That means both share responsibility for providing you with a safe and healthy workplace under the\u00a0<a href=\"https:\/\/www.osha.gov\/laws-regs\/oshact\/completeoshact\" target=\"_blank\" rel=\"noopener\">Occupational Safety and Health Act of 1970<\/a>\u00a0(OSH Act).<\/p>\n<p>Temporary roles exist across a wide range of industries. These include clerical work, manufacturing, education, information technology, and <span data-term-id=\"56706076\">healthcare<\/span>. Even in short-term roles, federal wage, safety, and anti-discrimination <span data-term-id=\"56706089\">labor laws<\/span> still apply to you.<\/p>\n<h3><strong>Seasonal Employees<\/strong><\/h3>\n<p>Companies hire\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/part-time-temporary-and-seasonal-employees.html\">seasonal employees<\/a>\u00a0to meet demand during their busiest periods. Retail is the most common example, with businesses bringing on extra workers each year to handle holiday shopping rushes. Seasonal work also shows up in hospitality, customer service, sales, delivery, and shipping.<\/p>\n<p>Most seasonal employees work part-time. Regardless of how short the assignment is, federal and state minimum wage and overtime laws still apply to you.<\/p>\n<h2><strong><span data-term-id=\"56706065\">Federal Laws<\/span> That Protect All Workers<\/strong><\/h2>\n<p>Certain federal protections apply to virtually all workers. This is regardless of how many hours you work or whether your position is labeled part-time, temporary, or seasonal.<\/p>\n<h3><strong><span data-term-id=\"56706052\">Fair Labor Standards Act<\/span>: Wage and Hour Protections<\/strong><\/h3>\n<p>The\u00a0<a href=\"https:\/\/webapps.dol.gov\/elaws\/elg\/minwage.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56706052\">Fair Labor Standards Act<\/span> (<span data-term-id=\"56706056\">FLSA<\/span>)<\/a>\u00a0sets the rules for minimum wage, <span data-term-id=\"56706054\">overtime pay<\/span>, <span data-term-id=\"56706082\">recordkeeping<\/span>, and youth employment. An employer cannot treat you differently because of your race, disability, age, or other protected characteristics, regardless of whether you are part-time or temporary.<\/p>\n<h3><strong>Workplace Safety<\/strong><\/h3>\n<p>The OSH Act requires employers to provide a workplace free from recognized hazards that are causing or likely to cause serious physical harm. This requirement is known as the General Duty Clause.<\/p>\n<p><a href=\"https:\/\/www.osha.gov\/laws-regs\/regulations\/standardnumber\/1904\/1904.31\" target=\"_blank\" rel=\"noopener\">OSHA&#8217;s <span data-term-id=\"56706082\">recordkeeping<\/span> rules<\/a>\u00a0require employers to record all employees&#8217; injuries and illnesses. The rules apply whether the injured employee is hourly, salaried, part-time, seasonal, or a migrant worker<\/p>\n<p>Not all workers fall under the federal OSHA&#8217;s jurisdiction. The\u00a0<a href=\"https:\/\/www.osha.gov\/node\/59586\" target=\"_blank\" rel=\"noopener\">OSH Act does not cover<\/a>\u00a0self-employed workers, immediate family members of farm employers, and workers whose hazards are regulated by another federal agency. State and local government workers are only protected under the OSH Act if they work in a state with an OSHA-approved state plan.<\/p>\n<p>If your employer violates safety rules, you have the right to file a complaint with OSHA without fear of retaliation.<\/p>\n<h2><strong><span data-term-id=\"56706065\">Federal Laws<\/span> With <span data-term-id=\"56706057\">Eligibility<\/span> Thresholds<\/strong><\/h2>\n<p>Some <span data-term-id=\"56706065\">federal laws<\/span> protect you only if you meet certain hours-of-service or employment-duration thresholds. These are some of the most important ones to know.<\/p>\n<h3><strong><span data-term-id=\"56706077\">Affordable Care Act<\/span>: <span data-term-id=\"56706051\">Health Insurance<\/span><\/strong><\/h3>\n<p>The <span data-term-id=\"56706077\">Affordable Care Act<\/span> (<span data-term-id=\"56706086\">ACA<\/span>) requires large employers with 50 or more full-time or full-time equivalent employees to offer health coverage to certain employees. This requirement applies to employees who work an average of 30 or more hours of service per week. If you average under 30 hours, the <span data-term-id=\"56706086\">ACA<\/span>&#8216;s employer mandate does not require your employer to offer you <span data-term-id=\"56706051\">health insurance<\/span>. Some employers voluntarily extend coverage to part-time staff.