No license or formal training is required to engage in journalism, though <span data-term-id=\"57115520\">citizen journalists<\/span> face the same legal limitations as professional reporters.<\/p>\n\n    <\/div>\n\n\n\n<div><p>Today&#8217;s media landscape is highly fragmented, leaving many communities without consistent local news coverage and creating opportunities for government actions to go unchecked. <span data-term-id=\"57115522\">Citizen journalism<\/span> helps fill these gaps by empowering anyone to document events, interview officials, and <span data-term-id=\"57115575\">share information<\/span> with the public.<\/p>\n<p><span data-term-id=\"57115520\">Citizen journalists<\/span> have the same <a href=\"https:\/\/constitution.findlaw.com\/amendment1\/first-amendment-freedom-of-the-press.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57115573\">First Amendment<\/span><span data-term-id=\"57115573\"> protections<\/span><\/a>\u200b as traditional reporters. They may face practical limits on access and credibility, making their persistence, accuracy, and community trust essential.<\/p>\n<h2>Anyone Can Be a Journalist<\/h2>\n<p>If you\u2019re looking to fill a news gap in your area, the <span data-term-id=\"57115525\">First Amendment<\/span>&#8216;s <span data-term-id=\"57115537\">freedom of speech<\/span> and <span data-term-id=\"57115524\">freedom of the press<\/span> guarantee that anyone can be a journalist. This is the essence of &#8220;<span data-term-id=\"57115522\">citizen journalism<\/span>.&#8221;<\/p>\n<h3>What We Mean by &#8220;Journalist&#8221;<\/h3>\n<p>You may hear different terms used for people doing journalism outside <span data-term-id=\"57115533\">traditional <\/span><span data-term-id=\"57115538\">media<\/span><span data-term-id=\"57115538\"> organizations<\/span>: <span data-term-id=\"57115520\">citizen journalist<\/span>, <span data-term-id=\"57115568\">independent journalist<\/span>, freelance reporter, documentary filmmaker, or content creator. Legally, these labels don&#8217;t matter. The <span data-term-id=\"57115525\">First Amendment<\/span> protects the activity of <span data-term-id=\"57115532\">newsgathering<\/span> and reporting, not your job title or platform.<\/p>\n<p>Whether you&#8217;re on TikTok documenting a protest, a <span data-term-id=\"57115554\">blogger<\/span> investigating local government, or a YouTuber interviewing community members about an issue, you&#8217;re engaging in journalism. You have constitutional protections when doing so.<\/p>\n<p>Not all content creation is journalism. Publishing entertainment, opinion, or commercial content is protected, but they differ from the <span data-term-id=\"57115532\">newsgathering<\/span> activities we\u2019re discussing here. The distinction matters because some legal protections, like <span data-term-id=\"57115552\">shield laws<\/span> in certain states, may only apply when you&#8217;re engaged in actual reporting.<\/p>\n<h3>No License or Credentials Required<\/h3>\n<p>While newspapers and other <span data-term-id=\"57115538\">media organizations<\/span> have advertising revenue to fund employees&#8217; salaries, benefits, and legal support, there are no barriers to becoming a journalist. <span data-term-id=\"57115523\">Professional journalists<\/span> at newspapers, magazines, and television stations may be part of unions, but they are neither <span data-term-id=\"57115574\">accredited<\/span> nor licensed.<\/p>\n<p><span data-term-id=\"57115520\">Citizen journalists<\/span> captured many newsworthy moments, often without intending to. In one of the most notable examples, <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2021\/06\/11\/darnella-frazier-pulitzer-prize-citation-george-floyd-video\/7656851002\/\" target=\"_blank\" rel=\"noopener\">teenager Darnella Frazier used her <span data-term-id=\"57115548\">cellphone<\/span> to record and then share<\/a>\u200b\u200b the murder of George Floyd by Minneapolis <span data-term-id=\"57115566\">police officer<\/span> Derek Chauvin. Without that video, there would have been significantly less evidence to challenge the police&#8217;s account of Floyd&#8217;s death.<\/p>\n<h2>What Can You Do as a <span data-term-id=\"57115520\">Citizen Journalist<\/span>?