In general, you can sue for <span data-term-id=\"57042635\">false representation<\/span> if you have evidence.<\/p>\n<h2>What Are <span data-term-id=\"57042624\">False Promises<\/span>?<\/h2>\n<p><span data-term-id=\"57042624\">False promises<\/span> from an employer or recruiter are statements that the company and its staff present as a \u201cdone deal\u201d to the employee or prospective hire, but cannot <span data-term-id=\"57042665\">follow through<\/span> on. This can be in any of the following forms:<\/p>\n<ul>\n<li>&#8220;Don&#8217;t take a different job. We\u2019re going to promote you soon.&#8221;<\/li>\n<li>&#8220;If you work extra shifts, you\u2019ll get the next promotion.&#8221;<\/li>\n<li>&#8220;If you take this job, you will easily make six figures.&#8221;<\/li>\n<li>&#8220;You can expand your territory and make more sales if you join my team.&#8221;<\/li>\n<li>&#8220;If you work for me, I will let you take all the big projects.&#8221;<\/li>\n<li>&#8220;Take this contractor role. It\u2019ll be full-time within a year.&#8221;<\/li>\n<li>&#8220;You&#8217;ll get two big bonuses a year.&#8221;<\/li>\n<\/ul>\n<p>If you take the job or stay in your current position and nothing ever changes, your employer may be liable for making a <span data-term-id=\"57042624\">false promise<\/span>. Whether intentional or unintentional, you might be able to claim damages if you were promised something that would have resulted in more money but never materialized.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/injury-damages.html\">Damages<\/a> are the money you lost by acting on the promise, such as taking a new job or staying in your current position. If an employer claims you&#8217;ll make $100,000 more by switching positions but limits your sales territory in the new role, you could sue for the amount of money you lost. A jury might also award damages for the <span data-term-id=\"57042641\">emotional distress<\/span> of moving jobs and having to go to court to fight for the money and <span data-term-id=\"57042634\">job security<\/span> you expected to have.<\/p>\n<h2><span data-term-id=\"57042624\">False Promises<\/span> vs. <span data-term-id=\"57042648\">At-Will Employment<\/span><\/h2>\n<p>Being an <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/at-will-employment-and-wrongful-termination.html\"><span data-term-id=\"57042650\">at-will employee<\/span><\/a> means you do not have specific guidelines in your\u00a0<span data-term-id=\"57042628\">employment contract<\/span> for when your job can end. Employees are presumed to be at-will in all states except for Montana. This allows your employer to fire you or change the job role, <span data-term-id=\"57042656\">working conditions<\/span>, or terms of employment at almost any time.<\/p>\n<p>You cannot sue them for firing you at-will unless there are other illegal circumstances at play, such as:<\/p>\n<ul>\n<li>Discrimination based on protected characteristics like race, gender, age, religion, or disability<\/li>\n<li>Public policy violations, such as firing you for refusing to commit an illegal act or for exercising a <span data-term-id=\"57042666\">legal right<\/span> (like filing a workers&#8217; compensation claim)<\/li>\n<li>Implied contract exceptions, where the employer&#8217;s policies, handbooks, or conduct created an implied promise of continued employment<\/li>\n<\/ul>\n<p>You must choose to continue working in the new conditions or leave, unless one of these exceptions applies.<\/p>\n<h2>When Contracts Are Formed<\/h2>\n<p>An employer can form a valid contract with you if there is:<\/p>\n<ul>\n<li>An offer that guarantees performance (such as getting a full-time role)<\/li>\n<li>Offer acceptance from the employee<\/li>\n<li>Consideration from both parties (both parties provide something of value, like work in exchange for promised compensation)<\/li>\n<\/ul>\n<p>If the guaranteed performance is not met, the employer has breached the contract. <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/contracts-faq.html\">Contracts<\/a> can be written or verbal, and judges take contract claims seriously. Keep in mind that in most states, <span data-term-id=\"57042628\">employment contracts<\/span> for terms longer than one year must be in writing to be enforceable under the statute of frauds.