It was enacted in 1970 as Title II of the Comprehensive Drug Abuse Prevention and Control Act. This Act serves as the legal foundation for many opioid related enforcement and lawsuits.<\/p>\n<p>Pharmaceutical companies and drug manufacturers violated CSA requirements through\u00a0their business practices. These practices led to widespread addiction and engendered\u00a0subsequent legal actions.<\/p>\n<p>The term &#8220;<a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights\/opioid-lawsuits.html\">opioid<\/a>&#8221;\u00a0refers to a broad class of drugs. It includes poppy-derived opiates such as morphine and heroin, along with\u00a0synthetic opiates such as fentanyl, oxycodone, and hydrocodone. Drug makers marketed these substances as safe and not prone to abuse due to\u00a0protective coatings that allow for time-released dosage. However, many patients remained addicted after their prescriptions ran out. This led to the substance abuse of heroin, fentanyl, or other illicit opioids.<\/p>\n<p>Companies sold these drugs using false claims,\u00a0prompting the federal government to implement stricter protocols.\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/controlled-substances-act-csa-overview.html\">Under the CSA,<\/a>\u00a0pharmaceutical companies manufacturing these drugs must register with the\u00a0<a href=\"https:\/\/www.dea.gov\/\" target=\"_blank\" rel=\"noopener\">Drug Enforcement Administration<\/a>\u00a0(DEA) and\u00a0comply with strict manufacturing quotas and reporting requirements.<\/p>\n<p>Often, opioid lawsuits concern the companies&#8217; failure to follow CSA requirements. Companies\u00a0fail to monitor suspicious orders of controlled substances and\u00a0to report these orders to prevent\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-charges.html\">illegal use and drug abuse<\/a>.<\/p>\n<h2><strong data-redactor-tag=\"strong\">Opioid Lawsuits: Federal, Tribal, State, and Local<\/strong><\/h2>\n<p>State resources became stressed due to skyrocketing addiction rates and overdoses. As a result, many states filed lawsuits against opioid manufacturers and distributors. There were also suits\u00a0filed by the\u00a0<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCOURTS-oked-6_18-cv-00056\/pdf\/USCOURTS-oked-6_18-cv-00056-0.pdf\" target=\"_blank\" rel=\"noopener\">Cherokee Nation<\/a>\u00a0and\u00a0other Native American tribes. Patient advocacy groups also supported these efforts to hold companies accountable.\u00a0<\/p>\n<p>A growing\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/ag.ny.gov\/press-release\/2025\/attorney-general-james-announces-every-state-has-joined-74-billion-settlement\" target=\"_blank\" rel=\"noopener\">list of states<\/a>\u00a0filed lawsuits. These states include Ohio, Mississippi, Oklahoma, Missouri, New Hampshire, Texas, Florida, Nevada, North Carolina, North Dakota, and Tennessee. Ohio was particularly hard-hit by the epidemic.<\/p>\n<p>These complaints were consolidated into\u00a0<span data-redactor-tag=\"strong\">federal Multi-District Litigation proceedings<\/span>\u00a0in the\u00a0Federal District\u00a0Court in Cleveland, Ohio, in December 2017. Plaintiffs in the suit alleged the following, stating that they contributed to the current opioid epidemic:<\/p>\n<ul>\n<li>Manufacturers of prescription opioid medications overstated the benefits of their drugs:\u00a0They also downplayed the risks of using these opioids while\u00a0aggressively marketing\u00a0these drugs to physicians,\u00a0both directly and through medical experts<\/li>\n<li>Distributors failed to monitor, detect, investigate, refuse, and report suspicious orders of prescription opiates<\/li>\n<\/ul>\n<p>The Centers for Disease Control and Prevention (CDC) reported troubling statistics for 2024. Drug overdose deaths reached\u00a0<a href=\"https:\/\/www.cdc.gov\/media\/releases\/2025\/2025-cdc-reports-decline-in-us-drug-overdose-deaths.html\" target=\"_blank\" rel=\"noopener\">around 87,000<\/a>\u00a0from October 2023 to September 2024. In response, the U.S. Department of Health and Human Services worked with other agencies to address substance use disorders.\u00a0<\/p>\n<p>The economic costs also escalated dramatically. According to reports, illicit opioids cost Americans an estimated $2.7 trillion in 2023 alone. This is equal to 9.7 percent of Gross Domestic Product (GDP).<\/p>\n<h2><strong data-redactor-tag=\"strong\">The Legal Implications of an Opioid Lawsuit<\/strong><\/h2>\n<p>The consolidated federal opioid case is\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.ohnd.uscourts.gov\/mdl-2804\" target=\"_blank\" rel=\"noopener\">In Re: National Prescription Opiate Litigation, MDL 2804<\/a>. The legal implications of this case extend far beyond financial settlements. It reshaped the controlled substance system in the United States. The law changed how these substances are manufactured, distributed, and prescribed. The two main legal arguments target opioid manufacturers and distributors.