They follow a different process. If you are appealing a court judgment, you&#8217;ll need to understand the rules of appellate procedure.\u00a0<\/p>\n<p>The following is an overview of the appellate process. It details the steps in challenging court decisions and the distinctions between trials and appeals.<\/p>\n<p>Successful appeals require a strong argument that shows a legal error. It&#8217;s a good idea to work with an <a href=\"https:\/\/lawyers.findlaw.com\/litigation-appeals\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">appeals attorney<\/a> who has experience building these cases. They can review whether an appeal is worth your effort. A lawyer can advocate for you in appellate court.\u00a0<\/p>\n<h2>Can You Always Appeal a Court Decision?<\/h2>\n<p>No, you can&#8217;t appeal a court ruling unless you have valid legal grounds. Whether the appeal concerns a judge&#8217;s order or a jury&#8217;s verdict, an appellate court <a href=\"https:\/\/dictionary.findlaw.com\/definition\/review.html\" target=\"_blank\" rel=\"noopener\">reviews what happened<\/a> in prior proceedings for any errors of law. A legal error must be present in the original case to overturn the decision.<\/p>\n<p>This means losing parties can&#8217;t appeal a case just because they&#8217;re unhappy with the outcome. They may only challenge decisions that may have resulted from legal errors.<\/p>\n<p>Appeal attempts are also limited. Every time you appeal, you bring the case to a <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/how-is-the-court-system-structured.html\">higher court<\/a>. There are only a few levels within the <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system.html\">court system<\/a>. As the number of parties filing civil appeals has risen, the state and\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/us-federal-court-system.html\">federal court systems<\/a>\u00a0have implemented changes to keep up.<\/p>\n<h2>What Is the Difference Between Trials and Appeals?<\/h2>\n<p>A trial and an appeal have a few similarities and significant differences. Compare both processes below.<\/p>\n<h3>How Trials Work<\/h3>\n<p>The parties present their\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/trial-and-verdict.html\">cases at trial<\/a>, calling witnesses for testimony and presenting other evidence such as\u00a0documents, photographs, reports, surveys, diaries, and\u00a0blueprints.\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-is-the-role-of-a-jury-in-a-criminal-case.html\">The jury<\/a>\u00a0weighs this evidence and determines the facts of the case to determine\u00a0what they believe happened. A\u00a0jury is sometimes called the &#8220;finder of fact.&#8221;<\/p>\n<p>The trial judge controls the activities in the courtroom and makes all the legal decisions, such as ruling on motions and objections raised by the attorneys. The judge is often called the &#8220;finder of law.&#8221; If the parties have chosen a\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/bench-trial.html\" target=\"_blank\" rel=\"noopener\">bench trial<\/a>\u00a0rather than a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-right-to-a-jury-trial.html\">jury trial<\/a>, the judge will make findings of fact and law.<\/p>\n<h3>How Appeals Differ<\/h3>\n<p>An appeal is a review of the trial court&#8217;s application of the law. The party appealing the case is called the appellant or the petitioner. The appellee or the respondent is the opposing party. The\u00a0<a href=\"https:\/\/www.americanbar.org\/groups\/public_education\/resources\/law_related_education_network\/how_courts_work\/appeals\/\" target=\"_blank\" rel=\"noopener\">appeal process<\/a>\u00a0begins when the appellant files a notice of appeal. The filing of the notice of appeal prompts the counting of time upon which the appellant can file the brief. The appellee also has a specified period to file an answering brief.<\/p>\n<p>There is no jury\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/appeals-appellate-courts-and-costs.html\">in an appeal<\/a>, nor do the lawyers present witnesses or\u00a0other forms of evidence. The court will accept the facts revealed in the trial court unless a factual finding disputes\u00a0the weight of the evidence.<\/p>\n<p>Another difference between a trial and an appeal is the number of judges involved. A single judge presides over a trial. However, several judges at once hear an appeal in a higher court. The number of appellate court judges depends on the jurisdiction. Courts may have three to a few dozen judges at the initial appeals court level.<\/p>\n<p>The total number of judges seldom hear claims together in larger courts. Instead, panels\u00a0listen to appeals, often comprising three court judges.\u00a0<\/p>\n<p>In rare instances, the full court may grant a motion for rehearing\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/en-banc.html\" target=\"_blank\" rel=\"noopener\">en banc<\/a>.\u00a0This happens when all the judges in the appeals court hear the case together and issue a new decision.\u00a0<\/p>\n<p>Supreme Courts have five to nine judges at the state and federal level, referred to as U.S. Supreme Court Justices.