You may be able to sue a code enforcement officer, investigator, or inspector in a civil action for discrimination or entering your property without permission. Yet, winning will be a challenge.&nbsp;<\/p>\n\n    <\/div>\n\n\n\n<div><p>Code enforcement officers inspect homes and commercial buildings to ensure local laws and zoning ordinances are being followed. What do you do if the code inspectors themselves are not following the law?<\/p>\n<p>You have the right to be free from discriminatory code enforcement if you are a member of a legally <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/discrimination.html\">protected class<\/a>. You also have the right to be free from unauthorized searches of your property unless the code official has a warrant. If a code enforcement officer violates your rights, you would have the basis for a lawsuit.<\/p>\n<p>Suing the code official, though, may not be your best bet. Like police officers, code enforcement officers have the\u00a0legal defense of\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/immunity.html\" target=\"_blank\" rel=\"noopener\">qualified immunity<\/a>\u00a0and, in general,\u00a0cannot be sued. The exception is when a court has previously ruled that what you say they did was illegal.<\/p>\n<p>You may have better luck suing the local government that the code enforcement officer works for. Local governments cannot rely on qualified immunity. You would only need to show that your <a href=\"https:\/\/www.findlaw.com\/civilrights.html\">rights were violated<\/a> by a code enforcement officer in the course of doing their job.<\/p>\n<p>These types of claims are known as civil rights actions. They are complicated and hard to win. You may benefit from consulting with an\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">experienced civil rights attorney<\/a>\u00a0who can give you legal advice and further information about your specific situation and help you decide if a lawsuit is your best option. It&#8217;s worth the attorney&#8217;s fees.<\/p>\n<h2>What Is a\u00a0Code Enforcement Officer?<\/h2>\n<p>Code enforcers are public officers that have the authority to ensure people and businesses are following the local laws. One of the primary functions of local government is meeting the needs of its citizens. This includes setting standards for things that can impact public health and well-being so that people can trust that places and services are safe.<\/p>\n<p>These standards generally include:<\/p>\n<ul>\n<li>Zoning and building codes<\/li>\n<li>Public health<\/li>\n<li>Public safety<\/li>\n<li>Fire safety<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/consumer.html\">Consumer protections<\/a><\/li>\n<li>Business practices<\/li>\n<\/ul>\n<p>To ensure that these municipal codes are being met, local governments hire people who inspect, investigate, and enforce city and county ordinances. These people,\u00a0known as code enforcement officers, city inspectors, or investigators,\u00a0patrol for possible ordinance infractions and investigate complaints as part of their code enforcement job.<\/p>\n<h3>Can a Code Enforcer Enter My Home or Business?<\/h3>\n<p>To do their jobs, code enforcement officers are\u00a0allowed to enter both commercial and residential properties for their inspections.\u00a0However, that doesn&#8217;t mean that they have free rein to go wherever they want or to do whatever they want whenever they want on your private property while fishing for code violations. Ensuring code compliance doesn&#8217;t override your rights.<\/p>\n<h2>Code Enforcers Can&#8217;t Violate Your Rights<\/h2>\n<p>Let&#8217;s consider two different reasons why you might want to sue a code enforcement officer. The first is for illegal discrimination, while the second\u00a0is for entering your property without a warrant.<\/p>\n<h3>Illegal Discrimination<\/h3>\n<p>Under federal law, you have the right not to be harassed or discriminated against based on your membership in what&#8217;s called a\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination.html\">protected class.<\/a>\u00a0Protected classes include race, sex, national origin, religion, disability, age, and likely sexual orientation and gender identity (the law isn&#8217;t clear).<\/p>\n<p>If the government discriminates against you for one of these reasons, they violate federal law. The government, for example, cannot target Latino mobile homeowners for building code inspections, which\u00a0was an\u00a0actual case. Code enforcement discrimination can become a barrier to <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/housing-discrimination.html\">fair housing<\/a>.<\/p>\n<h3>Entering Your Property Without Permission<\/h3>\n<p>The Fourth Amendment of the U.S. Constitution grants you the right to be free from\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-and-seizure-and-the-fourth-amendment.html\">unreasonable searches and seizures.<\/a>\u00a0In general, this right\u00a0protects you from having law enforcement officers enter your property unless they have a warrant based upon\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\">probable cause<\/a>,\u00a0which is\u00a0a reasonable basis to believe a crime is being or has been committed.<\/p>\n<p>There are a few exceptions to the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\">warrant requirement<\/a>. For example, if a dangerous condition can be seen without entering your property, a code enforcement officer can cite you for the violation.<\/p>\n<p>Under what&#8217;s called the\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/search.html\" target=\"_blank\" rel=\"noopener\">administrative search exception<\/a>,\u00a0government investigators conducting searches pursuant to a regulatory scheme,\u00a0which a code enforcement officer is and does,\u00a0can enter and search certain property so long as they adhere to reasonable legislative or administrative standards. This often\u00a0applies to commercial buildings. It&#8217;s more of a legal gray area if a building inspector is entering your home.<\/p>\n<p>States have created these standards by establishing a procedure for obtaining what&#8217;s called an \u201cadministrative warrant&#8221; or an \u201cinspection warrant.