Understanding these laws helps protect farm workers&#8217; rights and ensures fair treatment in the workplace.<\/p>\n\n    <\/div>\n\n<p>The Fair Labor Standards Act (FLSA) covers agricultural workers&#8217; rights and mandates&nbsp;minimum wage&nbsp;and labor standard protections. The <a href=\"https:\/\/www.dol.gov\/agencies\/whd\" target=\"_blank\" rel=\"noopener\">Wage and Hour Division<\/a> (WHD) of the U.S. Department of Labor (DOL) also ensures that H-2A workers are employed in compliance with H-2A labor certification requirements.<\/p>\r\n<p>Farm workers have rights just like other workers. Read on to learn more about farm labor laws and H-2A workers&#8217; rights.<\/p>\r\n<h2>What Is the Difference Between H-2A and H-2B Programs?<\/h2>\r\n<p>Both H-2A and <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/h-2b-temporary-non-agricultural-workers\" target=\"_blank\" rel=\"noopener\">H-2B visa programs<\/a> are for work of a temporary or seasonal nature. But, there are key differences in the type of work they allow:<\/p>\r\n<ul>\r\n<li><b>H-2A <\/b>is for agricultural work, such as harvesting, planting, and livestock herding.<\/li>\r\n<li><b>H-2B<\/b> is for non-agricultural work, such as in construction, hospitality, landscaping, and tourism.<\/li>\r\n<\/ul>\r\n<p>Both H-2A and H-2B visas require a <a href=\"https:\/\/www.dol.gov\/agencies\/eta\/foreign-labor\" target=\"_blank\" rel=\"noopener\">Foreign Labor Certification<\/a> (FLC) from the DOL before the U.S. Citizenship and Immigration Services (USCIS) can approve the visa.&nbsp;<\/p>\r\n<p>There are other differences between these two programs, including annual cap, wage rates, and employer housing and transportation requirements.<\/p>\r\n<p>This article discusses the H-2A program and how it relates to farm workers.<\/p>\r\n<h2>Farm Workers&#8217; Coverage<\/h2>\r\n<p>Most&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/agriculture\" target=\"_blank\" rel=\"noopener\">agricultural<\/a>&nbsp;workers are covered by the FLSA. Farm workers&#8217; coverage under the FLSA extends to essential labor protections. It addresses things like work hours, workdays, and wage rates. It stipulates that agricultural employees can&#8217;t receive compensation below the federal minimum wage unless&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">specific exemptions<\/a>&nbsp;apply.<\/p>\r\n<p>Whether remunerated on an hourly basis or through a piece rate, growers must ensure compliance with minimum wage standards. Unlike an hourly wage, a piece rate compensates employees based on the quantity of units or pieces they produce or complete rather than the number of hours worked.<\/p>\r\n<p>The FLSA also mandates that farm workers receive a written statement detailing earnings and deductions from pay. Employers are obligated to provide written information about wages and working conditions at their place of employment in a language comprehensible to the farm workers. This ensures that details related to compensation and <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/protecting-yourself-from-unsafe-working-conditions.html\">working conditions<\/a> are effectively communicated to foreign workers.<\/p>\r\n<h2>Overtime Pay: Agricultural Labor Exemptions<\/h2>\r\n<p>Employees working in agriculture are exempt from overtime pay requirements. They don&#8217;t have to be paid time and one-half their regular rate of pay for hours worked over 40 per week.<\/p>\r\n<p>An agriculture employer who didn&#8217;t use more than 500 &quot;man-days&quot; of agricultural labor in any calendar quarter of the preceding calendar year is exempt from the minimum wage and overtime requirements of the FLSA for the current calendar year. A &quot;man-day&quot; is defined as any day during which an employee performs agricultural work for at least one hour.<\/p>\r\n<p><a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fact-sheets\/12-agricultural-employment-flsa#:~:text=Exemptions%20from%20Minimum%20Wage%20and%20Overtime&amp;text=Employees%20who%20are%20employed%20in,per%20week%20under%20the%20FLSA.\" target=\"_blank\" rel=\"noopener\">Exemptions from the FLSA&#8217;s minimum wage and overtime requirements<\/a>&nbsp;apply to the following:<\/p>\r\n<ul>\r\n<li>Agricultural employees who are immediate family members of their employer<\/li>\r\n<li>Employees primarily on the range in the production of livestock<\/li>\r\n<li>Local hand harvest laborers who commute daily from their permanent residence, are paid on a piece rate basis in traditionally piece-rate occupations, and were engaged in agriculture for less than 13 weeks during the preceding calendar year<\/li>\r\n<li>Non-local minors, 16 years old or under, who are hand harvesters, paid on a piece rate basis in traditionally piece-rate occupations, employed on the same farm as their parent, and paid the same rate as those over 16<\/li>\r\n<\/ul>\r\n<h2>Safety and Health Regulations<\/h2>\r\n<p>Any housing or transportation provided by the employer&nbsp;<a href=\"http:\/\/www.dol.gov\/whd\/FLSAEmployeeCard\/AgGuideEnglish.pdf\" target=\"_blank\" rel=\"noopener\">must