In the agreement, they promise to find you interviews for gainful employment with legitimate employers within 30 days.<\/p>\n<p>The only disclaimer in their contract states that you must submit a truthful and competent resume that qualifies you for the kind of work the <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/employment-law-101.html\">job agency<\/a> promises.<\/p>\n<p>The employment agency&#8217;s failure to keep its promise can give rise to a lawsuit for both breach of contract and negligent misrepresentation.<\/p>\n<h3>When an Agency Breaches Your Contract<\/h3>\n<p>You can sue for breach of contract when:<\/p>\n<ul>\n<li>You have a <b>valid contract<\/b> with the job agency.<\/li>\n<li>You held up (\u201c<b>performed<\/b>&#8220;) your end of the deal by submitting a truthful and competent resume.<\/li>\n<li>The job agency <b>breached <\/b>the contract by failing to hold up its end of the deal (e.g. by not getting you an interview in a timely way, or by getting you an interview with a fake employer).<\/li>\n<li>You were <b>damaged <\/b>because you lost time, money, and opportunities for gainful employment.<\/li>\n<\/ul>\n<h3>When an Agency Lies About an Employment Opportunity<\/h3>\n<p>You can sue for negligent misrepresentation when:<\/p>\n<ul>\n<li>The job agency makes a misrepresentation of a material fact (like lying about a prospective employer&#8217;s credibility and inflating their poor reputation).<\/li>\n<li>The job agency has no reasonable ground for believing their representation to be true (e.g., they didn&#8217;t reasonably have any legitimate reason to embellish the employer&#8217;s reputation other than to pull you in).<\/li>\n<li>The job agency intended that you rely on the representation (essentially because they wanted your business, to make money off of you).<\/li>\n<li>You justifiably relied on the representation, and your reliance caused you damages.<\/li>\n<\/ul>\n<p>Sometimes, if a negligent misrepresentation case involves facts that are particularly damning for the job agency and they acted intentionally or recklessly, you might also have a similar claim for <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/fraudulent-misrepresentation.html\">fraudulent misrepresentation<\/a> against them.<\/p>\n<h2>Employment Law Violations<\/h2>\n<p>There are several employment law violations you could sue for, including:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/sexual-harrassment.html\">Sexual harassment<\/a><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/how-to-report-wage-and-hour-violations.html\">Wage and hour violations<\/a><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/meal-break-and-rest-break-laws.html\">Meal and rest break violations<\/a><\/li>\n<\/ul>\n<p>Federal and state agencies might do their own investigations. But having your own private lawsuit against a job agency will probably lead to a quicker recovery and larger payout.<\/p>\n<p>Even if you were a temp worker or an <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/independent-contractors-overview.html\">independent contractor<\/a>, the law gives you a list of civil employment claims you can make against a job agency or employer who violated your employment rights.<\/p>\n<h2>Civil Rights and Discrimination Violations<\/h2>\n<p>The <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/eeoc-s-charge-processing-procedures.html\">Equal Employment Opportunity Commission<\/a> (EEOC) enforces civil rights laws against workplace discrimination. If you&#8217;ve faced employment discrimination while dealing with a job agency or while dealing with an employer found by a job agency, you may be able to sue.<\/p>\n<p>There are various federal laws that protect employees from discrimination:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/the-americans-with-disabilities-act-overview.html\">The Americans with Disabilities Act of 1990 (ADA)<\/a> prohibits discrimination based on disability.<\/li>\n<li>Title VII of the <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/what-are-civil-rights.html\">Civil Rights Act of 1964<\/a> prohibits race, color, religion, sex, and national origin discrimination.<\/li>\n<li>The <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-employment-opportunity-age-discrimination.html\">Age Discrimination in Employment Act of 1967 (ADEA)<\/a> protects job applicants 40 years and older from workplace age discrimination.<\/li>\n<\/ul>\n<p>If a job agency or an employer referred to you by the job agency violates your civil rights by discriminating against you in the ways described above, you may be able to sue them both.<\/p>\n<h2>How Can a Job Agency Be Responsible for an Employer&#8217;s Misconduct?<\/h2>\n<p>It makes sense to <a href=\"https:\/\/www.findlaw.com\/employment\/legal-help-and-resources\/-can-i-sue-my-employer-.html\">sue an employer<\/a> who caused you harm \u2014 but what does that have to do with the job agency?