This process, rooted in the National Labor Relations Act, enables a collective bargaining team to represent the interests of all workers. The process typically begins with identifying disagreements and proceeds through stages of proposal exchanges and negotiations until a final agreement is reached and ratified by union members.<\/p>\n\n    <\/div>\n\n<p>Workers and employers often disagree about crucial employment terms and conditions. This can cause conflict in the workplace.<\/p>\r\n<p>Sometimes, employees organize with a union to resolve important labor issues. Rather than have individual employees address these issues, a collective bargaining team represents the workers\u2019 interests. Workers rely on their union representatives to protect their labor rights in exchange for paying <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/how-to-stop-paying-union-dues.html\">union dues<\/a>.<\/p>\r\n<p>One benefit of having unions handle labor-management relations is that they derive power from the federal government. Labor unions\u2019 right to negotiate collective bargaining agreements (CBA) comes from the&nbsp;<a href=\"https:\/\/corporate.findlaw.com\/human-resources\/employer-penalties-for-violating-the-national-labor-relations-act.html\" target=\"_blank\" rel=\"noopener\">National Labor Relations Act<\/a> (NLRA), otherwise known as the Wagner Act.<\/p>\r\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/taft-hartley-act-overview.html\">Wagner Act<\/a> (1935) dictates how union bargaining representatives negotiate&nbsp;employment conditions with private and public employers. Each bargaining unit has an exclusive agent representing it at arbitration and negotiating labor agreements.<\/p>\r\n<h2><b>The Collective Bargaining Process<\/b><\/h2>\r\n<p>The collective bargaining process typically begins with a <a href=\"https:\/\/corporate.findlaw.com\/human-resources\/resolving-employment-disputes.html\" target=\"_blank\" rel=\"noopener\">labor disagreement<\/a>. This happens when workers and their employers disagree on a particular employment issue.<\/p>\r\n<p>Some of the topics and issues that collective bargaining addresses include:<\/p>\r\n<ul>\r\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits.html\">Wages and hours<\/a><\/li>\r\n<li>Time off<\/li>\r\n<li>Working conditions<\/li>\r\n<li>Health coverage, retirement, and other benefits<\/li>\r\n<li>Raises and promotions<\/li>\r\n<li>Insurance<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-are-your-legal-rights-if-you-are-laid-off\/\">Layoffs<\/a><\/li>\r\n<\/ul>\r\n<p>The goal is for the union leader to reach a tentative agreement with the employer\u2019s human resources team. The union representatives will then present the agreement to the members for approval.<\/p>\r\n<p>The actual collective bargaining process is relatively straightforward:<\/p>\r\n<ul>\r\n<li>Each side chooses a representative to protect their interests at the bargaining table.<\/li>\r\n<li>After agreeing to specific ground rules, the parties begin the negotiation process by meeting for an initial discussion.<\/li>\r\n<li>The parties exchange proposals and begin to explore potential compromises.<\/li>\r\n<li>The parties draft a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/collective-bargaining-agreement.html\" target=\"_blank\" rel=\"noopener\">tentative&nbsp;agreement<\/a>.<\/li>\r\n<li>After further negotiations, the two sides reach a final agreement.<\/li>\r\n<li>The representatives sign the final collective bargaining agreement (CBA) after presenting the agreement to the union members for ratification.<\/li>\r\n<\/ul>\r\n<p>The above process is standard for unions in the private sector. In the public sector, the negotiations may also involve representatives from various state agencies.<\/p>\r\n<p>Those participating in the collective bargaining process must act in&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/good-faith.html\" target=\"_blank\" rel=\"noopener\">good faith<\/a>. They must refrain from certain behaviors while at the bargaining table, such as:<\/p>\r\n<ul>\r\n<li>Refusing to meet and bargain<\/li>\r\n<li>Engaging in sham or misleading negotiations<\/li>\r\n<li>Changing a written agreement without conferring with the other side<\/li>\r\n<li>Misrepresenting the employee organization<\/li>\r\n<\/ul>\r\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/what-is-the-nlrb.html\">National Labor Relations Board<\/a> (NLRB) governs this behavior.<\/p>\r\n<p>A successful collective bargaining process promotes dignity and mutual respect in the workplace. A breakdown in the negotiation process can lead to strikes and lockouts.<\/p>\r\n<h2><b>How Does a Union Protect Workers?<\/b><\/h2>\r\n<p>Unions protect workers in various ways, both in the public and private sectors. The three most common types of unions in the U.S. are <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/list-of-us-labor-unions.html\">trade unions<\/a>, general unions, and industrial unions.<\/p>\r\n<p>Unions protect worker rights, help maintain <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety.html#:~:text=This%20section%20covers%20OSHA%20regulations%2C%20enforcement%2C%20and%20workplace,requires%20employers%20to%20protect%20workers%20against%20workplace%20risks.\">health and safety standards<\/a>, and improve employees\u2019 overall well-being.<\/p>\r\n<p>Some of the ways in which labor organizations protect workers include:<\/p>\r\n<ul>\r\n<li>Negotiate contracts for higher wages and benefits on behalf of their members<\/li>\r\n<li>Teach members how to protect their rights as American workers<\/li>\r\n<li>Provide members with a toolkit to air grievances and work-related complaints<\/li>\r\n<li>Advocate for their members\u2019 labor rights<\/li>\r\n<li>Leverage and maintain workers\u2019 healthcare benefits, sick\/vacation time, and pensions<\/li>\r\n<li>Help with <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/workplace-safety-osha-and-osh-act-overview.html\">OSHA violations<\/a><\/li>\r\n<li>Increase job security<\/li>\r\n<li>Create training and apprenticeship programs<\/li>\r\n<\/ul>\r\n<p>While all these benefits are key, contract negotiations are the most important.