&#8221; A code enforcement officer needs to follow proper procedures and get an administrative warrant before they can enter your property and cite you as an alleged violator. As the property owner, you have rights.<\/p>\n<h3>Responding to a Neighbor&#8217;s False Reports<\/h3>\n<p>Code enforcement officers may investigate reports from people in the community. Let&#8217;s say your neighbor repeatedly reports your property for violations that they know don&#8217;t exist.\u00a0You may have a claim \u2014 but probably not against the officer.<\/p>\n<p>Routinely calling law enforcement or code inspectors with <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/neighbors-false-accusations-what-to-do.html\">fake reports<\/a> is a form of harassment. You could pursue legal action <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/can-i-sue-my-neighbor-for-harassment-.html\">against your neighbor<\/a> for code enforcement harassment instead.<\/p>\n<h2>You May Have a Civil Rights Lawsuit Under Section 1983<\/h2>\n<p>If a code enforcement official, such as a code inspector or building inspector, violates your rights, you may be able to sue them under federal law.\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/section-1983.html\" target=\"_blank\" rel=\"noopener\">42 U.S.C. section 1983<\/a>\u00a0creates a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/42-u-s-code-section-1983.html\">civil rights claim<\/a>\u00a0you can file in either state or federal court against a code enforcement officer for violating your rights.<\/p>\n<p>In order to <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/how-to-sue.html\">prevail in court<\/a>, you need to show two things:<\/p>\n<ul>\n<li>The code enforcement officer violated your federal rights<\/li>\n<li>The code enforcement officer was acting\u00a0under color of law<\/li>\n<\/ul>\n<p>We have already discussed two rights you have that a code enforcement officer might violate. The phrase \u201c<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/conspiracy-against-rights.html\">color of law<\/a>&#8221; refers to the conduct at issue: the officer must be acting on behalf of the state. This\u00a0happens if the officer is doing their job for the purposes of their job at the time they violate your rights. If they are off the clock, they wouldn&#8217;t be acting on behalf of the state, and you wouldn&#8217;t be able to file a section 1983 claim.<\/p>\n<h2>Do Code Enforcers Have Qualified Immunity?<\/h2>\n<p>Yes, the problem with suing a code enforcement officer is that they have a powerful defense to a section 1983 lawsuit called <a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/pros-vs-cons-of-qualified-immunity-both-sides-of-debate.html\" target=\"_blank\" rel=\"noopener\">qualified immunity<\/a>. In general, a\u00a0code official is\u00a0immune from suit,\u00a0meaning\u00a0they can&#8217;t be sued,\u00a0unless they violate a\u00a0clearly established right\u00a0of which a reasonable person would have known.<\/p>\n<p>Courts have construed the phrase \u201cclearly established right&#8221; very narrowly. You essentially need to show that the controlling authority, which is\u00a0a higher court in your jurisdiction,\u00a0has previously ruled that\u00a0the same conduct was illegal. This can be\u00a0difficult\u00a0to do, making it challenging\u00a0to win a case against the code enforcement officer themselves.<\/p>\n<h2>Sue the Local Government Instead<\/h2>\n<p>The local government itself is not entitled to rely on qualified immunity. You would be able to <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/filing-civil-rights-claims.html\">sue the local government<\/a> that employs the code enforcement officer if you can show that the code enforcement officer, while following enforcement procedures according to the city code, violated your rights.<\/p>\n<h2>You Don&#8217;t Have To Sue \u2013 You Have Other Options<\/h2>\n<p>You don&#8217;t have to file a lawsuit, however. There are two common ways to fight a wrongful code enforcement action.<\/p>\n<h3>Challenge the Citation<\/h3>\n<p>Your first is to challenge the issuance of the citation before your local code enforcement board. The enforcement procedures vary depending on where you are, but you may be able to respond to the alleged violation by raising the violation of your rights as a defense to the citation.\u00a0<\/p>\n<p>You don&#8217;t have the same rights in an administrative enforcement proceeding as you would in a criminal proceeding, but you may be able to persuade the code officers to drop their enforcement action.<\/p>\n<h3>File an Administrative Complaint<\/h3>\n<p>You could also file an administrative complaint. The procedures for this vary from municipality to municipality. In general, you submit a formal complaint with the code officer&#8217;s employer, just like you would submit complaints against individual police officers with the police department. A supervisor will consider the complaint and get back to you within a reasonable time period, such as\u00a014 business days,\u00a0with their determination.<\/p>\n<p>You may be able to get them to drop the citation without having to go through an enforcement proceeding. That way, you may avoid having to pay a civil penalty for a potential violation. You will have less luck, however, if you have been cited for repeat violations.<\/p>\n<h2>A Civil Rights Lawyer Can Help<\/h2>\n<p>These civil rights cases can seem straightforward, but\u00a0they can often\u00a0get very complicated. They are dependent upon the specific facts of any given case and, if qualified immunity is involved, you have a fair amount of legal research in front of you before you can even file your lawsuit.<\/p>\n<p>An experienced\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">civil rights attorney<\/a>\u00a0would be able to give you additional information and advise you about your particular situation. They can help you decide whether you have a valid legal claim that is worth pursuing in court. There are also lawyers who focus\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/state-local-municipal-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">on state and local law<\/a>\u00a0who may be
