This is because it could open the school to liability and abuse problems. For example, students may begin selling prescription drugs to other students. However, many students have legitimate medical needs. Most states have laws and procedures for dispensing medications to students.<a title=\"Code of Virginia \u00a7 54.1-3408\" href=\"https:\/\/law.lis.virginia.gov\/vacode\/title54.1\/chapter34\/section54.1-3408\/\" target=\"_blank\" rel=\"noopener\"><\/a><\/p>\r\n<p>The state department of education often requires public schools within the state to adopt policies. These policies should address the administration of medication. The following information provides an overview of relevant state laws. These laws govern the administration of medication in schools.<\/p>\r\n<h2>General Overview: Medication at School<\/h2>\r\n<p>For many students, taking medicine during the school day is crucial. They may need these interventions to stay healthy and take part in school activities. Often, a middle school or high school staff member is responsible for giving medicine to students. These school staff follow strict rules to ensure school safety. They must follow guidelines before dispensing any medication. This is true regardless of whether the medication is over-the-counter or prescription.<\/p>\r\n<p>For example, medications must be in their original containers. This helps the school staff ensure they give the right medicine to the right student. It also ensures the medicine is safe and has not expired. Parents share information about the student&#8217;s health condition at enrollment. This information helps the school prepare. For example, the school knows to keep auto-injectors handy if a student has anaphylaxis or a severe allergic reaction.<\/p>\r\n<p>Medicines aren&#8217;t only given during regular school hours. The school staff is responsible for students on field trips or attending after-school activities. They must make sure they get the medicine they need.<\/p>\r\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/rehabilitation-act-of-1973-sections-501-and-505.html\" title=\"Rehabilitation Act of 1973\">Rehabilitation Act of 1973<\/a>&nbsp;is a federal law addressing related services for students with disabilities. This law requires schools to help students with disabilities in many ways, including by giving them their medicine. Parents must collect any medicine left at school when the school year finishes. It also creates rules and regulations to approve medication administration.<\/p>\r\n<h3><a id=\"Alaska\"><\/a>Alaska<\/h3>\r\n<p>The&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ak\/title-14-education-libraries-and-museums\/ak-st-sect-14-30-141.html\" title=\"Alaska Statutes Title 14. The School Nursing\/School Health Program and the School Health Nurse Advisory Committee also contributed.<\/p>\r\n<h3><a id=\"Arizona\"><\/a>Arizona<\/h3>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/az\/title-15-education\/az-rev-st-sect-15-344\/\" title=\"Arizona Revised Statutes Title 15. Education \u00a7 15-344\" target=\"_blank\" rel=\"noopener\">Title 15 of the Arizona Revised Statutes&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a>&nbsp;<a href=\"https:\/\/codes.findlaw.com\/az\/title-15-education\/az-rev-st-sect-15-344\/\" title=\"Arizona Revised Statutes Title 15. Education \u00a7 15-344\" target=\"_blank\" rel=\"noopener\">15-344<\/a>&nbsp;provides for administering prescription, patent, or proprietary medications by school employees. The law delegates authority to establish policies and procedures to local school district governing boards.<\/p>\r\n<h3><a id=\"Arkansas\"><\/a>Arkansas<\/h3>\r\n<p>Under&nbsp;<a href=\"https:\/\/govt.westlaw.com\/arreg\/Document\/NF7456A607CF711EB9C3EF341DD7766C6?originationContext=document&amp;transitionType=StatuteNavigator&amp;needToInjectTerms=False&amp;viewType=FullText&amp;contextData=%28sc.Default%29\" target=\"_blank\" title=\"Arkansas Administrative Code\" rel=\"noopener\">Arkansas Code<\/a>&nbsp;<a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a>&nbsp;<a href=\"https:\/\/govt.westlaw.com\/arreg\/Document\/NF7456A607CF711EB9C3EF341DD7766C6?originationContext=document&amp;transitionType=StatuteNavigator&amp;needToInjectTerms=False&amp;viewType=FullText&amp;contextData=%28sc.Default%29#:~:text=No%20medication%20shall%20be%20dispensed,them%20on%20the%20medical%20record.