Those agreements greatly vary from site to site.<\/p>\n\n    <\/div>\n\n\n\n<div><p>An online retailer&#8217;s user agreement might:<\/p>\n<ul>\n<li>Allow you to\u00a0sue, but only in a particular county of a particular state<\/li>\n<li>Allow you to bring a case on your own behalf in your local small claims court, but you must submit any larger claims to a process called arbitration<\/li>\n<li>Require arbitration, but you can opt out of arbitration if you notify them within 30 days<\/li>\n<\/ul>\n<p>As you will see, those agreements can be quirky.\u00a0These are just some ways that your options could depend on the online retailer in question.\u00a0You may be able to get a refund or otherwise resolve your dispute through informal means, so try that first.<\/p>\n<p>A <a href=\"https:\/\/lawyers.findlaw.com\/contracts\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">litigation attorney<\/a> could help you better understand the terms of your user agreement with the online company. A lawyer can\u00a0give you legal advice about whether you should seek relief through the courts.<\/p>\n<h2>E-Commerce Is Big Business<\/h2>\n<p>In the United States, e-commerce is huge. In the first quarter of 2026 alone, the estimated U.S. e-commerce retail sales totaled about <a href=\"https:\/\/www.census.gov\/retail\/mrts\/www\/data\/pdf\/ec_current.pdf\" target=\"_blank\" rel=\"noopener\">$302.3 billion<\/a>.<\/p>\n<p>While Amazon has by far the largest market share, more than half of online retail sales flow through <a href=\"https:\/\/www.statista.com\/statistics\/274255\/market-share-of-the-leading-retailers-in-us-e-commerce\/\" target=\"_blank\" rel=\"noopener\">five major online retailers<\/a>, including:<\/p>\n<ul>\n<li>Amazon (40.5% of the market)<\/li>\n<li>Walmart (9.2% of the market)<\/li>\n<li>Apple (3.2% of the market)<\/li>\n<li>Tesla (3.1% of the market)<\/li>\n<li>eBay (2.8% of the market)<\/li>\n<\/ul>\n<p>Three out of these five companies facilitate third party sales. Each online retailer operates differently and has distinct procedures for resolving disputes. We will focus on the top companies mentioned above, as they each have specific requirements.<\/p>\n<h2>Returns and Refunds Can Avoid Lawsuits<\/h2>\n<p>At the outset, you should consider two points common to all e-commerce sites. The first is that\u00a0before you go looking to bring legal action, consider trying to work out your dispute through easier methods. Each site has a <a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/return-policies-and-refunds.html\">return policy<\/a> and claims resolution processes that may help you get a refund.<\/p>\n<p>If you paid by credit card, you may be able to get your credit card company to start a fraud investigation and <a href=\"https:\/\/www.findlaw.com\/consumer\/credit-banking-finance\/sample-billing-dispute-letter.html\">reverse the charges<\/a> if you don&#8217;t receive your item. In either case, you may be able to work things out without having to pay a lawyer to step in.<\/p>\n<h2>Suing for Bad Reviews on E-Commerce Platforms<\/h2>\n<p>The second point is the subject of bad reviews. You may be a seller on an e-commerce platform and get bad reviews.<\/p>\n<p>You do not have the right to sue the platform for bad reviews under\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-47-telecommunications\/47-usc-sect-230.html\" target=\"_blank\" rel=\"noopener\">Section 230<\/a> of the Telecommunications Decency Act of 1996. Platforms like Amazon, Walmart, and eBay are not legally responsible for third-party reviews, whether those bad reviews are truthful or not.<\/p>\n<p>You may be able to sue the individual reviewer for defamation if you can find them, but you need to be careful. Certain states, including California, have laws that punish you if you are a business owner and retaliate against a reviewer. The platform may be upset with you as well and remove your account.<\/p>\n<p>Before you choose to go to the time and expense of suing the customer, strongly consider a brief consultation with an attorney to see if it&#8217;s worth the effort.<\/p>\n<h2>Suing Amazon<\/h2>\n<p>Let&#8217;s start with Amazon. Amazon began as an online bookstore, but now you can buy pretty much\u00a0anything on Amazon.<\/p>\n<h3>If You&#8217;re a Buyer on Amazon<\/h3>\n<p>You can buy from either\u00a0Amazon\u00a0or one of those third-party sellers on its site. If you buy from Amazon, you are bound by the user agreement you signed up for when you opened your Amazon account.