<\/h2>\n<p>Anyone can be a journalist, which means that you can do anything a &#8220;professional&#8221; journalist does. You can:<\/p>\n<ul>\n<li><strong>Interview people, including <span data-term-id=\"57115565\">public officials<\/span><\/strong>: If you\u2019re acting as a journalist, you&#8217;re bound by the same rules as other journalists. &#8220;Off the record&#8221; is a mutual agreement between journalist and source, not a unilateral declaration. If you interview someone and agree that information is &#8220;off the record,&#8221; you cannot publish or attribute that information to them. However, you&#8217;re not automatically bound just because someone declares something &#8220;off the record.\u201d It requires mutual agreement, ideally established before the conversation begins.<\/li>\n<li><strong>Film newsworthy events<\/strong>: You can<a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/recording-in-public-your-legal-rights-when-filming-events-and-people.html\"> film in public locations<\/a>, since there is no reasonable expectation of privacy. Journalists of any description cannot sneak into private places to film or record.<\/li>\n<li><strong>Publish your stories, videos, podcasts, and other media<\/strong>: You do not have the right to demand that your story be published by the <span data-term-id=\"57115539\">New York<\/span> Times. If the only publication that will air your video is your brother&#8217;s podcast, that will have to do.<\/li>\n<li><strong>Conduct investigations by examining public records<\/strong>: Anyone can access government records through <a href=\"https:\/\/www.findlaw.com\/civic-engagement\/citizen-journalism\/how-to-get-government-information-under-the-freedom-of-informati.html\">Freedom of Information Act (FOIA) requests<\/a>\u200b and other processes. There will always be some limits. You are not entitled to go into the Oval Office and rummage through the President&#8217;s personal archives.<\/li>\n<li><strong>Receive confidential information from anonymous sources<\/strong>: If you use such information, you may not reveal your anonymous source to anyone. Doing so may open you up to a civil lawsuit.<\/li>\n<\/ul>\n<p>In general, you can record or photograph anyone where they do not have a <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/what-is-the-reasonable-expectation-of-privacy.html\">reasonable expectation of privacy<\/a>. There are other factors involved with <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-privacy\/is-it-legal-to-record-your-boss-or-coworkers.html\">recording individuals without their consent<\/a>. Approximately a dozen states require all parties to consent to the recording of conversations where there&#8217;s a reasonable expectation of privacy (often called &#8220;two-party&#8221; or &#8220;all-party&#8221; consent states). This typically applies to private conversations, not public events or statements made without expectation of privacy.<\/p>\n<p><span data-term-id=\"57115523\">Professional journalists<\/span> have their agency&#8217;s legal departments behind them, but you won\u2019t. Check your state laws before recording anyone.<\/p>\n<h2>The Limitations of <span data-term-id=\"57115522\">Citizen Journalism<\/span><\/h2>\n<p>Just because you call yourself a journalist, it doesn&#8217;t mean everyone will treat you like one. Remember:<\/p>\n<ul>\n<li>People do not have to talk to you. They can refuse to make a comment to anyone, including <span data-term-id=\"57115523\">professional journalists<\/span>.<\/li>\n<li>If only credentialed members of the press may attend an event, and the event organizer declines to give you a credential, you cannot attend. You may still have the right to film or observe from public spaces outside the event.<\/li>\n<li>You cannot trespass on <span data-term-id=\"57115560\">private property<\/span>. Bathrooms, locker rooms, and posted areas are off-limits to anyone at any time.<\/li>\n<li>There is no right to a printing press, television broadcast channel, or any other equipment or infrastructure typical of &#8220;the press.&#8221; <span data-term-id=\"57115538\">Media organizations<\/span> pay for all this themselves.<\/li>\n<li>Publishing false statements that damage someone&#8217;s reputation can expose you to a <span data-term-id=\"57115534\">defamation<\/span>\u00a0lawsuit. Public figures must prove you acted with &#8220;actual malice,\u201d meaning you knew the statement was false or recklessly disregarded the truth. Private individuals face a lower burden of proof.