<\/p>\n<h2>What Employers Can\u2019t Do<\/h2>\n<p>Recruiters and managers may make jobs sound better than they are to attract top talent. There are protections in place for <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/employees-rights-101.html\">your rights<\/a>. This means employers cannot:<\/p>\n<ul>\n<li>Share confidential information<\/li>\n<li>Pay you less than agreed or <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/how-to-report-unpaid-wages-and-recover-back-pay.html\">not pay you enough<\/a> under the law<\/li>\n<li>Provide unsafe <span data-term-id=\"57042656\">working conditions<\/span><\/li>\n<li>Take away vacation time or benefits that are in your contract<\/li>\n<\/ul>\n<p>If an employer violates these rules or breaks a valid contract, you may have <span data-term-id=\"57042639\">legal claims<\/span> such as <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/wrongful-termination.html\"><span data-term-id=\"57042633\">wrongful termination<\/span><\/a> or <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/breach-of-contract-and-lawsuits.html\"><span data-term-id=\"57042645\">breach of contract<\/span><\/a>.<\/p>\n<p>Some red flags to look for during the employment process (interviews, salary negotiations, etc.) include:<\/p>\n<ul>\n<li>The employer makes verbal promises but refuses to commit anything to writing. Be especially wary if the <span data-term-id=\"57042630\">employer promises<\/span> to fix everything in your final contract but won\u2019t put anything in your offer letter.<\/li>\n<li>Be wary if the contract language is vague, and the employer refuses to give you specific figures or timetables. Unless you\u2019re taking a commission-based position, an employer should give you a concrete salary figure.<\/li>\n<li>Are you getting pressure to accept or sign quickly? Watch out for situations where you\u2019re asked to sign an incomplete contract or <span data-term-id=\"57042642\">employment agreement<\/span> with a promise that they\u2019ll get the final agreement to you when others have signed it.<\/li>\n<li>Promises that seem too good or out of step for the industry usually are. Always do your homework before accepting a <span data-term-id=\"57042636\">job offer<\/span>. Salaries or perks that are not standard for the job market or that seem unrealistic for your skill set should be approached with caution.<\/li>\n<\/ul>\n<p>These are only a few of the things to beware of. If something doesn\u2019t feel right, take a moment to reassess the situation.<\/p>\n<h2>Taking Your Claim to Court<\/h2>\n<p>You can make a\u00a0<span data-term-id=\"57042639\">legal claim<\/span>\u00a0for &#8220;<span data-term-id=\"57042629\">fraudulent inducement<\/span>\u00a0of employment&#8221; if the employer has defrauded you into staying at a job, taking a new job, or accepting a new position. <span data-term-id=\"57042629\">Fraudulent inducement<\/span> involves intentional <span data-term-id=\"57042625\">misrepresentation<\/span>. This is more common in employment cases than <span data-term-id=\"57042668\">negligent <\/span><span data-term-id=\"57042625\">misrepresentation<\/span>, where an employer makes <span data-term-id=\"57042626\">false statements<\/span> carelessly but without intent to deceive. As long as the change is based on the employer&#8217;s <span data-term-id=\"57042626\">false statements<\/span>, you have a claim.<\/p>\n<p>You will need to prove:<\/p>\n<ul>\n<li>The employer&#8217;s intention<\/li>\n<li>The <span data-term-id=\"57042625\">misrepresentation<\/span> (whether written or verbal)<\/li>\n<li>How the promises made you decide to take or leave a job<\/li>\n<li>How you relied on the <span data-term-id=\"57042624\">false promises<\/span><\/li>\n<li>The amount of damages you suffered (that can be calculated, like losing a certain amount of money or moving your family across the country)<\/li>\n<\/ul>\n<p>If you think you may be facing a\u00a0<span data-term-id=\"57042624\">false-promises<\/span> scenario, keep track of everything that&#8217;s been said or done regarding your potential job. Save all job postings, emails, and <span data-term-id=\"57042658\">text messages<\/span>. If you receive an offer letter, highlight any differences between the job listing and your offer letter.<\/p>\n<p>Send emails to confirm what was said in phone conversations or Zoom meetings. This ensures that everything said is written and agreed to by both sides. If there are any witnesses to your discussion, make sure they get copies of your emails. For <span data-term-id=\"57042651\">legal issues<\/span> with your current job, keep copies of your performance reviews or other documents that promise promotions, bonuses, etc. Note any dates or deadlines by which you were promised action.<\/p>\n<p>The <span data-term-id=\"57042624\">false promises<\/span> must be intentional, which can be hard to prove. Employers can say they made a mistake or a misstatement. Without a record of the conversation, an employee can be in a &#8220;they said\/I said&#8221; argument with no proof. You might also have a hard time proving you believed a promise if it is unreasonable or outlandish. A judge is unlikely to believe you took a job after you were promised triple the normal salary for the role or a private jet, for example.