\" target=\"_blank\" title=\"Arkansas Administrative Code\" rel=\"noopener\">007.05.10-12<\/a>, licensed nursing personnel must give medications. The Arkansas Nurse Practice Act requires this. The law also requires a written order by a licensed prescriber before any medication is dispensed or administered.<\/p>\r\n<h3><a id=\"California\"><\/a>California<\/h3>\r\n<p>The&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ca\/education-code\/edc-sect-49423-6\/\" title=\"California Code, Education Code - EDC \u00a7 49423.6\" target=\"_blank\" rel=\"noopener\">California Education Code&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"https:\/\/codes.findlaw.com\/ca\/education-code\/edc-sect-49423-6\/\" target=\"_blank\" rel=\"noopener\">&nbsp;49423.6<\/a>&nbsp;requires the state board of education to adopt regulations on the administration of prescription medication in public schools. The law clarifies that any administration is to be at the request of the student&#8217;s parent or legal guardian.<\/p>\r\n<h3><a id=\"Colorado\"><\/a>Colorado<\/h3>\r\n<p>The state of Colorado addresses student possession and administration of medication in&nbsp;<a href=\"https:\/\/codes.findlaw.com\/co\/title-22-education\/co-rev-st-sect-22-1-119-3\/\" title=\"Colorado Revised Statutes Title 22. Education \u00a7 22-1-119.3\" target=\"_blank\" rel=\"noopener\">Colorado Revised Statutes \u00a7 22-1-119.3<\/a>. This law requires school district boards of education to adopt and implement policies relevant to the administration of medication at school. It defines the process for approval and outlines prohibited substances.<\/p>\r\n<h3><a id=\"Connecticut\"><\/a>Connecticut<\/h3>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/ct\/title-10-education-and-culture\/ct-gen-st-sect-10-212a\/\" title=\"Connecticut General Statutes Title 10. Education and Culture \u00a7 10-212a\" target=\"_blank\" rel=\"noopener\">Connecticut General Statute&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a>&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ct\/title-10-education-and-culture\/ct-gen-st-sect-10-212a\/\" target=\"_blank\" rel=\"noopener\">10-212a<\/a>, as well as&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ct\/title-10-education-and-culture\/ct-gen-st-sect-10-212a\/\" title=\"Connecticut General Statutes Title 10. Education and Culture \u00a7 10-212a\" target=\"_blank\" rel=\"noopener\">Connecticut State Agencies Regulation&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7\u00a7<\/a>&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ct\/title-10-education-and-culture\/ct-gen-st-sect-10-212a\/\" target=\"_blank\" rel=\"noopener\">10-212a-2, 5, and 6<\/a>, allow school boards of education to adopt written policies. A Connecticut law passed in 2001 (the first of its kind in the nation) prohibits teachers, counselors, and other school personnel from recommending psychiatric drugs for schoolchildren. The state&nbsp;<a href=\"https:\/\/portal.ct.gov\/-\/media\/SDE\/School-Nursing\/Medication_Administration_Regs.pdf\" target=\"_blank\" title=\"Administration of Medication\" rel=\"noopener\">requires schools to document any skipped dose<\/a>&nbsp;and the reasons for it.<\/p>\r\n<h3><a id=\"Delaware\"><\/a>Delaware<\/h3>\r\n<p>The&nbsp;<a href=\"https:\/\/regulations.delaware.gov\/AdminCode\/title14\/800\/817.shtml\" target=\"_blank\" title=\"Medications and Treatments\" rel=\"noopener\">Delaware Regulations Administrative Code Title 14&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"https:\/\/regulations.delaware.gov\/AdminCode\/title14\/800\/817.shtml\" target=\"_blank\" rel=\"noopener\">&nbsp;817<\/a>&nbsp;addresses medications and treatments in school. The section provides guidance on the medications and treatments for students pursuant to the Delaware code.