<\/li>\n<li>While the <span data-term-id=\"57115525\">First Amendment<\/span> provides broad protections, <span data-term-id=\"57115543\">free speech<\/span> has limits in certain contexts. These include true threats, incitement to imminent lawless action, or disclosure of properly classified national security information.<\/li>\n<li>Certain restricted areas within government buildings may require special credentials. Some courtroom recordings will demand permission from the presiding judge. Many courtrooms allow public access without credentials, though recording restrictions often apply.<\/li>\n<\/ul>\n<p>If the community sees you as a &#8220;credentialed,&#8221; &#8220;professional,&#8221; or &#8220;serious&#8221; journalist, it may affect your ability to attend events such as press conferences. While this used to require capital investments, the barriers to <span data-term-id=\"57115522\">citizen journalism<\/span> have been reduced by internet publishing, <span data-term-id=\"57115521\">social media<\/span>, and crowdfunding sites.<\/p>\n<p>There are also instances where police and judges may not respect your right to engage in <span data-term-id=\"57115532\">news-gathering<\/span>. While your <span data-term-id=\"57115545\">First Amendment<\/span><span data-term-id=\"57115545\"> rights<\/span> are the same, that does not mean you may not face arrest in the heat of the moment.<\/p>\n<h2>Accessing Public Information<\/h2>\n<p>One of the most powerful tools available to <span data-term-id=\"57115520\">citizen journalists<\/span> is access to government records. At the federal level, the <a href=\"https:\/\/www.findlaw.com\/civic-engagement\/citizen-journalism\/how-to-get-government-information-under-the-freedom-of-informati.html\">Freedom of Information Act (FOIA)<\/a>\u200b allows anyone to request information from federal agencies that isn&#8217;t already publicly available. Each state also has its own public records laws (often called &#8220;sunshine laws&#8221;) that govern access to state and local government information.<\/p>\n<p>Public records often include:<\/p>\n<ul>\n<li>Government meeting minutes and agendas<\/li>\n<li>Budget documents and contracts<\/li>\n<li>Police reports and arrest records<\/li>\n<li>Building permits and inspection reports<\/li>\n<li>Agency correspondence and emails<\/li>\n<li>Court documents<\/li>\n<\/ul>\n<p>In some cases, you may need to file a document request or subscribe to a document access agency to access these documents. Some, such as court documents through PACER, may charge a fee or require a paid subscription.<\/p>\n<h3>How To Get Records<\/h3>\n<p>Different documents require different access methods. Be as specific as possible about what you&#8217;re requesting to avoid delays and reduce fees. Some requests can take months or even years to fulfill.<\/li>\n<li><strong>State and local records<\/strong>: Contact the appropriate state or local agency. Each state has different procedures, timelines, and fee structures.<\/li>\n<li><strong>Already public information<\/strong>: Before filing a request, check if the information is already available online. The federal government publishes extensive information through the Federal Register and agency websites.<\/li>\n<\/ul>\n<p>Keep in mind that government documents are often unredacted (edited). Sensitive and identifying information, such as names, addresses, and Social Security numbers, cannot be left on documents received from government agencies.<\/p>\n<h3>Attending Public Meetings<\/h3>\n<p>Most government meetings at all levels must be open to the public under open meetings laws. You can typically record these meetings, though some jurisdictions have specific rules about where recording equipment can be placed or the need for prior notification.<\/p>\n<h3>Recording the Police<\/h3>\n<p>In recent years, questions of whether<a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/do-you-have-the-right-to-record-interactions-with-police.html\"> citizens may record police<\/a>\u200b in the course of their duties have become a hot-button topic for civilians, <span data-term-id=\"57115540\">law enforcement<\/span>, and politicians. This is a delicate subject, and unlikely to have a solution soon.