These local minimum wages are applicable to most hourly employees, with certain exemptions. These regulations also dictate overtime calculations, which is essential for assessing potential wage claims.<\/p>\n\n    <\/div>\n\n<p>Workers covered by the federal wage law called the Fair Labor Standards Act (the&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act\/\">FLSA<\/a>) are entitled to at least the federal minimum wage of $7.25 an hour. In states with no established minimum wage rate or one lower than the federal wage rate, the higher minimum wage federal rate will apply to many workers who are paid hourly. Use the table below to jump to your state\u2019s minimum wage and overtime details.<\/p>\r\n<h2>Minimum Wages and Overtime Requirements by State<\/h2>\r\n<p>Nearly half of the states have a rate equal to the federal pay rate of $7.25. But several other states and D.C. have set a rate higher than the federal minimum wage through their own state minimum wage laws. Some local governments and cities have also passed their own minimum wage laws. The higher rates these states and municipalities set will apply to most workers.<\/p>\r\n<p>But, the minimum wage and overtime pay requirements below do not apply to&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">exempt employees<\/a>, farm workers, or public sector employees, as defined by both federal and state laws.<\/p>\r\n<p>Some laws also include a minimum wage increase tied to inflation or the federal rate.
