A small number of states extend restrictions to certain private businesses open to the public.<\/p>\n<p>Below, we\u2019ve compiled a list of states requiring individuals to access bathrooms based on their biological sex or the sex they were assigned at birth.<\/p>\n<p>More than twenty states have statewide laws or policies that restrict at least some <span data-term-id=\"57965682\">transgender people<\/span> from using bathrooms and similar facilities consistent with their <span data-term-id=\"57965681\">gender identity<\/span> in <span data-term-id=\"57965698\">public schools<\/span> or other government settings (see table below).<\/p>\n<p>In addition, many states and the District of Columbia require or encourage schools and other <span data-term-id=\"57965709\">public buildings<\/span> to make at least one single\u2011user or all\u2011gender restroom available. But specific requirements and terminology vary by jurisdiction.<\/p>\n<p>Many states do not have explicit statewide laws either requiring or banning access based on <span data-term-id=\"57965681\">gender identity<\/span>. In those jurisdictions, bathroom access is governed by a mix of local ordinances, school\u2011district policies, and broader <span data-term-id=\"57965693\">nondiscrimination laws<\/span>.<\/p>\n<h2>State <span data-term-id=\"57965684\">Bathroom Bans<\/span><\/h2>\n<p>In states with <span data-term-id=\"57965684\">bathroom bans<\/span>, most have similar locations where the ban applies and similar exceptions. Below are a few terms you\u2019ll find in the table:<\/p>\n<ul>\n<li>\n<p><strong>Standard applications:<\/strong> <span data-term-id=\"57965697\">K-12 schools<\/span>, state colleges and universities, and government-owned and operated facilities.<\/p>\n<\/li>\n<li>\n<p><strong>Standard bans:<\/strong> Multiple-occupancy restrooms, <span data-term-id=\"57965683\">locker rooms<\/span>, <span data-term-id=\"57965694\">changing rooms<\/span>, sleeping facilities.<\/p>\n<\/li>\n<li>\n<p><strong>Standard exceptions:<\/strong> Generally include maintenance and janitorial staff, assisting small children or disabled individuals, emergency or <span data-term-id=\"57965700\">law enforcement<\/span>, and inspections.<\/p>\n<\/li>\n<\/ul>\n<p>The table and list below reflect laws in effect or scheduled to take effect as of July 2026. The state filed a formal appeal on July 16, 2026.\u00a0<\/p>\n<h1>Court Cases on Bathroom Access<\/h1>\n<p>Bathroom access for <span data-term-id=\"57965741\">transgender individuals<\/span> has been litigated in various contexts, including workplaces, schools, and athletic facilities. And courts have reached vastly different conclusions over the past two decades.\u00a0<\/p>\n<p>The cases below involve both federal and state courts. Federal appellate court decisions interpret <a href=\"https:\/\/www.findlaw.com\/education\/discrimination-harassment-at-school\/title-ix-protections-for-transgender-students.html\">federal laws like Title IX<\/a> and apply across multiple states within their circuit. State <span data-term-id=\"57965686\">supreme court<\/span> decisions interpret state civil rights laws and are binding only within that state.<\/p>\n<p>One of the earliest cases on this issue came from <span data-term-id=\"57965728\">Minnesota<\/span>.<\/p>\n<p>In 2001, the <span data-term-id=\"57965728\">Minnesota<\/span> <span data-term-id=\"57965686\">Supreme Court<\/span> ruled in<a href=\"https:\/\/caselaw.findlaw.com\/court\/mn-supreme-court\/1061687.html\" target=\"_blank\" rel=\"noopener\"> <em><u>Goins v. West Group<\/u><\/em><\/a> that an employer requiring bathroom use based on &#8220;biological gender&#8221; was not discriminatory. This early case established a restrictive precedent in <span data-term-id=\"57965728\">Minnesota<\/span> employment settings. However, as noted above, <em>Goins<\/em> was only binding on <span data-term-id=\"57965728\">Minnesota<\/span> courts and employers.<\/p>\n<p>Few other state <span data-term-id=\"57965686\">supreme courts<\/span> addressed bathroom access issues for transgender workers during this era. While some states added <span data-term-id=\"57965681\">gender identity<\/span> protections to their civil rights statutes (such as<a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-civil-rights-laws.html\"> <u>California<\/u><\/a> in 2003), most disputes were resolved by state human rights commissions or settled before reaching appellate courts.