<\/p>\n<h3>Misconduct Involving Both the Agency and Employer<\/h3>\n<p>If the job agency acted in concert with the employer to cause you harm, then the job agency would be a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/co-conspirator.html\" target=\"_blank\" rel=\"noopener\">co-conspirator<\/a>. In other words, the job agency&#8217;s direct involvement in any discrimination, harassment, or labor law violation means they could be <a href=\"https:\/\/dictionary.findlaw.com\/definition\/joint-and-several-liability.html\" target=\"_blank\" rel=\"noopener\">just as liable<\/a> as the employer.<\/p>\n<p>For example, if a job agency went out of its way to make your national origin a negative aspect of your resume while presenting the resume to a potential employer, and the employer doesn&#8217;t hire you for the same \u201cnegative&#8221; reason, both the job agency and the employer acted illegally and may be sued jointly.<\/p>\n<h3>Misconduct Involving Only the Employer<\/h3>\n<p>But what if the job agency didn&#8217;t do anything wrong? If an employer that they sent your way violates your rights, the job agency can still be responsible under an agency <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/what-is-law-of-agency-.html\">relationship or principal-agent relationship theory<\/a>.<\/p>\n<p>By the way, it is entirely by coincidence that the phrase \u201cagency relationship&#8221; has a word in common with the phrase \u201cjob agency<b>.<\/b>&#8221; Let&#8217;s make this distinction clear to avoid confusion:<\/p>\n<ul>\n<li>A job\/staffing\/temp agency is a business that provides an employment matching service. It&#8217;s a job-finding company, so let&#8217;s call it that from here on to avoid confusion.<\/li>\n<li>An agency relationship or principal-agent relationship is a legal theory that says someone with authority to act on a principal&#8217;s behalf makes them the agent of that principal.<\/li>\n<\/ul>\n<p>If an employer holds itself out as an agent of a job-finding company, then you might be able to sue the job-finding company (the \u201cprincipal&#8221;) for the bad actions of the employer (the \u201cagent&#8221;).<\/p>\n<p>To sue a principal (job-finding company) for the agent&#8217;s (employer&#8217;s) bad deeds, you have to show all the following elements:<\/p>\n<ul>\n<li>You reasonably believed that the agent had authority from the principal to act on behalf of the principal.<\/li>\n<li>Your belief was a result of some negligence of the principal.<\/li>\n<li>You yourself weren&#8217;t negligent in the ordeal.<\/li>\n<\/ul>\n<h3>An Example of Relationship or Principal-Agent Relationship Theory<\/h3>\n<p>For example, let&#8217;s say you&#8217;re having some <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/payday-laws-overview.html\">pay issues<\/a> and you&#8217;re not sure if the job-finding company or the employer they found for you is to blame.<\/p>\n<p>The employer says to you that you shouldn&#8217;t worry about talking to the job-finding company. The employer, who seems pretty credible as the CEO of your new workplace, claims they&#8217;re \u201cthe boss&#8221; at both places, and it&#8217;s enough that you would only talk to the employer regarding any problems with your pay.<\/p>\n<p>Still unsure about what to do, you call up the job-finding company and you tell them about what the employer said to you. The agency hangs up on you without explaining that you&#8217;re required to speak to them directly if the problems with your pay have something to do with their commission deductions.<\/p>\n<p>Here, you may reasonably believe your employer&#8217;s claim that they have the authority to handle pay issues even when they relate to the job-finding company&#8217;s commissions. The job-finding company is negligent because they carelessly hung up on you when you confronted them, and you yourself behaved reasonably in trying to figure out how to handle your pay issues, to the point that you made the investigative phone call even after your employer reassured you of who is \u201cthe boss.&#8221;<\/p>\n<p>Let&#8217;s now assume your employer commits some kind of pay violation that affects your wages. In this situation, you may have a <a href=\"https:\/\/www.findlaw.com\/employment\/legal-help-and-resources\/workplace-rights-true-or-false.html\">strong claim<\/a> that the employer was an agent of the job-finding company, which would then allow you to sue the job-finding company as a principal under an agency theory of law.<\/p>\n<p>It&#8217;s easy to see how this can get complicated. You can also talk to an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/?keyword=Employment\" target=\"_blank\" rel=\"noopener\">employment law attorney<\/a> about your specific situation.
