-id=\"55751090\">out-of-state<\/span> investigators. <a href=\"https:\/\/riag.ri.gov\/federal-action-response\/our-cases\/gender-affirming-care-declaration\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751113\">Rhode Island<\/span>\u2019s attorney general<\/a> has joined a state lawsuit challenging the Department of Health and Human Services (HHS) recent attempt to deny <span data-term-id=\"55751082\">Medicaid<\/span> funding to states that permit minors\u2019 access to <span data-term-id=\"55751065\">gender-affirming care<\/span>.<\/p>\n<h3><span data-term-id=\"55751088\">South Carolina<\/span><\/h3>\n<p><a href=\"https:\/\/www.scstatehouse.gov\/sess125_2023-2024\/bills\/4624.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751088\">South Carolina<\/span><\/a> is one of six states that has criminal penalties for <span data-term-id=\"55751066\">health care<\/span> professionals who provide <span data-term-id=\"55751065\">gender affirming care<\/span> to minors. Performing surgery is a felony with possible penalties of up to 25 years\u2019 imprisonment. <span data-term-id=\"55751069\">Providers<\/span> also face civil penalties and loss of their medical license.<\/p>\n<p><span data-term-id=\"55751088\">South Carolina<\/span>\u2019s laws also:<\/p>\n<ul>\n<li>\n<p>Require school officials to notify parents if children ask to use different pronouns, different names, or any other gender-related matters<\/p>\n<\/li>\n<li>\n<p>Bans the use of any public funds including <span data-term-id=\"55751082\">Medicaid<\/span> and state employee <span data-term-id=\"55751066\">healthcare<\/span> plans for any transition-related <span data-term-id=\"55751066\">healthcare<\/span>, including adults<\/p>\n<\/li>\n<\/ul>\n<h3>South Dakota<\/h3>\n<p><a href=\"https:\/\/sdlegislature.gov\/Session\/Bill\/24100\" target=\"_blank\" rel=\"noopener\">South Dakota<\/a>\u00a0has banned all forms of <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors, including \u201cvalidating a minor\u2019s perception\u201d of their gender. <span data-term-id=\"55751066\">Health care<\/span> <span data-term-id=\"55751069\">providers<\/span> may not provide hormones, puberty blockers, or surgical treatment. Penalties include loss of licensing and civil action. The law does not affect <span data-term-id=\"55751084\">mental health<\/span> treatment or prevent adults from seeking care. However, it bars public funds, including <span data-term-id=\"55751082\">Medicaid<\/span>, from being used.<\/p>\n<h3><span data-term-id=\"55751076\">Tennessee<\/span><\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/tn\/title-68-health-safety-and-environmental-protection\/tn-code-sect-68-33-103\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751076\">Tennessee<\/span><\/a> prohibits <span data-term-id=\"55751066\">health care<\/span> <span data-term-id=\"55751069\">providers<\/span> from giving <span data-term-id=\"55751065\">gender-affirming care<\/span> to minors. The law prohibits all forms of care, including hormones, puberty blockers, and surgical treatment for anyone under the age of 18. Penalties for violation include a private right of action for minors and for non-consenting parents (as in custody cases) and loss of medical license for up to two years.<\/p>\n<h3><span data-term-id=\"55751089\">Texas<\/span><\/h3>\n<p><a href=\"https:\/\/legiscan.com\/TX\/text\/SB14\/id\/2811355\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55751089\">Texas<\/span><\/a> law prohibits all <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors under the age of 18. Any entity that provides such care loses all public funding including <span data-term-id=\"55751082\">Medicaid<\/span>, CHIP and state funds. <span data-term-id=\"55751089\">Texas<\/span> requires individuals to use restrooms and other public facilities based on one\u2019s birth-assigned gender, and recognizes only two genders, \u201cmale\u201d and \u201cfemale&#8221;. Currently, there are no bans against adults who seek <span data-term-id=\"55751065\">gender-affirming care<\/span>.<\/p>\n<h3>Utah<\/h3>\n<p><a href=\"https:\/\/le.utah.gov\/~2023\/bills\/sbillenr\/SB0016.pdf\" target=\"_blank\" rel=\"noopener\">Utah<\/a> bans <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors, requires those receiving care at the time of the laws passage to cease treatment, and forbids any new treatment. The ban includes \u201cfacilitating treatment.