<\/p>\r\n<h3><a id=\"District\"><\/a>District of Columbia<\/h3>\r\n<p><a href=\"https:\/\/doh.dc.gov\/sites\/default\/files\/dc\/sites\/doh\/publication\/attachments\/DC%20Nurse%20Practice%20Act.pdf\" target=\"_blank\" title=\"District of Columbia Nurse Practice Act\" rel=\"noopener\">D.C. Code \u00a7 38-632<\/a>&nbsp;gives school employees the right to administer medication. D.C. schools must get authorization from the student&#8217;s parent or guardian, as well as orders\/instructions from the licensed physician before administering medication. School personnel must be trained&nbsp;<a href=\"https:\/\/dcps.dc.gov\/health\" target=\"_blank\" title=\"Medication and Treatment at School\" rel=\"noopener\">to administer medications<\/a>. Each school must have three trained personnel, including two trained to manage diabetes.<\/p>\r\n<h3><a id=\"Florida\"><\/a>Florida<\/h3>\r\n<p><a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_Mode=Display_Statute&amp;Search_String=&amp;URL=Ch0232\/Sec46.htm&amp;StatuteYear=1999\" target=\"_blank\" title=\"Florida Statutes\" rel=\"noopener\">Florida Statutes Annotated&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a>&nbsp;<a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_Mode=Display_Statute&amp;Search_String=&amp;URL=Ch0232\/Sec46.htm&amp;StatuteYear=1999\" target=\"_blank\" rel=\"noopener\">232.46<\/a>&nbsp;require district school boards to adopt local policies and procedures. Each school district must include a school health services plan to provide training by a registered nurse or licensed practical nurse. Each district school board must adopt policies and procedures governing the administration of prescription medication.<\/p>\r\n<h3><a id=\"Georgia\"><\/a>Georgia<\/h3>\r\n<p>Georgia codifies self-administration of medication laws under the&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ga\/title-20-education\/ga-code-sect-20-2-776.html\" title=\"Georgia Code Title 20. Education \u00a7 20-2-776\" target=\"_blank\" rel=\"noopener\">Georgia Code \u00a7 20-2-776<\/a>. This statute clarifies that each local board of education should adopt a policy. This policy should allow students to carry and self-administer prescription auto-injectable epinephrine. The student&#8217;s parent or guardian should provide a written statement from the physician under Chapter 34 of Title 43. They should also provide a written statement by the parent\/guardian.<\/p>\r\n<h3><a id=\"Hawaii\"><\/a>Hawaii<\/h3>\r\n<p>Under the Hawaii Revised Statutes, medication administration is codified under&nbsp;<a href=\"https:\/\/www.capitol.hawaii.gov\/hrscurrent\/vol05_ch0261-0319\/hrs0302a\/hrs_0302a-1164.htm\" target=\"_blank\" title=\"Self-Administration of Medication by Student\" rel=\"noopener\">\u00a7 302A-1164<\/a>. Under this law, the department permits the self-administration of certain medications. For example, it allows the self-administration of medication for asthma, anaphylaxis, diabetes, or other life-threatening illnesses and blood glucose monitoring for the student. The student&#8217;s parent or guardian must provide written authorization. There should also be a written certification from the student&#8217;s physician.<\/p>\r\n<h3><a id=\"Idaho\"><\/a>Idaho<\/h3>\r\n<p>The state codified the administration of medication under&nbsp;<a href=\"https:\/\/codes.findlaw.com\/id\/title-33-education\/id-st-sect-33-520\/\" title=\"Idaho Statutes Title 33. Education \u00a7 33-520\" target=\"_blank\" rel=\"noopener\">Idaho Statutes \u00a7 33-520<\/a>. Under this law, the board of trustees of each school district must adopt a policy permitting the self-administration of medication. The student is permitted to have and use a prescribed inhaler or epinephrine auto-injector. The student may also use insulin or blood glucose monitoring supplies anytime.<\/p>\r\n<h3><a id=\"Illinois\"><\/a>Illinois<\/h3>\r\n<p>Under&nbsp;<a href=\"https:\/\/codes.findlaw.com\/il\/chapter-105-schools\/il-st-sect-105-5-10-20-14b\/\" title=\"Illinois Statutes Chapter 105. This law requires school boards to develop local policies for school administration of medication. The state also adopts the policy that the administration of medication to students during regular school hours and during school-related activities should be discouraged.