<\/p>\n<h3><strong data-redactor-tag=\"strong\">False Advertising and Marketing<\/strong><\/h3>\n<p>The opioid lawsuits are similar to state and federal claims against Big Tobacco in the 1990s. Plaintiffs claim that Purdue Pharma and other manufacturers knew their products were prone to abuse and addiction.<\/p>\n<p>Companies directed materials to both physicians and patients. The materials claimed that opioid addiction is a &#8220;myth.&#8221; They also argued that opioids were necessary because pain was undertreated. Manufacturers regularly cited a\u00a0<a href=\"https:\/\/retractionwatch.com\/2017\/06\/02\/nejm-issues-unusual-warning-readers-1980-letter-opioid-addiction\/\" target=\"_blank\" rel=\"noopener\">1980 letter<\/a>\u00a0to support their claims. The letter was published in the New England Journal of Medicine. It claimed that addiction is rare in patients treated with narcotics. This wasn&#8217;t a peer-reviewed study, but merely a letter that its author now regrets writing.<\/p>\n<p>Research and federal agencies, including the FDA and CDC, later contradicted many of these marketing claims. The complaint notes that the\u00a0<a href=\"https:\/\/www.fda.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Food and Drug Administration (FDA)<\/a>\u00a0and the CDC confirmed the falsity of the Defendant&#8217;s misrepresentation.<\/p>\n<p>Ohio Attorney General Mike DeWine filed a complaint against Purdue Pharma and other opioid manufacturers on May 31, 2017. In the\u00a0<a href=\"https:\/\/www.ohioattorneygeneral.gov\/Files\/Briefing-Room\/News-Releases\/Consumer-Protection\/2017-05-31-Final-Complaint-with-Sig-Page.aspx\" target=\"_blank\" rel=\"noopener\">complaint<\/a>, DeWine claimed that the defendant spent millions of dollars on materials and activities. These materials falsely deny the risks of opioids and overstate their benefits for treating chronic pain.<\/p>\n<h3><strong data-redactor-tag=\"strong\">Failure To Monitor Distribution<\/strong><\/h3>\n<p>Federal and some state laws place requirements on distributors of controlled substances. These distributors must monitor prescription dispensing. The goal is to prevent misuse and abuse of the system. The so-called &#8220;<a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC4177012\/\" target=\"_blank\" rel=\"noopener\">diversion theory<\/a>&#8221; argues that distributors should have known something wasn&#8217;t quite right. The sheer volume of prescriptions being filled should have alerted them to the issue. Plaintiffs claim that distributors simply looked the other way, blinded by record profits.<\/p>\n<p>Under the CSA, distributors are legally required to maintain effective controls against diversion. They must also design and operate a system to disclose suspicious orders of controlled substances. Failure to follow these requirements can result in both civil and criminal penalties.<\/p>\n<p>An investigation by the Charleston Gazette-Mail discovered that\u00a0roughly nine\u00a0million hydrocodone pills flooded into a single pharmacy in just two years. This pharmacy was located in the small town of\u00a0<a href=\"https:\/\/wvpublic.org\/story\/wvpb-news\/how-drug-companies-flooded-west-virginia-with-opioid-pills\/\" target=\"_blank\" rel=\"noopener\">Kermit, West Virginia<\/a>, which has a population of only 393. Many of these pharmacies and pain clinics have been described as &#8220;pill mills.&#8221; They earned this label because of their allegedly loose prescribing of pain medications.<\/p>\n<p>In April 2017, the\u00a0Cherokee Nation\u00a0filed the first lawsuit by a tribal government against distributors. The distributors involved in the lawsuit are:<\/p>\n<ul>\n<li>McKesson Corporation<\/li>\n<li>Cardinal Health, Inc.<\/li>\n<li>AmerisourceBergen<\/li>\n<li>CVS Health<\/li>\n<li>Walgreens Boots Alliance, Inc., and<\/li>\n<li>Wal-Mart Stores, Inc.<\/li>\n<\/ul>\n<p>According to the lawsuit, distributors sent an\u00a0<a href=\"https:\/\/www.prnewswire.com\/news-releases\/cherokee-nation-files-landmark-lawsuit-to-hold-pharmacies-opioid-distributors-accountable-300442781.html\" target=\"_blank\" rel=\"noopener\">estimated 845 million milligrams<\/a>\u00a0of opioids to the 14-county Cherokee Nation in 2015. This amount of opioids averages out to between 360 and 720 pills per year per prescription opioid user in the\u00a0Cherokee Nation. According to the reports by the CDC, opioid overdose deaths in the Cherokee Nation doubled between 2003 and 2014.