State laws must meet or exceed the federal standard.<\/p>\n<p>For example, the\u00a0<a href=\"https:\/\/www.dol.gov\/general\/topic\/wages\/minimumwage\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">federal minimum wage<\/a>\u00a0has been $7.25 per hour since 2009. Many states have set a higher minimum wage.\u00a0<a href=\"http:\/\/dir.ca.gov\/dlse\/faq_minimumwage.htm\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">California<\/a>\u00a0has a minimum wage of $16.50\u00a0per hour in 2025, and\u00a0<a href=\"https:\/\/dol.nebraska.gov\/PressRelease\/Details\/301\/minimumwageincrease\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Nebraska<\/a>\u00a0has set its minimum wage at $12 per hour in 2024.<\/p>\n<p>If state law does not meet the federal standard, then the federal statute will apply. Several states, such as\u00a0<a href=\"https:\/\/dol.georgia.gov\/minimum-wage\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Georgia<\/a>\u00a0and\u00a0<a href=\"https:\/\/drive.google.com\/file\/d\/1AZKBT_JCGnKI4zW8VNjw6b1-Oqhnsdjv\/view?pli=1\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Wyoming<\/a>, have wages below the federal standard. However, these states must pay the federal minimum wage for any job protected under the\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/federal-wage-law-the-fair-labor-standards-act.html\" rel=\"noopener noreferrer nofollow\">Fair Labor Standards Act<\/a>\u00a0(FLSA).<\/p>\n<h2>Important Employment Laws<\/h2>\n<p>You should be aware of several important federal employment or labor laws as an employee. These laws guarantee your basic rights in the workplace. The U.S.\u00a0<a href=\"https:\/\/www.dol.gov\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Department of Labor<\/a>\u00a0enforces most labor laws. The\u00a0<a href=\"https:\/\/www.eeoc.gov\/how-file-charge-employment-discrimination\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Equal Employment Opportunity Commission<\/a>\u00a0hears discrimination complaints.<\/p>\n<p>Often, your employer&#8217;s human resources department takes your complaint. If you have suffered a violation of the law, you should also file a complaint with the appropriate government office. Your\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/state\/contacts\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">local state labor office<\/a>\u00a0can help as well.<\/p>\n<p>You should be familiar with the rights afforded to you by the following statutes:<\/p>\n<h3>Title VII of the Civil Rights Act of 1964<\/h3>\n<p>Title VII prohibits employment discrimination in hiring, refusing to hire, or firing employees. Employers cannot discriminate on the basis of:<\/p>\n<ul>\n<li>Race<\/li>\n<li>Religion<\/li>\n<li>Gender<\/li>\n<li>National origin<\/li>\n<li>Sexual orientation<\/li>\n<li>Gender identity<\/li>\n<\/ul>\n<p>Title VII also prohibits sexual harassment. The\u00a0<a href=\"https:\/\/www.eeoc.gov\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Equal Employment Opportunity Commission<\/a>\u00a0(EEOC) enforces these antidiscrimination laws and regulations.<\/p>\n<h3>The Fair Labor Standards Act (FLSA)<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\">The Fair Labor Standards Act<\/a>\u00a0(FLSA) establishes a national minimum wage and overtime pay for non-exempt employees. The FLSA also defines an employee and what qualifies as work and restricts child labor, setting a minimum age for minors to work. It requires equal pay regardless of gender after an amendment to FLSA called the\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-pay-and-discrimination-against-women.html\" rel=\"noopener noreferrer nofollow\">Equal Pay Act<\/a>\u00a0(EPA). Employers cannot retaliate against whistleblowers who file a claim against them.<\/p>\n<h3>Americans with Disabilities Act (ADA)<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/the-americans-with-disabilities-act-overview.html\">The ADA<\/a>\u00a0applies to employers with 15 or more employees. They must make reasonable accommodations for people with disabilities or certain health conditions. Employers cannot discriminate against employees or job applicants with disabilities.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.eeoc.gov\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Equal Employment Opportunity Commission<\/a>\u00a0(EEOC) handles complaints and violations of the ADA.<\/p>\n<h3>The Occupational Safety and Health Act (OSHA)<\/h3>\n<p>OSHA&#8217;s goal is to protect workers from\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/protecting-yourself-from-unsafe-working-conditions.html\">hazardous and unsafe working environments<\/a>. You have the right to a safe workplace and protection from conditions that can cause injury, illness, or death. OSHA has whistleblower protections. Your employer cannot retaliate against you for reporting unsafe conditions to the\u00a0<a href=\"https:\/\/www.osha.gov\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Occupational Safety and Health Administration<\/a>.