These legal protections extend to those who identify as lesbian, gay, bisexual, transgender, or queer (LGBTQ+). Laws and court rulings support that discriminating against LGBTQ+ people is illegal in many contexts. <\/p>\n\n    <\/div>\n\n<p>Millions of lesbian, gay, bisexual, transgender, and queer Americans now have greater protections against discriminatory treatment. Modern laws help ensure LGBTQ+ people have equal access to housing, work opportunities, and more.<\/p>\n<p>The federal government protects people against sex&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination.html\">discrimination<\/a>, among other things. The same is true for many states. A U.S. Supreme Court decision&nbsp;has clarified that &quot;sex&quot; in this context includes sexual orientation and gender identity.<\/p>\n<p>Federal, state, and corporate rules about LGBTQ+ rights constantly evolve. Be sure to check back here for updates or&nbsp;<a href=\"https:\/\/lawyers.findlaw.com\/discrimination\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">contact a local attorney<\/a>&nbsp;to get the most up-to-date information.<\/p>\n<h2>Do Sex Discrimination Laws Include Gender and Sexuality?<\/h2>\n<p>Yes, sex discrimination can include discrimination based on gender identity and sexual orientation. Federal court rulings set this precedent, which may shape future discrimination laws and cases.<\/p>\n<p>An example of sexual orientation is being gay. In contrast, an example of gender identity is being transgender or not conforming to the &quot;gender binary.&quot; Gender expression can include how a person behaves, speaks, or appears in a manner usually associated with a person\u2019s gender identity.<\/p>\n<p>In 2020, the Supreme Court decided a case called&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/17-1618.html\" target=\"_blank\" rel=\"noopener\"><i>Bostock v. Clayton County<\/i><\/a>. The decision related to three incidents. The first involved a Georgia man, Gerald Bostock, who was fired for being gay. The second involved a New York man, Donald Zarda, who was also fired for being gay. The third involved a transgender woman fired by a Michigan funeral home.<\/p>\n<p>The court ruled that discrimination on the basis of sex includes discrimination based on gender identity and sexual orientation. This means employers can&#8217;t base employment decisions like hiring or firing on sexual orientation or gender identity.<\/p>\n<h2>Gender and Sexuality Employment Discrimination<\/h2>\n<p>Americans enjoy federal protection against&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination.html\">employment discrimination<\/a>&nbsp;based on sexual orientation and gender identity. These laws encourage a safe and fair work environment.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/employment-discrimination-federal-laws.html\">Title VII of the Civil Rights Act of 1964<\/a>&nbsp;prohibits workplace discrimination on the basis of:<\/p>\n<ul>\n<li>Race<\/li>\n<li>Religion<\/li>\n<li>National origin<\/li>\n<li>Sex<\/li>\n<\/ul>\n<p>Due to the <i>Bostock <\/i>ruling, the basis of sex under Title VII now also includes the basis of sexual orientation and gender identity. The law entitles LGBTQ+ workers to equal treatment at work.<\/p>\n<p>These protections extend to workplace discrimination that:<\/p>\n<ul>\n<li>Takes place during the interview process<\/li>\n<li>Results in&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-pay-and-discrimination-against-women.html\">unequal pay<\/a><\/li>\n<li>Takes the form of&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/sexual-harrassment.html\">sexual harassment<\/a><\/li>\n<\/ul>\n<p>For example, a manager might be discriminatory if they <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/best-practices-for-employers-in-a-hiring-interview.html\">ask invasive personal questions<\/a> to a transgender employee or job applicant.<\/p>\n<h2>Other Examples of LGBTQ+ Sex Discrimination Protections<\/h2>\n<p>Federal law also protects against sexual orientation or gender identity discrimination in other areas. These include:<\/p>\n<ul>\n<li>Housing discrimination (see the&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/fair-housing-act.html\">Fair Housing Act<\/a>)<\/li>\n<li>Lending discrimination (addressed by the&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/credit-banking-finance\/equal-credit-opportunity-act.html\">Equal Credit Opportunity Act<\/a>)<\/li>\n<li>Education discrimination (look to&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/sex-discrimination-in-education.html\">Title IX of the Educational Amendments of 1972<\/a>)<\/li>\n<li>Health care and insurance discrimination (under <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/health-care-discrimination.html\">laws including the Affordable Care Act<\/a>)<\/li>\n<\/ul>\n<p>Federal law doesn&#8217;t protect against sexual orientation or gender identity discrimination in public accommodations.