<\/p>\n<p>Some states have attempted to pass laws that limit individuals&#8217; right to record police, based on the legal theory that this constitutes interference or obstruction with official police business. Most of these laws have not survived court challenges.<\/p>\n<p>Police may ask you to stop recording or move back. They can give you a lawful order to move back a &#8220;reasonable distance.&#8221; You should remain behind any marked off area, and you cannot trespass or film in any location you are not lawfully permitted to be. So far, police cannot legally seize your recording device or demand you unlock your phone without a <span data-term-id=\"57115562\">court order<\/span>. They can still arrest you if you get too close or interfere with an active arrest. Use discretion.<\/p>\n<h2>Legal, Ethical, and Personal Safety<\/h2>\n<p>It is no secret that <span data-term-id=\"57115530\">public interest<\/span> recording and <span data-term-id=\"57115520\">citizen journalists<\/span> are at risk these days. If you decide to film public events, you may find yourself in the middle of a physical confrontation or a legal tangle you didn&#8217;t anticipate. To avoid that, keep some things in mind before setting out with your camera and microphone.<\/p>\n<h3>Legal Considerations<\/h3>\n<p><span data-term-id=\"57115573\">First Amendment<\/span><span data-term-id=\"57115573\"> protections<\/span> extend to <a href=\"https:\/\/constitution.findlaw.com\/amendment1\/first-amendment-freedom-of-the-press.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57115524\">freedom of the press<\/span><\/a>, but only up to a point. When <span data-term-id=\"57115553\">members of the public<\/span> act as journalists, they must obey the same restrictions as <span data-term-id=\"57115523\">professional journalists<\/span>. <span data-term-id=\"57115535\">Media freedom<\/span> to write about matters of <span data-term-id=\"57115530\">public interest<\/span> is not unlimited. You can protect yourself by avoiding these legal traps.<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-libel-slander.html\"><strong><span data-term-id=\"57115534\">Defamation<\/span><\/strong><\/a>: Slander, libel, and intentional <span data-term-id=\"57115529\">dissemination<\/span> of <span data-term-id=\"57115551\">misinformation<\/span> are not protected by the <span data-term-id=\"57115525\">First Amendment<\/span>. Intentionally spreading lies or falsehoods under the cover of <span data-term-id=\"57115541\">freedom of expression<\/span> is illegal, and you could face civil or criminal penalties.<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/invasion-of-privacy.html\"><strong>Violation of privacy<\/strong><\/a>: As noted, some areas are off-limits to all journalists. Releasing certain types of information is not permitted by law. Although invasion of privacy is a tort (civil) offense, you could face criminal charges if you trespassed to get your journalistic scoop.<\/li>\n<li><strong>Release of classified information<\/strong>: <span data-term-id=\"57115542\">Watchdog<\/span> and <span data-term-id=\"57115571\">advocacy<\/span> groups often seek out whistleblowers who want to expose wrongdoing in government and industry. There are legal channels for releasing this information, but dropping it on your webpage usually isn&#8217;t one of them. The initial WikiLeaks document dump, widely hailed as a necessary exposure of U.S. wrongdoing in Iraq and Afghanistan in 2010, resulted in the indictment and arrest of founder Julian Assange.<\/li>\n<li><strong>Incitement and credible threats<\/strong>: Hate speech, fighting words, and &#8220;true threats&#8221; are not protected under the <span data-term-id=\"57115525\">First Amendment<\/span>. The <span data-term-id=\"57115549\">U.S. <\/span><span data-term-id=\"57115526\">Supreme Court<\/span> ruled in a series of <span data-term-id=\"57115561\">court cases<\/span> that speech &#8220;directed to inciting or producing imminent lawless action&#8221; is not covered and can be prohibited.