They may come about for various reasons. Sometimes they pose legal issues that can give rise to certain claims.<\/p>\n<p>Both state and federal law govern these claims. Depending on <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/guide-to-creating-employee-handbooks.html\">employer policy<\/a>, employees may also have an opportunity to provide a rebuttal to negative feedback or a negative review.<\/p>\n<h3>Performance Review&nbsp;Topics<\/h3>\n<p>Common areas addressed in the review process include the employee&#8217;s:<\/p>\n<ul>\n<li>Strengths<\/li>\n<li>Areas for improvement<\/li>\n<li>Achievements over the specified period<\/li>\n<li>Future performance goals<\/li>\n<li>Career development opportunities<\/li>\n<\/ul>\n<p>When done properly, these evaluations can help employees understand how well they are meeting job expectations. We sometimes see <a href=\"https:\/\/www.findlaw.com\/employment\/legal-help-and-resources\/protecting-the-rights-of-workers.html\">unfair treatment of employees<\/a> in the review process.&nbsp;<\/p>\n<h2>Legal Claims Based on Performance Reviews<\/h2>\n<p>The legal claims an employee might bring in response to an unfair evaluation can vary. They&#8217;ll generally depend on the specific circumstances and state law.&nbsp;<\/p>\n<p>Below, we review some of the legal claims frequently asserted by employees facing unfair performance reviews.<\/p>\n<h3>Discrimination<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/employment-discrimination.html\">Discrimination claims <\/a>are among the most common legal actions related to employee performance reviews. They can arise when an employee believes they were evaluated unfairly due to a protected characteristic like race or gender.
