It strengthened protections against employment discrimination. It also clarified the legal framework for civil actions. It saw the rise of the <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/what-are-civil-rights.html\">civil rights<\/a> movement and a push for greater equality in American society. This is evident in the laws passed during this period. Those pertaining to employment discrimination are no exception.<\/p>\r\n<p>For example, the <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-pay-act-of-1963.html\">Equal Pay Act of 1963<\/a> (EPA) addressed the longstanding issue of women being paid less than men. The EPA mandated equal pay for equal work.<\/p>\r\n<p>On a broader scale, Congress passed <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/title-vii-of-the-civil-rights-act-of-1964-equal-employment.html\">Title VII of the Civil Rights Act of 1964<\/a> (Title VII) to prohibit employment discrimination. The revolutionary law made it illegal for employers to discriminate against job applicants and employees on the basis of race, color, religion, sex, or <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/national-origin-discrimination.html\">national origin<\/a>.<\/p>\r\n<p>The <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-employment-opportunity-age-discrimination.html\">Age Discrimination in Employment Act of 1967<\/a> (ADEA) also aimed to protect older workers from age discrimination in the workplace.<\/p>\r\n<p>Together, these and other laws marked important steps in the fight against discrimination and reflected the changing social attitudes of the time.<\/p>\r\n<h2>Supreme Court Cases<\/h2>\r\n<p>However, several <a href=\"https:\/\/supreme.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">Supreme Court <\/a>decisions in the late 1980s weakened some of these protections. They made it harder for victims of discrimination to challenge and prove unlawful employment practices.<\/p>\r\n<h3>Wards Cove Packing Co. vs. Atonio<\/h3>\r\n<p>For example, <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/490\/642.html\" target=\"_blank\" rel=\"noopener\"><i>Wards Cove Packing Co. v. Atonio<\/i> <\/a>(1989) made it more difficult for employees to prevail on disparate impact discrimination claims. The ruling put the <a href=\"https:\/\/dictionary.findlaw.com\/definition\/burden-of-proof.html\" target=\"_blank\" rel=\"noopener\">burden of proof<\/a> on the plaintiff.<\/p>\r\n<h3>Martin vs. Wilks<\/h3>\r\n<p><a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/490\/755.html\" target=\"_blank\" rel=\"noopener\"><i>Martin v. Wilks<\/i><\/a> (1989) made it easier for non-parties to challenge existing <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/are-employers-required-to-have-affirmative-action-plans.html\">affirmative action plans<\/a> through consent decrees long after implementation.<\/p>\r\n<h3>Lorance vs. AT&amp;T Technologies<\/h3>\r\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/490\/900.html\" target=\"_blank\" rel=\"noopener\"><i>Lorance v. AT&amp;T Technologies<\/i> <\/a>(1989), the Supreme Court held that the statute of limitations for challenging a discriminatory seniority system began to run when the system was adopted, not when its effects were felt by individual employees.<\/p>\r\n<h2>The Civil Rights Act of 1991<\/h2>\r\n<p>In response to these decisions, the federal government passed the Civil Rights Act of 1991 as an amendment to Title VII. The Act enhanced the overall enforcement of <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/civil-rights-laws.html\">civil rights laws<\/a> in the workplace. It did this through several key provisions.<\/p>\r\n<h3>Title I<\/h3>\r\n<p>Title I of the Act, in part:<\/p>\r\n<ul>\r\n<li>Clarified that the rights protected under federal <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/civil-rights-basics.html\">civil rights laws<\/a> are safeguarded against impairment by state law<\/li>\r\n<li>Extended protections to American employees working for U.S. companies abroad<\/li>\r\n<li>Allowed victims of intentional employment discrimination under Title VII, the Americans with Disabilities Act of 1990 (ADA), and other federal anti-discrimination laws, to receive <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-are-compensatory-damages.html\">compensatory damages<\/a> (excluding back pay) and punitive damages<\/li>\r\n<li>Gave Title VII plaintiffs the right to a <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/judge-versus-jury-trials.html#:~:text=to%20defend%20themselves.-,Jury%20Trials,-In%20a%C2%A0\">jury trial<\/a> in cases where they sought monetary damages<\/li>\r\n<li>Extended the right to jury trials to ADEA plaintiffs<\/li>\r\n<li>Prohibited employer use of seniority systems adopted with discriminatory intent<\/li>\r\n<li>Increased the time allowed for filing an <a href=\"https:\/\/www.eeoc.gov\/\" target=\"_blank\" rel=\"noopener\">Equal Employment Opportunity Commission<\/a> (EEOC) discrimination charge in some cases<\/li>\r\n<li>Allowed reasonable expert fees as part of the <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/attorney-fees-and-costs.html\">attorney&#8217;s fees<\/a> awarded to the prevailing party in employment discrimination cases<\/li>\r\n<li>Clarified employer obligations to provide <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/reasonable-accommodations-and-the-americans-with-disabilities-act.html\">reasonable accommodations under the ADA<\/a><\/li>\r\n<li>Reduced the plaintiff\u2019s burden of proof in mixed-motive cases<\/li>\r\n<\/ul>\r\n<p>These measures aimed to provide stronger protections and remedies for victims of <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/what-is-discrimination.html\">discrimination<\/a>.<\/p>\r\n<h3>Title II<\/h3>\r\n<p>Title II of the Act sought to address and clarify certain legal standards. Amongst other features, it:<\/p>\r\n<ul>\r\n<li>Limited the ability to challenge <a href=\"https:\/\/dictionary.findlaw.com\/definition\/decree.html#:~:text=%5Bdivorce%20%5D%20%5Binterlocutory%20%5D-,consent%20decree,-%3A%20a%20decree\" target=\"_blank\" rel=\"noopener\">consent decrees<\/a> for individuals who had notice and a reasonable opportunity to present objections<\/li>\r\n<li>Shifted the burden of proof for <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/disparate-impact-discrimination.html\">disparate impact claims<\/a> to the respondent\/employer to show that the challenged practice is job-related and consistent with business necessity<\/li>\r\n<li>Clarified that the <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/is-there-a-time-limit-to-file-a-lawsuit-what-are-statutes-of.html\">statute of limitations<\/a> for filing a discrimination claim begins to run when the discriminatory act occurs and is communicated to the employee<\/li>\r\n<li>Established a commission to study barriers preventing women and minorities from workplace advancement<\/li>\r\n<li>Mandated creation of the Technical Assistance Training Institute to provide guidance about laws enforced by the EEOC<\/li>\r\n<\/ul>\r\n<p>These and other provisions set out to streamline the relevant legal processes.<\/p>\r\n<h3>Title III<\/h3>\r\n<p>Title III focused on expanding protections against <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/discrimination-and-harassment.html\">employment discrimination and harassment<\/a>. It did this in various ways. These included:<\/p>\r\n<ul>\r\n<li>Extending the rights and protections of the Act and Title VII to instrumentalities of Congress<\/li>\r\n<li>Prohibiting discrimination in personnel actions affecting <a href=\"https:\/\/constitution.findlaw.com\/article1\/annotation02.html\" target=\"_blank\" rel=\"noopener\">Senate and House of Representatives<\/a> employees<\/li>\r\n<\/ul>\r\n<p>These measures were largely designed to enhance the enforcement of federal civil rights laws.<\/p>\r\n<h2>Impact of the 1991 Civil Rights Act<\/h2>\r\n<p>The Act had a significant impact on workplace discrimination laws and <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/discriminatory-practices.html\">practices<\/a>.