<\/p>\r\n<p>Medication should be &quot;limited to those required during school hours which are necessary to maintain the student in school and those needed in the event of an emergency.&quot; This is according to the &quot;<a href=\"https:\/\/www.dhs.state.il.us\/onenetlibrary\/27897\/documents\/schoolhealth\/medguide2000.pdf\" target=\"_blank\" title=\"Recommended Guidelines for Medication Administration in Schools\" rel=\"noopener\">Recommended Guidelines for Medication Administration in Schools<\/a>.&quot; The Illinois Department of Human Services and the Illinois State Board of Education published this document.<\/p>\r\n<h3><a id=\"Indiana\"><\/a>Indiana<\/h3>\r\n<p>Medication administration is codified under Title 20: Education. Under&nbsp;<a href=\"https:\/\/codes.findlaw.com\/in\/title-20-education\/in-code-sect-20-19-8-3\/\" title=\"Indiana Code Title 20. Education \u00a7 20-19-8-3\" target=\"_blank\" rel=\"noopener\">I.C. \u00a7 20-19-8-3<\/a>, the medication administration code is under&nbsp;<a href=\"https:\/\/casetext.com\/regulation\/indiana-administrative-code\/title-511-indiana-state-board-of-education\/article-7-special-education\/rule-511-iac-7-36-general-administration-of-programs\/section-511-iac-7-36-9-medication-administration\" target=\"_blank\" title=\"511 Ind. Admin. Code 7-36-9\" rel=\"noopener\">511 Indiana Administrative Cod \u00a7 7-36-9<\/a>. This code establishes written medication administration policies for public schools.<\/p>\r\n<h3><a id=\"Iowa\"><\/a>Iowa<\/h3>\r\n<p>Iowa Section 507.2&nbsp;provides for the administration of medicine to students.&nbsp;This&nbsp;<a href=\"https:\/\/emmetsburg.iowaschoolfinance.com\/book\/export\/html\/752\" target=\"_blank\" title=\"Administration of Medication to Students\" rel=\"noopener\">statute<\/a>&nbsp;requires agencies to establish medication administration policies and procedures, including certain provisions. The code also mandates that medication must be in its original container. Schools should also keep a record containing certain information required by the statute.<\/p>\r\n<h3><a id=\"Kansas\"><\/a>Kansas<\/h3>\r\n<p>The state of Kansas codifies the administration of medication under&nbsp;<a href=\"http:\/\/www.kslegislature.org\/li_2012\/b2011_12\/statute\/072_000_0000_chapter\/072_082_0000_article\/072_082_0052_section\/072_082_0052_k\/\" target=\"_blank\" title=\"Policies To Allow Student to Self-Administer Certain Medications\" rel=\"noopener\">Kansas Statute \u00a7 72-8252<\/a>. This statute addresses the self-administration of medication and the related regulations. The law also encourages schools to adopt policies pursuant to other state laws.<\/p>\r\n<h3><a id=\"Kentucky\"><\/a>Kentucky<\/h3>\r\n<p><a href=\"https:\/\/apps.legislature.ky.gov\/law\/kar\/titles\/702\/001\/160\/\" target=\"_blank\" title=\"Kentucky 158:834\" rel=\"noopener\">Kentucky 158:834<\/a>&nbsp;addresses medications at schools. Under this law, a school employee must be trained to administer medication to a student. This law also addresses the self-administration of glucagon, insulin, or seizure rescue medications.<\/p>\r\n<h3><a id=\"Louisiana\"><\/a>Louisiana<\/h3>\r\n<p><a href=\"https:\/\/legis.la.gov\/legis\/Law.aspx?d=81087\" target=\"_blank\" title=\"Louisiana Revised Statute\u00a7 17:436.1\" rel=\"noopener\">Louisiana Revised Statute<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a>&nbsp;<a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-17-sect-436.html#:~:text=(1)%20A%20registered%20nurse%20or,the%20legal%20standards%20of%20the\" target=\"_blank\" rel=\"noopener\">17:436.1<\/a>&nbsp;prescribes policies for delegating administration of medications in schools to unlicensed personnel and makes other provisions.<\/p>\r\n<h3><a id=\"Maine\"><\/a>Maine<\/h3>\r\n<p>Maine codifies the administration of medication under&nbsp;<a href=\"https:\/\/mainelegislature.org\/legis\/statutes\/20-A\/title20-Asec254.html\" target=\"_blank\" title=\"Title 20A of the Maine Revised Statutes \u00a7 254.5\" rel=\"noopener\">Title 20A of the Maine Revised Statutes \u00a7 254.5<\/a>. The law states that schools must adopt rules for the administration of medication in public or approved private schools. They must each create a written local policy and procedure for administering medication.