<\/p>\n<h2>Appeal Procedures Vary by Case Type<\/h2>\n<p>It is essential to know that the court applies different rules depending on the\u00a0<a href=\"https:\/\/www.uscourts.gov\/about-federal-courts\/types-cases\/appeals\" target=\"_blank\" rel=\"noopener\">type of case<\/a>\u00a0during an appeal.<\/p>\n<h3>Civil Case<\/h3>\n<p>Either party can file an appeal challenging a court order in a\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/civil-cases-the-basics.html\">civil case<\/a>.<\/p>\n<h3>Criminal Case<\/h3>\n<p>The defendant can challenge a guilty verdict by filing an appeal in a criminal case. The plaintiff does not have the right to appeal a court order acquitting the defendant. Both parties in a criminal case can appeal the sentence imposed following a guilty verdict.<\/p>\n<h3>Other Types of Appeals<\/h3>\n<p>A party not pleased with the decision issued by a\u00a0<a href=\"https:\/\/libraryguides.law.pace.edu\/c.php?g=319332&amp;p=2134043\" target=\"_blank\" rel=\"noopener\">federal administrative agency<\/a>\u00a0can seek\u00a0the\u00a0<a href=\"https:\/\/www.uscourts.gov\/about-federal-courts\/court-role-and-structure\/about-us-courts-appeals\" target=\"_blank\" rel=\"noopener\">court of appeals<\/a>\u00a0for review by filing a petition. For specific federal agencies or programs, these cases often\u00a0require the district court to conduct a judicial review before the court of appeals.\u00a0<\/p>\n<p>For instance, in disputes related to Social Security benefits, a Social Security official who was\u00a0<a href=\"https:\/\/faq.ssa.gov\/en-US\/Topic\/article\/KA-01855\" target=\"_blank\" rel=\"noopener\">previously not involved<\/a>\u00a0in the original administrative decision reviews the case. If you disagree with the original decision, you can ask an\u00a0<a href=\"https:\/\/www.ssa.gov\/apply\/appeal-decision-we-made\" target=\"_blank\" rel=\"noopener\">administrative law judge<\/a>\u00a0for a hearing.<\/p>\n<h2>What Are Appellate Briefs?<\/h2>\n<p>The main form of persuasion on appeal is the written\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/appellate-brief.html\" target=\"_blank\" rel=\"noopener\">appellate brief<\/a>\u00a0filed by counsel for each party. With this brief, the\u00a0party that lost in the trial court will argue that the lower court&#8217;s decision incorrectly applied the law. The party that won below will say that the trial court&#8217;s decision was correct. Both parties will support their positions about applicable legal arguments and case laws.<\/p>\n<p>An appeal is a more scholarly court proceeding than a trial. Litigators\u00a0must be\u00a0active strategists\u00a0in the courtroom by\u00a0calling witnesses, cross-examining, and making motions or objections. The appellate lawyer builds their case in the brief before the court hears the appeal.\u00a0<\/p>\n<p>Appeals often include a short period for\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/oral-argument.html\" target=\"_blank\" rel=\"noopener\">oral argument<\/a>. Court judges often\u00a0consume this period with questions for the attorney prompted by the briefs.<\/p>\n<h2>The\u00a0Record\u00a0on Appeal<\/h2>\n<p>Appeals court decisions turn on\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/record.html\" target=\"_blank\" rel=\"noopener\">the record<\/a>, which documents what happened in the trial court. The record contains the pleadings (plaintiff&#8217;s complaint and defendant&#8217;s answer), pre-trial motions, and a transcript of what occurred during the trial. It also includes the exhibits put into evidence,\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment5\/fifth-amendment-due-process--post-trial-due-process.html\" target=\"_blank\" rel=\"noopener\">post-trial motions<\/a>, and any discussion with the judge that did not happen\u00a0off the record.\u00a0<\/p>\n<p>The success of an appeal\u00a0depends on what occurred at trial. If an attorney fails to introduce necessary or available evidence into the record or they fail to object to something prejudicial, they lose the opportunity to do so.<\/p>\n<h2>Advancing to Supreme Court Review<\/h2>\n<p>The party that loses in a state or federal appeals court may appeal to the <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/court-directories.html\">state Supreme Court<\/a> or the\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/the-u-s-supreme-court-overview.html\">U.S. Supreme Court<\/a>. Most states call their highest court the\u00a0Supreme Court,\u00a0though New York calls theirs the\u00a0Court of Appeals.<\/p>\n<p>Review in these venues\u00a0is discretionary with the court. As\u00a0these courts receive many more requests for review than they can handle, they tend to\u00a0grant review only to court orders involving unsettled questions of law.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/how-does-the-u-s-supreme-court-decide-whether-to-hear-a-case.html\">U.S. Supreme Court<\/a>\u00a0can only review cases that raise some federal or constitutional issue. Court cases that concern state law\u00a0are beyond its jurisdiction.