<\/p>\n<p>Other areas for which there is protection include:<\/p>\n<ul>\n<li>Hate crimes<\/li>\n<li>Miscellaneous policies<\/li>\n<li>Same-sex marriage<\/li>\n<\/ul>\n<h3>Hate Crimes<\/h3>\n<p>Federal law protects LGBTQ+ individuals from&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/hate-crimes.html\">hate crimes<\/a>&nbsp;motivated by the victim&#8217;s sexual orientation. Some states have their own laws about hate crimes.<\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.justice.gov\/crt\/matthew-shepard-and-james-byrd-jr-hate-crimes-prevention-act-2009-0\" target=\"_blank\" rel=\"noopener\">Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act<\/a>&nbsp;(often called the Matthew Shepard Act) became law in 2009. It more severely penalizes violent offenders who target gay and lesbian people.<\/p>\n<h3>Miscellaneous Policies<\/h3>\n<p>The president has the power to issue policies that expand the rights of LGBTQ+ citizens. This can be achieved through executive orders. Federal agencies under the president&#8217;s control execute and enforce these policies.<\/p>\n<p>For example, President Barack Obama ordered all hospitals accepting Medicare and Medicaid payments to:<\/p>\n<ul>\n<li>Allow same-sex partners of patients to visit their loved ones<\/li>\n<li>Allow same-sex partners of patients to make medical decisions for their loved ones<\/li>\n<\/ul>\n<h3>Same-Sex Marriage<\/h3>\n<p>Finally, the federal government recognizes&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/marriage\/same-sex-marriage\/\">same-sex marriages<\/a>. Married gay and lesbian couples enjoy the same privileges as straight couples. Transgender people also hold the same rights.<\/p>\n<p>On June 26, 2015, the U.S. Supreme Court decided a case called&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/marriage\/same-sex-marriage-understanding-obergefell-v-hodges.html\"><i>Obergefell v. Hodges<\/i><\/a>. The majority of justices held that same-sex couples have a fundamental right to marriage. The court&#8217;s ruling relied on the Constitution&#8217;s equal protection clause and the due process clause.<\/p>\n<p>The Supreme Court&#8217;s landmark decision overturned all state laws banning same-sex marriage. As a result, same-sex marriage became legal in all 50 states and U.S. territories except American Samoa.<\/p>\n<h2>State Protections for Gender Identity and Sexual Orientation<\/h2>\n<p>Each state can choose to add protections for LGBTQ people. For example, laws in New York may be quite different from laws in Texas. Check your state&#8217;s nondiscrimination laws to determine your protections. Certain issues, such as protected use of <a href=\"https:\/\/www.findlaw.com\/lgbtq-law\/transgender-people-and-bathroom-access-laws.html\">bathrooms and locker rooms<\/a>, vary significantly.<\/p>\n<p>State laws can affect the following legal areas:<\/p>\n<ul>\n<li>Discrimination in&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/sexual-orientation-discrimination-in-the-workplace.html\">employment<\/a><\/li>\n<li>Discrimination in&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/fair-housing-laws-renters-protection-from-sexual-orientation.html\">housing<\/a><\/li>\n<li>Discrimination in lending<\/li>\n<li>Discrimination in&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/gender-discrimination-in-education.html\">education<\/a><\/li>\n<li>Discrimination in public accommodations<\/li>\n<li>Family law<\/li>\n<\/ul>\n<p>Same-sex marriage is legal in all states. Still, some states have other options for same-sex couples. These include&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/domestic-partnerships\/civil-unions.html\">civil unions<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/domestic-partnerships\/state-laws-domestic-partnerships.html\">domestic partnerships<\/a>. Another relevant area of family law concerns&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/adoption\/same-sex-adoption.html\">adoption by same-sex couples<\/a> and transgender individuals.<\/p>\n<h2>Additional Protections by Private Employers<\/h2>\n<p>Employers may grant higher protections to gay, lesbian, bisexual, transgender, and queer employees. These safeguards can exist even when federal or&nbsp;local laws&nbsp;don&#8217;t require them.<\/p>\n<p>If you&#8217;ve experienced harassment or discrimination on the job, look at your employer&#8217;s discrimination policies. The human resources department should make this information available to you. Note that the law offers exemptions to some types of employers.<\/p>\n<p>Complaints of discrimination on the basis of sexual orientation can often be brought to the federal Equal Employment Opportunity Commission (EEOC).<\/p>\n<h2>Talk to an Attorney About Sexual Orientation or Gender Identity Discrimination<\/h2>\n<p>Have you suffered sexual orientation or gender identity discrimination?<\/p>\n<p>Maybe you&#8217;re wondering if you&#8217;ve been singled out based on your transgender status.