\u00a0<\/p>\n<p>During this period, many states addressed transgender rights through legislation rather than litigation. By 2020, over 20 states and the District of Columbia had added explicit protections for <span data-term-id=\"57965681\">gender identity<\/span> to their <a href=\"https:\/\/www.findlaw.com\/state\/civil-rights-laws.html\"><u>civil rights laws<\/u><\/a>, while others issued administrative guidance through state human rights commissions. However, these protections rarely address bathroom access specifically, leaving that issue largely unresolved.<\/p>\n<p>While workplaces saw little litigation, schools became the primary battleground for <span data-term-id=\"57965689\">transgender bathroom<\/span> access cases. Federal appellate courts examining the same federal laws (mainly <a href=\"https:\/\/www.findlaw.com\/education\/discrimination-harassment-at-school\/title-ix-protections-for-transgender-students.html\"><u>Title IX<\/u><\/a> and the Fourteenth Amendment\u2019s <a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation04.html\" target=\"_blank\" rel=\"noopener\"><u>equal protection clause<\/u><\/a>) reached opposite conclusions, creating a circuit split that persists today.<\/p>\n<p>We explore some of these landmark cases below.\u00a0<\/p>\n<h3>G.G. v. Gloucester County School Board (2015 &#8211; 2021)<\/h3>\n<p><strong>Fourth Circuit Court of Appeals: Binding precedent for Maryland, <span data-term-id=\"57965695\">North Carolina<\/span>, <span data-term-id=\"57965731\">South Carolina<\/span>, Virginia, West Virginia<\/strong><\/p>\n<p>In 2015, transgender high schooler Gavin Grimm sued the Gloucester County School Board for gender discrimination under Title IX, for being required to use the girls&#8217; bathroom instead of the boys&#8217; bathroom that matched his gender preference. The federal district court initially held that the School Board had not discriminated and that Title IX did not include <span data-term-id=\"57965681\">gender identity<\/span>.<\/p>\n<p>In 2016, the Fourth Circuit <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-4th-circuit\/1732026.html\" target=\"_blank\" rel=\"noopener\"><u>overturned the lower court&#8217;s judgment<\/u><\/a> and remanded the case for retrial, finding that the lower court failed to follow <span data-term-id=\"57965736\">Department of Education<\/span> guidelines and that the district court judge made prejudicial remarks.\u00a0<\/p>\n<p>The case was appealed to the U.S. <span data-term-id=\"57965686\">Supreme Court<\/span>, which vacated the Fourth Circuit decision in 2017 because the Trump administration abandoned the OCR guidelines. The case was returned to the trial court, which ruled in Grimm&#8217;s favor in 2019. The School Board appealed in 2020, and the Fourth Circuit upheld that ruling. <a href=\"https:\/\/www.acluva.org\/press-releases\/supreme-court-allows-gavin-grimms-victory-stand\/\" target=\"_blank\" rel=\"noopener\"><u>The <span data-term-id=\"57965686\">Supreme Court<\/span> declined to take the case in 2021<\/u><\/a>, allowing the lower court decisions to stand.\u00a0<\/p>\n<h3>Ashton Whitaker v. Kenosha Unified <span data-term-id=\"57965737\">School District<\/span> No. 1 Board of Education (2017)<\/h3>\n<p><strong>Seventh Circuit Court of Appeals: Binding precedent for Illinois, Indiana, Wisconsin<\/strong><\/p>\n<p><a href=\"https:\/\/transgenderlawcenter.org\/category\/cases\/whitaker\/\" target=\"_blank\" rel=\"noopener\">Ashton (Ash) Whitaker<\/a>, a <span data-term-id=\"57965733\">transgender youth<\/span> in Wisconsin, began publicly identifying as male in ninth grade. In his sophomore year, Ash requested permission to use the boys&#8217; restrooms. The school denied the request and told him he had two options:<\/p>\n<ul>\n<li>\n<p>Use the girls&#8217; restrooms, or<\/p>\n<\/li>\n<li>\n<p>Use a single-user <span data-term-id=\"57965723\">gender-neutral<\/span> bathroom in the main office, far from his classrooms<\/p>\n<\/li>\n<\/ul>\n<p>Ash was the only student given access to the <span data-term-id=\"57965723\">gender-neutral<\/span> bathroom, which further singled him out amongst his classmates. To avoid using any restrooms, Ash began restricting his water intake at school. This exacerbated a medical condition that causes fainting and seizures when dehydrated. He also experienced severe depression, anxiety, and suicidal ideation.