It requires the former employer to provide the final paycheck on the regular payday for the period worked, regardless of whether the employee quit or was terminated.<\/p>\r\n<h2><b>File for Unemployment Compensation<\/b><\/h2>\r\n<p>To maintain your income even after you lose your job, you should try to file for <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/unemployment-insurance-overview.html\" title=\"unemployment benefits\">unemployment benefits<\/a>. In general, state law allows unemployed workers to collect their workers&#8217; compensation if:<\/p>\r\n<ul>\r\n<li>You lost your job through no fault of your own, such as layoff, reduction in force, or business closure<\/li>\r\n<li>You meet your state&#8217;s requirements for wages earned or time worked during the &quot;base period&quot;<\/li>\r\n<li>You are physically capable of working and available for immediate employment<\/li>\r\n<li>You are in an active job search for new suitable work<\/li>\r\n<\/ul>\r\n<p>Note that the amount of unemployment benefits varies significantly in every state. It often covers around 40% to 60% of your previous salary. Each state also has a set maximum amount of <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/unemployment-insurance-overview.html\" title=\"unemployment compensation benefits\">unemployment compensation benefits<\/a>. The standard benefits in most states last for up to 26 weeks. However, extensions are available in certain scenarios.<\/p>\r\n<p>You should file your claim immediately after losing employment to avoid delays in benefit payments. Your state&#8217;s Department of Labor will ask you to provide proof of identification. If you were wrongfully terminated, you may be able to recover damages or even get your job back.<\/p>\r\n<h2><b>Recognize Signs of Employment Discrimination<\/b><\/h2>\r\n<p>The <a href=\"https:\/\/www.eeoc.gov\/\" title=\"Equal Employment Opportunity Commission\" target=\"_blank\" rel=\"noopener\">Equal Employment Opportunity Commission<\/a> (EEOC) protects employees from discrimination. The law may still look at this as unlawful termination.<\/p>\r\n<p>The following are some of the circumstances that need to be present to prove a case of constructive dismissal:<\/p>\r\n<ul>\r\n<li>The employer had knowledge of the intolerable working conditions or intended to force you to resign<\/li>\r\n<li>Your working environment was unusually adverse that a reasonable employee would be forced to resign<\/li>\r\n<\/ul>\r\n<p>Courts often look at the continuing pattern of conduct to provide a case of constructive dismissal.