be safe<\/a>. Employer-provided housing requirements include, but aren&#8217;t limited to:<\/p>\r\n<ul>\r\n<li>One bed for each person<\/li>\r\n<li>Hot and cold running water<\/li>\r\n<li>Heating<\/li>\r\n<li>No signs of infestation<\/li>\r\n<li>First aid kits<\/li>\r\n<li>Sanitary bathrooms<\/li>\r\n<li>At least one shower for every 10 people<\/li>\r\n<li>A clean kitchen area<\/li>\r\n<\/ul>\r\n<p>Transportation requirements include, but aren&#8217;t limited to:<\/p>\r\n<ul>\r\n<li>A separate seat for each passenger<\/li>\r\n<li>Properly working parts of the vehicle<\/li>\r\n<li>Seatbelts, when required by state law<\/li>\r\n<li>Licensed drivers<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/consumer\/insurance\/automobile-insurance.html\">Vehicle insurance<\/a><\/li>\r\n<\/ul>\r\n<p>Farmworkers must also be provided a safe workplace and safe drinking water, toilets, and handwashing facilities at the worksite at no cost.<\/p>\r\n<h2>Recordkeeping for Farm Labor<\/h2>\r\n<p>Agriculture employers must keep accurate and complete payroll records. There isn&#8217;t a required form for these records, but&nbsp;<a href=\"http:\/\/www.dol.gov\/whd\/regs\/compliance\/whdfs21.pdf\" target=\"_blank\" rel=\"noopener\">the records must include<\/a>:<\/p>\r\n<ul>\r\n<li>Employee&#8217;s full name and Social Security Number<\/li>\r\n<li>Address, including zip code<\/li>\r\n<li>Birthdate (if younger than 19)<\/li>\r\n<li>Sex and occupation<\/li>\r\n<li>Time and day of week when the employee&#8217;s workweek begins<\/li>\r\n<li>Hours worked each day<\/li>\r\n<li>Total hours worked each workweek<\/li>\r\n<li>Basis on which employee&#8217;s wages are paid<\/li>\r\n<li>Regular hourly rate<\/li>\r\n<li>Total daily or weekly straight-time earnings<\/li>\r\n<li>Total overtime earnings for the workweek (agricultural employees are exempt from overtime pay requirements)<\/li>\r\n<li>All additions to or deductions from the employee&#8217;s wages<\/li>\r\n<li>Total wages paid each pay period<\/li>\r\n<li>Date of payment and the pay period covered by the payment<\/li>\r\n<\/ul>\r\n<h2>Temporary Labor for Non-Agricultural Jobs<\/h2>\r\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/temporary-worker-visas.html\">H-2B provisions<\/a>&nbsp;of the Immigration and Nationality Act provide for the admission of nonimmigrant workers, typically under an H-2b visa, to the U.S. to fill temporary nonagricultural jobs. The&nbsp;<a href=\"http:\/\/www.dol.gov\/whd\/regs\/compliance\/whdfs69.htm\" target=\"_blank\" rel=\"noopener\">Wage and Hour Division<\/a>&nbsp;of the Department of Labor is responsible for ensuring H-2B workers are employed in compliance with H-2B labor certification requirements.<\/p>\r\n<h3>Job Opportunities for Temporary Work<\/h3>\r\n<p>An employer seeking authorization to employ H-2B workers must:<\/p>\r\n<ol>\r\n<li><p>Offer terms and working conditions normal to U.S. workers similarly employed in the area of intended employment, which aren&#8217;t less favorable than those offered to H-2B workers<\/p>\r\n<\/li>\r\n<li><p>Offer a job opportunity to H-2B workers that is a bona fide, full-time temporary position with qualifications consistent with normal and accepted qualifications required by non-H-2B employers in the same or comparable occupations<\/p>\r\n<\/li>\r\n<li><p>Truly and accurately state the dates of temporary need, the reason for temporary need, and number of positions being requested for labor certification<\/p>\r\n<\/li>\r\n<\/ol>\r\n<p>Working conditions and terms must also comply with all applicable federal, state, and local employment laws. This includes laws on <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/workplace-safety-osha-and-osh-act-overview.html\">health and safety standards.<\/a><\/p>\r\n<h3>Wages for H-2B Workers<\/h3>\r\n<p>H-2B workers must be paid the higher of either the statutory&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/minimum-wage-and-overtime-basics.html\">minimum wage<\/a>&nbsp;or the prevailing wage for the area of intended employment during the approved H-2B labor certification period.<\/p>\r\n<p>Employers must also make all lawful deductions from H-2B workers&#8217; <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/payday-laws-overview.html\">paychecks <\/a>required by law, including federal and state taxes. But employers can&#8217;t require H-2B workers to pay, directly or indirectly, anything related to obtaining labor certification.<\/p>\r\n<h3>Employer Requirements for Temporary Workers<\/h3>\r\n<p>Employers can&#8217;t place H-2B workers outside the area of intended employment without obtaining a new <a href=\"https:\/\/www.dol.gov\/agencies\/eta\/foreign-labor\/programs\/h-2b\" target=\"_blank\" rel=\"noopener\">temporary labor certification<\/a> from the Department of Labor. Employers are also required to provide return transportation to H-2B workers&#8217; home country if the workers are dismissed before the end of the authorized period of stay.<\/p>\r\n<h3>Records for H-2B Employment<\/h3>\r\n<p>H-2B workers should keep a record of hours worked and wages paid.