<\/p>\n<h2><strong data-redactor-tag=\"strong\">How Much Is the Total Opioid Settlement?<\/strong><\/h2>\n<p>The opioid settlement represents the largest liability settlement in American history. Nationwide, agreements have almost reached\u00a0<a href=\"https:\/\/www.texasattorneygeneral.gov\/globalopioidsettlement\" target=\"_blank\" rel=\"noopener\">$60 billion<\/a>\u00a0in settlements with states and other local governments. Drug manufacturers, distributors, and pharmaceutical companies shouldered these settlement payments.<\/p>\n<p>The most recent development came in June 2025.\u00a055 Attorney Generals signed the $7.4 billion settlement agreement resolving\u00a0the litigation against Purdue Pharma and the Sackler family in their role in the opioid crisis. For years, they aggressively marketed\u00a0<a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/oxycontin-lawsuit-overview.html#:~:text=Visit%20our%20attorney%20directory%20to%20find%20a%20lawyer,and%20much%20more%20at%20FindLaw%27s%20Dangerous%20Drugs%20section.\">OxyContin<\/a>\u00a0and other prescription painkillers. Under the terms of the agreement, they are permanently prohibited from selling, promoting, or manufacturing opioids in the United States.<\/p>\n<p>Opioid distributors now face enhanced oversight and accountability, along with being subject to an independent monitor. This monitor will track the nationwide distribution of opioids. This is designed to prevent deliveries to places where misuse or diversion could happen. Pharmacists are also subject to this oversight. They are required to flag suspicious orders and refuse to fill them.<\/p>\n<h2><strong data-redactor-tag=\"strong\">A Patient&#8217;s\u00a0Right to Pain Management<\/strong><\/h2>\n<p>The issue of patients&#8217; right to pain management became more complex after the opioid crisis and the following regulatory responses. Medical organizations recognize the ethical obligations related to pain relief. The\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC6301399\/\" target=\"_blank\" rel=\"noopener\">American Medical Association<\/a>\u00a0understands a\u00a0physician&#8217;s duty to relieve patients&#8217; pain and suffering, a position echoed by the World Health Assembly. It&#8217;s agreed that healthcare professionals have an ethical duty to alleviate patients&#8217; pain and suffering.<\/p>\n<p>The United States tackles this issue with\u00a0a more complex legal framework. At present, there is no federal right to pain treatment. The only law that controls the prescription of pain medicines is the Controlled Substances Act (CSA).\u00a0<\/p>\n<p>However, several states enacted\u00a0provisions that protect patients&#8217; right to pain treatment. These regulations often require documentation in medical records to support treatment options. For instance,\u00a0<a href=\"https:\/\/app.leg.wa.gov\/wac\/default.aspx?cite=246-919-850\" target=\"_blank\" rel=\"noopener\">Washington State<\/a>\u00a0explicitly mentioned that physicians should not fear disciplinary action if they prescribed controlled substances for legitimate medical reasons.\u00a0<a href=\"https:\/\/www.medcentral.com\/pain\/chronic\/state-pain-laws-case-intractable-pain-centers-part-iii\" target=\"_blank\" rel=\"noopener\">Other states<\/a>\u00a0with similar state laws are Arkansas, California, Colorado, Montana, and North Dakota.<\/p>\n<p>If you would like to learn more about your right to pain management under your state laws,\u00a0speak with\u00a0a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/health-health-care-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">healthcare attorney.<\/a><\/p>\n<h2><strong data-redactor-tag=\"strong\">The MAT Act<\/strong><\/h2>\n<p>The\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.samhsa.gov\/substance-use\/treatment\/statutes-regulations-guidelines\/mat-act\" target=\"_blank\" rel=\"noopener\">Medication-Assisted Treatment for Addiction and Treatment (MAT) Act<\/a>\u00a0is a federal policy. It aims to help those struggling with drug addiction. The act\u00a0focuses on those suffering from opioid use disorder (OUD) and alcohol use disorder (AUD). This Act simplified how physicians treat opioid addiction.\u00a0<\/p>\n<p>Prior to this law, physicians needed special permission to prescribe certain medications. They had to have a waiver to prescribe medications that help people recovering from opioid addiction. The MAT Act eliminated these waiver requirements. All practitioners with updated DEA registration can prescribe buprenorphine. These practitioners must have Schedule III authority.