<\/p>\n<p>During his junior year, Ash used the boys&#8217; restrooms for six months without incident or complaint from other students. However, after a teacher saw him washing his hands in a boys&#8217; restroom, school administrators again prohibited his access. The school stated he would need &#8220;legal or medical documentation&#8221; to change his designation in school records. But they never provided a written policy explaining what documentation would suffice. Two letters from Ash&#8217;s pediatrician identifying him as transgender were deemed insufficient. School officials indicated that Ash would have to go through a surgical transition (a procedure that\u2019s typically prohibited for <span data-term-id=\"57965720\">minors<\/span>) in order to use the boys\u2019 bathrooms.<\/p>\n<p>Security guards were instructed to monitor Ash&#8217;s bathroom use, and he was repeatedly removed from class to discuss policy violations. This drew attention from classmates and teachers, further intensifying his depression and anxiety.<\/p>\n<p>Ash filed suit under federal civil rights laws and requested a preliminary injunction allowing him to use the boys&#8217; restroom while the case was pending. The district court granted the injunction.<\/p>\n<p>The<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-7th-circuit\/1862358.html\" target=\"_blank\" rel=\"noopener\"> <u>Seventh Circuit affirmed<\/u><\/a>, holding that Ash was likely to succeed on both his Title IX and equal protection claims. The court found that while the policy caused well-documented harm to Ash, the harms it aimed to prevent (identified by the <span data-term-id=\"57965737\">school district<\/span>) were all speculative.<\/p>\n<p>The school initially appealed to the <a href=\"https:\/\/www.scotusblog.com\/cases\/kenosha-unified-school-district-no-1-board-education-v-whitaker\/\" target=\"_blank\" rel=\"noopener\">U.S. <span data-term-id=\"57965686\">Supreme Court<\/span><\/a>. But, in 2018, it withdrew the appeal and settled.<\/p>\n<h3>Doe v. Boyertown Area <span data-term-id=\"57965737\">School District<\/span> (2017-2019)<\/h3>\n<p><strong>Third Circuit Court of Appeals: Binding precedent for Delaware, New Jersey, Pennsylvania, U.S. Virgin Islands<\/strong><\/p>\n<p>In 2017, a student sued the Boyertown Area <span data-term-id=\"57965737\">School District<\/span> in Pennsylvania. They alleged that allowing transgender boys to use the same bathroom and <span data-term-id=\"57965683\">locker room<\/span> as the student violated their right to privacy.<\/p>\n<p>The student asked for an injunction to prohibit the <span data-term-id=\"57965737\">School District<\/span> from allowing <span data-term-id=\"57965726\">transgender students<\/span> to use the bathrooms and <span data-term-id=\"57965683\">locker rooms<\/span> consistent with their gender. The federal district court denied the student&#8217;s motion for a preliminary injunction.<\/p>\n<p>The<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-3rd-circuit\/1899569.html\" target=\"_blank\" rel=\"noopener\"> <u>Third Circuit upheld the ruling<\/u><\/a>. The school responded with a &#8220;Student Safety Plan&#8221; that allowed him and others to use the <span data-term-id=\"57965683\">locker rooms<\/span>, restrooms, and showers consistent with their <span data-term-id=\"57965681\">gender identity<\/span>.\u00a0<\/p>\n<p>A group of parents and students sued two years later, citing privacy and religious freedom concerns. The federal district court dismissed the case.<\/p>\n<p>The<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-9th-circuit\/2047934.html\" target=\"_blank\" rel=\"noopener\"> <u>Ninth Circuit upheld the district court&#8217;s ruling<\/u><\/a>. The U.S. <span data-term-id=\"57965686\">Supreme Court<\/span> denied certiorari later that year.<\/p>\n<h3>Drew Adams v. School Board of St. Johns County, <span data-term-id=\"57965688\">Florida<\/span> (2017-2022)<\/h3>\n<p><strong>Eleventh Circuit Court of Appeals: Binding precedent for <span data-term-id=\"57965712\">Alabama<\/span>, <span data-term-id=\"57965688\">Florida<\/span>, Georgia<\/strong><\/p>\n<p>In 2017, Drew Adams filed suit in federal district court against the St. Johns County School Board because he was required to use the girls&#8217; bathroom or a <span data-term-id=\"57965723\">gender-neutral<\/span> bathroom instead of the bathroom that aligned with his gender preference. He alleged that the restrictions and bathroom policy violated his rights under Title IX and the Equal Protection Clause.<\/p>\n<p>A federal district court three-judge panel initially ruled for Adams. However, in 2021, the full Eleventh Circuit vacated the decision and reheard the appeal. In 2022, the<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-11th-circuit\/2080486.html\" target=\"_blank\" rel=\"noopener\"> <u>full court held that Title IX allowed schools to determine gender based on biological sex<\/u><\/a>.