<\/p>\r\n<h3><a id=\"Maryland\"><\/a>Maryland<\/h3>\r\n<p>The&nbsp;<a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" title=\"Maryland Code, Education \u00a7 7-401\" target=\"_blank\" rel=\"noopener\">Annotated Code of Maryland Education Code \u00a7 7-401<\/a>&nbsp;codifies the administration of medication in this statute. It works in conjunction with&nbsp;<a href=\"http:\/\/mdrules.elaws.us\/comar\/13a.05.05.08\" target=\"_blank\" title=\"Maryland Administrative Regulation\" rel=\"noopener\">Maryland Administrative Regulation<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a>&nbsp;<a href=\"http:\/\/mdrules.elaws.us\/comar\/13a.05.05.08\" target=\"_blank\" rel=\"noopener\">13A.05.05.08 and 10<\/a>. This law requires county boards of education to adopt policies for the administration and storage of medication within school systems.<\/p>\r\n<h3><a id=\"Massachusetts\"><\/a>Massachusetts<\/h3>\r\n<p>Massachusetts was one of the earliest to have a statute in place, dating from the early 1970s. New regulations were created in 1993, and old ones were updated. Four statutes in the Massachusetts General Laws are pertinent.<\/p>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-71-sect-53\/\" title=\"Massachusetts General Laws Part I\" target=\"_blank\" rel=\"noopener\">Chapter 71&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-71-sect-53\/\" target=\"_blank\" rel=\"noopener\">&nbsp;53<\/a>&nbsp;requires registered nurses in all public school districts. Chapter 71, Section 54B contains registration requirements for students receiving medications.&nbsp;<a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=210.003\" target=\"_blank\" title=\"105 Code of Massachusetts\" rel=\"noopener\">105 Code of Massachusetts Reg.&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7\u00a7<\/a>&nbsp;<a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=210.003\" target=\"_blank\" rel=\"noopener\">210.003<\/a>&nbsp;to&nbsp;<a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=210.100&amp;bid=11285\" target=\"_blank\" title=\"210.100\" rel=\"noopener\">210.100<\/a>&nbsp;requires schools to adopt local policies consistent with the above laws and regulations.<\/p>\r\n<h3><a id=\"Michigan\"><\/a>Michigan<\/h3>\r\n<p><a href=\"http:\/\/www.legislature.mi.gov\/(S(muzkuztufuszdcq3j3ufayle))\/mileg.aspx?page=GetObject&amp;objectname=mcl-380-1178a\" target=\"_blank\" title=\"Michigan Compiled Laws \u00a7 380.1178a\" rel=\"noopener\">Michigan Compiled Laws \u00a7 380.1178a<\/a>&nbsp;(Revised School Code, Act 451 of 1976) addresses the administration of medication in Michigan schools. This law requires Michigan schools to adopt a model local policy about the administration of medication to pupils at schools. This law also mandated certain training to individuals administering the medication.<\/p>\r\n<h3><a id=\"Minnesota\"><\/a>Minnesota<\/h3>\r\n<p><a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/121a.22\" target=\"_blank\" title=\"Minnesota Statutes Annotated \u00a7 121A.22\" rel=\"noopener\">Minnesota Statutes Annotated&nbsp;<\/a><a href=\"http:\/\/www.legislature.mi.gov\/(S(muzkuztufuszdcq3j3ufayle))\/mileg.aspx?page=GetObject&amp;objectname=mcl-380-1178a\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/121a.22\" target=\"_blank\" rel=\"noopener\">&nbsp;121A.22<\/a>&nbsp;requires local school boards to develop prescription medication administration procedures with health care professionals. Under this statute, several provisions regulate the administration of medication in schools.<\/p>\r\n<h3><a id=\"Mississippi\"><\/a>Mississippi<\/h3>\r\n<p>The state of Mississippi codifies the administration of medication for asthma and anaphylaxis in&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ms\/title-37-education\/ms-code-sect-37-11-71\/\" title=\"Mississippi Code Title 37. Education \u00a7 37-11-71\" target=\"_blank\" rel=\"noopener\">Mississippi Code \u00a7 37-11-71<\/a>. This code authorizes emergency treatment for asthma, anaphylaxis, and all other life-threatening diseases. Several provisions must be followed under this code.