Civil commitment is the legal process where a judge decides if a person with a mental illness will be committed against their will.<\/p>\n<p>This article provides a summary of patient rights on involuntary commitment. Patients&#8217; and the public&#8217;s constitutional rights weren&#8217;t protected until the 1970s.<\/p>\n<p>In 1975, the U.S. Supreme Court decided\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/422\/563.html\" target=\"_blank\" rel=\"noopener\">O&#8217;Connor v. Donaldson<\/a>, wherein it held that &#8220;A State cannot constitutionally confine&#8230; a non-dangerous individual who is capable of surviving safely in freedom by himself or with the help of willing and responsible family members or friends&#8230;&#8221;<\/p>\n<p>Under this decision, &#8220;mental illness&#8221; alone cannot result in an involuntary commitment. They must also be either:<\/p>\n<ul>\n<li>A danger to the public, or<\/li>\n<li>A danger to themselves<\/li>\n<\/ul>\n<p>State civil commitment laws reflect this standard. These standards include state laws that allow for the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/civil-commitment.html\">confinement of habitual sex offenders<\/a>.<\/p>\n<p>Before 1975, mentally ill persons had little autonomy over their treatment and the commitment process. There was a presumption that the mentally ill were incompetent to make decisions. The state and family members made decisions for mentally ill persons as they saw fit.<\/p>\n<p>They believed in-patient care at state hospitals or private treatment facilities was beneficial. Almost anyone could commit a mentally ill person to in-patient care.<\/p>\n<h2>Patient Rights<\/h2>\n<p>A person with mental illness is still a person. They do not lose their\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/civil-rights-basics.html\">civil rights<\/a>\u00a0because they are mentally ill. They also do not lose their rights because of a civil commitment. They have the right to refuse treatment. They also have the right to freedom from constraints and abuse.<\/p>\n<p>They have the same rights under\u00a0<a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights\/hipaa-the-health-insurance-portability-and-accountability-act.html#:~:text=Under%20HIPAA%2C%20you%20and%20your,conditions%20(physical%20or%20mental)%3B\">HIPAA<\/a>\u00a0as persons without a mental illness. In short, a person&#8217;s rights do not end if they are under an involuntary commitment.<\/p>\n<h2>Civil Commitment Proceedings<\/h2>\n<p>Civil commitment proceedings are not only for mentally ill persons. Persons with substance abuse disorders can face civil commitment.\u00a0<a href=\"https:\/\/www.nimh.nih.gov\/health\/topics\/substance-use-and-mental-health#:~:text=Substance%20use%20disorder%20(SUD)%20is,most%20severe%20form%20of%20SUD.\" target=\"_blank\" rel=\"noopener\">Substance abuse<\/a>\u00a0is a mental health disorder, involving the use of illegal drugs, alcohol, or other substances.<\/p>\n<p>The civil commitment of a mentally ill person varies by jurisdiction, but many follow similar steps.<\/p>\n<h3>Establishing a Treatable Mental Illness<\/h3>\n<p>The first step is establishing the person has a treatable mental illness. The person may already be in a mental health facility. Some get help through the local department of health or human services.<\/p>\n<p>The person must be a danger to themselves or others. Sometimes, the person may disclose a desire to cause serious harm to themselves or someone else. Or, depending on the severity of the person&#8217;s mental illness, they clearly need a higher level of medical care.<\/p>\n<h3>Establishing Dangerousness<\/h3>\n<p>The next step in this process is to establish dangerousness. The mentally ill patient is a danger to themselves or other persons. This is clear when someone makes a threat to harm themselves or others.<\/p>\n<p>In many states,\u00a0grave disability\u00a0is grounds for involuntary commitment. A person with a grave disability <a href=\"https:\/\/www.webmd.com\/schizophrenia\/story\/schizophrenia-right-to-psychosis-smi\" target=\"_blank\" rel=\"noopener\">cannot handle their basic needs<\/a>. This includes bathing, food, and shelter.<\/p>\n<h3>Mental Health Treatment<\/h3>\n<p>Finally, the person must need treatment. The treatment record should disclose any side effects of the proposed medications.<\/p>\n<p>Some mental health institutions offer <a href=\"https:\/\/www.webmd.com\/anxiety-panic\/mental-health-tests-you-take\" target=\"_blank\" rel=\"noopener\">specific treatment programs<\/a> for different illnesses.<\/p>\n<h2>\u00a0What To Expect in a Mental Health Institutition<\/h2>\n<p>Involuntary commitments happen in psychiatric hospitals or mental health facilities. Some patients go into treatment voluntarily. Some patients come prepared for their time in a mental health institution.<\/p>\n<p>Patients who expect an extended stay bring their own clothes and toiletries. If voluntary admission is part of crisis intervention, patients don&#8217;t have time to gather personal items.<\/p>\n<hr \/>\n<div data-testid=\"ai-message-body\">\n<div>\n<div id=\"gJNCw4huRpug9m8RRwL1M-content-0\">\n<p>When someone you love has been committed, it&#8217;s natural to feel helpless, overwhelmed, and unsure how to proceed. During this time, mental health professionals evaluate their mental well-being. Social workers find appropriate community-based services. Almost anyone (a legal guardian or law enforcement) can refer someone for a mental health evaluation.