<\/p>\n<p>If you have a dispute with Amazon, you can sue it, but only in a court in King County, Washington. In doing so, you waive any right to a jury trial. That makes filing a lawsuit in most cases impractical at best, as\u00a0a lawsuit could cost a lot more than the price of the item.<\/p>\n<p>If you have a dispute with a third-party seller, you can sue it for breach of contract if you do not receive your item or receive an item that is significantly different from what is depicted (abbreviated \u201cSNAD&#8221;).<\/p>\n<p>The biggest problem is finding them and, if you can, bringing your claim in a court with power over them. The only place you may be able to sue is in the seller&#8217;s home state. That may be inconvenient or too\u00a0expensive. Make sure you check with a contract attorney if you are planning on taking action against a third-party seller.<\/p>\n<h3>If You&#8217;re a Seller on Amazon<\/h3>\n<p>If you&#8217;re a <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-operations\/internet-and-e-commerce.html\">third-party seller<\/a>, you may have a dispute with Amazon. You would be bound by the terms of Amazon&#8217;s Services Business Solutions Agreement. According to those terms, they can sue Amazon in small claims court in King County, Washington. Otherwise, they have to submit their dispute to\u00a0<a href=\"https:\/\/www.findlaw.com\/adr\/arbitration.html\">arbitration<\/a>.<\/p>\n<p>Arbitration is a process by which the parties to a dispute hire a neutral third party, known as\u00a0an arbitrator,\u00a0to resolve it without going to court. That person hears both sides of the dispute and makes a binding decision. In general, you\u00a0cannot appeal an arbitrator&#8217;s award.<\/p>\n<p>Some lawyers like arbitration, while\u00a0some don&#8217;t. Although the process can be faster, cheaper, and simpler than a court proceeding, that is not always the case. Arbitrations can be just as lengthy and expensive as full-blown jury trials.<\/p>\n<p>If you find yourself thinking about pursuing arbitration\u00a0against a company as big as Amazon, you should\u00a0consider getting an experienced consumer protection attorney to represent you.<\/p>\n<h2>Suing Walmart<\/h2>\n<p>Walmart differs from Amazon. Walmart doesn&#8217;t have third-party sellers, so the user agreement focuses only on buyers.<\/p>\n<p>You can sue Walmart, but only on your own behalf\u00a0in small claims court. You cannot group your claims with those of other people in what is called a class action lawsuit. Larger\u00a0claims must be submitted\u00a0to binding arbitration.<\/p>\n<h2>Suing Tesla<\/h2>\n<p>As a vehicle company, Tesla has been the subject of a variety of lawsuits related to <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/vehicle-recalls-and-defects.html\">vehicle defects<\/a>, injuries, <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/car-defect-injury-claims.html\">car accidents<\/a>, and other types of claims. Tesla sells its own vehicles, chargers, and energy products online.\u00a0<\/p>\n<p>If you bought a Tesla vehicle, you accepted the company&#8217;s terms of the <a href=\"https:\/\/www.tesla.com\/configurator\/api\/v4\/terms?locale=en_CA&amp;model=m3&amp;saleType=Sale\" target=\"_blank\" rel=\"noopener\">motor vehicle purchase agreement<\/a>. As of 2026, the standard agreement says what can happen in a dispute, including:<\/p>\n<ul>\n<li>You agree to mandatory arbitration (similar to Amazon&#8217;s policy described above) unless you opted out within 30 days of your purchase.<\/li>\n<li>You can sue in <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/how-do-i-file-a-small-claims-court-lawsuit.html\">small claims court<\/a>, but this court limits how much you can recover.<\/li>\n<li>You can sue as part of a class action against the company, but only if you opted out of arbitration or a judge removes the arbitration requirement for your claim.<\/li>\n<\/ul>\n<h2>Suing eBay<\/h2>\n<p>You can&#8217;t buy eBay products, as\u00a0eBay doesn&#8217;t make any. Rather, eBay is an online auction site and an online marketplace. There are only third-party sellers. Its user agreement for your eBay account is clear that a buyer&#8217;s contract is between the buyer and the seller, and that eBay is not responsible for any harm that results from an eBay transaction.<\/p>\n<p>Nonetheless, you may have a claim against eBay. If you do, you can sue it on your own behalf in small claims court in your home state. You must submit larger claims to arbitration.