<\/p>\n<p>If you are not offered employer-sponsored coverage, you may also look for a plan through the\u00a0<a href=\"https:\/\/obamacare-registration.org\/obamacare-enrollment\/?utm_source=CjwKCAiA2PrMBhA4EiwAwpHyCx0nzLrBlujxKMd9G0LBryRnJdmhvgI-m27dJ3XmFgWcVOCeMP37QxoCPDAQAvD_BwE&amp;gad_source=1&amp;gad_campaignid=16094069720&amp;gbraid=0AAAAACmmg-WuRzBck6CkAwPvmRZMFaQZy&amp;gclid=CjwKCAiA2PrMBhA4EiwAwpHyCx0nzLrBlujxKMd9G0LBryRnJdmhvgI-m27dJ3XmFgWcVOCeMP37QxoCPDAQAvD_BwE.\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56706051\">Health Insurance<\/span> Marketplace<\/a>. Depending on your income, you may qualify for premium tax credits or be eligible for\u00a0<a href=\"https:\/\/www.medicaid.gov\/\" target=\"_blank\" rel=\"noopener\">Medicaid<\/a>.<\/p>\n<h3><strong><span data-term-id=\"56706080\">Family and Medical Leave Act<\/span> (<span data-term-id=\"56706063\">FMLA<\/span>)<\/strong><\/h3>\n<p>The\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fmla\/faq\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56706080\">Family and Medical Leave Act<\/span> (<span data-term-id=\"56706063\">FMLA<\/span>)<\/a>\u00a0provides <span data-term-id=\"56706096\">eligible employees<\/span> with up to 12 weeks of unpaid, job-protected leave per year for qualifying family or medical reasons. To qualify, you must meet the following requirements:<\/p>\n<ul>\n<li>Have worked for your employer for at least 12 months<\/li>\n<li>Have worked at least 1,250 hours during the past 12 months<\/li>\n<li>Work at a location where the employer has 50 or more employees within 75 miles<\/li>\n<\/ul>\n<p>Many <span data-term-id=\"56706049\">part-time employees<\/span> will not meet the 1,250-hour threshold. If you do, you have the same <span data-term-id=\"56706063\">FMLA<\/span> rights as <span data-term-id=\"56706091\">full-time positions<\/span>.<\/p>\n<h3><strong><span data-term-id=\"56706083\">Retirement Benefits<\/span><\/strong><\/h3>\n<p><span data-term-id=\"56706049\">Part-time employees<\/span> who work\u00a0<a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/EBSA\/about-ebsa\/our-activities\/resource-center\/faqs\/retirement-plans-and-erisa.pdf\" target=\"_blank\" rel=\"noopener\">1,000 hours or more<\/a>\u00a0during a calendar year may be eligible for <span data-term-id=\"56706083\">retirement benefits<\/span> under the Employee Retirement Income Security Act (<span data-term-id=\"56706092\">ERISA<\/span>). The 1,000-hour rule is no longer the only path to <span data-term-id=\"56706064\">retirement plan<\/span> <span data-term-id=\"56706057\">eligibility<\/span> for <span data-term-id=\"56706053\">part-time workers<\/span>.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.irs.gov\/pub\/irs-drop\/n-24-73.pdf\" target=\"_blank\" rel=\"noopener\">SECURE 2.0 Act of 2022<\/a> significantly expanded access to employer-sponsored <span data-term-id=\"56706064\">retirement plans<\/span>. For plan years that start after December 31, 2024, your employer must allow you to participate in their 401(k) plan under certain conditions. This requirement applies if you have worked at least 500 hours per year for two consecutive years and are at least 21 years old. It\u2019s a significant change from the prior three-year requirement under the original SECURE Act of 2019.<\/p>\n<p>Employers are not required to make matching contributions for <span data-term-id=\"56706049\">part-time employees<\/span>, but they must allow you to participate in the plan if you qualify.<\/p>\n<h2><strong>State and Local Legal Protections<\/strong><\/h2>\n<p><span data-term-id=\"56706065\">Federal law<\/span> sets the minimum requirements, but state and local governments often provide additional protections for part-time, temporary, and seasonal workers. These vary significantly by location. Let\u2019s take a look at some important protections.<\/p>\n<h3><strong><span data-term-id=\"56706058\">Workers&#8217; Compensation<\/span><\/strong><\/h3>\n<p>In most states, <span data-term-id=\"56706058\">workers&#8217; compensation<\/span> covers part-time, temporary, and seasonal employees, not just <span data-term-id=\"56706062\">full-time workers<\/span>. If you are injured on the job, you are generally entitled to file a claim regardless of how many hours you work each week. Requirements vary by state, so check your state&#8217;s <span data-term-id=\"56706058\">workers&#8217; compensation<\/span> board for specifics.<\/p>\n<h3><strong>Unemployment Insurance<\/strong><\/h3>\n<p>State unemployment insurance programs may also cover part-time and seasonal workers who lose their jobs through no fault of their own.
