Most video surveillance in the workplace is permissible as long as employers notify workers about it.<br>\r\n<\/p>\r\n<p>But there are some instances where surveillance isn&#8217;t allowed. For example, the law limits employers&#8217; surveillance rights when recording union activity. Other state laws determine how and where employers can videotape workers. Federal <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/do-the-police-have-the-right-to-tap-my-telephone.html\">wiretap law<\/a> prohibits the recording of certain oral communications. This is why surveillance cameras don&#8217;t have audio.<\/p>\r\n<p>This article outlines the legal reasons an employer can have a camera in the workplace. State privacy and federal laws determine which surveillance systems are lawful. Of course, your employer can also install cameras when they have party consent. Your employer may have a surveillance policy requiring you to sign a form releasing them from liability. They must maintain copies of this policy in the <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/guide-to-creating-employee-handbooks.html\">employee handbook<\/a>.<\/p>\r\n<p>Certain businesses use video surveillance all the time. These include:<\/p>\r\n<ul>\r\n<li>Retail stores<\/li>\r\n<li>Restaurants<\/li>\r\n<li>Bars<\/li>\r\n<li>Hotels<\/li>\r\n<li>Casinos<\/li>\r\n<\/ul>\r\n<p>They limit camera use to locations where security and theft prevention are essential.<\/p>\r\n<p>Even if you think you have employee privacy, many companies watch employee interactions. <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/liability-and-insurance\/insurance-policies.html\">Business insurance providers<\/a> may offer lower premiums if the insured company uses video surveillance.<\/p>\r\n<p>Regardless, employers must inform workers that they are using cameras in the workplace.