<\/p>\n<p>Having a record of the meetings, emails, promises, phone calls, messages, letters, and other communications can go a long way in court to prove your case. Each state has laws governing the\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/workplace-privacy\/employer-recording-personal-conversations-on-work-phones-and-com.html\">recording of conversations<\/a>\u00a0without the consent of one or both parties.<\/p>\n<p>Keep all messages and communications from your employer or potential employer. Communications made prior to a\u00a0<span data-term-id=\"57042636\">job offer<\/span>\u00a0that differ from the actual offer may constitute primary evidence. New evidence sources may include Slack conversations, LinkedIn DMs, MS Teams chats, and other intra-office communications.<\/p>\n<h2>Should You File a Lawsuit?<\/h2>\n<p>You should only consider <span data-term-id=\"57042640\">legal action<\/span> if you relied on the promises made by your employer or potential employer. In most cases, you do not have a cause of action if a possible employer made extravagant promises, but you turned the job down. However, if you declined other jobs in reliance on this job, you could have a possible claim for that lost opportunity.<\/p>\n<p>You must also be able to show that the offer was made under <span data-term-id=\"57042644\">false pretenses<\/span>. Having evidence that the employer made a <span data-term-id=\"57042624\">false promise<\/span> with the specific intention to induce you to take the job can go a long way toward winning your claim.<\/p>\n<p>Making major changes in your life based on promises made can serve as a basis for claiming damages. Examples include moving across the country, leaving school early, or leaving a comfortable position. You have a better chance of succeeding in a <span data-term-id=\"57042654\">false promises<\/span><span data-term-id=\"57042654\"> lawsuit<\/span> than if you merely left one job for another comparable job.<\/p>\n<p>Several common elements of successful lawsuits can be found in <a href=\"https:\/\/scholar.google.com\/scholar_case?case=5151671814693239935&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\" target=\"_blank\" rel=\"noopener\"><em>Lazar v. Rykoff<\/em><\/a> (1996), including :<\/p>\n<ul>\n<li><strong><span data-term-id=\"57042635\">False representations<\/span> of material facts, such as lying about salaries or the financial status of the company<\/strong>: The California Supreme Court upheld the plaintiff\u2019s claim of <span data-term-id=\"57042629\">fraudulent inducement<\/span> when the defendant concealed facts about the company\u2019s financial troubles and bonus caps<\/li>\n<li><strong>Intent to deceive at the time the offer is made<\/strong>: The defendant company knew that the promise of long-term employment was a lie and that the plaintiff was being hired as an \u201cat-will\u201d employee, regardless of his job performance<\/li>\n<li><strong>Detrimental reliance on the promise<\/strong>: The plaintiff left a job and a residence of 20 years to move his family from New York to Los Angeles in reliance on the <span data-term-id=\"57042636\">job offer<\/span><\/li>\n<li><strong>Damages<\/strong>: The plaintiff, who purchased a home in Los Angeles, was terminated two years after accepting employment in violation of the verbal (but not written) terms of his agreement, and was not able to find work in either Los Angeles or New York<\/li>\n<\/ul>\n<p><em>Lazar<\/em> demonstrates that even without a written agreement, an employee can sue for <span data-term-id=\"57042624\">false promises<\/span> and recover damages for <span data-term-id=\"57042638\">lost wages<\/span>, lost benefits, moving costs, and other detrimental effects.<\/p>\n<h2><span data-term-id=\"57042624\">False Promises<\/span> vs. False Advertising<\/h2>\n<p>Few things are as irritating as so-called \u201cghost jobs,\u201d those job listings that seem to exist simply to collect resumes. Almost as bad are companies that rope you in with promises of good jobs and high salaries before interviewing you for entry-level positions and low wages instead.<\/p>\n<p>These ghost jobs may be classified as false advertising. They may fall under the Federal Trade Commission (FTC) and <a href=\"https:\/\/www.congress.gov\/crs-product\/IF12977\" target=\"_blank\" rel=\"noopener\">laws against deceptive advertising<\/a>. If employers post these listings in an effort to conceal their company\u2019s financial straits or to encourage workers to apply and draw workers away from competitors, they could create <span data-term-id=\"57042652\">employment issues<\/span>. For now, these are not considered <span data-term-id=\"57042624\">false promises<\/span> in the same way as <span data-term-id=\"57042625\">misrepresentation<\/span> of salary is.<\/p>\n<h2>When To Call an Attorney Over <span data-term-id=\"57042624\">False Promises<\/span><\/h2>\n<p>If you think your case meets the criteria above, you may be able to recover damages from an employer&#8217;s fraudulent promises.