<\/p>\r\n<h3><a id=\"Missouri\"><\/a>Missouri<\/h3>\r\n<p>Chapter 167 of the Missouri Revised Statutes, &quot;Pupils and Special Services,&quot;&nbsp;<a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=167.208RSMo%20167.627\" target=\"_blank\" title=\"Missouri Revised Statutes\" rel=\"noopener\">&nbsp;167.627<\/a>,&nbsp;addresses state requirements of self-administered medications for asthma &quot;or other potentially life-threatening respiratory illnesses.&quot; Section 167.181 discusses compulsory immunizations.&nbsp;<a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=167.191#:~:text=167.191.,having%20been%20exposed%20to%20it.\" target=\"_blank\" title=\"Children With Contagious Diseases\" rel=\"noopener\">Section 167.191<\/a>&nbsp;prohibits children with contagious diseases from attending school, with penalties of $5 to $100 for violations.<\/p>\r\n<h3><a id=\"Montana\"><\/a>Montana<\/h3>\r\n<p>Beginning in 2021, Montana schools must create and follow policies about the storage, administration, and disposal of medication at schools. This includes controlled substances, prescriptions, and nonprescription supplements. This is required under&nbsp;<a href=\"https:\/\/dphhs.mt.gov\/schoolhealth\/schoolrules\/\" target=\"_blank\" title=\"Montana School Health Rules 37.111.801\" rel=\"noopener\">Montana School Health Rules 37.111.801<\/a>.<\/p>\r\n<h3><a id=\"Nebraska\"><\/a>Nebraska<\/h3>\r\n<p><a href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=71-6725\" target=\"_blank\" title=\"Nebraska Revised Statutes\" rel=\"noopener\">Nebraska Revised Statutes<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7\u00a7<\/a>&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-71-public-health-and-welfare\/ne-rev-st-sect-71-6718.html\" target=\"_blank\" rel=\"noopener\">71-6718<\/a>&nbsp;to 6742, ie, Section 6725, in conjunction with the Nebraska Administrative Code, Chapters 59 and 95, regulate the administration of medication in schools by unlicensed personnel through competency assessments and procedural requirements.<\/p>\r\n<h3><a id=\"Nevada\"><\/a>Nevada<\/h3>\r\n<p><a href=\"https:\/\/www.leg.state.nv.us\/nac\/nac-632.html#NAC632Sec226\" target=\"_blank\" title=\"Nevada Administrative Code \u00a7 632.226\" rel=\"noopener\">Nevada Administrative Code&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"https:\/\/www.leg.state.nv.us\/nac\/nac-632.html#NAC632Sec226\" target=\"_blank\" rel=\"noopener\">&nbsp;632.226<\/a>&nbsp;requires school nurses (rather than local school boards) to develop procedures. These procedures address the administration of medication to pupils during school hours. The code also requires schools to keep a record of medication administered to the student.<\/p>\r\n<h3><a id=\"NHampshire\"><\/a>New Hampshire<\/h3>\r\n<p>The state of New Hampshire addresses the administration of medication in the New Hampshire Code Administrative Rules. Specifically,&nbsp;<a href=\"https:\/\/casetext.com\/regulation\/new-hampshire-administrative-code\/title-ed-board-of-education\/chapter-ed-300-administration-of-minimum-standards-in-public-schools\/part-ed-311-school-health-services\/section-ed-31102-medication-during-school-day\" title=\"New Hampshire Code Administrative Rules\" target=\"_blank\" rel=\"noopener\">N.H. Code Admin. R. Ed. \u00a7 311.02<\/a>&nbsp;addresses medication during the school day. The code requires a written statement from a licensed prescriber containing certain important information. The Code also requires written authorization from a parent or legal guardian. The school nurse must develop a record of medication administered to the student.<\/p>\r\n<h3><a id=\"Jersey\"><\/a>New Jersey<\/h3>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/nj\/title-18a-education\/nj-st-sect-18a-40-12-6\/\" title=\"New Jersey Statutes Title 18A. Education 18A \u00a7 40-12.6\" target=\"_blank\" rel=\"noopener\">New Jersey Section 18a-40<\/a>&nbsp;governs the administration of medication at school. This code requires that all medications be prescribed in writing. There are certain requirements for what the writing must contain. Medications must also remain in their original prescription container until drug administration.