<\/p>\n<p>After a 72-hour waiting period, patients can leave unless their treatment team decides they need to stay. <a href=\"https:\/\/www.findlaw.com\/family\/guardianship\/conservatorship-vs-guardianship-key-legal-differences.html\">Legal guardians or conservators<\/a> make this choice if their ward needs hospitalization. Patients can continue the voluntary admission. Or, the treatment team can seek an involuntary commitment if necessary. This is in-patient involuntary commitment.<\/p>\n<h3>Court Order<\/h3>\n<p>The mental health professionals petition the court for a court order if necessary. The petition&#8217;s goal is a court order forcing the person into in-patient care against their will. In most states, a court order comes within two to three days of emergency confinement.<\/p>\n<p>A hearing often takes a few days. The patient has a right to legal counsel during the hearing. Courts usually <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/are-you-entitled-to-a-court-appointed-attorney.html\">appoint an attorney<\/a>.<\/p>\n<p>If the court agrees that the patient is a danger to themselves or the community, they will issue an order. Patients are only confined for as long as is necessary for treatment. A release may come after later hearings.<\/p>\n<h2>Federal Involuntary Commitment Laws<\/h2>\n<p>Federal law addressing involuntary commitment is part of criminal procedure. This includes the civil\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-4248.html\" target=\"_blank\" rel=\"noopener\">commitment of a sexually dangerous person<\/a>.<\/p>\n<p>Federal laws also address hospitalizing:<\/p>\n<ul>\n<li>Defendants found\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-4243.html\" target=\"_blank\" rel=\"noopener\">not guilty because of insanity<\/a><\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-4244.html\" target=\"_blank\" rel=\"noopener\">Convicted persons<\/a>\u00a0who have mental diseases<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-4245.html\" target=\"_blank\" rel=\"noopener\">Imprisoned persons<\/a>\u00a0suffering from mental disorders<\/li>\n<li>Persons\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-4246.html\" target=\"_blank\" rel=\"noopener\">due for release<\/a>\u00a0but suffering from mental impairment<\/li>\n<\/ul>\n<h3>State Laws<\/h3>\n<p>Civil commitment laws in most states allow the following kinds of involuntary confinement:<\/p>\n<ul>\n<li><strong>Emergency Hospitalization<\/strong> &#8211; A &#8220;psychiatric hold&#8221; that involves short-term confinement during a crisis for evaluation purposes<\/li>\n<li><strong>In-Patient Civil Commitment<\/strong> &#8211; Longer-term confinement, often in a specialized unit<\/li>\n<li><strong>Outpatient Civil Commitment<\/strong> &#8211; Often referred to as &#8220;mandated&#8221; or &#8220;assisted&#8221; outpatient treatment (AOT), this involves court-ordered mental health treatment<\/li>\n<\/ul>\n<p>The following is a sampling of state involuntary commitment laws:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/tx\/health-and-safety-code\/health-safety-sect-574-001.html\" target=\"_blank\" rel=\"noopener\">Texas<\/a>\u00a0&#8211; The state presents a medical examination certificate and a supporting affidavit. The court appoints an attorney for the patient.<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/il\/chapter-405-mental-health-and-developmental-disabilities\/il-st-sect-405-5-3-600.html\" target=\"_blank\" rel=\"noopener\">Illinois<\/a>\u00a0&#8211; Anyone who believes an individual needs immediate hospitalization may present a petition for their commitment.<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/ca\/welfare-and-institutions-code\/wic-sect-5150.html\" target=\"_blank\" rel=\"noopener\">California<\/a>\u00a0&#8211; An authorized person (peace officer, mental health professional, etc.) must establish probable cause for involuntary commitment. They must prove the patient is a danger to others, a threat to themselves, or is &#8220;gravely disabled as a result of the mental disorder.&#8221;<\/li>\n<\/ul>\n<p>Advocacy groups, like the <a href=\"https:\/\/www.tac.org\/\" target=\"_blank\" rel=\"noopener\">Treatment Advocacy Center<\/a>, help states reform their civil commitment laws.<\/p>\n<h2>Standards for Treatment and Confinement<\/h2>\n<p>Standards for involuntary treatment and confinement vary from state to state. The Federal\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/other-constitutional-rights\/civil-rights-of-institutionalized-persons.html\">Civil Rights of Institutionalized Persons Act<\/a>\u00a0of 1980 (CRIPA) protects patients&#8217; rights in state institutions.<\/p>\n<p>In Florida, patients must receive\u00a0<a href=\"https:\/\/www.cchrflorida.org\/wp-content\/uploads\/2015\/04\/CCHR_FL_Mental-Health-Patient-Rights_2015.pdf\" target=\"_blank\" rel=\"noopener\">notice of their rights in a care facility<\/a>. These rights include\u00a0the right &#8220;to receive the least-restrictive, available treatment&#8221; possible. Also, Florida prohibits using &#8220;restraints, seclusion, isolation,&#8221; and other, more extreme measures.
