There&#8217;s nothing wrong with going the extra mile. The job description for\u00a0<a href=\"https:\/\/www.findlaw.com\/education\/special-education-and-disabilities\/special-education-and-disability-access-state-laws.html\">special education teachers<\/a>\u00a0will\u00a0have additional responsibilities and differ in other ways.<\/p>\n<h2>Duties of Special Education Teachers<\/h2>\n<p>The job descriptions of educators who teach children with\u00a0<a href=\"https:\/\/www.findlaw.com\/education\/special-education-and-disabilities\/disability-access-to-education.html\">special needs or disabilities<\/a>\u00a0require them to perform additional duties.\u00a0Some of these duties include:<\/p>\n<ul>\n<li>Help a child go to the bathroom*<\/li>\n<li>Potty training a child**<\/li>\n<li>Changing diapers or pull-ups*<\/li>\n<li>Supporting a child&#8217;s individualized health-care plan<\/li>\n<li>Complete tasks that a nurse or\u00a0<a href=\"https:\/\/codes.findlaw.com\/cfr\/title-34-education\/cfr-sect-34-200-58\/\" target=\"_blank\" rel=\"noopener\">paraprofessional<\/a>\u00a0would typically do<\/li>\n<li>Lift a child above 50 pounds<\/li>\n<li>Physically restrain a child during a tantrum or fight<\/li>\n<li>Clean injuries or wounds<\/li>\n<li>Change feeding tubes, catheters, colostomy bags, etc.<\/li>\n<li>Handle diabetic equipment<\/li>\n<\/ul>\n<p>*This does not apply to schools that are also licensed daycares<\/p>\n<p>**Many states have strict laws on children being potty-trained before attending school, while others, such as\u00a0<a href=\"https:\/\/www.nysed.gov\/memo\/early-learning\/prekindergarten-and-kindergarten-guidance-supporting-toilet-learning\" target=\"_blank\" rel=\"noopener\">New York<\/a>, do not have this requirement.<\/p>\n<p>If you don&#8217;t have the proper training to handle children with special needs, you should not attempt to perform the above tasks. If your supervisor demands that you perform these tasks, you should speak with your\u00a0<a href=\"https:\/\/www.findlaw.com\/education\/teachers-rights\/teachers-unions.html\">union representative<\/a>\u00a0(if applicable) or a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">local employment lawyer<\/a>.<\/p>\n<h2>How To Protect Your Rights as an Educator or Paraprofessional<\/h2>\n<p>Whether you teach at a high school, middle school, or elementary school, you must stand up for yourself and protect your rights as an educator. If you work for a public school,\u00a0<a href=\"https:\/\/www.findlaw.com\/education\/curriculum-standards-school-funding\/the-roles-of-federal-and-state-governments-in-education.html\">federal laws<\/a>\u00a0protect you as an employee.<\/p>\n<p>This can be easier said than done. You should also ensure that you meet the\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pre-employment-tests.html\">licensure requirements<\/a>\u00a0to perform the tasks in your job description.<\/p>\n<p>If you feel your supervisor demands that you perform duties outside your job description throughout the working day, document it. You&#8217;ll want a written record of this if you file a\u00a0<a href=\"https:\/\/www.findlaw.com\/education\/teachers-rights\/teachers-rights-state-and-local-laws.html\">complaint or grievance<\/a>\u00a0against the school board.<\/p>\n<p>You should also explain to your team that you are neither the primary nor backup provider for childcare duties if they are not in your job description. Emphasize that your job description only requires you to perform your duties during school hours.<\/p>\n<p>The school cannot demand that you spend time &#8220;off the clock&#8221; performing\u00a0<a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/seldom-performed-job-duties-can-be-essentional-functions-under.html\" target=\"_blank\" rel=\"noopener\">job duties<\/a>\u00a0for which you are not compensated,\u00a0are not in your contract, or were not part of your\u00a0job description. It&#8217;s common practice to include a provision in a contract\u00a0requiring\u00a0teachers to work beyond the school day. This type of &#8220;after hours&#8221; work is expected for teachers in many districts because they are salaried exempt employees under the Fair Labor Standards Act (FLSA). This means they may be\u00a0expected to perform duties like grading, lesson planning, and communications outside of classroom hours.<\/p>\n<h3>Contacting Your District, Association, or Union<\/h3>\n<p>If you work in a public school and have contractual issues, you should contact someone at the local school district. If\u00a0<a href=\"https:\/\/www.findlaw.com\/education\/teachers-rights\/teachers-unions.html\">you belong to a union<\/a>, contact your local branch to inform them of the situation.<\/p>\n<p>You can also contact a local educational agency to see what resources they have available. They may have additional information on how to\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/how-do-you-sue-a-school-district\/\">file a complaint<\/a>\u00a0against a school district, charter school, or private academy.<\/p>\n<h3>Going Above and Beyond the Call of Duty<\/h3>\n<p>There are times when you have no choice but to work outside regular school hours. Your\u00a0lesson plans aren&#8217;t going to create themselves, and a full day of teaching doesn&#8217;t offer much down time to wok on them. The same may be true for updating\u00a0<a href=\"https:\/\/govfacts.org\/federal\/ed\/ferpa-exceptions-when-schools-can-share-student-records-without-consent\/\" target=\"_blank\" rel=\"noopener\">student records<\/a>\u00a0with test scores, homework assignments, etc.<\/p>\n<p>Most teachers feel that it&#8217;s their job to ensure the well-being of their students, at least during the school year. While this is admirable, educators are not responsible for what happens to students outside their classroom.\u00a0There are exceptions to this rule, such as when a teacher suspects a student is suffering\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/legal-responsibility-of-teachers-to-report-abuse\/\">child abuse<\/a>\u00a0at home.<\/p>\n<h3>Speaking to Your Human Resources Department<\/h3>\n<p>If you&#8217;re still having issues, talk to your employer&#8217;s HR department about your situation. The school hired you to do a job and shouldn&#8217;t expect you to perform duties outside your\u00a0job description.