<\/p>\r\n<h3><a id=\"NMexico\"><\/a>New Mexico<\/h3>\r\n<p>New Mexico, through&nbsp;<a href=\"https:\/\/codes.findlaw.com\/nm\/chapter-22-public-schools\/nm-st-sect-22-5-4-3.html\" title=\"New Mexico Statutes Chapter 22\" target=\"_blank\" rel=\"noopener\">N.M. 22-5-4.3<\/a>, governs the administration of medication at schools. This code addresses the self-administration of medication. The statute also requires that students have a medication assistance record. This law also requires prescription medication to be in its original packaging.<\/p>\r\n<h3><a id=\"NYork\"><\/a>New York<\/h3>\r\n<p>In the state of New York, the administration of medication is codified under&nbsp;<a href=\"https:\/\/govt.westlaw.com\/nycrr\/Document\/I50393058cd1711dda432a117e6e0f345?transitionType=Default&amp;contextData=%28sc.Default%29\" target=\"_blank\" title=\"4 CRR-NY \u00a7 633.17\" rel=\"noopener\">14 CRR-NY \u00a7 633.17<\/a>. This statute requires schools to adopt a written policy or procedure. It also requires that medication should be prescribed and ordered in the safest possible manner.<\/p>\r\n<h3><a id=\"NCarolina\"><\/a>North Carolina<\/h3>\r\n<p><a href=\"https:\/\/www.ncleg.gov\/EnactedLegislation\/Statutes\/PDF\/ByArticle\/Chapter_115c\/Article_25A.pdf\" target=\"_blank\" title=\"North Carolina General Statute 115C-375.1\" rel=\"noopener\">North Carolina General Statute 115C-375.1<\/a>&nbsp;authorizes school boards of education to permit school personnel to administer prescriptive medications with parents&#8217; written authorizations.<\/p>\r\n<h3><a id=\"NDakota\"><\/a>North Dakota<\/h3>\r\n<p>North Dakota codifies the administration of medication under the&nbsp;<a href=\"https:\/\/www.hhs.nd.gov\/sites\/www\/files\/documents\/DOH%20Legacy\/School-nursing\/medication-administration.pdf\" target=\"_blank\" title=\"North Dakota 15.1-19-23\" rel=\"noopener\">North Dakota 15.1-19-23<\/a>. Under this statute, a licensed nurse supervises medication administration. The code outlines other regulations and guidelines for&nbsp;<a href=\"https:\/\/casetext.com\/statute\/north-dakota-century-code\/title-151-elementary-and-secondary-education\/chapter-151-19-students-and-safety\" target=\"_blank\" title=\"Medication Administration\" rel=\"noopener\">medication administration<\/a>.<\/p>\r\n<h3><a id=\"Ohio\"><\/a>Ohio<\/h3>\r\n<p><a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-3313.713#:~:text=A%20board%20or%20governing%20authority,convictions%2C%20to%20administering%20the%20drug\" target=\"_blank\" title=\"Ohio Revised Code \u00a7 3313.713\" rel=\"noopener\">Ohio Revised Code \u00a7 3313.713<\/a>&nbsp;requires local school boards of education to adopt policies permitting school employees to administer medication. In February 2000, Ohio became the 50th state to allow&nbsp;<a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-4723.50\" target=\"_blank\" title=\"Advanced Practice Nurses\" rel=\"noopener\">advanced practice nurses<\/a>&nbsp;to prescribe medication (under physician supervision). In school settings, they have no independent authority to prescribe.<\/p>\r\n<h3><a id=\"Oklahoma\"><\/a>Oklahoma<\/h3>\r\n<p>Under&nbsp;<a href=\"https:\/\/oksenate.gov\/sites\/default\/files\/2019-12\/os70.pdf\" target=\"_blank\" title=\"Oklahoma Statutes\" rel=\"noopener\">70 Oklahoma Statutes Annotated&nbsp;<\/a><a href=\"https:\/\/codes.findlaw.com\/md\/education\/md-code-educ-sect-7-401.html\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"https:\/\/oksenate.gov\/sites\/default\/files\/2019-12\/os70.pdf\" target=\"_blank\" rel=\"noopener\">&nbsp;1-116.2<\/a>, school nurses and other school personnel must administer medications according to statutory requirements.