Employees can file a wage and hour violation report with the U.S. Department of Labor to recover back wages. This process supports all workers, regardless of immigration status, and protects against employer retaliation.<\/p>\n\n    <\/div>\n\n<p>Claims of wage theft are increasing. States and federal agencies have recovered billions in unpaid wages. Employees denied&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/wage-and-hour-laws.html\">minimum wage and overtime pay<\/a>&nbsp;can recover compensation by reporting wage and hour violations, but most wage theft cases go unreported.<\/p>\r\n<p>You have a right to your earned wages. A local <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/\" target=\"_blank\" rel=\"noopener\">employment attorney<\/a> can help you understand your rights and recover the wages your employer owes.<\/p>\r\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/flsa-reference-guide.html\">Fair Labor Standards Act<\/a>&nbsp;(FLSA) is a federal law that requires minimum wage and overtime pay. Employers must pay at least the federal minimum wage and&nbsp;time and a half&nbsp;overtime pay for employees working more than 40 hours a week. If an employer fails to meet these requirements, an employee or third-party complaint can result in workers receiving back pay for the wages they were wrongly denied.<\/p>\r\n<p>This article explains employer wage theft. It also guides you through how to file a wage and hour violation report and when to get legal help.<\/p>\r\n<h2>Why File a Wage and Hour Violation Report?<\/h2>\r\n<p>If you haven&#8217;t received minimum wage or overtime pay and are&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">an employee covered by the FLSA<\/a>, you may consider filing a wage complaint with the U.S. Department of Labor (DOL). As of March 2025, the federal minimum wage is $7.25 an hour. However, many states have&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/state-minimum-wage-laws.html\">state minimum wage requirements<\/a>&nbsp;higher than the federal minimum. An employer is responsible for paying whichever minimum wage is highest.<\/p>\r\n<p>Similarly, the FLSA requires that employers pay&nbsp;time and a half&nbsp;overtime when an employee works more than 40 hours in a work week. For example, a worker making $9 an hour and working 50 hours a week&nbsp;should get overtime pay for the 10 hours they worked beyond 40 hours that week. In this case, overtime pay must be at least one and a half times the hourly rate, or $13.50 an hour.<\/p>\r\n<p>Employees who recover back wages include cashiers whose overtime hours aren&#8217;t accurately reported on their paycheck&nbsp;and cooks paid less than minimum wage. Workers paid lump sums who worked many hours have recovered when their hourly rate didn&#8217;t meet the minimum wage. In some cases, employees&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/being-an-independent-contractor-vs-employee.html\">misclassified as independent contractors<\/a>&nbsp;and denied overtime pay have recovered compensation.<\/p>\r\n<h2>Filing a Wage and Hour Complaint<\/h2>\r\n<p>If you have been denied proper wages under the FLSA, you may&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/contact\/complaints\" target=\"_blank\" rel=\"noopener\">file a complaint<\/a>&nbsp;by mail, or in person at <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/contact\/local-offices\" target=\"_blank\" rel=\"noopener\">an office of the Wage and Hour Division (WHD)<\/a> of the Department of Labor. The Wage and Hour Division enforces many of the nation&#8217;s federal labor laws. Complaints are confidential.<\/p>\r\n<p>The Labor Department has a&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/contact\/complaints\" target=\"_blank\" rel=\"noopener\">toll-free number<\/a>&nbsp;for information, questions, and concerns.<\/p>\r\n<p><a href=\"https:\/\/www.dol.gov\/agencies\/whd\/contact\/complaints\/third-party\" target=\"_blank\" rel=\"noopener\">Third parties<\/a>&nbsp;can file complaints for an employee denied proper wages.<\/p>\r\n<p>Immigration status is not important. Undocumented workers can file complaints over federal wage law and wage payment violations.<\/p>\r\n<h2>Information Needed for Wage and Hour Complaint<\/h2>\r\n<p>You will need to include the following information in the complaint:<\/p>\r\n<ul>\r\n<li>Your contact information, including&nbsp;personal information such as&nbsp;name, address, and phone number<\/li>\r\n<li>The employer&#8217;s name, address, phone number, and type of business<\/li>\r\n<li>The job title and description of work done<\/li>\r\n<li>Pay information, including pay stubs, how much the employee is paid, the method of payment, and how often wages are paid<\/li>\r\n<li>A description of the alleged violations<\/li>\r\n<li>Dates of the violations<\/li>\r\n<\/ul>\r\n<p>After a complaint form is filed, the WHD reviews the information and conducts an investigation. The WHD will contact the complainant if more information is needed.<\/p>\r\n<h2>No Retaliation or Discrimination for Filing a Labor Department Complaint<\/h2>\r\n<p>Employers cannot&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/retaliation\" target=\"_blank\" rel=\"noopener\">retaliate&nbsp;against you<\/a> for complaining. An employer can&#8217;t fire or otherwise discriminate against a worker participating in a legal proceeding under the FLSA.<\/p>\r\n<h2>Statute of Limitations for Wage Claims<\/h2>\r\n<p>The earlier you file a complaint, the better. The FLSA has a <a href=\"https:\/\/www.dol.gov\/general\/topic\/wages\/backpay\" target=\"_blank\" rel=\"noopener\">two-year deadline<\/a> for non-willful labor law violations. The agency has a <a href=\"https:\/\/www.dol.gov\/general\/topic\/wages\/backpay\" target=\"_blank\" rel=\"noopener\">three-year deadline<\/a> for willful violations. The WHD recommends filing no later than 18 months after the violation occurred.<\/p>\r\n<p>The statutes of limitations for state laws vary, but reporting a violation as early as possible is often recommended.<\/p>\r\n<h2>State Laws Wage Protections<\/h2>\r\n<p>Many states have additional protections for workers, including higher <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/state-minimum-wage-laws.html\">minimum wages and overtime<\/a> pay for any day&#8217;s work beyond eight hours. Wage and hour complaints over the same incident are often filed with DOL and a state labor department.<\/p>\r\n<h2>Other Laws Handled by the Labor Department<\/h2>\r\n<p>The FLSA isn&#8217;t the only statute the Labor Department enforces. The federal agency investigates violations of several other federal employment and labor laws. Those laws include:<\/p>\r\n<ul>\r\n<li>Family and Medical Leave Act<\/li>\r\n<li>Employee Polygraph Protection Act<\/li>\r\n<li>Migrant and Seasonal Agricultural Worker Protection Act<\/li>\r\n<li>Consumer Credit Protection Act (wage garnishment provisions)<\/li>\r\n<\/ul>\r\n<h2>Other Types of Complaints<\/h2>\r\n<p>The Labor Department isn&#8217;t the only federal agency that handles employment-related complaints. For instance, the Occupational Safety and Health Administration (OSHA) investigates and enforces working conditions and workplace safety laws.