<\/p>\n<p>This created the circuit split. The Third, Fourth, Seventh, and Ninth Circuits found that Title IX and the Equal Protection Clause permit <span data-term-id=\"57965726\">transgender students<\/span> to use bathrooms and <span data-term-id=\"57965683\">locker rooms<\/span> based on their <span data-term-id=\"57965681\">gender identity<\/span>. The Eleventh Circuit disagreed.\u00a0<\/p>\n<p>Despite this split and continued requests for clarification, the U.S. <span data-term-id=\"57965686\">Supreme Court<\/span> has stayed out of the debate, denying certiorari on at least three occasions since 2019. The Court has allowed laws on both sides of the issue to stand, permitting schools to both allow and deny <span data-term-id=\"57965689\">transgender bathroom<\/span> access.<\/p>\n<h3>The <span data-term-id=\"57965686\">Supreme Court<\/span> Weighs In<\/h3>\n<p>In 2020, the <span data-term-id=\"57965686\">Supreme Court<\/span>&#8216;s decision in<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/17-1618.html\" target=\"_blank\" rel=\"noopener\"> <em><u>Bostock v. Clayton County<\/u><\/em><\/a> held that discrimination against people for their <span data-term-id=\"57965701\">sexual orientation<\/span> and <span data-term-id=\"57965681\">gender identity<\/span> was prohibited in the workplace under Title VII of the Civil Rights Act. The decision represented a major victory for <span data-term-id=\"57965685\">LGBTQ<\/span>+ workplace rights.<\/p>\n<p>However, the decision was narrow. The justices made it clear that<a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/bostock-v--clayton-county-case-summary-.html#:~:text=Justice%20Alito%20also%20worried%20about%20the%20decision%27s%20impact%20on%20issues%20outside%20of%20the%20direct%20scope%20of%20the%20case%2C%20such%20as%20bathroom%20policies%20for%20schools%20and%20gyms.%20The%20majority%2C%20however%2C%20explicitly%20stated%20this%20ruling%20did%20not%20decide%20those%20issues%20in%20advance%20of%20any%20potential%20litigation.\" target=\"_blank\" rel=\"noopener\"> <u>it did not address bathroom access<\/u><\/a>. Justice Alito raised concerns about the decision&#8217;s potential impact on bathroom policies for schools and gyms in his dissent, but the majority explicitly stated this ruling did not decide those issues.<\/p>\n<p>Following <em>Bostock<\/em>, the U.S. Department of Labor&#8217;s Occupational Safety and Health Administration (OSHA) issued guidance with best practices for bathroom access for transgender employees. The main requirement was to create safe and convenient access to bathrooms consistent with an employee&#8217;s <span data-term-id=\"57965681\">gender identity<\/span>. These best practices told employers they could not require employees to provide medical or legal documentation of their <span data-term-id=\"57965681\">gender identity<\/span> as a prerequisite to using the bathroom that aligns with their gender.<\/p>\n<p>After <em>Bostock<\/em>, some state courts began reconsidering earlier restrictive precedents, while the unresolved circuit split in school cases continued to widen.<\/p>\n<h3>N.H. v. Anoka-Hennepin <span data-term-id=\"57965737\">School District<\/span> No. 11 (2020)<\/h3>\n<p>In 2020, the <span data-term-id=\"57965728\">Minnesota<\/span> Court of Appeals <a href=\"https:\/\/www.genderjustice.us\/wp-content\/uploads\/2020\/02\/09-28-20-Court-of-Appeals-decison.pdf\" target=\"_blank\" rel=\"noopener\"><u>distinguished the state&#8217;s earlier <\/u><em><u>Goins<\/u><\/em><u> decision<\/u><\/a>, holding that <em>Goins<\/em>&#8216; restrictive employment precedent does not apply in educational settings. The court concluded that restricting <span data-term-id=\"57965683\">locker room<\/span> access based on <span data-term-id=\"57965681\">gender identity<\/span> violated the <span data-term-id=\"57965728\">Minnesota<\/span> Human Rights Act. While <em>Anoka-Hennepin<\/em> involved a school rather than a workplace, it signaled <span data-term-id=\"57965728\">Minnesota<\/span> courts&#8217; willingness to limit <em>Goins<\/em>&#8216; reach.