<\/p>\r\n<h3><a id=\"Oregon\"><\/a>Oregon<\/h3>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/or\/title-30-education-and-culture\/or-rev-st-sect-339-869.html\" title=\"Oregon Revised Statutes Education and Culture \u00a7 339.869\" target=\"_blank\" rel=\"noopener\">Oregon Revised Statutes \u00a7 339.869<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/codes.findlaw.com\/or\/title-30-education-and-culture\/or-rev-st-sect-339-870.html\" title=\"Oregon Revised Statutes Education and Culture \u00a7 339.870\" target=\"_blank\" rel=\"noopener\">339.870<\/a>, in conjunction with&nbsp;<a href=\"https:\/\/www.oregon.gov\/ode\/about-us\/Documents\/Executive%20Numbered%20Memo%20001-2017-18%20Administration%20of%20Medication.pdf\" target=\"_blank\" title=\"Administration of Medication\" rel=\"noopener\">Oregon Administrative Rule 581-021-0037<\/a>, require local school district boards to adopt policies. Under these rules, trained school personnel must administer prescription and nonprescription medication. Some medications can be self-administered by students.<\/p>\r\n<h3><a id=\"Pennsylvania\"><\/a>Pennsylvania<\/h3>\r\n<p>Pennsylvania authorizes schools to administer medication in emergencies under&nbsp;<a href=\"https:\/\/www.pacodeandbulletin.gov\/Display\/pacode?file=\/secure\/pacode\/data\/022\/chapter12\/chap12toc.html\" target=\"_blank\" title=\"Title 22 \u00a7 12.41 of the Pennsylvania Code\" rel=\"noopener\">Title 22 \u00a7 12.41 of the Pennsylvania Code<\/a>. Under this statute, the school needs to prepare a written plan for implementing student services related to medication administration.<\/p>\r\n<h3><a id=\"RIsland\"><\/a>Rhode Island<\/h3>\r\n<p><a href=\"http:\/\/webserver.rilin.state.ri.us\/Statutes\/title16\/16-21\/16-21-22.htm\" target=\"_blank\" title=\"R.I. Gen. Laws \u00a7 16-21-22\" rel=\"noopener\">R.I. Gen. Laws \u00a7 16-21-22<\/a>&nbsp;provides for self-medication by students who have provided schools with medical documentation. The law also provides for immunity from civil damages for those negligently administering epinephrine or prescription inhalers.<\/p>\r\n<h3><a id=\"SCarolina\"><\/a>South Carolina<\/h3>\r\n<p><a href=\"https:\/\/www.scstatehouse.gov\/code\/t59c063.php#:~:text=SECTION%2059%2D63%2D95.,%2Dadministering%3B%20immunity%20from%20liability.\" target=\"_blank\" title=\"S.C. Code \u00a7 59-63-95\" rel=\"noopener\">S.C. Code \u00a7 59-63-95<\/a>&nbsp;codifies the administration of medication. This law was not passed until May 2023. Under this section, there must be proper authorization for administering or self-administrating lifesaving medications. This law also requires school districts to create and adopt written policies about the administration of medication.<\/p>\r\n<h3><a id=\"SDakota\"><\/a>South Dakota<\/h3>\r\n<p>This state codifies the administration of medication under&nbsp;<a href=\"https:\/\/sdlegislature.gov\/Statutes\/13-32-11\" target=\"_blank\" title=\"South Dakota 13-32-11\" rel=\"noopener\">South Dakota 13-32-11<\/a>. Under this statute, schools must adopt policies and procedures. They must also get written orders from the prescribing physician for medication. School physicians or nurses must properly store and label all drugs. A release by the parents is also required.<\/p>\r\n<h3><a id=\"Tennessee\"><\/a>Tennessee<\/h3>\r\n<p><a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/education\/documents\/CSH_School_Health_Laws_2021.pdf\" target=\"_blank\" title=\"Tennessee Code Annotated \u00a7 49-50-1602\" rel=\"noopener\">Tennessee Code Annotated \u00a7 49-50-1602<\/a>&nbsp;requires licensed health care professionals to administer medications. School boards may allow unlicensed personnel to assist students with self-administration. This law also requires that schools maintain records of administration.<\/p>\r\n<h3><a id=\"Vermont\"><\/a>Vermont<\/h3>\r\n<p>The state of Vermont&#8217;s Department of Health publishes a &quot;<a href=\"https:\/\/www.healthvermont.gov\/sites\/default\/files\/documents\/pdf\/cyf_22%20N%20MedicationTrainingGuide-3-18-2019.pdf\" target=\"_blank\" title=\"Vermont Medication Training Guide for School Nurses\" rel=\"noopener\">Vermont Medication Training Guide for School Nurses<\/a>.&quot; The medication laws are codified under&nbsp;<a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/16\/031\/01387\" target=\"_blank\" title=\"Vermont Statutes\" rel=\"noopener\">16 V.S.A. \u00a7 1387<\/a>. This statute addresses the self-administration of emergency medication. It requires certain written authorizations.
