It\u2019s difficult to know the proper legal response. That way, you can figure out the best way to proceed.<\/p>\n<p>In the meantime, let&#8217;s start with some background information about the ADA.<\/p>\n<h2>The <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628593\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628593\">Americans with Disabilities Act<\/span><\/h2>\n<p>The ADA is a landmark federal <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628595\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628595\">civil rights<\/span> law passed in 1990. Its goal is to ensure that people with disabilities have the same rights and opportunities as everyone else. As such, it prohibits <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/disability-discrimination.html\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628604\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628604\">disability discrimination<\/span><\/a> in various aspects of public life.<\/p>\n<p>The law is divided into sections called &#8220;titles.&#8221; For example, Title I deals with <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/ada-disabilities-your-rights-as-an-employee.html\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628604\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628604\">disability discrimination<\/span> in employment<\/a>. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628608\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628608\">Title II<\/span> addresses <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628604\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628604\">disability discrimination<\/span> by public entities, like state and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628601\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628601\">local government<\/span>.<\/p>\n<h2><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span> of the ADA<\/h2>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span> prohibits <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628604\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628604\">disability discrimination<\/span> by places known as &#8220;<span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">public accommodations<\/span>.&#8221; <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">Public accommodations<\/span> are open to the public but owned and operated by private entities. For example, restaurants and hotels are <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/discrimination-in-public-accommodations.html#:~:text=Privately%2Downed\/operated%20businesses%20and%20buildings\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">public accommodations<\/span><\/a>.\u00a0<\/p>\n<p>Other <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">public accommodations<\/span>\u00a0include:<\/p>\n<ul>\n<li>Stores<\/li>\n<li>Museums<\/li>\n<li><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628632\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628632\">Social service<\/span> centers<\/li>\n<li>Gyms<\/li>\n<li>Movie theaters<\/li>\n<\/ul>\n<p>These <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span>-covered places may not discriminate against people based on their disability. This means a restaurant may not refuse to serve someone just because they&#8217;re in a wheelchair, but discrimination under <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span> isn&#8217;t always so obvious.<\/p>\n<p>These businesses often fail to make <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628610\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628610\">reasonable accommodations<\/span> for individuals with disabilities. What&#8217;s actually required can sometimes be confusing. To clarify other ways that <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/public-accommodations-equal-rights.html#:~:text=anti%2Ddiscrimination%20laws.-,Discrimination%20in%20Public%20Accommodations,-The%20U.S\">discrimination under <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span><\/a> may appear, let&#8217;s take a look at what the law says.<\/p>\n<h3><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">Public Accommodations<\/span><\/h3>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span> imposes three main obligations on <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">public accommodations<\/span>. They&#8217;re intended to ensure equal access for individuals with disabilities. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span> entities must comply with them unless doing so would fundamentally alter the nature of their offerings or impose an undue burden. Specifically, they have to:<\/p>\n<ul>\n<li><strong>Make reasonable modifications to policies and procedures<\/strong>: Like allowing <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628634\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628634\">service animals<\/span> despite a no-pets policy<\/li>\n<li><strong>Remove architectural barriers from existing facilities when readily achievable<\/strong>: Installing ramps or modifying restrooms, for example<\/li>\n<li><strong>Provide effective communication aids and services<\/strong>: Such as visual emergency alert systems, <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628637\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628637\">mobile app<\/span> accessibility, or <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628624\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628624\">telecommunication<\/span> aids like text telephone (<span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628596\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628596\">TTY<\/span>) devices<\/li>\n<\/ul>\n<p>In addition, <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">public accommodations<\/span> must follow the <a href=\"https:\/\/www.ada.gov\/law-and-regs\/design-standards\/\" target=\"_blank\" rel=\"noopener\">ADA Standards for Accessible Design<\/a> for new construction\/alterations. These contain the technical requirements for physical features like ramps, restrooms, and signage. They became mandatory for new projects started after January 26, 1993.<\/p>\n<h3>Commercial Facilities<\/h3>\n<p>Although <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span> mainly focuses on <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628609\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628609\">public accommodations<\/span>, <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/ada-access-to-buildings-and-businesses-public-accommodations.html#:~:text=New%20Construction%20and%20Alterations\">the accessible design requirement<\/a> also applies to commercial facilities. These are privately owned, non-residential buildings that aren&#8217;t open to the public and include places like warehouses, factories, and office buildings.<\/p>\n<h2><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span> <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628594\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628594\">ADA Complaints<\/span><\/h2>\n<p>The <a href=\"https:\/\/www.justice.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628600\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628600\">U.S. Department of Justice<\/span> (<span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628635\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628635\">DOJ<\/span>)<\/a> is the primary <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628603\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628603\">federal agency<\/span> responsible for enforcing <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_52628629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"52628629\">Title III<\/span>.