<\/li>\n<\/ul>\n<p>Some states have &#8220;<span data-term-id=\"57115552\">shield laws<\/span>&#8221; that protect journalists from revealing their\u00a0sources. <span data-term-id=\"57115552\">Shield laws<\/span> only protect reporters from contempt charges in court if a prosecutor or plaintiff demands the identity of a source and the reporter cites confidentiality. Not all states have these laws, and judges can issue a <span data-term-id=\"57115562\">court order<\/span> to overcome the privilege. There is no federal <span data-term-id=\"57115552\">shield law<\/span>, and federal courts generally do not recognize a reporter&#8217;s privilege to protect confidential sources. Some federal circuits have recognized limited protections in certain circumstances.<\/p>\n<p>If you&#8217;re not sure whether your work may fall into these brackets, <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">ask an attorney<\/a>. As a <span data-term-id=\"57115520\">citizen journalist<\/span>, you won&#8217;t have your news agency&#8217;s legal department at your back.<\/p>\n<h3>Ethical Concerns<\/h3>\n<p>&#8220;<span data-term-id=\"57115559\">Gatekeeping<\/span>&#8221; is the modern term for people who try to monitor what newcomers can and cannot do on their platforms. In this case, it also means the public perception of <span data-term-id=\"57115520\">citizen journalists<\/span> who stray beyond ethical or acceptable behavior in the pursuit of news.<\/p>\n<p>Although you may not face <span data-term-id=\"57115572\">legal action<\/span>\u00a0for\u00a0<span data-term-id=\"57115559\">gatekeeping<\/span>, you should avoid it to maintain a good reputation in your community and among other journalists. Here are a few common mistakes to watch out for:<\/p>\n<ul>\n<li><strong>Do not publish unverified information:<\/strong> Always <span data-term-id=\"57115546\">fact-check<\/span> your information and sources, no matter how reliable you think they are<\/li>\n<li><strong>Do not trespass or violate anyone&#8217;s privacy<\/strong>: This includes &#8220;accidentally&#8221; forgetting to ask for consent to record in two-party states<\/li>\n<li><strong>Present facts, not productions<\/strong>: Do not post dramatizations, AI, or recreated scenes without a clear indication that this is what they are<\/li>\n<li><strong>Stay neutral<\/strong>: Do not present biased information unless you are clearly presenting an op-ed or opinion piece<\/li>\n<li><strong>Report, don\u2019t influence<\/strong>: Never harass your sources, interview subjects, or other officials<\/li>\n<li><strong>Be mindful of others<\/strong>: Use extreme caution when reporting on sensitive subjects such as minor children, active <span data-term-id=\"57115561\">court cases<\/span>, or local tragedies<\/li>\n<\/ul>\n<p>In most instances, none of these are illegal. You may do all these things with little or no legal consequence, but it might mean facing other consequences in the public sphere.<\/p>\n<h3>Protecting Your Work<\/h3>\n<p>Most <span data-term-id=\"57115520\">citizen journalists<\/span> seek <span data-term-id=\"57115570\">breaking news<\/span> or interesting information for public consumption. To ensure your recordings reach your office, be sure to protect them as you travel from the location. While there&#8217;s no need to be paranoid and hire a hacker to brick your hard drive, make sure your work is safe. Keep the following in mind:<\/p>\n<ul>\n<li>Upload all recordings and videos as soon as you can to sites like the <a href=\"https:\/\/www.aclu.org\/know-your-rights\/stopped-by-police\" target=\"_blank\" rel=\"noopener\">ACLU&#8217;s Mobile Justice<\/a>\u200b app<\/li>\n<li>Use data encryption for hard drives and USB flash drives<\/li>\n<li>Use two-factor authentication and password managers to protect your online access<\/li>\n<li>Update your software and drivers regularly or enable automatic updates<\/li>\n<li>Use a VPN or Tor browser to mask IP addresses<\/li>\n<li>Disable cookies and trackers<\/li>\n<\/ul>\n<p>If you enter a volatile situation, a live stream on a\u00a0<span data-term-id=\"57115556\">social media<\/span><span data-term-id=\"57115556\"> platform<\/span>\u00a0ensures that your video is stored online and that as many eyes as possible\u00a0see the raw footage as it happens. A little paranoia in those situations never hurts.<\/p>\n<h3>Take Care of Yourself<\/h3>\n<p><span data-term-id=\"57115555\">Mainstream media<\/span> reporters usually wear their station&#8217;s logo and bring camera crews and sound trucks when they report on events and emerging situations. You will not have these things.