<\/p>\n<p>One of the differences with eBay, however, is that the user agreement lets you opt out of arbitration if you notify eBay of your decision to do so within 30 days after you accept the user agreement for the first time. That means you would be able to file larger claims in court, so long as you follow eBay&#8217;s notification procedure.<\/p>\n<p>You may not need to take action against eBay, however. Many eBay transactions are handled through\u00a0<a href=\"https:\/\/www.ebay.com\/help\/buying\/paying-items\/paying-paypal?id=4033\" target=\"_blank\" rel=\"noopener\">PayPal<\/a>. According to\u00a0<a href=\"https:\/\/www.paypal.com\/us\/webapps\/mpp\/paypal-safety-and-security\" target=\"_blank\" rel=\"noopener\">PayPal&#8217;s Buyer Protection Program<\/a>\u00a0for your PayPal account, you may be able to get a refund as long as you qualify for the program and follow the proper procedures. So before you take action against eBay, you may want to see if you can get your money back through PayPal.<\/p>\n<h2>Suing Apple<\/h2>\n<p>Apple makes and sells its own products. There are no third-party sellers on Apple&#8217;s site. You can purchase Apple products (iPhones, iPads, etc.) at its stores or online. Apple also sells a lot of software and media through iTunes and the App Store.<\/p>\n<p>Apple&#8217;s user agreement is very specific. You can sue Apple, but only in a court in Santa Clara County, California. You only have one year under the agreement in which to bring your claim.<\/p>\n<p>Before you go to court, however, the user agreement requires you to\u00a0try to work out your dispute for 30 days. Then you may, but are not required, to try to resolve your claims through a process known as\u00a0<a href=\"https:\/\/www.findlaw.com\/adr\/mediation.html\">mediation<\/a>. In mediation, you hire a neutral third party, known as\u00a0a mediator,\u00a0who tries to help the parties come to a satisfactory resolution.<\/p>\n<p>Mediation is\u00a0<a href=\"https:\/\/www.findlaw.com\/adr\/mediation\/mediation-vs-arbitration-vs-litigation-whats-the-difference.html\">different<\/a>\u00a0from arbitration. A mediator may review submissions by the parties, talk with them, and make a decision. Sometimes they just negotiate between the parties,\u00a0often with them in separate rooms. Unlike arbitration, however, the mediator&#8217;s decision is not binding.<\/p>\n<h2>Suing Other Large Online Retailers<\/h2>\n<p>The companies above certainly aren&#8217;t the only retailers with disputes. Customers may wonder about their options to sue other large online companies, such as:<\/p>\n<ul>\n<li>Wayfair, IKEA, and other <a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/can-i-sue-an-appliance-company-.html\">furniture or appliance<\/a> stores<\/li>\n<li>Home Depot, Lowe&#8217;s, and other <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-a-home-supply-store-for-bad-products-or-bad-advice.html\">home improvement stores<\/a><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/can-i-sue-tv-gaming-and-technology-retailers-findlaw.html\">Technology and electronics retailers<\/a> like Best Buy, Newegg, and Target<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/can-i-sue-a-video-game-creator-or-company-.html\">Game sellers<\/a>, such as Steam, Xbox, and PlayStation<\/li>\n<li>Clothing retailers, such as Nordstrom, Gap, Kohl&#8217;s, Shein, and Macy&#8217;s<\/li>\n<li>Large <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-online-craft-sellers-like-etsy-.html\">platforms like Etsy<\/a> that host smaller sellers&#8217; digital storefronts<\/li>\n<\/ul>\n<p>Each of these online stores has its own user agreement. When in doubt, you can talk to a lawyer about your case.<\/p>\n<h2>Consider Consulting a Lawyer<\/h2>\n<p>As you can see, whether you can sue an online marketplace, auction, seller, or retailer depends on your user agreement. The user agreements differ\u00a0from site to site. If you have a dispute with an online seller, you need to\u00a0review your user agreement with extreme\u00a0care. They can be complicated.<\/p>\n<p>You should consider bringing in a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/contracts\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">contract attorney<\/a>. An attorney can help you better understand your user agreement and represent you if you need to arbitrate your claims. Having an attorney in your corner also gives you leverage, even if you are just trying to work out your dispute in an informal manner.<\/p>\n<p>Keep in mind that you may need to bring legal action within a particular period of time under the user agreement or the state&#8217;s statute of limitations.