<\/p>\n<h3>Cooper v. USA Powerlifting (2025)<\/h3>\n<p>In 2025, in a case involving athletic facility access, <a href=\"https:\/\/caselaw.findlaw.com\/court\/mn-court-of-appeals\/115948558.html\" target=\"_blank\" rel=\"noopener\"><u>the <span data-term-id=\"57965728\">Minnesota<\/span> <span data-term-id=\"57965686\">Supreme Court<\/span> further clarified<\/u><\/a> that <em>Goins<\/em> was a narrow decision specifically tied to &#8220;employment&#8221; and &#8220;<span data-term-id=\"57965701\">sexual orientation<\/span>&#8221; definitions as they existed in 1997\u20132001. This suggests the court may not be willing to apply <em>Goins <\/em>to current <span data-term-id=\"57965681\">gender identity<\/span> claims.<\/p>\n<h2>Federal Restrictions<\/h2>\n<p>Beginning in 2025, federal policy shifted dramatically toward more restrictive interpretations of transgender rights, including bathroom access.<\/p>\n<p>On January 20, 2025, President Trump issued Executive Order 14168, which fundamentally changed federal policy regarding <span data-term-id=\"57965741\">transgender individuals<\/span>. The order defines &#8220;sex&#8221; as an immutable biological classification as either male or female, explicitly stating that sex is &#8220;not changeable&#8221; and excludes the concept of &#8220;<span data-term-id=\"57965681\">gender identity<\/span>.&#8221;<\/p>\n<p>The order directs all federal agencies to use these definitions when interpreting and applying federal law. It also requires that sex-segregated spaces\u2014including bathrooms, prisons, shelters, and detention facilities\u2014be designated by biological sex rather than <span data-term-id=\"57965681\">gender identity<\/span>. It specifically addresses the <span data-term-id=\"57965686\">Supreme Court<\/span>&#8216;s <em>Bostock<\/em> decision, directing the Attorney General to issue guidance clarifying that <em>Bostock<\/em> does not require <span data-term-id=\"57965681\">gender identity<\/span>-based access to single-sex spaces under laws like Title IX.<\/p>\n<p>The order also mandates that federal agencies remove all policies promoting &#8220;gender ideology,&#8221; revise government-issued identification documents to reflect biological sex, and ensure that federal funds are not used to support <span data-term-id=\"57965681\">gender identity<\/span>-based policies. It rescinds multiple prior executive orders and guidance documents that had extended protections to <span data-term-id=\"57965741\">transgender individuals<\/span>.<\/p>\n<p>Later that year, the state of <span data-term-id=\"57965690\">Texas<\/span> filed suit against the Equal Employment Opportunity Commission (EEOC), alleging that the agency had overstepped its mandate and misinterpreted portions of Title VII of the Civil Rights Act. The judge in that case agreed and<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCOURTS-txnd-2_24-cv-00173\/pdf\/USCOURTS-txnd-2_24-cv-00173-0.pdf\" target=\"_blank\" rel=\"noopener\"> <u>ordered the EEOC to remove portions of the guidance<\/u><\/a> specifically referring to <span data-term-id=\"57965741\">transgender individuals<\/span>.<\/p>\n<p>In January 2026, the EEOC rescinded previous guidance on the issue of misgendering <span data-term-id=\"57965741\">transgender individuals<\/span> in the workplace. The guidance had included<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/transgender-employee-issues.html\"> <u>detailed hypotheticals<\/u><\/a> of what might and might not be considered &#8220;harassment&#8221; and how employers might deal with such issues in their own workplaces.<\/p>\n<p>The EEOC board stated that, in their view, &#8220;sex&#8221; as defined in the <span data-term-id=\"57965686\">Supreme Court<\/span>&#8216;s decision <em>Bostock v. Clayton County<\/em> (2020) only refers to biological sexual markers and not to <span data-term-id=\"57965681\">gender identity<\/span>, and that protections in <em>Bostock<\/em> only extend to adverse actions such as termination.<\/p>\n<p>In February 2026, <a href=\"https:\/\/www.eeoc.gov\/sites\/default\/files\/2026-02\/2025003976.pdf\" target=\"_blank\" rel=\"noopener\"><u>the EEOC ruled 2-1<\/u><\/a> that federal agencies may require transgender employees to use bathrooms corresponding to their birth sex. The case involved a civilian worker at a military facility.<\/p>\n<p>In the first case of its kind filed since the EEOC ruling and Executive Order #14168, <a href=\"https:\/\/www.aclu.org\/cases\/withrow-v-united-states-et-al#legal-documents\" target=\"_blank\" rel=\"noopener\"><em><u>Withrow v. United States<\/u><\/em><\/a> is a class action lawsuit filed by the <span data-term-id=\"57965725\">ACLU<\/span> on behalf of all individuals affected by the order. <em>Withrow<\/em> was filed in December 2025 and the defendants filed a motion to dismiss or transfer in March 2026.