<\/p>\n<h3>The Family and Medical Leave Act (FMLA)<\/h3>\n<p>The FMLA provides\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/family-and-medical-leave-act.html\">12 weeks of unpaid leave of absence<\/a>\u00a0per year to eligible employees to deal with:<\/p>\n<ul>\n<li>Serious medical conditions<\/li>\n<li>To care for a family member with a serious health condition<\/li>\n<li>To adjust to the birth of a baby, adoption, or foster care placement.<\/li>\n<\/ul>\n<p>Once your leave ends, your job or a similar position with the same pay and employee benefits must be available. You can use paid vacation and sick leave in combination with FMLA.<\/p>\n<h3>The Pregnancy Discrimination Act<\/h3>\n<p>The\u00a0<a href=\"https:\/\/www.eeoc.gov\/pregnancy-discrimination\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Pregnancy Discrimination Act<\/a>\u00a0amended Title VII to include protections for pregnant persons. It prohibits discrimination because of pregnancy, childbirth, or related health conditions. Your employer cannot fire, demote, or prevent promotion based on your pregnancy.<\/p>\n<h3>Electronic Communications Privacy Act (ECPA)<\/h3>\n<p>An ECPA amendment\u00a0<a href=\"https:\/\/bja.ojp.gov\/program\/it\/privacy-civil-liberties\/authorities\/statutes\/1285\" target=\"_blank\" rel=\"noopener\">prohibits employers from monitoring phone calls<\/a>\u00a0and electronic communications, except under certain conditions. Your employer must outline any surveillance practices in your employee handbook.<\/p>\n<h3>Age Discrimination in Employment Act (ADEA)<\/h3>\n<p>The ADEA prohibits\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/age-discrimination-in-employment.html\">discrimination based on age<\/a>, particularly if you are 40 or older.<\/p>\n<h3>Consolidated Omnibus Budget Reconciliation Act (COBRA)<\/h3>\n<p>Under COBRA, employees have\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/cobra-insurance-rights.html\">guaranteed access to continued healthcare<\/a>\u00a0for a period of time after leaving their jobs. This helps ensure that you have health coverage even while between jobs.<\/p>\n<h2>Union Employees<\/h2>\n<p>The National Labor Relations Act establishes the right to form a union. If you are part of a union, your rights and employment relationship fall under an employment contract called a collective bargaining agreement. Your employer and union leadership negotiate this agreement. It details your working conditions, benefits, pay, and other employment details.<\/p>\n<p>You should contact your labor union representatives if you experience a workplace offense. You may also file a complaint with the\u00a0<a href=\"https:\/\/www.nlrb.gov\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">National Labor Relations Board<\/a>.<\/p>\n<h2>Common Employment Law Issues<\/h2>\n<p>Legal issues can arise in a wide range of employment situations. One of the most common circumstances occurs when your employer uses an illegal reason for firing you.<\/p>\n<p>Termination based on race, religion, gender, national origin, ethnicity, disability, or age is illegal. Employers who do so may be subject to civil liability for\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/wrongful-termination.html\">wrongful termination<\/a>. The ban on discrimination applies to firings and other aspects of employment. This includes hiring and promotion decisions.<\/p>\n<p>Federal and state laws also protect employees from unfair labor practices. For example, the Family and Medical Leave Act ensures employees time off to welcome a new baby or deal with a serious illness.<\/p>\n<p>Other employment law issues involve workplace conditions. OSHA requires employers to provide a safe workplace by adhering to national safety standards. Failing to do so can lead to fines and civil liability.<\/p>\n<p>Employees have certain\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/workplace-privacy\/privacy-in-the-workplace-overview.html\">privacy rights<\/a>\u00a0while at work. For example, employers can&#8217;t track personal telephone conversations or search an employee&#8217;s car. To appeal a workers&#8217; compensation decision, find an attorney versed in\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/workers-compensation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">workers&#8217; compensation law<\/a>.<\/p>\n<p>If you are a union member or work under a collective bargaining agreement, speak to a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/labor-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">labor attorney<\/a>\u00a0if you have questions or have had your rights violated.<\/p>\n<h2>Employment Law Attorneys at a Glance<\/h2>\n<p>Disputes over employment terms &#8212; hiring, firing, promotions, discrimination &#8212; are quite common. There are two main types of employment law attorneys:\u00a0those who represent employers and those who represent employees (often the plaintiffs). Some attorneys work with both employers and employees, but most specialize in one or the other.<\/p>\n<p>Larger employers typically have in-house employment lawyers who draft contractual language, review human resources policies, and\u00a0work to limit an employer&#8217;s legal exposure.