\u201d Currently, <span data-term-id=\"55751084\">mental health<\/span> treatment is not affected, but legislation is being considered to make the moratorium permanent. Utah law requires individuals to use public restroom facilities, including school toilets, that correspond to their birth-assigned sex.<\/p>\n<h3>Vermont<\/h3>\n<p><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/01\/003\/00150\" target=\"_blank\" rel=\"noopener\">Vermont<\/a> is a sanctuary state. Vermont law protects <span data-term-id=\"55751077\">gender-affirming <\/span><span data-term-id=\"55751066\">healthcare<\/span> and shields <span data-term-id=\"55751090\">out-of-state<\/span> patients, doctors, and families. Health insurance companies must cover <span data-term-id=\"55751065\">gender-affirming care<\/span>. <a href=\"https:\/\/ago.vermont.gov\/blog\/2025\/12\/24\/attorney-general-clark-sues-trump-administration-federal-attack-gender-affirming-care\" target=\"_blank\" rel=\"noopener\">Vermont\u2019s Attorney General<\/a> has joined 17 other states challenging the HHS attempt to block <span data-term-id=\"55751082\">Medicaid<\/span> payments for states that provide <span data-term-id=\"55751065\">gender-affirming care<\/span> to minors.<\/p>\n<h3>Virginia<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/va\/title-38-2-insurance\/va-code-sect-38-2-3449-1\/\" target=\"_blank\" rel=\"noopener\">Virginia<\/a> does not have strong laws protecting or prohibiting <span data-term-id=\"55751077\">gender-affirming <\/span><span data-term-id=\"55751066\">healthcare<\/span> for minors or adults. All proposed restrictions have stalled in the legislature. Virginia prohibits insurance companies from discriminating against transgender adults.<\/p>\n<h3>Washington<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/wa\/title-74-public-assistance\/wa-rev-code-74-09-675\/\" target=\"_blank\" rel=\"noopener\">Washington<\/a> is a sanctuary state. The state\u2019s Gender Affirming Treatment Act provides strong protections for all <span data-term-id=\"55751065\">gender-affirming care<\/span>, prohibits law enforcement and other agencies from cooperating with <span data-term-id=\"55751090\">out-of-state<\/span> officials, protects <span data-term-id=\"55751066\">health care<\/span> <span data-term-id=\"55751069\">providers<\/span> who give treatment and services, and continues to expand protection and coverage.<\/p>\n<h3>West Virginia<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-30-professions-and-occupations\/wv-code-sect-30-3-20\/\" target=\"_blank\" rel=\"noopener\">West Virginia<\/a> defines \u201cbiological sex\u201d as the biological indicators and potential reproductive capacity present at birth, and \u201cgender\u201d as the psychosocial aspects of being male or female. Senate Bill 299, passed in June 2025, banned all remaining options for <span data-term-id=\"55751065\">gender-affirming care<\/span> for <span data-term-id=\"55751074\">transgender youth<\/span>.<\/p>\n<h3>Wisconsin<\/h3>\n<p>Wisconsin does not have any laws banning or protecting <span data-term-id=\"55751065\">gender-affirming care<\/span> for adults or minors. Several proposed laws passed the <span data-term-id=\"55751087\">state legislature<\/span> in 2025 but were vetoed by the governor. This state remains in flux.<\/p>\n<h3>Wyoming<\/h3>\n<p><a href=\"https:\/\/www.wyoleg.gov\/Legislation\/2024\/SF0099\" target=\"_blank\" rel=\"noopener\">Wyoming<\/a> specifically bans all forms of <span data-term-id=\"55751065\">gender-affirming care<\/span> for minors, although it excludes <span data-term-id=\"55751084\">mental health<\/span> treatment that does not violate the language of the statute. The law provides for the suspension of any medical professional, including nurses and pharmacists, who violate the law.<\/p>\n<p>The law does not affect adults who seek <span data-term-id=\"55751065\">gender-affirming care<\/span>.<\/p>\n<h2>Federal Laws On <span data-term-id=\"55751065\">Gender-Affirming Care<\/span><\/h2>\n<p>There have been a number of <span data-term-id=\"55751075\">Executive Orders<\/span> and declarations from the Department of Human Services affecting the accessibility of <span data-term-id=\"55751065\">gender-affirming care<\/span>.
